RESOLUTION O1-30
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR AN OFFICE
BUILDING AT 2101 LEXINGTON AVENUE
WHEREAS, Catholic Cemeteries at 2101 Lexington Avenue has applied for a
Conditional Use Permit for an office building as proposed in Planning Case #01-10; and
WHEREAS, The Planning Commission held a public hearing on this application at their
regular meeting on May 22, 2001; and
WHEREAS, The Planning Commission voted 7-0 to recommend that the Council
approve this application;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights that a Conditional Use Permit for an office building as proposed in Planning
Case #O1-10 is hereby approved on the following conditions:
l. There shall be no parking or proof-of-parking within the 20-foot setback from Lexington
Avenue.
2. The applicant shall revise the parking lot dimensions to a 64-foot width.
3. The applicant shall provide a"Proof-of-Parking" agreement letter for parking lot
expansion to the full number of spaces required by the ordinance if eventual usage
demonstrates additional need.
4. The applicant shall provide additional shrub screening along the sides of the parking lot
facing Lexington Avenue.
5. The office shall be limited to cemetery uses.
6. There shall be sufficient parking lot lighting for security and safety purposes as approved
by city staff.
7. There shall be no signage.
8. There shall be no outside storage.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights
that this Conditional Use Permit for an office building as proposed in Planning Case #01-10
would not have an adverse impact on the health, safety, and general welfare of the citizens of the
community and the surrounding land, and would not be adverse to the general purpose and intent
of the Zoning Ordinance.
