A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
TO PLACE 41 NIICRO CELL CONTROLLERS (MCCS) ON NSP UTII..ITY
POLES THROUGHOUT THE CITY TO COLLECT METER READING DATA
' AT SPECI�"IED LOCATIONS
� WHEREAS, representatives of Cellnet Data Services have applied for a
Conditional Use Permit to place 41 Micro Cell Controllers (MCCs) on NSP utility poles
throughout the City to collect meter reading data at specified locations, as proposed on
, plans on file in Planning Case No. 98-35; and
WHEREAS, The Planning Commission of the City of Mendota Heights discussed
this application at their regular meeting on October 27, 1998; and
� WHEREAS, The Planning Commission held a public hearing on this application at
their October 27, 1998 meeting; and
WHEREAS, The Planning Commission voted 6-0 (with one Commissioner
absent) on October 27, 1998 to recommend that the City Council approve this application
under certain conditions,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit to place 41 Micro Cell Controllers
(MCCs) on NSP utility poles throughout the City to collect meter reading data at specified
locations, as proposed on plans on file in Planning Case No. 98-35 is hereby approved
under the following conditions:

that the equipment is removed within six months of when the operation ceases
that proof of any applicable state or federal licenses is submitted
that written agreement is given to support, participate in, and refrain from interfering
with public warning systems and public safety communications.
that all FCC standards and regulations are met
that a report guaranteeing non-interference with other communications is submitted
that an abandonment bond is furnished to the City equal to one and one half times the
current cost of removal and clisposal.
that an annual update of locations of MCC units is provided each year to the City �
that the City and the applicant �enter into a Developer's Agreement
BE IT FiJRTHER RESOLVED by the City Council of the City of Mendota
Heights that this approved Conditional Use Permit to place 41 Micro Cell Controllers
(MCCs) on NSP utility poles throughout the City to collect meter reading data at specified
locations, as proposed on plans on file in Planning Case No. 98-35 under the above
conditions would not have an adverse impact on the health, safety and general welfare of
the citizens of the community and the surrounding land, and would not be adverse to the
general purpose and intent of the Zoning Ordinance.
