Res 1997 - 14 Adopting Dakota County Ordinance No. 113 Individual Sewage Treatment SystemsCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MiNNESOTA RESOLUTION NO. 97-14 A RESOLUTION ADOPTING DAKOTA COUNTY ORDINANCE NO. 113 INDIVIDUAL SEWAGE TREATMENT SYSTEMS (ISTS) WHEREAS, Individual Sewage Treatment Systems (ISTS) are a potential source of surface water and ground water contamination as defined in Minnesota Rules Chapter 7080, Dakota County Ordinance No. 113. Individual Sewage Treatment Systems, and the "Dakota County Ground Water Protection Plan"; and WHERFAS, on June 4, 1985, the Dakota County Board of Commissioners adopted Ordinance No. 113: Individual Sewage Treatment Systems (Resolution No. 85-364) and the Ordinance adopted the Minnesota Pollution Control Agency Rules Chapter 7080 by reference, establishing minimum regulations and administrative procedures; and WHEREAS, the Dakota County Board of Commissioners established the ISTS Advisory Committee on March 18, 1986, comprised of municipal inspectors, contractors, realtors, and the general public (Resolution No. 86-55) for the purposes of assisting Dakota County with ISTS program development and implementation and to recommend amendments to Ordinance No. 113; and WHEREAS, on December 6, 1994, the Dakota County Board of Commissioners directed staff to develop amendments to Ordinance No. 113 based on the recommendations proposed by the Dakota County ISTS Advisory Committee; and WHEREAS, meetings with cities and townships in the County were held for the purposes of receiving comments and discussing the proposed Ordinance amendments; and WHFREAS, a properly noticed public hearing was held before the Dakota County Board of Commissioners on July 23, 1996; and WHERFAS, on July 23, 1996, the Dakota County Board of Commissioners , approved and adopted amendments to County Ordinance No. 113; and WHEREAS, the Dakota County Board of Commissioners recommends that all municipalities adopt Dakota County Ordinance No. 113: Individual Sewage Treatment Systems, as adopted by the Dakota County Board on July 23, 1996; and NOW, THEREFORE, BF /T RESOLVED, that the City of Mendota Heights, a Municipality in Dakota County, Minnesota, hereby adopts Ordinance No. 113 as amended as of November 1, 1996.
