A RESOLUTION GRANTING A TWENTY-EIGHT FOOT REAR YARD
SETBACK VARIANCE FOR A HOME ADDITION
AT 1459 CLEMENT STREET
WHEREAS, Gary and Holly Gustner have applied for a twenty-eight foot rear
yard setback variance for a home addition at 1459 Clement Street as proposed on plans
on file in Planning Case No. 99-09; and
WHEREAS, The Planning Commission of the City of Mendota Heights held a
public hearing on this application at their regular meeting on March 23, 1999; and
WHEREAS, The Planning Commission voted 6-0 on March 23, 1999 (with one
member excused from the meeting) to recommend that the City Council approve this
application,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a twenty-eight foot rear yard setback variance for a home
addition at 1459 Clement Street as proposed on plans on file in Planning Case No. 99-09
is hereby approved and the accompanying building permit is hereby authorized.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this twenty-eight foot rear yard setback variance for a home addition at 1459
Clement Street as proposed on plans on file in Planning Case No. 99-09 would not have
an adverse impact on the health, safety and general welfare of the citizens of the
community and the surrounding land, and would not be adverse to the general purpose
and intent of the Zoning Ordinance.
