RESOLUTION 99- 79A
A RESOLUTION APPROVING A FIVE FOOT SIDE YARD SETBACK
VARIANCE FOR A GARAGE EXPANSION AT 1718 SUTTON LANE
WHEREAS, Mr. Jerry Kobrin of 1718 Sutton Lane had originally applied for a
seven foot side yard setback variance for a garage expansion as proposed on plans on file
in Planning Case File No. 99-38; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on September 28, 1999, and
WHEREAS, The Planning Commission recommended 7-0 that the Council deny
this application,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a five foot side yard setback variance for a garage expansion
as proposed on plans on file in Planning Case File No. 99-38 is hereby approved on the
following conditions:
1. that the applicant provide a drainage plan for review and approval by City
Engineering Staff, and
2. that the exterior materials of the garage addition match the exterior materials of
the existing home.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this a five foot side yard setback variance for a garage expansion as proposed
on plans on file in Planning Case File No. 99-38 is based on the hardship that the house is
not centered upon the lot and that the variance would not have an adverse impact on the
health, safety and general welfare of the citizens of the community and the surrounding
land, and would be adverse to the general purpose and intent of the Zoning Ordinance.
