Res 2001 - 43 Approving a Subdivision for Robert & Patricia Pace at 991 Wagon Wheel TrailCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 01-43 A RESOLUTION APPROVING A SUBDIVISION FOR ROBERT AND PATRICIA PACE AT 991 WAGON WHEEL TRAIL WHEREAS, Robert and Patricia Pace have applied for a Subdivision to create one additional lot at 991 Wagon Wheel Trail as proposed in Planning Case #01-19; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on July 31, 2001; and WHEREAS, The Planning Commission voted 7-0 to recommend that the Council approve the Subdivision subject to certain conditions; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Subdivision to create one additional lot at 991 Wagon Wheel Trail as proposed in Planning Case #01-19 is hereby approved on the following conditions: 1. The proposed lot descriptions are found to be acceptable by the Dakota County Recorder. 2. The City Engineer verify whether or not right-of-way should be formally dedicated as part of this subdivision. 3. Subject to a five-foot utility easement in favor of the City adjacent to all interior lot lines of both parcels. 4. That one or more of the existing accessory structures on the property be removed in order to bring the property into conformance with Section 7.3(10) of the zoning ordinance. 5. That the existing accessory structure encroaching upon the east boundary line of Parcel B shall be removed prior to the applicant receiving a building permit to construct a new residential structure on Parcel A. 6. .That the applicant be required to apply for a wetlands permit if the final plans for the house show any construction or disturbance of land within 100' of the wetland on the property, per the City's wetlands ordinance. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that the Subdivision to create one additional lot at 991 Wagon Wheel Trail as proposed in Planning Case #01-19 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
