Also attached please find a copy of the City's existing Land
Use plan for the properties under question in Case 87-35 from
the City of Mendota Heights. This material was inadvertently
left out of,the previous packets.

Ordinance far Aircraft Noise Attenuatian
In my memo of Octaber 16th, I described the difficulties
staff and hame builders are having with enfarcement of the
noise attenuation ordinance. I also indicated that we would
be meeting with Metropolitan Council representatives Monday
afternoon ta resolve the problems. I will provide Cauncil
with a verbal report at the Cauncil meeting.
Until the difficulties are resolved to the paint that we have
a workable ordinance, developers Diak Putnam and Centex Hames
have requested that we temporarily amend the ardinance. T
will alsa discuss that in my verbal presentation. Attached
is an ordinance amendment that Council could pass to grant
the request, if after the discussion it is of a mind that
some temporary relief is needed. Also attached is some ather
in�ormation to which i will refer.

the City Planner's affice was nat able to deliver the report
today as planned. It wi11 come in later this week, and be
delivered to yau with yaur Friday afternaon packets.
Council should still discuss and set a date for the

Recognized Acoustical Specialist'for compliance with this Ordinance.
B. Within 30 days of receipt of appropriate plans and specifications, the
City shall approve or re�ect the plans based upon the ability of the
proposed materials and construction techniques to adequately attenuate
noise. The City shall approve the plans and specifications if:
1. The plans and specifications adequately document the use of
construction assemblies that meet or exceed the STC ratings
required by the following table:

*Al1 values +/- 2 STC. The STC laboratory test of construction materials
and assemblies must be conducted according to the requirements of the
American Society for Testing and Materials (ASTM E90 or ASTM E 336); or
2. The plans and s�ecifications have been certified b� a Recognized
Acoustical Specialist as achieving the interior noise level
reduction required by the applicable portion of the Noise
Compatibility Table.
In the event that the drawings are rejected, the reasons for such
rejection shall be submitted to the applicant in writing. No construction
shall occur prior to the approval of the appropriate �lans and
specifications. All construction shall be �erformed in accordance with the
approved plans and specifications as determined by the City shall be deemed
to meet the noise attenuation requirements of this Ordinance.
SECTION 11. Inspections
A. All construction or work for which a building permit is required shall
� be subject to inspections b� the City. Inspections of noise attenuation
L... work shall be performed during the required building construction
inspections specified by the City of Mendota Heights code.
B. Field Testing. When inspection indicates that the construction is not
in accordance with the approved plans, the City may order such
corrective action as may be necessary to meet the noise attenuation

SECTION 8. Noise CompatibilitV Tables
�
A11 construction ar recon�truation requiring a buildinc� permit and
located within an Aircraft Noise Zane �hall be constructed in such a way
that the applicable noise level reduction requirements contained in the
Noise Compa�ibility Tables (Appendix B) are met or exceeded. Where a
,�, particular structure cantaa.ns different land uses, the more stringent
requirements of the applicable tabl.e shall applx, except where it is
architecturally passible to achieve the appropriate noise reductian level
for each different use, and the uses are acoustically separated by a wall or
partition with a minimum STC o�' 25,
SECTION 9. Enforcement
The provisions of this Ordinance shall be enforced pursuant to Sections
10 and 11.
SECTION 10. Plans and Snecifications
A. All applicants for a building ar aacupancy permit shal.l include with the
ap�lication all plans, specifications or other in�ormation rec�uired by
th�s Ordinance. The plans and spacifications shall describe �.n
sufficient detail all pertinent features af the building, buildinc�
materials, heating and ventila�ion systems, including but not lim�ted to
the STC ratings of exterior•roafjceilings, wa11s, windows, and doors;
and other pertinent data as may be requested by the City to indicate
can�ormance with the applicable naise reductian level requirements as
specified in the Noise Compatibility Tables. To assure the �liminatior
af saund leaks, the plans and s�pecifications shall demanstrate
compliance with the following standards.
1. A mechanical ventilation syst�m shall be installad that will provide
the minimum air circulation and fresh air supply requirements as
pravided in the State and Unifarm Building Code far the propo�ed
occupancy without the need to open any exterior daors or windaws.
2. The perimeter of all exterior windows and door frames shall be
sealed air�Gight to the exteriar wall construction.
3. Fireplaces shali be equipped with well-fitted chimney c�osing
devices.
4. All ventilation ducts, exaept range haods, connecting interior space
ta outdoors shall be provided with a bend such that na direct line
of sight exist� from exterior ta interior thraugh the vent duct.
5. Doors and windows shall be canstructed so that they are close-
f^ fitting. Weatherstripping seals shall be incorporated to eliminate
all edge gaps.
6. All penetrations through exterior wall.s by pipes, ducts, conduits
and the like shall be caulked airtight to the exterior canstruction.
The City may require that plans and speci�ica�ions be certified by a

SUBJECT: Denial of Flood Damage Claim from Rodney and Paula
Carey, 976 Douglas Drive
I think most of you are aware that when we experienced
the huge storm on July 23, water from Marie Park backed up
into the basement of the Care� home at 976 Douglas Drive.
The Carey's subsequently submitted a claim to the City in the
amount of approximately $80,000 for damages to their
property.
Attached is a notice from our insurance carrier denying
the claim. Adjuster Giefer informs me that after
investigating the situation, he concluded that it would not
be financially possible for the City to have constructed a
storm drainage system of a size and magnitude to totally
contain the storm of July 23, and therefore could not have
reasonably prevented the damage to the Carey home.
ACTION REQUIRED:
This memo is for Council information only and no further
action is required.

ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO. 232
The City Council of the City of Mendota Heights,
Minnesota ordains as follows:
SECTION 1.
Ordinance No. 232, known and referred to as "ORDINANCE FOR
AIRCRAFT NOISE ATTENUATION" is hereby amended in the
following respects:
SECTION 10.B. of said Ordinance No. 232 is hereby
amended in its entirety so that as amended it shall read
as follows:
Within 30 days of receipt of appropriate plans and
specifications, the Cit� shall approve or reject the
plans based u�on the ability of the proposed materials
and construction techniques to adequately attenuate
noise. The Cit� shall approve the plans and
specifications if, in the opinion of the Building
Inspector, the plans and specifications demonstrate a
c�ood faith effort to attenuate noise by meeting the
intent of this ordinance to the maximum extent possible.
In the event that the drawings are rejected, the reasons
for such rejection shall be submitted to the applicant
in writing. No construction shall occur prior to the
approval of the appropriate plans and specifications.
All construction shall be performed in accordance with
the a�proved plans and specifications as determined by
the City shall be deemed to meet the noise attenuation
requirements of this Ordinance.
SECTION 2.
This ordinance shall be in full force and effect from and
after is passage. '
Enacted and ordained into an Ordinance this 20th day of
October, 1987.
