A RESOLUTION DENYING A CONDITIONAL USE PERMIT AND 20'
SETBACK VARIANCE FOR A SMOKERS' SHELTER FOR GOPHER STATE
ONE CALL OF 2020 CENTRE POINTE BOULEVARD
WHEREAS, Gopher State One Call of 2020 Centre Pointe Boulevard has applied
for a Conditional Use Permit and setback variance for a Smokers' Shelter as proposed in
Planning Case #01-40; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on November 27, 2001; and
WHEREAS, The Planning Commission voted 7-0 to recommend that the Council
deny the Conditional Use Permit and 20' setback variance for the Smokers' Shelter for
2020 Centre Pointe Boulevard.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit and 20' setback variance for a
Smokers' Shelter for Gopher State One Call of 2020 Centre Pointe Boulevard as
proposed in Planning Case #01-40 is hereby denied.
BE IT FURTHER RESOLVED that the Conditional Use Permit and setback
variance for a Smokers' Shelter for Gopher State One Call of 2020 Centre Pointe
Boulevard as proposed in Planning Case #01-40 would have an adverse impact on the
health, safety, and general welfare of the citizens of the community and the surrounding
land, and would be adverse to the general purpose and intent of the Zoning Ordinance.
