Res 2000 - 77 Denying a 16-Foot Front Yard Setback Variance for a Garage Addition at 2341 Kressin AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 00-77 A RESOLUTION DENYING A 16 -FOOT FRONT YARD SETBACK VARIANCE FOR A GARAGE ADDITION AT 2341 KRESSIN AVENUE WHEREAS, Mr. Jeffrey Kubat at 2341 Kressin Avenue has applied for an 16 -foot front yard setback variance to Section 4.6(4)b of the Zoning Ordinance for a garage addition as proposed in Planning Case #00-34; and WHEREAS, The Planning Commission discussed this application at their regular meeting on August 22, 2000, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a 16 -foot front yard setback variance to Section 4.6(4)b of the Zoning Ordinance for a garage addition as proposed in Planning Case #00-34 is hereby denied. BE IT FURTHER RESOLVED that in support of the above denial, the Council establishes the following Findings of Fact: 1. The proposed 16' front yard setback variance is not necessary to alleviate an undue hardship or practical difficulty as defined in the City's Zoning Ordinance No. 401. 2. The proposed garage addition would negatively impact the essential character of the neighborhood by violating the established setback for all houses in the vicinity. 3. The proposed garage addition would set a negative precedent for other homeowners in the vicinity to also violate the established setback for the neighborhood. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this 16 -foot front yard setback variance to Section 4.6(4)b of the Zoning Ordinance for a garage addition as proposed in Planning Case #00-34 would have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would be adverse to the general purpose and intent of the Zoning Ordinance.
