Res 1998 -102 Approving Building Permit Authorization & a 38.5 Foot Front Yard Setback Variance for a Building Addition for Lloyd's Barbeque at 1455 Mendota Heights Road CITY OF MENDOTA HEIGHTS DAKOTA COUNTY,MINNESOTA RESOLUTION 98- 102 A RESOLUTION APPROVING BUILDING PERMIT AUTHORIZATION AND A 38.5 FOOT FRONT YARD SETBACK VARIANCE FOR A BUILDING ADDITION FOR LLOYD'S BARBEQUE AT 1455 MENDOTA HEIGHTS ROAD WHEREAS, Mr. Ron Schmitz of Lloyd's Barbeque has applied for a 38.5' front yard setback variance for a building addition for 1455 Mendota Heights Road as proposed on plans on file in Planning Case No. 98-40; and WHEREAS, The Planning Commission of the City of Mendota Heights discussed this application at their regular meeting on November 24, 1998;and WHEREAS,The Planning Commission held a public hearing on this application at their November 24, 1998 meeting; and WHEREAS, The Planning Commission voted 4-0(with three Commissioners excused) on November 24, 1998 to recommend that the City Council approve this application under certain conditions, NOW, THEREFORE,IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a 38.5' front yard setback variance for a building expansion for 1455 Mendota Heights Road and building permit authorization as proposed on plans on file in Planning Case No. 98-40 is hereby approved under the following conditions: 1. that additional landscaping be planted on the west side of the addition as well as on the north side of the building to help diminish the massiveness of the structure 2. that a landscape plan be submitted to the Council for their review 3. that all ground and rooftop mechanical units be properly screened 4. that the new addition be built with matching building materials and 5. that the drainage plans be subject to review and approval by the City Engineering Department. , BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this approved 38.5' front yard setback variance for a building expansion for 1455 Mendota Heights Road and building permit authorization as proposed on plans on file in Planning Case No. 98-40 under the above conditions would not have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
