RESOLUTION 00 - 03
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
AND VARIANCES FOR A DETACHED GARAGE
WHEREAS, Robert and Christine Salmen have applied for a Conditional Use
Permit and variances for a detached garage for their home at 1694 Dodd Road, as
proposed on plans on file in Planning Case File No. 99-36; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on November 23, 1999, and
WHEREAS, The Planning Commission recommended that the Council approve
the Conditional Use Permit and two of the variances, but deny two other variances, and
WHEREAS, pursuant to Minnesota Statutes Section 462-357, subd. 6a., the City
Council is guided by the stated policy of the State of Minnesota that handicapped persons
should not be excluded by municipal zoning ordinances or other land use regulations
from the benefits of normal residential surroundings; and
WHEREAS, the City Council believes that approving the requested Conditional
Use Permit and the requested variances will facilitate Mr. Salmen's use of said benefits of
normal residential surroundings;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit for a detached garage, a variance
for its location, a variance for its size, and a variance for the door configuration are
hereby granted for a detached garage at 1694 Dodd Road, as proposed on plans on file in
Planning Case File No. 99-36 on the following conditions:
1. that the existing attached garage be converted into living area within one year of
the date of this Resolution.
2. that the new detached garage be no more than 15 feet in height.
3. that the second floor of the detached garage never be finished off as living space,
and
4. that the above conditions be covenanted and filed against the title for this property
with Dakota County.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this Conditional Use Permit for a detached garage, a variance for its location,
and a variance for its size for a detached garage at 1694 Dodd Road, as proposed on plans
on file in Planning Case File No. 99-36 would not have an adverse impact on the health,
safety and general welfare of the citizens of the community and the surrounding land, and
would not be adverse to the general purpose and intent of the Zoning Ordinance.
