Res 1999 - 22 Approving a Conditional Use Permit for a Planned Unit Development for Moen Leuer Construction, Inc. for an Office Building at 35E & Mendota Heights RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 99- 22 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A PLANNED UNIT DEVELOPMENT FOR MOEN LEUER CONSTRUCTION, INC. FOR AN OFFICE BUILDING AT 35E AND MENDOTA HEIGHTS ROAD WHEREAS, Moen Leuer Construction, Inc. has applied for a Rezoning from B-lA to LB-PUD and a Conditional Use Permit for a Planned Unit Development for an office building at Interstate 35E and Mendota Heights Road as proposed on plans on file in Planning Case No. 99-06; and � WHEREAS, The Planning Commission of the City of Mendota Heights held a public hearing on this application at their regular meeting on March 23, 1999; and WHEREAS, The Planning Commission voted 6-0 on March 23, 1999 (with one member excused from the meeting) to recommend that the City Council approve this application under certain conditions, NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for a Planned Unit Development for an office building at Interstate 35E and Mendota Heights Road as proposed on plans on file in Planning Case No. 99-06 and building permit authorization is hereby approved under the following conditions: 1. that the applicant clarify the lighting plan for the Council 2. that the entrance from Mendota Heights Road aligns with the entrance to Patterson Dental to the north 3. that appropriate fencing or landscaping (such as a dense hedge) be provided on the east side of the site to screen the building from the Tousignant parcel and the pond 4. that Staff review and approve the grading and drainage plans 5. that the applicant return to the Planning Commission and the City Council for separate approval of the building signage and monument signage 6. that the retaining walls be adorned with some type of plantings where feasible 7. that the issue of fencing off the pond be left open for the future 8. that the properly owner maintain the adjacent MnDOT right-of-way in the manner shown on the Landscape Plan submitted and on file in Planning Case File 99-06. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this approved Conditional Use Permit for a Planned Unit Development for an office building at Interstate 35E and Mendota Heights Road as proposed on plans on file in Planning Case No. 99-06 under the above conditions would not have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
