RESOLUTION 99-58
A RESOLUTION APPROVING A VARIANCE TO THE CRITICAL AREA
ORDINANCE FOR A FENCE AT 711 WOODRIDGE DRIVE
WHEREAS, Ms. Janie Berg has applied for a Variance to the Critical Area
Ordinance for a Fence at 711 Woodridge Drive as progosed on plans on file in Planning
Case File No. 99-29; and
WI�REAS, The Planning Commission held a public hearing on this application
at their regular meeting on August 24, 1999, and
WHEREAS, The Planning Commission recommended 4-2 with one
Commissioner excused that the Council approve this application as presented with certain
conditions,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Variance to the Critical Area Ordinance allowing for a
Fence to be constructed to the bluff line at 711 Woodridge Drive as proposed on plans on
file in Planning Case File No. 99-29 is hereby approved on the following conditions:
1. The fence have no more than seventy percent opacity.
2. The fence be no greater than five feet in height.
3. Both fences shall match on each side of the house.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this Variance to the Critical Area Ordinance for a Fence at 711 Woodridge
Drive as proposed on plans on file in Planning Case File No. 99-29 under the above
conditions would not have an adverse impact on the health, safety and general welfare of
the citizens of the community and the surrounding land, and would not be adverse to the
general purpose and intent of the Zoning Ordinance.
