Res 1998 - 93 Approving a Conditional Use Permit to Place an Antenna & Cellmaster Equipment On & Near the Existing NSP High Tension Tower on Outlot B, Mendakota EstatesCITY OF MENDOTA HEIGHT5 DAKOTA COUNTY, MINNESOTA RESOLUTION 98- 93 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO PLACE AN ANTENNA AND CELLMASTER EQUIPMENT ON AND NEAR THE EXISTING NSP ffiGH TENSION TOWER ON OUTLOT B, MENDAKOTA ESTATES W�REAS, representatives of Cellnet Data Services has applied for a Conditional Use Permit to place an antenna and cellmaster equipment on and near the existing NSP high tension tower on Outlot B, Mendakota Estates, as proposed on plans on file in Planning Case No. 98-36; and WHEREAS, The Planning Commission of the City of Mendota Heights discussed this application at their regular meeting on October 27, 1998; and WHEREAS, The Planning Commission held a public hearing on this application at their October 27, 1998 meeting; and WHEREAS, The Planning Commission voted 6-0 on October 27, 1998 to recommend that the City Council approve this application under certain conditions, NOW, T�REFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit to place an antenna and cellmaster equipment on and near the existing NSP high tension tower on Outlot B, Mendakota Estates, as proposed on plans on file in Planning Case No. 98-36 is hereby approved under the following conditions: 1. that the antennae not exceed 15' in height above the existing pole 2. that the equipment is removed within six months of when the operation ceases 3. that proof of any applicable state or federal licenses is submitted 4. that written agreement is given to support, participate in, and refrain from interfering with public warning systems and public safety communications. 5. that all FCC standards and regulations are met 6. that a report guaranteeing non-interference with other communications is submitted 7. that an abandonment bond is furnished to the City equal to one and one half times the current cost of removal and disposal. 8. that the applicants install the less obtrusive 4.5' x 4.5' building as opposed to the 6' x 6' building 9. that the facility rest on a concrete slab and be protected by a 6' fence with plastic slating 10. that the fence be screened by attractive landscaping at least 6' high 11. that a more accurate set of drawings locating the facility and landscaping be submitted to Council 12. That the City and the applicant enter into a Developer's Agreement. BE IT FiJRTHER RESOLVED by the City Council of the City of Mendota � Heights that this approved Conditional Use Permit to place an antenna and cellmaster equipment on and near the existing AT&T tower at 894 Sibley Memorial Highway, as proposed on plans on file in Planning Case No. 98-36 under the above conditions would not have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
