RESOLUTION 00- 06
A RESOLUTION APPROVING A ONE -FOOT HEIGHT VARIANCE
FOR A FOUR FOOT FENCE TO BE WITHIN 13 FEET
OF THE REAR PROPERTY LINE AT 985 DELAWARE AVENUE
WHEREAS, Mr. Gregory K. Mansur has applied for a one foot height variance for a
four foot fence to be within 13 feet of the rear property line at 985 Delaware Avenue, as
proposed on plans on file in Planning Case File #00-05; and
WHEREAS, The Planning Commission held a public hearing on this application at their
regular meeting on January 25, 2000, and
WHEREAS, The Planning Commission voted 5-0 to recommend that the Council
approve this application with two members absent,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights that a one foot height variance for a four foot fence to be within 13 feet of
the rear property line at 985 Delaware Avenue, as proposed on plans on file in Planning Case
File #00-05 is hereby approved.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights '
that this one foot height variance for a four foot fence to be within 13 feet of the rear property
line at 985 Delaware -Avenue, as,proposed,onvplans-on:file in Planning Case File;.#00-05 would: •
not have an adverse impact on the health, safety and general welfare of the citizens of the
community and the surrounding land, and would not be adverse to the general purpose and. intent
of the Zoning Ordinance.
