A RESOLUTION DENYING A TWO-FOOT FENCE HEIGHT VARIANCE
FOR 870 MENDAKOTA COURT
WHEREAS, Mr. Roger Grothe has applied for a Two-Foot Fence Height
Variance for 870 Mendakota Court as proposed in Planning Case #O1-06; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on Apri124, 2001, and
WHEREAS, the Planning Commission recommended that the Council deny this
application on a 6-1 vote,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Two-Foot Fence Height Variance for 870 Mendakota
Court as proposed in Planning Case #01-06 is hereby denied due to the lack of a
demonstrable hardship, the view obstruction that would be imposed on the neighbors, and
the lack of a compelling safety reason for the variance.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this Two-Foot Fence Height Variance for 870 Mendakota Court as proposed
in Planning Case #O 1-06 would have an adverse impact on the health, safety, and general
welfare of the citizens of the community and the surrounding land, and would be adverse
to the general purpose and intent of the Zoning Ordinance.
