Res 2000 - 33 Denying Subdivision Application 990 Wagon Wheel TrlCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 00- 33 RESOLUTION DENYING A SUBDIVISION APPLICATION AT 990 WAGON WHEEL TRAIL WHEREAS, Mr. Ira G. Kipp has applied for a Subdivision to create three additional lots at 990 Wagon Wheel Trail as proposed in plans on file in Planning Case File No. 00-02; and WHEREAS, The Planning Commission held public hearings on this application at their regular meetings on January 25, 2000, and February 22, 2000, and the Commission raised questions relative to lot size and street width; and WHEREAS, The Planning Commission recommended that the City Council approve the application with increased lot sizes and reduced street width. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights to deny this Subdivision request based on the following findings of fact: 1. The proposed cul-de-sac does not meet the City's minimum standards [Ordinance 301, Section 5.3(2)]. 2. The applicant has not met the City's standard requiring subdivisions to relate well with existing or potential adjacent subdivisions [Ordinance 301, Sec. 4.1(4)d]. 3. The proposal does not meet the City's minimum street design [City Street Rehabilitation/Reconstruction Policy] . 4. Leave be granted to the applicant to re -apply with a revised application within six months from the date hereof together with a waiver of a new application fee during the six month period. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this Subdivision request creating three additional lots at 990 Wagon Wheel Trail, as proposed in plans on file in Planning Case File No. 00-02 would have an adverse impact on the health, safety and general welfare of the citizens of the Community and the surrounding land, and would be adverse to the general purpose and intent of the Subdivision and Zoning Ordinances.
