RESOLUTION TO COMMIT TO THE ADOPTION OF URBAN STORM WATER
POLLUTION CONTROL ORDINANCE FOR NEW DEVELOPMENTS
WHEREAS, the Environmental Protection Agency (EPA), Minnesota Pollution Control
Agency (MPCA), Metropolitan Council, and Metro cities are working to reduce non-point storm
water pollution; and
WI�REAS, the EPA has determined that Mendota Heights is a community that will be
required to comply with the regulations of the EPA's National Pollutant Discharge Elimination
System program - Phase II storm water permit (NPDES - Phase II) when they are enacted; and
WHEREAS, the Metropolitan Council concluded that all communities that will fall
under the jurisdiction of the EPA's NPDES - Phase II storm water permit should adopt an urban
storm water pollution control ordinance when updating their comprehensive plans to reduce non-
point source storm water pollution on an interim basis until they are modified or superseded by
the final EPA NPDES - Phase II regulations; and
WI�REAS, Mendota Heights is in the process of finalizing their Comprehensive Plan
Update; and
� NOW THEREFORE, IT IS HEREBY RESOLVED that the Mendota Heights City
Council will adopt the MPCA Urban Storm Water Pollution Control Ordinance, or one sunilar
with the endorsement of the Metropolitan Council, as part of the City's Comprehensive Plan
update within 120 days of the Mendota Heights Comprehensive Plan update approval by the
Metropolitan Council as a means of reducing non-point source pollutant loadings in storm water
runoff. The City of Mendota Heights will work with the Metropolitan Council to implement this
policy by incorporating these Urban Storm Water Pollution Control Ordinance standards and
requirements into its storm water management plan and land use controls.
