RESOLUTION 01-35
A RESOLUTION DENYING AN APPLICATION FOR A COMPREHENSIVE
PLAN AMENDMENT FOR AN OFFICE HEADQUARTERS BUILDING
FOR THE AMERICAN LUNG ASSOCIATION OF MINNESOTA
WHEREAS, The American Lung Association of Minnesota has applied for a
Comprehensive Plan Amendment to redesignate the "Garron" site on the west side of
Pilot Knob Road from HR, High Density Residential, to LB, Limited Business for a new
office headquarters building as proposed in Planning Case #al -07; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on Apri124, 2001;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Comprehensive Plan Amendment to redesignate the
"Garron" site on the west side of Pilot Knob Road from HR, High Density Residential, to
LB, Limited Business for a new office headquarters building as proposed in Planning
Case #O1-07 is hereby denied.
BE IT FURTHER RESOLVED that in support of the above denial, the City
Council of the City of Mendota Heights hereby makes the following findings of fact:
1. The City P�anning Consultant, Mr. Stephen W. Grittman of Northwest Associated
Consultants, Inc. of Saint Louis Park, recommended in his Memorandum to the
Mendota Heights Planning Co�nmission dated April 17, 2001, that the City deny
this application for a Comprehensive Plan Amendment.
2. The site is one of seven "Focus Area" sites that were given special attention in the
recent Comprehensive Plan Update process during which the Council made the
decision to leave the current HR designation as is.
3. The City Planner was unable to find any compelling reasons based on land use
analysis that would make redesignating the property to business from residential
use desirable. Mr. Grittman also advises the City to defer to the recent City
Comprehensive Plan revision process in which the Council decided to leave the
HR designation for the site as it is.
4. Planner Grittman refers to the unique attributes of the site and the City's desire to
utilize the area as the gateway to the community. The proposal made by the
American Lung Association does not rise to what was originally envisioned by
the Council for this site.
5. The City has very little vacant residential land left and has already determined in
the recent Comprehensive Plan revision process that this site is best suited for
residential use.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this Comprehensive Plan Amendment to redesignate the "Garron" site on the
west side of Pilot Knob Road from HR, High Density Residential, to LB, Limited
Business for a new office headquarters building as proposed in Planning Case #01-07
would have an adverse impact on the health, safety, and general welfare of the citizens of
the community and the surrounding land, and would be adverse to the general purpose
and intent of the Zoning Ordinance. �
