Res 2000 - 99 Approving a 4.5-Foot Heights Variance for a New Home at 1858 Orchard HillCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 00-99 A RESOLUTION APPROVING A 4.5 -FOOT HEIGHT VARIANCE FOR A NEW HOME AT 1858 ORCHARD HILL WHEREAS, Mr. Dick Bjorklund has applied for a 4.5 -foot height variance for a new home at 1858 Orchard Hill, as proposed on plans in Planning Case File 00-42; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on October 24, 2000 and WHEREAS, The Planning Commission voted 5-0 (with two Commissioners absent) to recommend that the Council approve this application. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a 4.5 -foot height variance for a new home at 1858 Orchard Hill, as proposed on plans in Planning Case File 00-42 is hereby approved on the following condition: 1. Six evergreen trees a minimum of six feet in height shall be planted southeast of the house to filter the view of the house from Orchard Hill and Lexington Avenue as presented by the applicant to the Council on December 5, 2000. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this 4.5 -foot height variance for a new home at 1858 Orchard Hill, as proposed on plans in Planning Case File 00-42 under the above condition is necessary to alleviate undue hardship based on the topography and orientation of the lot, and would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
