Res 1999 - 60 Approving a 28-Foot Front Yard Setback Variance for a 5-Foot High Fence at 905 Nina CtCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 99- 60 A RESOLUTION APPROVING A 28 FOOT FRONT YARD SETBACK VARIANCE FOR A FIVE FOOT HIGH FENCE AT 905 NINA COURT WHEREAS, Mr. Gonzalo Martinez has applied for a 28 Foot Front Yard Setback Variance for a Five Foot High Fence at 905 Nina Court as proposed on plans on file in Planning Case File No. 99-31; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on August 24, 1999, and WHEREAS, There was no-one present to speak at the public hearing, and WHEREAS, The Planning Commission recommended 5-1 with the Chair voting in the negative and with one Commissioner excused that the Council approve this application as presented with certain conditions, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a 28 Foot Front Yard Setback Variance for a Five Foot High Fence at 905 Nina Court as proposed on plans on file in Planning Case File No. 99- 31 is hereby approved on the following conditions: 1. The fence be 5 feet high and made of wrought iron. 2. The northeast corner of the fence shall be black cyclone. 3. The fence shall be 2 feet from the front property line and 15 feet from the street 4. Some shrubbery shall be added on the street side of the fence along Diane Road BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this 28 Foot Front Yard Setback Variance for a Five Foot High Fence at 905 Nina Court as proposed on plans on file in Planning Case File No. 99-31 under the above conditions would not have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
