RESOLUTION 01-70
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND FIVE-
FOOT SIDE -YARD SETBACK VARIANCE FOR A DETACHED GARAGE FOR
JOE FILHART OF 1033 DELAWARE AVENUE
WHEREAS, Joe Filhart of 1033 Delaware Avenue have applied for a
Conditional Use Permit and Five -Foot Side -Yard Setback Variance for a Detached
Garage as proposed in Planning Case #01-36; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on October 23, 2001; and
WHEREAS, The Planning Commission voted 7-0 to recommend that the Council
approve the Conditional Use Permit and Five -Foot Side -Yard Setback Variance for the
Detached Garage for 1033 Delaware Avenue, citing the narrowness of the lot, the
existence of the power lines, and the difficulty backing out of a conforming garage as
hardships justifying the variance.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit and Five -Foot Side -Yard Setback
Variance for a Detached Garage for Joe Filhart of 1033 Delaware Avenue as proposed in
Planning Case #01-36 is hereby approved.
BE IT FURTHER RESOLVED that the Conditional Use Permit and Five -Foot
Side -Yard Setback Variance for a Detached Garage for Joe Filhart of 1033 Delaware
Avenue as proposed in Planning Case #01-36 would not have an adverse impact on the
health, safety, and general welfare of the citizens of the community and the surrounding
land, and would not be adverse to the general purpose and intent of the Zoning
Ordinance.
