Res 1999 - 89 Vacating the 5-Foot Wide Utility & Drainage Easement Along the Northeasterly & Southeasterly Lines of Lot 1, Block 1 Einess Addition & as Rededicated in Lots 1 & 2, Block 1 Birch AdditionCity of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 99- 89 A RESOLUTION VACATING THE 5 FOOT WIDE UTILITY AND DRAINAGE EASEMENT ALONG THE NORTHEASTERLY AND SOUTHEASTERLY LINES OF LOT 1, BLOCK 1 EINESS ADDITION AND AS REDEDICATED IN LOTS 1 AND 2, BLOCK 1 BIRCH ADDITION WHEREAS, the City of Mendota Heights is the current record owner of a utility and drainage easement described as follows; A permanent easement for utility and drainage purposes described as follows: A five (5) foot easement along the northeasterly and southeasterly lines of Lot 1 Block 1 Einess Addition and as rededicated in lots 1 and 2, Block 1 Birch Addition. WHEREAS, a notice of hearing on said vacation has been duly published and posted for more than two weeks before the date scheduled for the hearing on said vacation, all in accordance with applicable Minnesota Statutes; and WHEREAS, a public hearing was held on said vacation on December 7, 1999, at 8:00 o'clock P.M., or as soon as possible thereafter, at the City Hall of the City of Mendota Heights; and WHEREAS, the City Council then proceeded to hear all persons interested in said vacation and all persons were afforded an opportunity to present their views and objections to the granting of said petition. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: l. That the vacation of the utility and drainage easement described above, situated in the City of Mendota Heights, is in the best interest of the public and the City, and is not detrunental to the health, safety and welfare of the community. 2. That the above described easement be and the same is hereby vacated. 3. That the City Clerk be and is hereby authorized and directed to prepare and present to the proper Dakota Council officials a notice of completion of these vacation proceedings, all in accordance with the applicable Minnesota.
