Res 2000 - 50 Approving a Conditional Use Permit for a Wireless Antennae on the Municipal Water Tower & Accompanying Apparatus at 2341 Lexington AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 00- 50 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A WIRELESS ANTENNAE ON THE MUNICIPAL WATER TOWER AND ACCOMPANYING APPARATUS AT 2431 LEXINGTON AVENUE WHEREAS, Mr. Paul Harrington representing Metricom, Inc. has applied for a Conditional Use Permit to place wireless internet antennae on the Municipal water tower at 2431 Lexington Avenue and accompanying apparatus, as proposed in Planning Case #00-22; and WHEREAS, The Planning Commission discussed this application at their regular meeting on May 23, 2000 and WHEREAS, The Planning Commission voted 5-0-1 (with one Commissioner excused from the meeting and one Commissioner recused from the vote) to recommend that the Council approve this application, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit to place wireless internet antennae on the Municipal water tower at 2431 Lexington Avenue and accompanying apparatus, as proposed in Planning Case #00-22 is hereby approved on the following condition: 1. That Metricom, Inc. execute a lease agreement with the City of Mendota Heights governing including but not limited to the terms and amount of the lease to be paid to the City for water tower space, maintenance, security, and placement of all antennae and accompanying equipment. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this Conditional Use Permit to place wireless internet antennae on the Municipal water tower at 2431 Lexington Avenue and accompanying apparatus, as proposed in Planning Case #00-22 under the above condition would not have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
