Res 2001 - 38 Authorizing Acquisition of Fee Title, Permanent & Temporary Easements, Mendota Heights Town Center Development Project� RESOLUTION NO.O1-38 , , � � RESOLUTION AUTHORIZING ACQUISITION OF FEE TITLE, PERMANENT AND TEMPORARY EASEMENTS, MENDOTA HEIGHTS TOWN CENTER DEVELOPMENT PROJECT WFIEREAS, pursuant to City Council Resolution No. 01-11, the City Council of the City of Mendota Heights adopted and approved Modification No. 3 to the Municipal Development District No. 1 of the City of Mendota Heights, and Modification No. 3 to the Tax Increment Financing District No. 1 of the City o�Mendota Heights both on March 20, 2001; and , WHEREAS, Modification No. 3 to the Municipal Development District No. 1 of the City of Mendota Heights, and Modification No. 3 to the Tax Increment Financing District No.1 of the City of Mendota Heights authorize development and construction of the Mendota Heights Town Center Development Project ("Project") within the Municipal Development District No. l .; and � WHEREAS, tlie` City.Council requires acquisition in fee title of certain properties and certain additional permanent and temporary easements for the construction of the Project all as shown an Exhibit A liereto; and WHEREAS, the City Council hereby finds and declares that, because of the timin.g of the Project, it must acquire the properties and property interests required for the Project and shown on Exhibit A prior to an award by the court appointed co�nmissioners, if it is necessary to acquire properties and property interests by eminent domain; NOW, THEREFORE, be it resolved by the City Councit of the City of Mendota Heights, Minnesota as follows: 1. That the acquisition of the properties identified and shown on E�ibit A hereto and any permanent and temporary easements affecting such properties are reasonably necessary and convenient to the furtherance of the Mendota Heights Town Center � Development Project and, in the judgment of the City Council, such acquisition will further the health, safety and welfare of the citizens and residents of the City of Mendota Heights, and are undertaken in accordance with Minnesota Statutes and applicable law; and 2. That the City Council hereby directs its staff andlor representatives to attempt to negotiate the acquisition of properties and the permanent and temporary easements necessary for the Project; and . �— 3. That the City Administrator shall present for final approval of the City Council each proposed acquisition necessary for the Project that is accomplished through negotiation; and 4. If the properties and/or easements necessary for the Project cannot be promptly acquired through negotiation, then the City Council hereby directs its special counsel, Faegre & Benson, to acquire by quick-take and under eminent domain those property interests not acquired by direct negotiation and that such eminent domain proceedings be in accordance with the procedures authorized under Minnesota Statutes Chapter 117, including the quick-take provisions of Minnesota Statutes § 117.042.
