Res 2000 - 05 Granting a Critical Area Permit for a New Home at 1147 Orchard Circle (2)d. There shall be permanent preservation of as many trees as possible on
slopes greater than 18 percent except in the case of diseased trees or
designated exotic nuisance species; the applicant will not cut a view
corridor.
e. Any tree or vegetation replanting will utilize native species appropriate
to the site.
f. Disturbed areas are to be restored and planted with native vegetation to
reduce erosion, provide habitat, and increase buffering. Ground cover to
be established on slopes greater than 18 percent (those disturbed during
construction) should be native species, not Kentucky bluegrass.
2. That all requirements of the City's Critical Area Ordinance, Number 403 Site
Plan Approval Standards (Section 2.5) be met as shown on the site plan.
3. That a landscape plan be submitted to the City for approval by the City Planner
no later than March 1, 2000. That the landscape plan specifically signify which
trees are being planted to replace the three basswood trees referred to in Steve
Johnson's letter (condition 4). The City will not issue a certificate of occupancy
for the home prior to approval of this landscape plan.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights
that this Critical Area Permit for a new home at 1147 Orchard Circle as proposed on plans on
file in Planning Case File No. 99-39 as amended and designated "Option B" would not have an
adverse impact on the health, safety and general welfare of the citizens of the community and.
the surround land, and would not be adverse to the general purpose and intent of the Zoning
Ordinance.

A RESOLUTION GRANTING A CRITICAL AREA PERMIT
FOR A NEW HOME AT 1147 ORCHARD CIRCLE
WHEREAS, Mr. Steven Kleineman of SKD Architects, Inc. has applied for a Critical
Area Permit for a new home at 1147 Orchard Circle as proposed in plans on file in Planning
Case File No. 99-39; and
WHEREAS, The Planning Commission held a public hearing on this application at
their regular meeting on October 26, 1999; and
WHEREAS, The Planning Commission recommended 4-0 that the Council approve
this application with one Commissioner absent and two Commissioners excused; and
WHEREAS, the applicant has worked with Barr Engineering Company and the
Minnesota DNR to arrive at a compromise plan designated "Option B"
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota heights that a Critical Area Permit for a new home at 1147 Orchard Circle as
proposed in plans on file in Planning Case File No. 99-39 is hereby approved as amended and
designated ",Option B" under the following conditions:
1. That the following conditions of Mr. Steve Johnson, MN DNR River
Management Supervisor's, letter dated December 20, 1999, be implemented:
a. Disturbance of the slope to create a walkout be minimized as much as
possible; the area excavated for the walkout need only be the area in
front of the door opening, while the slope can be restored to just below
the window levels to the sides.
b. Disturbance of the 18 percent slope be minimized during construction;
attempt to maintain a construction limit of 10 feet beyond the structure.
c. In addition to the erosion control and stormwater management shown on
the revised plan, runoff shall be managed at the two downspout sites to
prevent erosion and increase infiltration of runoff.
