Res 1997 - 38 Granting a Conditional Use Permit & a 4' Side Yard Setback Variance to 1311 Delaware Ave to Replace an Existing Detached Garage with a New Detached GarageCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 97-�. 38 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT AND A 4' SIDE YARD SETBACK VARIANCE TO 1311 DELAWARE AVE TO REPLACE AN EXISTING DETACHED GARAGE WITH A NEW DETACHED GARAGE WHEREAS, Mr. David Giguere of 1311 Delaware Avenue has requested a Conditional Use Permit and a 4' side yard setback variance to replace an existing detached garage with a new detached garage, as proposed on plans on file in Planning Case No. 97-18; and WHEREAS, The Planning Commission of the City of Mendota Heights held a public hearing on this application at their July 29, 1997 meeting; and WHEREAS, The Planning Commission voted 6-0 (with one Commissioner absent) on July 29, 1997 to recommend that the City Council approve this application, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit and a 4' side yard setback variance for garage replacement, as pr,�posed on plans on file in Planning Case No. 97-18 is hereby granted. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that the proposed Conditional Use Permit and 4' side yard setback variance for a garage replacement, as proposed on plans on file in Planning Case No. 97-18 will have no adverse impact on the health, safety or general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
