Res 2001 - 41 Approving a Wetlands Permit for 739 Knollwood CtCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 01-41 A RESOLUTION APPROVING A WETLANDS PERMIT FOR 739 KNOLLWOOD COURT WHEREAS, Mr. Gary Kravitz and Ms. Anna Schorer, owners of the home located at 739 Knollwood Court, have applied for a Wetlands Permit as proposed in Planning Case No. 01-26; and WHEREAS, the homeowners' home and land are being threatened by severe erosion; and WHEREAS, the homeowners have hired licensed professional engineers to analyze the problem and who have prepared recommendations concerning slope remediation and foundation repair; and WHEREAS, the City Council informed Ms. Schorer at their regular meeting on July 24, 2001, that it has the jurisdiction to grant the permit but does not have the professional judgment to determine the merits of the proposed solution, and that the City of Mendota Heights disclaims any liability for its sucess; and WHEREAS, the applicant indicated to the Council on July 24, 2001 that immediate approval of the application is necessary to prevent further erosion; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that the Planning Commission review of this application be waived and that a Wetlands Permit be granted allowing the Kravitz's to complete the work as described in the GME Consultants, Inc. report dated May 17, 2001. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this Wetlands Permit at 739 Knollwood Court as proposed in Planning Case #01-26 would not have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
