RESOLUTION NO. 97=42
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
AND A MODIFIED CRITICAL AREA PERMIT
FOR 1907 HUNTER LANE FOR AN ACCESSORY STRUCTURE
WHEREAS, Mr. Gary D. Pihlstrom of 1907 Hunter Lane has requested a
Conditional Use Permit and a Modified Critical Area Permit for an accessory structure, as
proposed on plans on file in Planning Case No. 97-22; and
WHEREAS, The Planning Commission of the City of Mendota Heights held a
public hearing on this application at their July 29, 1997 meeting; and
WHEREAS, The Planning Commission voted 6-0 (with one Commissioner
absent) on July 29, 1997 to recommend that the City Council approve this application,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit and a Modified Critical Area
Permit for a home addition, as proposed on plans on file in Planning Case No. 97-22 is
hereby granted on the following conditions:
1. that the proposed accessory structure conform to the R-1 zoning code in all respects,
specifically the ten-foot setback from the south property line
2. that City Staff review and approve all submitted plans in regards to drainage
3. that any future fences that may be erected on the property, be set back a minimum of
one foot from the south property line.
BE IT FURTHER RESOLVED by the City Council of tlze City of Mendota
Heights that the proposed Conditional Use Permit and Modified Critical Area Permit for
a home addition, as proposed on plans on file in Planning Case No. 97-22 under the
above conditions will have no adverse impact on the health, safety or general welfare of
the citizens of the community and the surrounding land, and would not be adverse to the
general purpose and intent of the Zoning Ordinance.
