RESOLUTION 99-25
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
FOR A PLANNED IJNIT DEVELOPMENT, AND A WETLANDS PERMIT
UNDER CERTAIN CONDITIONS TO HOFFMAN HOMES °
FOR THE AUGUSTA SHORES DEVELOPMENT
WHEREAS, Mr. Patrick Hoffman of Hoffinan Homes has applied for a
Comprehensive Plan Amendment, a Plat, a Conditional Use Permit for a Planned Unit
Development, and a Wetlands Permit for a 46-unit townhome development on land between
Lake Augusta and Highway 55 as proposed in plans on file in Planning Case No. 99-05; and
WHEREAS, the Planning Commission of the City of Mendota Heights discussed this
application at their regular meeting on February 23, 1999; and
WI�REAS, the Planning Commission held a public hearing on this application at their
February 23, 1999 meeting; and
WHEREAS, the Planning Commission voted 6-0 on February 23, 1999 (with one
member absent) to recommend that the City Council approve this application under certain
conditions; and
WH�REAS, the City Council has established a fmding that Cemetery guided land
within the Comprehensive Plan is compatible with Low Densiry Residential and that a
Comprehensive Plan Amendment is unnecessary,
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights that a Conditional Use Permit for a Planned Unit Development, and the
Wetlands Permit, as proposed in plans on file in Planning Case No. 99-OS is hereby approved
under the following conditions:
1. That the home construction meet or exceed the noise attenuation design
standards for construction within the City's Ordinance for Aircraft Noise
Attenuation, No. 232 Noise Compatibility Table 1, Aircraft Noise Zone III for a
multiplex unit.
2. That the noise reduction levels to be achieved for the homes be conf'umed by a
qualified noise expert as approved by the City Council.
3. The execution of a Developer's Agreement
BE IT FLTRTHER RESOLVED by the City Council of the City of Mendota Heights
that this approved Conditional Use Permit for a Planned Unit Development, and Wetlands
Permit as proposed in plans on file in Planning Case No. 99-OS under the above conditions
would not have an adverse impact on the health, safety and general welfare of the citizens of
the community and the surrounding land, and would not be adverse to the general purpose and
intent of the Zoning Ordinance.
