Res 1999 - 91 Denying a Preliminary Plat, a 20-Foot Front Yard Setback Variance, & a Setback Variance for Shared Parking for an Office Development on a Vacant Parcel on Lexington AveCITY OF MENDOTA HEIGHTS DAKOTA �COUNTY, MINNESOTA RESOLUTION 99- 91 A RESOLUTION DENYING A PRELIMINARY PLAT, A TWENTY FOOT FRONT YARD SETBACK VARIANCE, AND A SETBACK VARIANCE FOR SHARED PARKING FOR AN OFFICE DEVELOPMENT ON A VACANT PARCEL ON LEXINGTON AVENUE WHEREAS, Tony Feffer has applied for a Preliminary Plat, a twenty foot front yard setback variance, and a setback variance for shared parking for an office development on a vacant parcel on Lexington Avenue, as proposed on plans on file in Planning Case File No. 99-37; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on November 23, 1999, and ., . .. �.�•, . , WHEREAS, the City Council considered the application at its regular meeting on December 7, 1999; and WHEREAS, members of the Council expressed various specific concerns relating to the application, including without limitation the following: •� .. , 1. safety and visibility concerns pertaining to traffic at and around the intersection of Mendota Heights Road and Lexington Avenue resulting from the construction � _,_.F � . described in the application. - 2. concerns relating to the subdivision of the land into four separate lots, rather than ,,_;, retaining ownership of the entire parcel and the attendant consistency of appearance, maintenance and management. 3. concerns relating to the impairment of neighboring property owner's visibility, and the appearance from the proposed construction from Lexington Avenue. 4. concerns relating to the timing and likelihood of the proposed vacation of the existing Minnesota Department of Transportation right-of-way on the site. 5. The fact that the variances required for this development are not necessary due to any hardship or practical difficulty inherent in the land, but rather are needed due to the large number of lots proposed to be subdivided from a single parcel and that said variances would not be needed for the equally feasible option of a single- building, single-lot development. � WHEREAS, the Council invited Mr. Feffer to address its concerns and submit a revised proposal at a future Council meeting; and WHEREAS, Mr. Feffer declined the Council's invitation and requested that the Council vote on his proposal as submitted. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that this Preliminary Plat, a twenty foot front yard setback variance, and a setback variance for shared parking for an office development on a vacant parcel on Lexington Avenue, as proposed on plans on file in Planning Case File No. 99- 37 would have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would be adverse to the general purpose and intent of the Zoning Ordinance. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that for the reasons described in the foregoing recitals and the reasons set forth herein, a Preliminary Plat, a twenty foot front yard setback variance, and a setback variance for shared parking for an office development on a vacant parcel on Lexington Avenue, as proposed on plans on file in Planning Case File No. 99-37 are hereby denied.
