RESOLUTION 01-77
A RESOLUTION APPROVING A TWENTY -TWO -FOOT FRONT YARD
SETBACK VARIANCE FOR A GARAGE ADDITION FOR JOSEPH AND
LEANN NOEKER OF 1257 DELAWARE AVENUE
WHEREAS, Joseph and Leann Noeker of 1257 Delaware Avenue have applied
for a twenty -two -foot front yard setback variance for a garage addition as proposed in
Planning Case #01-38; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on November 27, 2001; and
WHEREAS, The Planning Commission voted 7-0 to recommend that the Council
approve the twenty -two -foot front yard setback variance for the garage addition for 1257
Delaware Avenue, citing the difficulty creating a two -car garage in any other manner as a
hardship justifying the variance. The motion of approval was also on the condition that a
window be added to the north side of the garage as requested by a neighbor.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a twenty -two -foot front yard setback variance for a Garage
Addition for the Noekers of 1257 Delaware Avenue as proposed in Planning Case #01-38
is hereby approved on the condition that a window be added to the north side of the
garage.
BE IT FURTHER RESOLVED that the twenty -two -foot front yard setback
variance for a garage addition for the Noekers of 1257 Delaware Avenue as proposed in
Planning Case #01-38 would not have an adverse impact on the health, safety, and
general welfare of the citizens of the community and the surrounding land, and would not
be adverse to the general purpose and intent of the Zoning Ordinance.
