Res 2000 - 09 Denying a Subdivision at 642 Maple Park DrCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 00-09 A RESOLUTION DENYING A SUBDIVISION AT 642 MAPLE PARK DRIVE WHEREAS, Mr. Chris Doyle has applied for a Subdivision to create one additional lot at 642 Maple Park Drive, as proposed on plans on file in Planning Case File No. 00-03; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on January 25, 2000, and raised questions concerning drainage, building setback, wetlands, soil suitability (no soil report), drainage easement impact, lot size relative to the neighborhood; and WHEREAS, The Planning Commission voted 4-1 to recommend that the Council deny this application with two members absent and one member voting in the negative, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights denies the Subdivision request based on the following findings of fact: 1. The proposed lot is in the area of a former open City drainage channel. 2. A large portion of the proposed lot is encumbered by an easement which dramatically reduces the developable area available on the lot. 3. The grades on the lot are high in the back (north) and low in the front (formally a drainage way) making the home design difficult. 4. The area is a City designated wetlands area. 5. The lot drains towards Ivy Falls Creek which has significant drainage and erosion concerns and any increased runoff from development of this lot will add to the concern. 6. The lot size is not compatible with the other lots in the neighborhood. 7. Neighborhood opposition. BE IT FURTHER RESOLVED that a Subdivision to create one additional lot at 642 Maple Park Drive, as proposed on plans on file in Planning Case File No. 00-03 is hereby denied. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this Subdivision to create one additional lot at 642 Maple Park Drive, as proposed on plans on file in Planning Case File No. 00-03 would have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would be adverse to the general purpose and intent of the Zoning Ordinance.
