A RESOLUTION APPROVING A LOT LINE ADJUSTMENT AND LOT AREA
VARIANCE FOR ROBERT AND FLORIE MARVY OF 1837 SUMMIT LANE,
RICHARD LEE DVORAK OF 1831 SUMMIT LANE, AND
JAMES AND SHARON AWADA OF 1825 SUMMIT LANE
WHEREAS, the above homeowners have applied for a Lot Line Adjustment and
Lot Area Variance for the three properties on Summit Lane as proposed in Planning Case
#01-17; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on July 31, 2001; and
WHEREAS, The Planning Commission voted 7-0 to recommend that the Council
approve this application;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Lot Line Adjustment and Lot Area Variance for the three
properties on Summit Lane as shown on the Bolton and Menk survey dated July 19, 2001
in Planning Case #01-17 is hereby approved subject to the following:
1. conditioned upon the approval by the Dakota County Surveyor of the Bolton and
Menk Survey dated July 19, 2001.
2. subject to the applicants satisfying the recommendation of the Dakota County
Surveyor to re-establish a five-foot utility easement in favor of the city adjacent
to the interior lot lines as adjusted.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this Lot Line Adjustment and Lot Area Variance for the three properties on
Summit Lane as proposed in Planning Case #01-17 will not have an adverse impact on
the health, safety, and general welfare of the citizens of the community and the
surrounding land, and will not be adverse to the general purpose and intent of the Zoning
Ordinance.
