Res 1999 - 29 Approving a Conditional Use Permit & a 7.5-Foot Side Yard Setback Variane for a Detached Garage at 987 Delaware AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, NIINNESOTA RESOLUTION 99-291 A RESOLUTION APPROVING A CONDITIONAL USE PERNIIT AND A 7.5 FOOT SIDE YARD SETBACK VARIANCE FOR A DETACHED GARAGE AT 987 DELAWARE AVENUE WHEREAS, Mr. David P. May of Delaware Avenue has applied for a Conditional Use Permit and a 7.5 foot side yard setback variance for a detached garage as proposed on plans on file in Planning Case No. 99-16; and WHEREAS, The Planning Commission of the City of Mendota Heights discussed this application at their regular meeting on May 25, 1999; and WHEREAS, There was no one present to speak at the public hearing on this application, and WHEREAS, The Planning Commission voted 6-0 (with one Commission absent) on May 25, 1999 to recommend that the City Council approve this application, NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit and a 7.5 foot side yard setback variance for a detached garage as proposed on plans on file in Planning Case No. 99-16 and building permit authorization is hereby approved under the following conditions: 1. Changes to grades and drainage are approved by the City Engineer. 2. The garage addition building materials and colors complement the principal structure. BE IT FURT�IER RESOLVED that the side yard setback variance is necessary to alleviate the hardship of the nanowness of the lot. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this approved Conditional Use Permit and a 7.5 foot side yard setback variance for a detached garage as proposed on plans on file in Planning Case No. 99-16 under the above conditions would not have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
