Res 2001 - 09 Approving a Conditional Use Permit for the Nextel to be the Second Communications Provider (After AT&T) on AT&T's Monopole Tower at 1168 Northland Dr�,-- t-.�. CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 0�-�9' , — A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR NEXTEL TO BE THE SECOND COMMIJNICATIONS PROVIDER (AFTER AT&T) ON AT&T'S MONOPOLE TOWER AT 1168 NORTHLAND DRIVE WHEREAS, Mr. Nathan Ward of Nextel Communications has applied for a Conditional Use Permit for Nextel to be the second communications provider (after AT&T) on AT&T's Monopole Tower at 1168 Northland Drive as proposed in Planning Case #O1-02; and WI3EREAS, The Planning Commission held a public hearing on this application at their regular meeting on January 23, 2001, and WHEREAS, The Planning Commission voted 4-0 (with two Commissioners absent) to recommend that the Council approve this application. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for Nextel to be the second communications provider (after AT&T) on AT&T's Monopole Tower at 1168 Northland Drive as proposed in Planning Case #01-02 is hereby approved on the following conditions: 1. Execution of a Development Agreement acceptable to the City. 2. Compliance with all applicable requirements of the Zoning Ordinance sections regulating such facilities, including Section 21.6. 3. Provision of appropriate site data illustrating the ground equipment and building design. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this Conditional Use Permit for Nextel to be the second communications provider (after AT&T) on AT&T's Monopole Tower at 1168 Northland Drive as proposed in Planning Case #01-02 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
