RESOLUTION APPROVING MODIFICATION NO. 3
TO THE TAX INCREMENT FINANCING PLAN�AND
DEVELOPMENT DISTRICT PLAN (FREEWAY ROAD
PROJECT) FOR TAX INCREMENT FINANCING
DISTRICT NO. 1 AND MUNICIPAL DEVELOPMENT
DISTRICT NO. 1
WHEREAS, there has been presented to the City Council Modification No. 3 to
Municipal Development District No. 1 of the City of Mendota Heights; and
�- ' WHEREAS, it is desirable to modify fhe Development District Plan to add specific
objectives to promote a variety of housing types for a range of incomes including specifically
low and moderate income liousing for seniors, and the redevelopment of under-utilized
property to create a mixed use "town center" in the city; and
WHEREAS, there has been presented to the City Council, Modification No. 3 to the
T� Increment Financing Plan for T� Increment Financing District No. 1, City of Mendota
Heights; and
WHEREAS, Minnesota Laws 2000, Ch. 490, Art. 11, Sec. 39, authorizes the
expenditure of up to $4.5 million for the public improvements in the Freeway Road project
from funds available frokn Tax Increment Financing District No. 1; and
WHEREAS, it is desirable to modify the T� Increment Financing Plan to provide
for the authorized expenditures and to indicate the purposes of those expenditures, including
but not limited to acquisition and site assembly, removal of blighting existing uses,
construction of new infrastructure and si�e improvements, and provision of area wide storm
water drainage; and , `

WHEREAS, the City has completed the n�cessary procedural steps �for the
modification of the MuniCipal Development District and the T� Increment Financing
District�-plans, including a publi.c hearing held thereon after at least ten (10) days published
notice in a newspaper of general circulation in the City, notification and receipt of comrnents
from the affected taxing jurisdictions, review by the City Planning Department and
notification of the County Commissioner for the area, all as more fully provided in the
applicable statutes; and �

WHEREAS, Modification No. 3 to the Tax Increment Financing Plan and the
Development District Plan will further and permit accomplishment of the objectives
described therein; and
WHEREAS, the projects contemplated by the Municipal Development District Plan
constitute a"development program" within the meaning of Minnesota Statutes, § 469.125,
Subd. 3, and the modification to the Tax Increment Financing Plan is consistent with the
provisions of the T� Increment Financing Act, Minn. Stat. § 469.174-469.179, and the
expenditures contemplated in the Plan are permitted expenditures in furtherance of a
"project," as more fully described therein.
NOW, THEREFORE, be it resolved by the City Council of the City of Mendota
Heights, Minnesota, as follows:
1. It is hereby found, determined and declaxed that:
(a) Modification No. 3 to the Tax Increment Financing Plan for Tax
Increment Financing District No. 1 is consistent with and authorized under Minnesota
Laws 2000, Ch. 490, Art. 1 l, Sec. 39;
(b) The proposed development or redevelopment as contemplated in the
T� Increment Financing Plan as amended by Modification No. 3, would not
reasonably be expected to occur solely through private investment within the
reasonably foreseeable future, and therefore the use of Tax Increment Financing is
deemed and determined to be necessary;
(c) Modification No. 3 to the Tax Increment Financing Plan for Tax
Increment Financing District No. 1 conforms to the plan for the development and
redevelopment of the City of Mendota Heights as a whole;
(d) Modification No. 3 to the Tax Increment Financing Plan for Tax
Increment Financing District No. 1 is consistent with the "program" adopted as part of
the Municipal Development District No. 1 Plan;
(e) The "project" as contemplated under Modification No. 3 is
substantially as described in the Livable Communities Grant Application for the
Freeway Road — Town Center development funded by the Metropolitan Council
under the Metropolitan Livable Communities Demonstration Account; and
(� The Tax Increment Financing Plan as amended by Modification No. 3
will afford m�imum opportunity, consistent with the sound needs of the municipality
as a whole, for the development or redevelopment of the proj ect by private enterprise.
The reasons and supporting facts for each of the above determinations are as set forth in
Modification No. 3 to the Development District Plan and the Tax Increment Plan and in
various underlying staff reports and planning documents relating thereto submitted to this
Council.
2. Modification No. 3 to the Development District Plan of Municipal
Development District No. 1 is necessary to improve the district of the City identified in the
Plan and to provide impetus for commercial development, the provision of a variety of
housing types, including low and moderate income housing for seniors, the redevelopment of
under-utilized property, the provision of necessary parking and linkages between parking and
shopping and to protect pedestrians, and the development and redevelopment of this area
cannot reasonably be expected to occur without governmental intervention as contemplated
under Minn. Stat. § 469.124-469.134.
3. Modification No. 3 to the Tax Increment Financing Plan and Modification No.
3 to the Development District Plan is hereby approved and adopted, and the City shall
undertake the activities described in Modification No. 3 through the use of Tax Increment
Financing and the powers granted to the City in the Development District Law, Minn. Stat.
§ 469.124-469.134.
4. The City shall file a copy of Modification No. 3 with the Dakota County
Auditor in accordance with Law.
Motion for the foregoing Resolution was made by Council Member Dwyer
and seconded by Council Member Krebsbach . Upon a vote being duly taken
thereon, the following voted in favor of the Resolution: All Yea
and the following voted against the Resolution: None
and the following were absent: Schneeman
WHEREUPON, the Resolution was declared duly passed and adopted the 20th day
of March, 2001.

PARK AND RECREATION Councilmember Schneeman stated that she �vould like to discuss
COMMISSION MINUTES park cleaning and that she would like to work with Assistant
Hollister to set up a park cleaning day in May. She informed the
audience that residents will be solicited to help with the clean up
activity.
Councilmember Schneeman moved to approve the minutes of the
Parks and Recreation Commission meeting held on March 13, 2001.
Councilmember Vitelli seconded the motion.
