Attached is a copy of a very prelinimary proposal for deer hunting
in the Fort Snelling State Park and Pti.nnesota Valley National ti9ildlife
Refuge bet��een I-35�r �nd the l�7innesota River. The field staff hae
pmrosed a.dditional hunting to m�imize the number of d�eer taken
in that manner as opposed to the sharpshooting operation undertaken
last season.
�e are oFtimistic that vre can rea.ch our goal this ye�r based on the
relatively good success last year., A total of 225 deer were taken by hunting
and sharpshooting� but ��ve estimate that this only kept the population
from i.�creasing rather than decreasing it.

to be done on both the Perk and Refuge lands. Our papulation modelling
indicates thafi fihis witl result in a 25� reduction in fihe winfier or
post-hunt popuiafiian. We wil! further reduce the papulation by 25� in
#988, 1989 and 1990. After the 1990 reduction, the population ot 17

The l987 goa! is theorettcal because it is based solely on the
w(nter aerial census af 1986 and the known and estimated mortality and
production slnce then. Numbers wlll be adjusted based on later surveys.

4. Alternative for increased hunting harvest.

3) Add additional weekend for 3B hunters - outside regular season,
I.e. hunt November 21-22 and 28-29.
4) Open area for Special Muzzleloader hunt on both weekends (Dec. 5-6
and II-13) or open entire season.
5) Have option to bring back 3A and/or 3B hunters to hunt addttional
weekends or weekdays after the season.
These alternatives would be difficuit to sell to locai commun(ttes.
These alternatives would requi�e additional staff to be assigned to
monitor speclal hunts. It was felt tha the original proposai provided
the maximum hunting possible while maintaining relatively normal
operations on the Refuge and Park. I recommend the originai proposal
and belleve there ts a reasonable chance to take most If not all of the
goal by hunting. This proposal is similar enough to last years
operation to create mfnimal problems with the local city governments
(although they have not approved all of thls as yet) and it still
provides an expanded hunting program wtth at least the theoretical
posslbility of reaching our entlre goal by this method.
The main proposai (excludtng the aiternatives) is based on the
concensus of a meeting of July 27, 1987. Attendees were Frank Knoke,

RE: Community Park Facilities
BACKGROUND
1. The 1979 Comprehensive Plan noted the concern of the Planning
Commission and Council as of that time relating to the need for
establishing additional "community park facilities". There was a
recognizable need for a large increase in organized play field facilities
to accommodate a future population of 13,000 to 15,000 people.
2. The plan recommended an acquisition of a Priority One location of the
approximately 25 acre Wachtler site to serve the community basically
north of Highway 110. The plan further recommended as Priority Two,
the acquisition of an approximately 35 acre site from the School Board
at the northwest corner of the extension of Huber Road and Me�dota
Heights Road (see map attached). The 60 acres added, coupled with 30
acres of additions to Valley Park, and an additional 25 acres of
neighborhood parks would increase the then 174 acre system to 289
acres (a standard appropriate for the anticipated population at that time
figured conservatively at 11,000 to 13,000).
3. Subsequent to the adoption of these proposals, a decision was made to
fulfill the community scale play field needs by an acquisition and �
development program in conjunction with the School District on
properties contiguous to and north of the high school site in Mendota
Heights. We were not asked and did not offer an opinion regarding this
proposal, though when asked by individuals we expressed our concerns
regarding the feasibility of such a program. Historically, it has been
our experience that the joint ownership and/or operation of such
facilities is difficult to accomplish and effectuate over time. The
obvious inherent difficulty is the difference in constituencies and conflict
in administrative control (and policies) due to the differences in the
mission and objectives of the two jurisdictions.

4. The Wachtler site (originally established as Priority One in the
Comprehensive Plan) is now approved and scheduled for development.
The more appropriate easterly portion of the school site (at Huber and
Mendota ,Heights Roads), we understand, is to be reserved as a potential
school f�cilities location (established as a Priority Two acquisition).
Thus, it would appear that the two previously designated community
scale park sites are not in fact available to provide for the needed
facilities. -
Recommendation
, .; .
' 1. Under the circumstances, it would appear very important that an area
' be planned, reserved, acquired, and (over time) developed to serve the
community scale play field function.
2. Based on the lands potentially available, we suggest that a portion of
the property south between Mendota Heights Road and the freeway is
the most appropriate location for current consideration.
3. Having not done an analysis of the needs, care should be taken to
acquire an adequate area to fulfill the purpose. If this need is
undetermined, the determination should be made quickly.
4. The area south of Mendota Heights Road is also in need of a
neighborhood park designed for local children and adults. This facility
, may well be separate from the community play field function.
5. It would appear (without further analysis) that an are�e of at least 40
acres of a community scale facility will be needed.
PLAN ANALYSIS
1. We have not seen a plan for a potential community scale park. We
have reviewed two plans prepared by or for Dick Putnam. One plah
combines the neighborhood and community scale park functions where an
access to the park and contiguous development is provided through the
use of cul-de-sacs. We suggest that these cul-de-sacs are excessive in
length and are not the most appropriate access method.
2. The second plan proposes a loop street south of and with access to
Mendota i--leights Road. It is, in our opinion, a more preferred plan.
The emphasis on the use of the land contiguous to the freeway for play
field purposes is appropriate. Access to such facilities via the loop
street system is excellent and provides an extensive open field vista
that will be attractive within and beyond the community.
3. The separation of the neighborhood park, in this case, from that of the
community scale park is appropriate, though not essential.
4. This plan suggests that a considerable area of high density development
easterly of the areas so designated in the Comprehensive Plan
Amendment. The use of density transfer from publicly acquired open
space is an appropriate concept which can be an important ingredient in
the negotiations for open space acquisition. Obviously, this should be

done in conjunction with consideration of density and aesthetic impact.
The concentration of higher density around significant open spaces,
however, is an accepted concept. .
Recommendation
1. We suggest a positive consideration of major play space acquisition
based on an access scheme employing a loop system similar to that
consistently suggested for the area in question.

The amount due is listed as $90.90. h1y St. Paul Water bill
for this same quarter is $31.68.
Over the past few years I have had a'Silent Leak' in the
basement toilet. This was discovered when I called the
• St. Paul 6�ater Company and asked them to investigate my
large water bills of $94.60, $103.22, etc. This leak was
corrected in March,1987 and my second quarter water bill
° of $31.68 reflects this correction. I�owever, my second
quarter sewer bill does not reflect this correction as it
is still $90.90.
I feel I have been pay�ing for this leak long enough and that
my sewer bill should be adjusted to reflect my actual water
usuage for this quarter.

ROGERS LAKE Council acknowledged a letter from Richard Paul, 940 Wagon
Wheel Trail, and an associated report from Public Works
Director Danielson regarding weeds in Rogers Lake. Mr. Paul,
present for the discussion, stated that he has received and
read the report. He informed Council that his main purpose
in writing to the Council is to point out the condition of
the lake and seek a remedy. He stated that he would like to
see a weed control program initiated that will eventually
provide a body of water in good coridition., He requested that
Council take steps this year to approve a program to
implement next year. '
Council discussed the matter and directed the Public Works
Director to find out more specific'details on chemical
treatment, when it can be done, coits and how much treatment
' the DNR will allow.

Councilmember Cummins moved to accept the bids for 1987 seal

Police Chief Delmont was present to recommend the appointment
of a Police Officer and Sergeant. Chief Delmont introduced
Police Officer candidate Dona Currie to the Council.
Councilmember Hartmann moved that Dona Gurrie be appointed to
the position of probationary Police Officer at a starting
annual salary of $24,420, effective August 3, 1987.
Councilmember Cummins seconded the motion.
Councilmember Witt moved that Larrie Mack be appointed to the
position of probationary Sergeant at a starting annual salary
of $36,080 effective August 3, 1987. •

The Council acknowledged and discussed a report from the City
Administrator recommending proposed procedures for
consideration of athletic sites. .
Mayor Mertensotto stated that he believes the proposed
program for the Riley site would be very difficult to
accomplish but that he sees no reason not to follow the
procedures recommended. He expressed concern over involving
Barton-Aschman in the specific plan the developer proposes
since the proposal must go through the planning process
first. He felt that Planner Dahlgren should be involved
because a park is being proposed in a development and should
be an early part of the planning consideration.

Councilmember Blesener felt that Planner Dahlgren should be
directed to specifically look at the park issue when he
prepares the planning reports that would normally be prepared
in response to the development proposals.

Administrator Frazell stated that he was suggesting that
Barton-Aschman look at the development plan relative to what
Centex proposes for the neighborhood park to be sure it meets
the City's recreational needs. He informed Council that Dick
Putnam appeared before the Park Commission last week and
proposed a sketch the location of a neighborhood park, which
the developers feel is consistent w,ith the development plan.
He suggested that Planner Dahlgrenibe asked to look at the
proposal and prepare a•report for tl e next Council meeting.
With regard to the Sibley site, Mayor Mertensotto commented
on the ownership issue, expressing;his concern that after 20
years the City will have a$2 million investment in the
complex and if the District pulls out of the agreement the
City will only own 7 acres of land�(under the original
agreement). I
Councilmember Cummins stated that the Council must protect
the long-term interest of the Gity�and the oniy that can be
done is for the City to take title to Lots 1, 2, 3 and 4 so
that the City would always have the four ballfields.
Mayor Mertensotto agreed, stating that if the City installed
the improvements up front on the 3.2 acres of school land and
title was given to the City, the City would have something
for its investment. I
Councilmember Cummins also suggested that there be some type
of agreement on parking, at least a lease arrangement, so
that if the agreement terminates tlie City would have parking
facilities.
There was also discussion over the alcohol consumption issue,
Recreation Board powers and respons,ibilities, scheduling, and
relative contributions. Councilmember Blesener felt that an
additional issue, priority of development, should be added to
the list of issues, pointing out that in her opinion the �.
installation of comfort stations would take priority over� ,•
tennis court lighting and soccer field draining. It was the
consensus that development priority and an arbitration
provision should both be added to the list of joint meeting
issues. I
Councilmember Blesener suggested that she and Councilmember
Cummins be appointed as the Council subcommittee to negotiate
and take a position on the issues and to go to the School
Board committee with a counter proposal.

Councilmembers Blesener and Cummins and Administrator Frazell

RAILROAD CROSSING Council acknowledged and discussed a report from the Public
Works Director regarding proposed construction of the
Northland Drive railroad crossing. Mr. Loren Sultze,
�=F�.� Contract Engineer for the Soo Line Railroad, was present for
� the discussion and informed the Council on the cost estimates
` he had developed for the project.

Public Works Director Danielson stated that it is proposed
that the project be financed by Tax Increment funds and
informed Council that United Properties has already paid for
the very costly legal expenses as part of the Northland Drive
improvement project. He pointed out that this is a very
important crossing and has been planned ever since the
industrial park was designed. Treasurer Shaughnessy stated
that it has always been contemplated that the costs would be
supported by Tax Increment monies.
Staff was directed to contact United Properties to�determine
how much of the project they would be willing to finance.
Mr. Sultza was requested to prepare an update on projected
costs. .
Fire Chief Maczko was present to request authorization to
purchase a Macintosh Plus computer, hard drive, printer and
software for the Fire Department.
After discussion, Councilmember Cwnmins moved to authorize
the purchase of the requested equipment at a total cost of
$4,187.
Councilmember Witt seconded the motion.
Fire Chief Maczko reviewed and responded to Council questions
regarding the proposed fire prevention code.
Councilmember Blesener suggested that staff be directed to
make sure builders be made aware of the ordinance provisions
and that copies be available for their information.

MINUTES, JULY 28, 1987
The regular meeting of the Mendota Heights Planninc�
Commission was held on Tuesday, July 28, 1987, in the City
Council Chambers. Chairman Morson called the meeting to
order at 7:30 P.M. The following members were present:
Morson, Anderson, Burke, Henning, K�ebsbach, and McMonigal.
Commissioner Duggan had notified the Commission that he would
be unable to attend. Also present were City Administrator
Kevin Frazell and Assistant Planner John 5hardlow. '
APPROVAL OF Minutes of the June 23 meeting,had been
MINUTES submitted previously. Commissioner
Anderson moved that the minutes be
approved as submitted.

motion.

CASE NO. 87-18, Chairman Morson called the meeting to
BJORKLUND/HANSON order for the purpose of a public hearing
SUBDIVISION, to consider an application from Richard
HEARING Bjorklund, Sr. and Roy Hanson. Mr. David
Hansing, consulting engineer for the
project, gave a presentation of the plan.
He noted the steep grades on the site,
and indicated that the developers felt
the two cul-de-sac arrangement as
proposed was a better arrangement than
servicing lots off Warrior Driv,e.
Mr. Hansing noted that there will be
drainage issues to the southwest corner
of the plat and into Knob Road, and said
that he would be meeting with the City
Engineering de�artment to resolve those
issues. He said that public utilities •
will be serviced off Warrior Drive. He
also noted that the plat proposes a 50 ��� �'b �
foot right-of-way for streets and a 100
foot radius on cul-de-sacs.
He said that there were other
alternatives that would have allowed the
developers to put more lots on the site,
but that those were less pleasing because
they required massive grading.
Chairman Morson questioned the plan for
saving trees, and why a vegetation plan

had not been included with the
application materials. He also noted the
long length of Henry Circle, and
�uestioned whether the two storm drain
inlets as proposed would'be adequate. He
also questioned why there wasn't more
information submitted on'the complete
storm sewer system and the relationship
of the proposal to surrounding platted
and unplatted property. �
Commissioner Henning asked whether it was
.�: , realistic to believe that emergency
vehicles could access homes on the cul-
de-sac directly over Warrior Drive.
Chairman Morson indictedlhis concern with
the lot size. He felt lot sizes of less
than 100 feet of frontage were too small
for'the sizes of houses that were usually
built by the Bjorklunds.� Mr. Hansing
responded that a plan that strictly meets
code could go up to 26 lots, but that it
was a less pleasing plan�than that being
submitted. CommissionerjAnderson said
that he felt reducing the subdivision by
one lot would help obviate a crowded
feeling. �
Mr. Dave Bjorklund responded that there
are lots of less than 100 feet of
frontage in the Copperfield development,
and that many times people simply set
their house back fartherlthan the minimum
• requirement of a 30 foot!setback.
Dick Bjorklund,.Sr. said that the issue
of School District No. 197 dedicating
additional right-of-way alonc� Warrior
Drive was being worked out with them. He
also said that he and Mr�. Hanson, co-
owners of the property, had met with City
Planner Howard Dahlgren several years ago
when the}� first bought the property.
Their original thouc�ht was a three cul-
de-sac approach, which p'reserved 100 foot
frontage on all lots. However, after
meeting with Planner Dahlgren, they
decided it was not the best layout
because of the steep grades on the
property. He indicted that a crowded
feeling could be resolved simply by
building some homes back''further than the
30 foot minimum setback. Commissioner

Henning agreed that he felt sizable
houses could be built with sufficient
setback.
Chairman Morson asked for questions or
comments from the audience.
Ms. Kay Hanzal, 1970 Knob Road, raised
questions about cost for movin� of
electrical lines, where a holding pond
would be located during the construction
of the development, who would be paying
for the storm sewer improvements, and
would ade�uate provision be made for
storm drainage coming into their
properties. Dick Bjorklund, .Sr.
responded that the developers had a
strong interest in seeing that the storm
drainage flow was adequately taken care
of, since they did not want to get into a
liability issue with surrounding
homeowners. He said the City would
require a storm sewer project, which
would actually cause an improvement for
the existing neighborhood. I •
There being no further questions from the
audience, Commissioner Henning moved to
close the public hearing at 8:19 P.M.

motion.

Mr. Hansing indicated that there were few
organic soils on the site, and that it
was mostly sand and gravel.
Assistant City Planner John Shardlow said
that their office supported the
development and that Planner Howard
Dahlgren felt the lots could be developed
adequately. However, the question of ,,,..,�
whether to allow the less than 100 foot
minimum frontage was a policy decision
for the Commission. ;
Commissioner Krebsbach moved�to recommend
approval of the plat conditioned upon:

1. That a letter from School District
197 approving conveyance of the extra
right-of-wa� along Warrior Drive be
provided prior to final plat!approval.

2. That there be no driveways extending
directly to Warrior Drive.
Commissioner McMonigal seconded the
motion. I
Commissioner Anderson said that he
couldn't support the motion without
removal of at least one�lot.
Commissioner Burke agreed that he would

CASE NO. 87-19, Mr. Jeff Schoenwetter, representing the
HALLEY, VARIANCES developer, briefly presented the two
requested variances for�Park Place. The
first is for construction of a
neighborhood recreation`center on one
lot, to be owned and operated ultimately
by the Park Place homeowners
association. The second variance was for
six foot entrance monuments at the two
streets entering the plat. He said that
the reason for the entrance monuments is
to help set a tone of alquality
neighborhood. It was noted that there
are also islands proposed to be
constructed at the entry streets, and he
said those would have low maintenance
landscaping. �
Commissioner Anderson noted•that the City
Planner staff report included a
recommendation that the'gazebo be moved
closer to the center of,the tennis
courts, the tot lot closer to the public
street, and some benches constructed for
watching children. It was noted that the
plan as submitted by the developer in the
packet did not include these changes.
Chair Morson felt that the application
should be sent back to the develo�er to
draw up a revised plan for resubmittal to
the Commission.
Mr. Schoenwetter indicated that each
homeowner would be payirig approximately
$50 a quarter toward the maintenance of
the recreation facility,� which should be
adec�uate given the low maintenance types
of improvements planned.' Chair Morson
noted that City staff seemed to have some
concern about on-going cost of

maintenance.� City Administrator Frazell
said that he disagreed with the
recommendation in the City Planner's
report that the City have authority to
take over maintenance of the lot and
assess the homeowners for such. Mr.
Frazell said that he doubted that the
City had legal authority to do that, and
instead suggested that the variance carry
a condition that at such time as the
homeowners associatidn fails to
adequately maintain the recreation lot,
the variance a�proval will be withdrawn
and the Cit�r will order the removal of
the recreation improvements.
Chairman Morson said that he couldn't
agree to the monuments as requested at
the entry ways since he felt Wachtler
Avenue was already a safety hazard, and
�� •this could reduce visibility for traffic
trying to get on and off of Wachtler. He
also said that he thought the zoning code
standard of a height of no more than 30
inches in a front yard should be
maintained. The monuments, as proposed,
are six feet. Mr. Schoenwetter said that
he felt the monuments were set back far
enough from the Wachtler right-of-way to
preserve existing site lines.
Commissioner Henning said that he thought
the plan for the recreation lot should be
revised per the discussion with the
planner and brought back to the
Commission. Mr. Schoenwetter responded
that the developers were most amenable to
making those changes, but would like to
get them approved since time was of some
concern.
Commissioner Anderson moved that the ,..:..� ,
requested variance for installation of
the entrance monuments be denied.

Commissioner Burke seconded the motion.
Mr. Dick Putnam of Tandem Corporation and
Mr. Tom Boyce of Centex'Corporation were
present to have a preliminary discussion
with the Commission regarding their plans
for submittal of development proposals in
the southeast area of the City. Mr.
Putnam began by briefly'reviewinc� the
City's southeast area comprehensive plan
amendment, and the original proposal
submitted by Tandem/Centex for low,
medium, and high density development
south of Mendota Heights Road, as well as
a commercial center at the corner of Dodd
and Mendota Heights Roai.
He said that at the July 7 City Council
meeting, the Council discussed its
alternative options for',development of a
community athletic complex, and requested
that he and Centex submit an alternative
plan for the southeast area that would
accommodate an athletic!complex, in case
the City decides not to�do a joint
project with School District No. 197 on
the Henry Sibley campus: He then
presented such a plan t( the Commission.
He indicated that the developers feel
there is still a need for a neighborhood
park in the area, even with the athletic
complex, since the uses'are different.
He presented both a plan that had been
shared with the Parks Commission two
weeks earlier, as well as a newly updated
plan that connected the�neighborhood and
athletic parks. The new plan places the
most highly lit facilities, i.e.,
baseball and softball fields, south along
the freeway, with tot lot and picnic
areas to the east. Athletic facilities
with less lighting, i.e!, soccer fields,
are to the north, with the passive
neighborhood park facility farthest north
along Mendota Heights Road. He noted
that they are proposingjto put high
density development around the park, with
medium density development north and east
toward the intersection;of Mendota
Heights Road and Delaware Avenue, and
single family homes to the southeast

toward the intersection of 494 and
Delaware avenue. He said this plan keeps
the most objectionable sports uses south
closest to the freeway.
He said that the City's parks consultant,
Barry Warner, would have to compute
construction costs for the new proposed
development, as well as make some
judgement on land costs. He indicated
that Centex Corporation was willing to
sell the acreage to the City at the same
price at which it would be ac�uiring the
property from current owner Jim Riley.
Mr. Putnam said that the total park
proposal as presented was about 32 acres,
and that a portion would be dedicated by
the developers as their park dedication
for the overall de�elopment.
A question was raised as to what this
plan did for overall density in the area
versus the plan without the athletic
complex. In the area roughly around the
park, Mr. Putnam indicated that there
were 350-400 units under the new plan
with the athletic complex, versus about
550 units without the complex.
It was noted that the developers would be
filing a formal application, and that the
item would be on the Commission agenda
for �ublic hearin� and formal
consideration at its August meeting.
City Administrator Frazell indicated that
the public hearing notice would also
include notice to residents that we would
be considering whether there should be a
change to the park designation of the
School Forest property, since there are
not currently any plans that would place
an athletic complex on that site.

MISCELLANEOUS Commissioner Henning raised a question
� about wh� the Commission is getting
applications, i.e., the Bjorklund/Hanson
subdivision, that did not have all the
, submittal materials as rec�uired by the
subdivision ordinance. City
Administrator Frazell responded that he
felt the City Planner and Engineering
department were meeting with developers
and indicating to them what was required.
However, Mr. Frazell said that perhaps

staff was not being careful to follow-up
and make sure that all of those items
were included with the submittal
materials before they are actuall�
forwarded to the Planning Commission. He
indicated that he would check`on it, and
correct the problem. ;

SYNOPSIS OF MONTHLY RUNS
The Fire Department responded to 32 calls durin� the
month of June. Only two of which resulted in real fire
damage both of which were vehicle fires. The Fire Department
also responded to a call on June 14 at 1:37 A.M. to the
warming house at Marie Park where an apparent arsonist threw
oil throughout the building and tried to ignite it. A
passerby from St. Paul put the fire out and called the Fire
Department. Fire damage was none but the area will have to
be cleaned and the oil drained. On June 14 at 6:50 P.M. our
Fire Department responded to an apartment fire in Eagan. our
Department responded two pieces of fire fighting equipment
and the rescue truck to carry man�ower to the call. We were
the second to respond in mutual aid. It should also be noted
that at no time was the City,of Mendota Heights left
unprotected with less than nine fire fighters and a Class A
Pumper. None of the members of our Department incurred any
injuries at the fire scene. On June 26 at 4:19 P.M.,�our
De�artment also responded to mutual aid call in Inver Grove
Heights as a standby. Our Department sent one engine and
five fire fighters to standby at Inver Grove's fire station
while they were helping Rosemount with a structure fire. �
SYNOPSIS OF MONTHLY DRILL
The monthly drill for the Mendota Heights Fire
Department was spent touring the Marriott Hotel. Twenty-six
members of the Department toured the hotel so that we would
be familiar with the building should we ever have a�roblem.
We also worked on pre-plans of hose layouts for Schwinn
Bicycle Shop and Swenson's Carriage House on Highway 110 and
also some preliminary pre-plan layouts at the NSP tank farm
facility on Highway 13. The rescue drill was spent with
instruction on use of the small hand tools such as the chain
saw and the K-12 Cut Off Saw and the boat was also.exercised
on Roger's Lake. �

After revi.ewing applicant status information with our Loan
officer i� appears we have two rehab files in the inspection
stage at this time. Since w� have enough funds ta complete about
8 homes, we may need to conduct some additional program
marketing. Ta date, we have advertised in the lacal paper and
have recently contac�ed Mendota Heights residents on the
Weatherization waiting list. If this latest effort is not
successful in generating sufficient interest for the funds
remaining, we will need to conduct additianal advertising.

DISCUSSION
The City construction praject to serve Evergreen Knoll
II Additian with sewer, water, and streats, has been
completed and an assessment roll has been prepared. The
ass�essment roll i� attached far your review. Assessment
spl.its between the Gryc property and the Kladis property were
based on the percent of the total area served that is owned
by each. At the request of the developer, Jim Gryc; the
total assessed to his development has been split evenly
amongst the 13 lots, and the outiat has been assessed�the
equivalent of four lots for street and starm, and three lots
for water and sanitary {becau�e one lot worth of the autlat
can be served from Dodd road). The total assessment per lot
for the Gryc lots will be $13,88U.41, which is below the
estimate. Assuming K3.adis plats his property into faur lots,
the assessment would be $1.2,452.19 far each of the three lots
complete2y served, and anly $?,197.73 for the lat partially
served off of Dodd Rd.
The interest rate for this project is nine percent.
Staff recommends that Council approve the attached
assessment roll a� prepared. �

FOR SANITARY SEWERS, WATERMAINS, STORM SEWERS, AND STREET
IMPROVEN�NTS TO SERVE EVERGREEN KNOLLS 2ND ADDITION AND
ADJACENT AREAS (IMPROVEMENT N0. 86, PROJECT N0. 8)
BE IT RESOLVED by the City Council of the City of Mendota Heights as
follows:
WHEREAS, the City Clerk, with the assistance of the City Engineer, has
calculated the proper amount to be specially assessed for the costs
��incurred to date with respect to Improvement No. 86, Project No. 6,
construction of sanitary sewers, watermains, storm sewers and street
improvements to serve the following described property situated in the
City of Mendota Heights, Dakota County, Minnesota, more particularly
described as follows:
Evergreen Knolls 2nd Addition and Part of Lot 41 lying East of
Line at Right Angle to North line 513 feet West of Northeast
Corner and North of Line parrallell and 183 feet South of North
Line, Auditors Subdivision No. 3, Section 24, Township 28 North,
Range 23 West.
WHEREAS, the proposed assessment roll has been on file with the Clerk
and at all times since its filing has been open for public inspection;
and notice thereof has been duly published and mailed as required by
law. Said notice stated the date, time and place of such meeting; the
general nature of the improvement; the area proposed to be assessed;
that the proposed assessment roll has been on file with the Clerk; and
that written or oral objections thereto by any property owner would be
considered; and
WHEREAS, said hearing was held at 8:00 o'clock P.M. on Tuesday, August
4, 1987, at the City Hall in the City of Mendota Heights, Minnesota;
and
WHEREAS, all persons present were then given an opportunity to present
oral objections, and all written objections thertofore filed with the
Clerk were presented and considered.
NOW THEREFORE, this Council, having heard and considered all objections
so presented, and being fully advised in the premises, and having made
all necessary adjustments and corrections, finds that each of the lots,
pieces and parcels of land enumberated in the proposed assessment roll
was and is specially benefited by the construction of said improvements
in not less than the amount of the assessment, as corrected, set oppo-
site the description of each such lot, piece and parcel of land, re-
spectively, and that such amount so set out is hereby levied against
each of the respective lots, pieces and parcels of land therein des-•
cribed; and

BE IT FURTHER RESOLVED, that the proposed assessmentlroll is hereby
adopted and confirmed as the proper special assessment for each of said
lots, pieces and parcels of land respectively, and the assesement
against each parcel, together with interest at the rate of nine percent
(9%) per annum accruing on the full amount thereof from time to time
unpaid, shall be a lien concurrent with general taxes upon such parcel
and all thereof. The total amount of each such assessment as to sani-
tary sewers, storm sewers, and watermains shall be payable in equal
amounts extending over a period of nineteen (19) yea�rs and each as-
sessment as to streets, curb and gutter shall be payable in equal
amounts extending over a period of ten (10) years; the first of said
installments, together with interest on the entire assessment com-
mencing thirty (30) days from the date hereof to December 31, 1987, to
be payable with general taxes for the year 1987, col,lectible in 1988
(now designated as real estate taxes payable in 1988'), and one of each
of the remaining installments, together with one yea;r's interest on
that and all other unpaid installments, to be payable with general
taxes for each consecutive year thereafter until the entire assessment
is paid; and � I
BE IT FURTHER RESOLVED, that prior to September 4, 1987 the owner of any
lot, piece or parcel of land assessed hereby may at�any time pay the
whole of such assessment, without interest to the City Treasurer; and
BE IT FURTHER RESOLVED, that the Clerk shall prepare and transmit to
the County Auditor a certified duplicateaof said assessment roll with
each then unpaid installment and interest set forth�separately, to be
extended upon the proper tax lists of the County, and the County Audi-
tor shall thereafter collect said assessments in the manner provided by

The Planning Commission considered this application for
a 25 lot subdivision at its July 28 meeting. The two issues
that seem to be of primary concern and discussion were:
1. Given that the Knob Road area already has storm
drainage problems, storm water runoff is a primary
concern to be addressed in this development.
2. The request for some lots of less than 100 feet of
frontage.
The Commission voted to recommend approval of the
preliminary plat conditioned upon:
1. The developer obtaining conveyance of property from
5chool District 197 for the extra right-of-way along
• Warrior Drive prior to fir.al plat approval.
2. That there be no drivewa� openings extending
directly onto Warrior Drive, per the recommendation
of the City Planner's report.
Commissioners Anderson and Burke dissented because they
felt the plat would be improved b� removal of one lot on the
Henry Circle cul-de-sac. Commissioner Duggan was not present �

After discussion, Council should pass a motion approving
the preliminary plat with whatever conditions it deems

Approval of Preliminary Plat
1. The property in question is an 11.61 acre site, the northerly portion of
which was the subject of a previous platting proposal. Two properties
have been combined in this proposal which develops the remaining
frontage between the previously approved "Ponds of Mendota Heights"
plat and the north boundary of the lots fronting on the service road on
the north side of Highway 110.
2. The Staff has met on several occasions with the applicants and their
platting advisors. This is a very difficult site from the sta�dpoint of
the terrain, and a variety of options were reviewed with the applicants
and the Staff. It appears that the plat as proposed represents the
. most reasonable �way in which to develop the property with the least
deleterious impact . on the site.
3. You will note that the site has a considerable slope on the west side
of Warrior Drive. That slope is the steepest and most difficult at the
north side. This is why the access at the northerly two-thirds of the
site is just north of the center. This results in a cul-de-sac
approximately 560 feet long, where as the City standard is 500 feet.
We do not feel that the additional 60 feet is of any significance. The
cul-de-sac solution, however, provides for the best home sites within
City standards and recognizes the terrain conditions.
4. The southerly cul-de-sac is 268 feet in length and again appears to be
the best method for creating the best home sites. We did examine
several alternatives where by a north-south roadway would run through
the site. However, this tends to result in a cul-de-sac that is too
long, excessive street right-of-way, and/or homes that front .on Warrior
Drive.
5. We suggest that this development be considered for approval with the
condition that there be no private driveways extending directly to
Warrior Drive. Warrior Drive, of course, is the principal access to the
high school site and it is contemplated that at some point in the future
to extend northerly to Marie Avenue. The right-of-way Is established at
80 feet, �0 feet wider than the typical suburban residential street.

7. Each of� the lots � meets the minimum 15,000 square feet and the 25 lots
proposed average 16,797 square feet. One of the lots (Lot 11) appears
to have less than 100 feet of frontage at the building line. That lot,
however, has a 117 feet plus a portion of the right-of-way on the south
side. Thus, it would appear not to be an important consideration. The
home proposed o'n Lot 14 appears to be less than 30 feet from the
cul-de-sac right-of-way. This should be corrected since there is more
than adequate area to set this home back the proper 30 feet as
required. This will result in a lot width of approximately 100 feet at
the building line. Lots 17,� 18, and 19 also have less than 100 feet
(though two of the three far exceed the minimum lot area). As in the
case of the Copperfield planning proposal, we suggest that the site
reduction and building frontage may not be that significant if the
Planning Commission and Council consider it so. The reduction of one
lot in this portion of the plat will result in lot frontage requirements
that meet or exceed the 100 square feet dimension.
8. This report is b�eing written prior to the receipt of the information

DISCUSSION•
Dick Bjorklund Sr. and Rox Hanson propose to subdivide
their property located on Warrior Drive west of Sibley High
School. Their parcel of land is a long, narrow piece
surrounded on all sides by developed or platted property.
Staff has reviewed the preliminary plat and offer the
following comments:
1. Just as in the Hampshire Estates plat which has been
recently reviewed and approved, 55 foot street
r-o-w's are being requested to facilitate a more
efficient layout of the plat.
2. Henry Circle, the north cul-de-sac, is drafted to be
557 feet long, which exceeds the City's maximum cul-
de-sac length. However, the lots at the extreme end
of the cul-de-sac abut on Warrior Drive and could be
accessed by public safety vehicles readily from
either street.
3. Staff counted eight lots that do not have the
required 100 feet of frontage at the building
setback line. All but two of these lots
considerably exceed the 15,000 square foot minimum
lot area
4 When the City constructed Warrior Drive, we acquired
some 25 feet of extra r-o-w on the southeast corner
of this site. We did this for slope purposes and it
is no longer needed by the City for r-o-w.. Staff
suggested that if the developer would acquire the
rights for that property from the School District,
the City could vacate it and the area could be
included with this plat.
5. The cul-de-sacs are indicated to be 50 feet in
diameter. The City requires a minimum of 55 feet.
ACTION REOUIRED:
Conduct a public hearing and based on input at that
hearing, make a recommendation to the City Council.

INTRODUCTION•
Attached is an application from Michael Halley Homes,
developers of Park Place, for variances concerning entrance
monuments and neighborhood playground area.
ENTRANCE MONUMENTS
As outlined in the attached reports, the developers are
seeking a variance to allow installation of entrance
monuments on the two streets cominc� into the Park Place
development. The Planning Commission considered this request
at its meeting of July 28, and unanimously recommended denial
of the request. It seems that their concerns were two:
1. The potential to create a traffic hazard from
reduced visibility of traffic on Wachtler Avenue.
2. A desire not to grant a variance from the zoning
code requirement which restricts fences and other
appurtenances in front yards to no more than 30
inches in height.
RECREATIONAL AREA LAYOUT
The proposed recreational area on one lot of the Park
Place plat requires a variance, since technically it is
placing accessory structures on a lot without any principal
structure. Attached is a copy of the developer's application
and site plan for the property. The site plan as submitted
does not appear to conform with the recommendation in City
Planner Howard Dahlgren's report. It appears that Howard
requested that the gazebo be placed on the centerline of the
tennis court, the tot lot moved nearer the street, and
benches installed for people sitting by watching children.
Because of the confusion over the plan, the Planning
Commission voted to recommend denial of the request on July
28, and asked that it be brought back to them at their
meeting of August 25. However, because of the urgency of
getting the improvements in place for the Parade of Homes
tour in September, the developer has asked that I place this
on the agenda for your consideration on August 4.
The developer phoned the next day to say that they felt
the plan as originally submitted was acceptable to City
Planner Howard Dahlgren, and that there were pros and cons
with going either way. We will try to clarify this with
Howard prior to Tuesday evening's Council meeting, so that a
verbal report can be made to Council. '

DISCUSSION:
Mr. Michael Halley has met with City Planner and staff
to present the attached �lans for entrance monuments along
Wachtler and the recreation area. Because Wachtler has a 50
foot r-o-w, the entrance monuments need to be set within five
feet of the �roperty line so that they can be seen. The
minimum required setback is 30 feet, therefore a 25 foot
setback variance needs to be'considered.
Mr. Halley also submitted the final layout for his
'recreation area. The area was discussed during plat approval
and now Mr. Halley wishes to be granted approval to construct
the proposed amenities. The proposal includes a tennis
court,, play structure and a gazebo-type structure.
The recreational area is proposed to be constructed on a
platted lot. Accessory structures such as these would not be
allowed without a principal structure. The Commission needs
to consider a variance to allow this.
ACTION REOUIRED:
Discuss the proposals with the applicant and make a
recommendation to the City Council on the granting of 25 foot
front yard setback variances for the entrance monuments and
on the granting of a variance to allow accessory structures
without a principal structure on Lot 9, Block 1, Park Place
Addition.

Owned Recreational Facilities
1. Firstly, the applicant proposes to build a brick and rod iron monument
at the two entrances to their site off of Wachtler Avenue. These
monuments are subject to that which was constructed for recent
additions in the Copperfield area.
2. They have supplied a plan and elevation of the proposed monument
which is attached. The post will be 6 feet in height, constructed of
brick with a brick wall and 18 inches in height at the top that will be
rod iron fencing. A sign approximating 6 square feet (as prescribed in
the ordinance) is proposed to be attached to the rod iron fencing.
3. This property is R-1 single-family and the setback required from public
right-of-ways is 30 feet. They propose to construct the entrance
signage within 5 feet of the property line as indicated on the attached
drawings. This is the typical location that is utilized i� other
subdivision entrance signage. Arrangements have been made with the
land owners of the lots for the rights to build and maintain the sign on
the property. It is proposed that the signage would belong to and be
maintained ultimately by the Home Owner's Association.
4. The second proposal is that of consideration and approval of the site
plan for a proposed private recreation area to be built and initially
maintained by the developer. Ultimately the title to the land and the
facilities on the land and their responsibility for maintenance would be
passed on to a Home Owner's Association.
5. Approval should be based on City review of the carefully prepared
document that will ensure the maintenance of the facility in the future.
The association agreement should include a clause that in the event
taxes are not paid and the land is not maintained, the City has the
right to induct such maintenance and assess the owners of the lots
within the plat, all of whom would have been members of the
association.

6. With respect to the design of the recreational facilities, we suggest that
the gazebo be located near center of the tennis court in order to
provide a shaded seating area for the observation of this facility. We
have suggested to the applicant that additional benches be provided near
and contiguous to the proposed child play area for parents supervising
their children. i
7. At this writing, we will not have seen the final site plan, but we will
have reviewed the preliminary plan with the applicants and their
landscape architects on July 20. Their arrangement of the site may
differ from what we have described. We feel that a loeation of the
play area should be visible from the public street as a matter of the
public policing the' area to the maximum degree. In this small setting,
this is not a crucial decision, but where possible more exposure to the
passing public is preferred when it comes to small children's play areas.
8. ` The tennis court proposed and other recreational facilities are normally
an accessory use to a principal use which would typically be a
single-family home: Such accessory uses are �ormally permitted without
Planning Commission or Council action if the principal use is on the
site. In this case, there is no principal use on the site and that is
wh� the pr.oposal and the design for the use of the land is referred to
the Planning Commission and Council for their review.

�•SUBJECT: Barton-Aschman Evaluation of Tandem Parks Proposal
At the Planning Commission meeting of July 28, Dick
Putnam of Tandem Corporation, presented yet a third
alternative for development of the southeast area. This
alternative provides for a community athletic complex south
of Mendota Heights Road, and connects that complex with a
neighborhood park more northerly along Mendota Heights Road.
This was a modification from the earlier plan discussed with
the Parks Commission at their meeting of July 14. Parks
Commissioner Bill Owens was present at the Planning
Commission meeting, and indicated that he felt the revised
proposal was better than the earlier plan.
As requested by Council, the City Planner's office has
provided the attached analysis of the compatibility of this
athletic complex proposal with land use issues in the
southeast area. The community athletic complex and
neighborhood �ark as proposed encompass approximately 32
acres, a portion of which will be obtained by the City
through park dedication from the surrounding Tandem/Centex
development. Mr. Putnam has indicated that Centex would be
willing to sell the remainder of the pro�erty to the City at
the same price at which it is acquiring it from Mr. Jim
Riley.
The Planning Commission will be considering the
alternative proposals both with and without the athletic
complex at their meeting of August 25. The Parks Commission
will be considering the alternatives of the Riley site as
proposed, and the progress on discussions with the School
District concerning the Sibley site at its meeting of
September 8. At its meeting of September 15, Council will
need to begin making some decisions as to which parks .
alternative it intends to pursue.
Obviously, an important piece of information
this point on the Riley alternative is whether it
meet our parks needs, and an estimate of the cost
development. If the plan as proposed by Tandem,

�evaluated by City Planner John Shardlow (I have not seen
John's report at the writing of this memo) leads Council to
believe that this continues to be a viable alternative, I
would recommend that we retain the services of Barton-Aschman
to evaivate the alternative to meet our parks need, and give
us a development cost estimate. Barry Warner has indicated
that the cost of such an evaluation should run no more than
$1,000 to $2,000. '
ACTION REQUIRED:
If Council concurs with the staff recommendation above,
to expedite the review in time for the Planning Commission
meeting, I recommend that Council pass a motion authorizing
the City,Administrator to order the evaluation by Barton-
Aschman in an amount not to exceed $1,500. 1

DISCUSSION
The construction of street and storm sewer for the
Northend has been substantially completed. Attached is a
copy of the pro�osed assessment roll for your approval. The
cost of street improvements has been finalized at 10.80 per
front foot. compared to an estimate several months ago of
$10.50 per front foot. The Storm sewer has been finalized at
0.093 per square foot, compared to an earlier estimate of
$0.090 per square foot. For comparison if there was no MSA
participation the costs would be $31.81 per front foot for
street and $0.119 per square foot for storm sewer.
RECOMMENDATION
5taff recominends Council call a public hearing for
assessments to properties in the Northend, and use the
attached assessment roll as a basis for distributing the
assessments.

SUBJECT: Assessment Hearing for Yorkton, Deer Trail, Spring
Creek, and Valley Curve.
DISCUSSION
Al1 the above projects are nearing completion. In order
to file an assessment role with the countx this year, it is
essential that hearings for all these pro�ects be called this
meeting. The interest that would accumulate over another
year if hearings are not called now would be very
significant. By the next meeting the projects should all be
finalized and the assessment roles should be completed.
RECOMMENDATION
If Council wishes to conduct public hearings this year
for the above named projects, Council should pass a
resolution ordering a public hearing for these projects to be
conducted on September 1, 1987. �

WHEREAS, contracts have heretofore been let for the construction of the
following described improvements:
The construction of sanitary sewer and water improvements to serve
Valley Curve Estates (which improvements have heretofore been
known and designated as Improvement No. 86, Project No. 5).
and
WHEREAS, the construction of said improvements has been substantially
completed; and .
WHEREAS, the City Clerk, with the aid and assistance of the City Engi-
neer, was previously directed by the City Council to prepare the as-
sessment roll for the above described improvements; and
WHEREAS, the City Clerk has notif ied the City Council that a proposed
assessment roll for the above described improvements has been completed
and filed in her office f or public inspection.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. That a public hearing on said proposed assessment roll shall
be held at the Mendota Heights City Hall at 750 South Plaza Drive,

Letters have been sent to the developers of the listed
projects. The Eide and DuPont delinquencies have been
referred to the City Attorney.
RECOMMENDATION:
Staff recommends that Council authorize staff to
withhold additional building permits in these projects and
to withhold certificates of occupancy for any construction
underway until the delinquent amounts have been paid.

At the last C3ty Council meeting Cauncilmember Witt reported that sh�
had read in the newspaper that the Mendota Interchange Project was in
jeopardy and asked that staff investigate. I called Bob Carford at Mn/DOT
District 9 for his comments and he reported to me that as a result of the
legislature's inac�ion on a funding bill, there was a$96 million funding
shortfall. He said that as a result af the shortfall, the Mendota
Interchange projec� has been deferred out of �he 1988-$9 construction
program. Iie i.s optimistic that �he next legis�.ative session will aga�.n
�provide highway funding and that the project could be added to the 1990-93
construction program. I�ie says that the redecking af the Mendota Bridge
project and this project shauld be tied together with both being completed
a.n the same timeframe (1990-93).
