When the 1987 budget was compiled last summer, our labor
contracts were unsettled, and the impact of pay equity
implementation unknown. Therefore, we simply,budgeted all
salary at the 1986 level, and included a cont�ngenc�r
a�propriation in each fund to cover later salary,ad�ustments.
With cost of living, labor contract, and pay equity
adjustments now all completed, we need to allocate those
monies from the contingency appropriation to the operating
budgets of the relevant departments. Attached is a memo and
recommended action from Treasurer Larry Shaughnessy that
accomplishes that.

INTRODUCTION
In ].987, the Fire Department budgeted $4,000 for fire hose replacement. This is
an annual replacement fund that we have far this purpose. This memo is to gain
authorization ta purchase the hase.�
DISCUSSION
We are able to purchase the necessary hose we need for replacement thraugh �
the Fire,Departmen� purchasing cansortium at a very reasonable cost of $4.60 per
foot.
RECQt4MENDATION
Staff recommends that we purchase 800 feet of 4 inch hase at a price of
$4.60 per faoi thraugh the Fire Department purchasing consortium bid no. A5391P1
awarded to Minnesota Conway. Four hundred feet of this hose will be billed to
the new pumper and 4QQ feet to repl acement of @X1 St`! CiC� I1052.

Department Personnel Changes
Due to the retirement of Captain Lange and pursuant to the re-organization plan approved by the
Council, the Police Department is prepared to recommend the appointment of a probationary
Sergeant and Patrol Officer.
DISCUSSION
At the last meeting, council authorized me to offer pona Currie the job of Patrol Officer and I
indicated that we would also be ready to make our recommendation for the vacant Sergeants
position. Dona has accepted the position and she will be present to meet the City Council.
The promotional list that was established for the rank of Sergeant is still current. It ranks the
top three candidates as: 1. Larrie Mack. 2. Larry Bridger. 3. David Olmstead. After
reviewing the testing procedures, completing psychological evaluations, and meeting with staff '
and the City Administrator, I am recommending that Larrie Mack be appointed to the
probationary position of Police Sergeant.
Larrie has been with ihe department for over 7 years. He worked as a police officer in West St.
Paul for 8 years prior to coming to Mendota Heights. Officer Mack is a bright and eager police
officer and i fully expect that he will develop into a valued member of our management team.
RECOMMENDATIONS
1. That council approve the appointment of Dona Currie to the position of probationary
Police Officer at a starting annual salary of $24,420.
2. That council approve the appointment of Larrie Mack to the position of probationary
Sergeant at a starting annual salary of $36,080.

Minutes of the Regular Meeting
Held Tuesday, June 16, 1987
Pursuant to due call and notice thereof, the regular meeting of the City Council,
City of Mendota Heights was held at 7:30 o'clock P.M. at City Hall, 750 South
Plaza Drive, Mendota Heights, Minnesota.
Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. The following
members were present: Mayor Mertensotto, Councilmembers Blesener, Hartmann and
Witt. Councilmember Cummins had notified the Council that he would be late.
AGENDA ADOPTION Councilmember Hartmann moved adoption,of the agenda for the
meeting, including additional items contained in the add-on
agenda.

Orfei & Sons, Inc., for Copperfield I Addition

j. Adoption of Resolution No. 87-54, "RESOLUTION APPROVING
FINAL PLAT FOR COPPERFIELD 3RD ADDITION."
k. Approval of the List of Claims dated June 16, 1987 and
totalling $318,677.91.
1. Approval of the list of contractor licenses dated June
16, 1987 and attached hereto.
m. Approval of the issuance of on-sale club liquo.r licenses

SPRINKLING BAN The Council acknowledged and discussed a report from the
Public Works Director informing Council that staff had
implemented an emergency sprinkling ban this morning and
recommending authorization to continue the ban. Mayor
Mertensotto informed the audience that the City's 2 million
gallon water tank has been running very low and ran dry on
Monday evening, creating a dangerous situation, particularly
in emergency situations. He asked that Council authorize an
immediate 48 hour ban on the sprinkling of lawns and
thereafter, an odd/even sprinkling ban. He suggested that
the only exception to the ban being for the watering of newly
seeded or sodded lawns, and that police, code enforcement and

public works staff be authorized to enforce the ban.
Councilmember Witt moved to establish a total sprinkling ban
through June 18th, with the exception of newly seeded and
sodded lawns, followed by an odd/even ban until the level of
water in the tank reaches 30 feet, and thereafter to empower
the Public Works Director to declare an emergency situation
and set conditions if the tank level goes below 30 feet.
Councilmember Hartmann seconded the motion.
Staff was directed to notify the media so that the residents
are notified of the ban.
Councilmember Hartmann moved that a Certification of
Appreciation be awarded to Captain Eugene Lange.
Councilmember Witt seconded the motion.
Mayor Mertensotto presented Captain Lange with an engraved
plaque, recognizing his forthcoming retirement after 25 years
of exemplary service to the City.
FURLONG ADDITION Administrator Frazell gave a brief synopsis of his report and
response to Robert Tousignant relative to questions and
concerns raised by Mr. Tousignant and Furlong Addition
residents at the June 2nd meeting.
Mr. Tousignant, present for the discussion, stated that the
report was excellent but that it is his observation that
there should be a better solution to the problems than just
to wait for the results of the planning study.
After discussion, Councilmember Hartmann moved to conduct a
special Council meeting on June 30th at 7:30 P.M. in the
Council Chambers for a neighborhood discussion and report by
the City Planner. •

NUISANCE COMPLAINT The Council acknowledged a report from the Police Chief
relative to the abatement of a nuisance at the George Noack,
Sr. property. Police Chief Delmont, present for the
discussion, highlighted the report and reviewed the status of
the case, informing Council and the audience that four
citations were issued today for 12 violations of City
� ordinances, and that the violations will be prosecuted.
Councilmember Cummins arrived at 8:12.
PUBLIC COMMENTS Mr. Melvin Swanson, 1778 Ridgewood Drive, was present to
complain over the placement of fill on the Krajniak lot on
Marie Avenue which is creating drainage problems on his lot.

The Public Works Director was directed to visit the Swanson
property and report to Council at the next meeting.
HEARING -- Mayor Mertensotto opened the meeting for the purpose of a
CASE N0. 87-09, public hearing on an application from G& L Properties for
G&L PROPERTIES the rezoning, Comprehensive Plan Amendment and subdivision of
property located at the southeast quadrant of Mendota Heights
Road and Highway 55.'
Mr�. Bill Pearson, representing G& L,'stated that the
applicants request the subdivision of the property into seven
lots and the rezoning from B-lA, B-3 and I to Industrial for
Block 1 and B-3 for Block 2 of the proposed plat. He
explained that prospective clients include a hotel, a strip
center and gas station, two restaurants, one of which would
be fast-food, and an office/service building.
Mayor Mertensotto stated that he would prefer to see a full
service gas station rather than a gas/convenience center, and
he expressed concern that once the property is rezoned to B-3
the Council will lose control over the type of use which can
o�cur.
Councilmember Cummins agreed, and asked whether the
applicants could wait on Block 2 and hold it open for a PUD
proposal which would allow Council to retain more control
until the applicant has a firm idea of what prospective
buyers might plan to construct on the lots.
Councilmembers Blesener and Witt shared the concerns over B-3
zoning and what might be proposed.
Mr. Pearson responded that his firm has spent nearly a year
working with the City's staff and the Planning Commission and
hopes to break ground this fall. He stated that the owners f
have to be able to sell th.e- lots and can't do that until
they know what the zoning�will be.
Mr. Gail Brodel, from G& L, stated that he understands
Council's concerns but that in order for him to sell the lots
he must be able to tell the prospective buyers what can be
built. He asked that Council approve the planning
applications so that he can market the property.
Administrator pointed out that the application is not for a
major rezoning but rather will clean up the lines of the
existing zoning districts. He stated that part of the
property is already zoned B-3 and that most of the uses
suggested by the developers can be accomplished under either
B-3 or I zoning.

Mr. Wayne Specktor, First Avenue, supported the applications,
stating that it appears that the applicants have done a great
deal of work on the plans, he believes the restaurants are
needed, and the total proposal makes sense to him.
There being no further comments; Councilmember Cummins moved
that the hearing be closed at $:58 P.M.
Councilmember Hartmann seconded the motion.
Councilmember Hartmann moved adoption�of Resolution No. 86-
55, "RESOLUTION AMENDING CITY'S�`COMPREHENSIVE PLAN."
Councilmember Witt seconded the motion.
Councilmember Hartmann moved adoption of Ordinance No. 235,
"AN ORDINANCE AMENDING ORDINANCE N0. 401," approving the
rezoning application, contingent upon Metropolitan Council
approval of the Comprehensive Plan Amendment, along with
approval of the preliminary plat dated March 18, 1987.
Councilmember Witt seconded the motion.
Staff was directed to communicate to send a letter to the
developers, notifying them to alert prospective buyers of the
B-3 lots of the Council's concerns over the ultimate
development of the lots, including landscaping and layout.
Staff was also directed to communicate the concerns over B-3
uses to the City Planner and to direct him to work closely
with the buyers of the lots on the ultimate development of
the property.
Councilmember Witt moved approval of a joint powers agreement
with the Cities of West St. Paul, South St. Paul and Inver
Grove Heights and a joint powers agreement with Dakota County
for operation and funding of a recycling center to be
operated on South Robert Street under contract by Goodwill
Industries. •
Councilmember Hartmann seconded the motion.
CASE N0. 87-07, Mr. Carl Anderson was present to request approval of the
ANDERSON preliminary plat for the subdi"vision of property located on
SUBDIVISION Third Avenue into 13 lots. He also stated that some street
. vacations will be required if the plat is approved.
Councilmember Cummins stated that there are several waterways
going either through or near the property and asked where the
areas are in the proposed plat where the Council should have
concern over waterflow.
Councilmember Blesener asked why the street that comes up
from the south of the proposed plat is not aligned with
proposed streets in the plat. Mr. Anderson stated that the
developers wanted to create lots which would conform with the

Ivy Falls neighborhood and to offset the streets to create an
atmosphere of a separate development.
After discussion, Councilmember Hartmann moved to approve the
preliminary plat for the Hillside Creek subdivision subject
to trail and utility easements being dedicated to provide
access along vacated Emerson Avenue and subject to
verification by the feasibility report that the utility
layout is correct.

STRATFORD WOODS Mr. Terry Dobie was present to request approval of the final
FINAL PLAT plat for the Stratford Woods Addition. With respect to the
boundary dispute with Mrs. McDonald, who was present for the
discussion, Mr. Dobie stated that the property corners shown
on the plat are those established by his surveyor. He stated
that he has a previous survey that was done by Wayne McLagan
which verified that the property corners that were in the
ground were not where they should have been. He pointed out
that, similarly, the southern boundaries of the McDonald
property are offset by an amount equal to what she feels her
north boundary is off by. He stated that he has an agreement
to convey �ut10t,A to Mrs. McDonald and Lot 9 is her lot.
In response to a question from Mayor Mertensotto, Mrs.
McDonald stated that she is in agreement with what Mr. Dobie
stated.
Mr. Dobie stated that in order to resolve the plat overlaps
he has platted overlaps along the south boundary and will
quit claim that area to the adjoining lots in the Wagenknecht
Addition. He further stated that he has agreed that Mrs.
McDonald will only be assessed for one lot and the large
parcel she owns, and that what would have been assessed for
the potential of one additional lot on her property can be
spread over all of the Stratford Woods lots.
After discussion,, Councilmember Hartmann moved adoption of
Resolution No. 87-56, "RESOLUTION APPROVING FINAL PLAT FOR
THE ROLLING WOODS ADDITION," conditioned upon receipt of the
required park contribution. � •

ROLLING WOODS Councilmember Hartmann moved adoption of Resolution No. 87-
ADDITION 57, "RESOLUTION APPROVING FINAL PLAT FOR THE ROLLING WOODS
ADDITION," conditioned upon receipt of the required park

Pursuant to due call and notice thereof, the regular meeting of the City Council,
City of Mendota Heights was held at 7:30 o'clock P.M. at,City Hall, 750 South
Plaza Drive, Mendota Heights, Minnesota.
Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. The following
members were present: Mayor Mertensotto, Councilmembers Blesener, Cummins,
Hartmann and Witt.

PUBLIC COMMENTS Mr. Richard Paul, 940 Wagon Wheel Trail, asked that Council
consider instituting a weed control program for Rogers Lake.
He was requested to submit written information to City staff
for research and report.
INTRODUCTIONS Mayor Mertensotto introduced School Board members Judy
Pendergrass, Bob Doffing and Kitty Haight and Park Commission
Chairperson Jim Stein to the sudience.
MISCELLANEOUS The Council acknowledged a letter from Mr. & Mrs. Emil
Slowinski, 806 Bachelor Avenue, regarding concerns over the
angle of the slopes in the Deer Trail Hills development and
the dumping of dirt from the Evergreen Knolls area.
Public Works Director Danielson stated that he has been in
contact with the Slowinskis, that the slopes in the area of
concern to the Slowinskis are the same as they we�e before
the project started, that there is very little erosion and the
slopes will be seeded soon, and that the slopes have been
changed because of construction will be corrected. Mr.
Danielson was directed to send a response to the Slowinskis.
HOUSE PAINTING The Council acknowledged a response from the City
ORDINANCE Administrator to a request for adoption of minimal housing and
REQUEST painting ordinances, recommending that the issues be addressed
as part of the zoning code review process.
Councilmember Cummins asked whether the City could pursue some
provision of the health ordinance and involve Dr. Chao in the
residents' complaint about a home in Friendly Hills.
Attorney Hart suggested that since there are conditions that
relate to public health, safety and welfare, the City could
take steps to remedy the problem under its police powers.

HEARING -- Mayor Mertensotto opened the meeting for the purpose of a
STREET VACATION public hearing on an application for the vacation of a portion
of Copperfield Drive platted in the Copperfield II Addition
and realigned in the Copperfield III Addition plat.
Mayor Mertensotto asked for questions and comments from the
audience.

HEARING -- CASE Mayor Mertensotto opened the meeting for the purpose of a
N0. 87-13, MASTEL public hearing on an application from Mr. & Mrs. Chuck Mastel
for a conditional use permit to construct a 6 foot high fence
in the rear yard of their through lot, 1341 Cherry Hill Road.

Mayor Mertensotto pointed out that the applicants have
requested permission to install the fence 33 feet from the
center line of Wachtler Road but that the County has a 50 foot
wide right-of-way for Wachtler. He informed the Mastels, who
were present for the discussion, that the City has been
advised that the County will not permit the fence to be
installed within the right-of-way.
Mr. Mastel stated that his legal counsel has conferred with
the County attorney and that he believes the issue can be
resolved and that the fence can be built at the 33 foot line.
He stated that the Council consider approval of the fence at
the 50 foot line if the original request is not acceptable.
Mayor Mertensotto asked for questions and comments from the
audience.
There being no questions or comments, Councilmember Blesener
moved that the hearing be closed at 8:01 P.M.

Councilmember Cummins moved adoption of Resolution No. 87-62,
"RESOLUTION APPROVING CONDITIONAL USE PERMIT," approving the
location of the fence 33 feet from the centerline of Wachtler
Avenue, subject to approval by Dakota County of the
installation of the fence in the location requested, and in
the alternative that the location is not approved by the
County that the applicant be authorized to place the six foot
high fence at the right-of-way line.

three lots, subject to receipt of the required park
contribution. ,

CASE N0. 87-16, Mr. James Loving was present to request approval of a 20 foot
LOVING rear yard setback variance at 672 Cheyenne Lane to allow
construction of a new home 10 feet from the rear property line
of the corner lot. Mr. Vogt, an adjacent property owner,
stated that he has no objection to the request.
Councilmember Witt moved approval of a 20 foot rear yard
setback at 672 Cheyenne Lane to allow construction of a home
ten feet from the property line, subject to the applicant
providing a 30 foot minimum sideyard setback.

CASE N0. 87-04, Mr. Dick Putnam was present to request approval of the final '
HAMPSHIRE plat for the Hampshire Estates Addition. As part of the
ESTATES discussion, Mr. Putnam stated that he would like to name the
park the "Hagstrom King Park" in honor of Bill and Lois King.
Councilmember Witt felt that the Park Commission should make a
determination on the park name.

Councilmember Blesener moved adoption of Resolution No. 87-
64, "RESOLUTION APPROVING FINAL PLAT FOR THE HAMPSHIRE ESTATES
SUBDIVISION," subject to reserving the park name for review by
the.Park Commission, along with authorization for execution of
the developers agreement by the Mayor and City Administrator.
Councilmember Cummins seconded the motion.

ATHLETIC COMPLEX The Council acknowledged a report from the City Administrator
relative to the Barton-Aschman report concerning the siting of
the proposed athletic complex along with a letter from the
School Board regarding the same matter.
Mayor Mertensotto stated that after the referendum was
withdrawn, the Council considered its options and commissioned
Barton-Aschman to study the Riley property and make
comparisons between it and the School District site. He
informed the audience that the Park Commission has acted on
the report and made a recommendation that the Council continue
negotiations with the School Board to work toward the Henry
Sibley alternative.
Commission Chairperson Jim Stein stated that he feels that
rather than dC��-tjg on the Commission recommendation this
evening, Council should first determine whether it is possible
to reach some type of agreement between the two public
agencies.
Councilmember Cummins asked Mr. Stein what the Commission's
reaction would be if the Council preference this evening is to
negotiate with the owner of the Riley property.
Mr. Stein responded that the sites have been narrowed down to
two and that the Commission feels that the school site is
better from many different standpoints. He also stated that
he feels that a bond issue for placing the complex on the
Riley site would likely fail because of the additional expense
for development of the site.
Mr. Barry Warner, from Barton-Aschman, stated that the study
prepared by his firm compares and contrasts the two sites. He
reviewed a conceptual layout on the Riley property and
reviewed the information contained in the report. He
estimated that development of the Riley site would cost
$1,938,000 and that the school site cost would be an estimated
$1,045,000. He then reviewed the facilities which would be
proposed to be located at the two sites. He stated that from
the consultant's standpoint the Sibley site is a more prudent
choice based on cost and other criteria.
There was discussion over the determination of value of the
Riley property. Councilmember Cummins asked whether there was
consideration given to the fact that seventeen acres of

property will be required as the park dedication for
development of the Riley property. Mr. Warner responded that
it is his feeling that even if the athletic complex is built
on the Riley site there will still be the need for a
neighborhood facility and that the park dedication should be
used for a more traditional park.
Mayor Mertensotto expressed concerns over negotiating an
agreement with the School District, and asked whether Mr.
Warner's recommendation would still be the same if the
agreement terminated in 20 years, as was a condition in the
earlier agreement with the District. He pointed out that
longevity is a factor -- the City would be contributing over
$1 million and that he is concerned over what the tax payers
will have for their investment�at the end of the contract
term. '
Mayor Mertensotto asked for questions and comments from the
audience.
Mr. Bernard Friel, 750 Mohican Lane, objected to the
consultant's use of values for the Riley property based on
medium and high density zoning. He felt that 70$ ownership in
10 acres of property for 20 years for $1 million (for the
school district site) is not as wise an investment as spending
the amount required for purchase and development of 36 acres
of the Riley property and having full control over the site.
He stated that Mr. Stein's suggestion that the Council
negotiate with the School Board would have the result of
closing the possibility of acquiring the Riley site.
Councilmember Witt stated that even if $500,000 were shaved
from the purchase price of the Riley site, it would still cost
the City $500,000 more than the School District site to
acquire and develop. She stated that there is no agreement
with the school district over distribution of ownership of
that site, and that the entire issue must be discussed with
the Board. '
Councilmember Blesener stated that the agreement that was
considered in the past is not acceptable and that this is
neither the time nor the place to negotiate an agreement.
Mr. Boyce, a representative of Centex, the firm holding an
option on the Riley property, stated that they will be
submitting a plan in the next two weeks for development of the
property. He stated that with regard to the park dedication,
if the City wants a forty acre athletic complex on the site,
only 80 acres would be left and that is what the park
dedication would be based on. He stated that this is not the
type of facility for a residential neighborhood and that as
far as the price is concerned, on a net acreage basis the
price would be very close to what Mr. Warner projected. He
felt that if the City were to purchase the property for the

athletic complex it should also buy a buffer zone between the
fields and the residential development. He stated that he is
more than willing to work with the City and is not opposed to
an athletic complex, feeling that it is a good thing for the
community.
Mr. Mel Swanson, 1778 Ridgewood, asked whether the City would
provide a buffer zone around the Sibley �lel'd' T►ltl �that �if the
City buys the Sibley property, four other communities will
have the "say" over what can be done with the land now and in
the future. He felt the City should choose the Riley site
because it would have total control over the site.
Mr. Gary Gustason, Cherry Hill Road, stated that in the case
of the Riley site, the City would be taking 35 acres off the
tax��rolls in contrast to seven acres for the Sibley site. At
10'..units per acre the City would lose about $280,000 per year
in tax revenues. He felt that that should be taken into
consideration in deliberation over siting the facility. He
felt that one thing missing in the City is a lack of community
identity and that if the facility were located at the school
it might be something which would develop more community
spirit.
Mr. Russ Wahl, 631 Callahan Place, suggested a number of
facilities which could be included in the athletic complex at
the Riley site and felt that more people would use that site.
He also stated that no traffic study has been done to
determine potential impact on Marie Avenue if the facility .
were located at Sibley.
School Board Chairperson Niemeyer stated that the primary
issue is which site would be in the best interest of the City.
He stated that the Board went through a series of negotiations
with the City this past spring and that there are new Board
members since that time. He informed the Council that the
Board talked about this project at its last meeting and stands
ready to go back to the negotiating table to try to arrive at
a decision good for all parties for a term of not twenty years
but for many more years that will serve the interests of the
citizens of Mendota Heights and the school district students.
He stated that the Board very much wants to see a contract
work as a successful partnership and would like to commit
themselves to a viable agreement.
Board member Bob Doffing, former Park Commission member,
reviewed the Commission's planning process for the athletic
complex, trails and neighborhood park improvements included in
the proposed referendum. He also reviewed results of a
community survey conducted by the Commission.
Mr. Stan Gustason stated that he feels a complex is needed and
that in his judgment had the agreement been approved both
parties would have been unhappy. He stated that it was a

poorly written agreement and that the School Board's primary
responsibility is the education of the students, not building
athletic complexes or providing other types'of facilities. He
felt that every time the Board commits to an agreement they
are committing funds that could be used otherwise. He felt
that the failure of the agreement was the best thing that
could have happened to the District and that all of the people
in the district, not just the Mendota Heights residents,
should pay for the facilities to be used by the High School.
James Losleben, 815 Hazel Court, stated that the Riley site
could be used for more than just soccer and football and
expressed his concern that at the end of the agreement with
the School District the City will have little to show for its
investment. He stated that the facility seems a natural use
for the Riley site because of the impact of air traffic noise
and freeway noise on the site.
Robert Lockwood, 2 Hingham Circle, pointed out that no one has
said anything about the impact of aircraft noise on the play
fields if the complex were developed on the Riley property.
He stated that the Friendly Hills residents are often
complaining about the noise and that he feels that this
complex would be impacted by the noise for the next ten years
and would be little good to anyone. He felt that no money
should be invested by the City in the Riley property and that
Council should trust the good faith of the citizens of the
school district and School Board members being able to develop
a good agreement that would last ad infinitum.
Ultan Duggan stated that if the Riley site is allowed to fully
develop there will be no land left in the community for open
space and that he would like to see the taxpayers' money
invested in that land as open space forever.
There being no further comments, Mayor Mertensotto•suggested
that the Council should pursue both the Riley site and the
School District site simultaneously so that it does not lose
the opportunity to consider the Riley site while negotiating
with the School Board.
Councilmember Cummins stated that he feels the proposal which
has formerly been discussed with the School District is
totally unacceptable and if there is to be an agreement it
must be totally different from the original. He also did not
want the City to lose its option for the Riley site.
Staff was directed to set up dual procedures to explore both
the Riley and School District options, with completion of the
process in 90 days.

offer the police officer position to Donna Udell Currie.
Councilmember Blesener moved to authorize Chief Delmont to
offer the Police Patrol Officer position to Donna Currie and
to ask her to appear before the Council for formal appointment
on July 21st. '

Chief Delmont reviewed his memo and recommendation on the
pt�rchase of vehicles to serve.as unmarked squad cars.
Councilmember Witt moved to authorize the expenditure of up to
$9,000 in 1987 for the purchase of a low mileage lease vehicle
tb be used as an unmarked po.lice car, and approve the
budgeting for a similar purchase in 1988, further authorizing
the reappropriation of funds from the General Fund balance to
the Police Department budget.

Doffing from the Park Commission with great appreciation for
his service to the community. �

Fire Chief Maczko was present to request authorization to
conduct a County wide drill involving the burning of a house
and outbuildings at 2305 Dodd Road.
After discussion, Councilmember Cummins moved to authorize a
local drill on either August 8th or 15th to be conducted
between the hours of 8:30 A.M. and no later than noon at 2305
Dodd Road.
Councilmember Blesener seconded the motion.
Council acknowledged a memo from the City Clerk regarding
public requests for amendment to the dog licensing ordinance.
Councilmember Hartmann moved to direct staff to thoroughly
review and recommend ordinance revision, in the areas of both
fees and enforcement, when the ordinance recodification
process occurs.

Council acknowledged a request from property owners in the
Eide Addition to waive the requirement for the cutting of
weeds on undeveloped lots in the Eide Estates.

PIPELINE HEARING Council discussed a memo from the Public Works Director
relative to a notice of public hearing by the Dakota County
Board on July 14th relative to a proposal by Koch Refinery and
the airport to construct a pipeline which will cross the
industrial area of Mendota Heights.
The Council directed Mr..Danielson to appear at the hearing to
reserve the right of the City to review the proposed
constructioN and comment on the safety aspects.
LAKE LEMAY Councilmember Cummins moved to authorize the expenditure of
$949 to Braun Engineering to conduct a general analysis of
• Lake Lemay.

DELAWARE AVENE Discussion on the condition of the Delaware Avenue sidewalk
SIDEWALK was tabled to July 21.
SWANSON DRAINAGE Council acknowledged a report from the Public Works Director
COMPLAINT� relative to a complaint from Mr. Melvin Swanson, 1778
Ridgewood Drive, over drainage from the Krajniak property.
Mr. Swanson stated that he does not entirely agree with the
report and should study the matter further.
The Council directed that the Public Works Director work with
Mr. Swanson and that the matter be placed on a future agenda
if the issue cannot be resolved by staff.
MISCELLANEOUS Council acknowledged a report from the Police Chief and Public
Works Director regarding stop signs at Pontiac and Decorah.
COUNCIL COMMENTS Councilember Witt asked that the owner of property at Marie
and Dodd be contacted regarding filling of the property.
She also informed staff that cars are being parked on the
Perkegwin property by Fischer's 66 in violation of ordinances.
Councilmember Cummins asked about a house in Copperfield that
collapsed during recent high winds.
Councilmember Blesener expressed concern over bicycle and
pedestrian safety at the intersection of TH 110 and Lexington/
Staff was directed to study the matter.

DISCUSSION:
Gregg Gund worked for Mendota Hea.ghts last year as a summer intern fram
St. Paul Va-Teeh. We liked his work and so whezt he graduated from TVI this
spring we invited him ta work for the City as a temporary full-time employee
at $$.S� per hour. Gregg recently pointed aut ta me that this is the same
wage that other mun3.cipalities are paying their summer interns and he feels
that he should be valued somewha�. higher than �he summer interns. I have
checked with a�her Cities and he a.s correc�. Because Gregg is doing a good
job for the City I�uggest we give him a$0.50 per hour mid-year increase,
in gart to reward him for his good work and inpart �a bring him more a.n line
with what his graduated counter parts are receiving (all of Gregg's salary
is charged to projects).
REC4MMENDATION:
Staff recammends that Gregg Gund receive a$0.50 per hour raise effec-
tive August l, 1987.

DISCUSSION:
Over the last few years we have resuriaced some of the tenni� courts in
�he City. We have budgeted $4,Q00 this year for the resurfacing of the
tennis courts at Valley Park. We have received quotes from Recreational
Surfacers in the amaunt of $2,880 and Action Caurts in the amount of $3,024,
Recreational Surfacers was the contractor for ].ast years resurfacing and we
were satisfied with thei.r wark. `
RECOMMENDATION:
I recommend that �he Counci�. accept the quotes and award the purchase
order to Recreational Surfacers for their quote of $2,$80.
ACTION REt�UIRED•
If Cauncil cancurs with the recammendation Council should direct staff
to praceed with the resurfaca.ng of the tennis courts at Valley Park and
prepare a purchase order for Recreational Surfacers in the arnount of $2,8$0.

SUBJECTz Weeds in Rogers Lake
DISCUSSION:
Attached is a letter from Mr. Richard Paui requesting that the City
take some action to contral the weeds in Rogers Lake.
I called Mr. Steve Oie at the Minnesota Department of Natural Resources
far his camments on the requesC;
1. There are two methods to remove lake weeds, chemically or mechani-
cally (with a harvestor). The mechaniGal method would be the only one
allawed far this large an area,
2. The cost to harvest lake weeds is estimated at $1.50 per shoreline
foot. The estimate far the area of Rogers Lake south af Wagon Whee1 Trail =
8000' X $1.50 = $12,000. •
3. A DNR permi�. would be needed and would take 3-4 weeks to process.
A�ter the permit is obtained then a contractor would need to be hired to
harvestor the weeds - it is already toa late to do�anything abaut the weeds
this year.

' 4. A lake associatian is the most common way to pay for weed control.

5. Aesthetic reasons are no�. valid reasons by Minnesota Statutues to
cut weeds. It has to be used for some recreational purpose.
6.' Perhaps the City cauld da its part by again maintaining a beach
area in Roger's Lake Park.

Having lived on Rogers Lake the past nine yeats. I have
obaerved a rather serious lake weed condition. During normal
seasons the lake becomes severly choked with weeds in late
July. The present aeason, however the condition is much more
severe. As by early June we seen the pre�ious August conditions
in the lake. Also the low slough areas surrounding the lake
are almost completely dry. And believe me the weeds in these.
areas were knee high by July Fourtho
The good newe in this is that these same conditions lend
themselves to provide an ideal time to begin a chemical weed
killing pro�ram. I am told that this is very effective method
of reducing the muck on the bottom of a body of water. T slso
understand that this same muck "Which is commonly blamed on
our state bird" is in reality decaying organic mater. And that,
given the proper conditions over an extended length of time.
Can actually reduce a body of water to a bog. And that
restoration at that time becomes a si�uation of dredging and
disposal of this aromatic muck.
I promise not to touch the controverisl subject of water
level control� I am however encouraging the city to take
steps, yet this season, to improve the quality of kogers Lake.
As I believe it to be a valuable asset to the city, the
property owners, including St Thomas, Mendakota, International
office systems and Dick Paula �he city of Mendota Heighta is
also a property owner with it's inveatment in Rogers Lake
Park. And hopefully thru a weed control program. The city
could provide the residents with an improved body of water
that wQuld support the recreational water activies such as
sailing, boating� swimming and perhaps fishing. Note that
the D.N.R. will plant adult pan fish, in lakes that support
them. In the "Take your kid fishing" program.
I want to thank the Council for the:tntritaion to be heard
which was extended thru the Regient Govermant News letter.
It was interesting to note that this same publication in-
cluded a threat to property owners who failed to remove noxious
weeds from there property. In checking the definition of
noxiouG I find it basicly means harmful. N�ow while most weeds
are not harmful to life� health or the property itself. An
excess of lake weeds are harmful to that body of w�ter,

Wesley Lane - Lots 1-5, Rolling Woods Addition
and Lot 6, Rolling Woods 2nd Addition
DISCUSSION:
The project to construction sanitary sewers, watermains, storm sewer
and streets to serve the United Methodist Church was completed in 1986, not
soon enough to conduct the hearing and certify the roll to the County in
October. The project is now completed and staff has prepared the attached
roll for Council review. There are six (6) parcels that abut the project, 5
lots in the Rolling Woods Addition and one lot (the church) in Rolling Woods
2nd Addition. Lot 5, Block 1, Rolling Woods Addition is not being assessed
for sanitary sewers or watermain because that property has already been
assessed for those utilities in a previous project. The interest rate for
this project is nine percent.
RECOIrII�IENDATION:
Staff recommends that Council approve the attached assessment roll as
prepared.
ACTION REQUIRED:
Conduct the required public hearing and then if Council desires to
implement the staff recommendation they should pass a motion adopting Re-

Comprehensive Plan Amendment,� and by the stated intent of
Tandem and Centex corporations to submit development plans in

processing of the Tandem/Centex application, the procedur.es
and timelines discussed below integrate the two. Following
is a brief narrative of steps� to be taken. For

designations in the Southeast Area.
3. August 25th - Planning Cammission holds public hearing,
then makes recommenda�ion to: 1} ap�rove plan with
athletic complex, 2) a�prove plan wi�hout athletic
complexr or 3) adopt ezther alternative depending on
Cauncii decision on athletic complex site preference,
�. September 8th - Parks Cammissian reviews sta�us of
discussions with School Board, as well as Riley site
alternative considered by the Planning Cammission.
Parks Cammission makes recammendation to Council.
5. September 15th - Council holds required public hearings
on reZaning and PUD. Amang ather things, Council must
decide; 1} whether to continue pursuit of, or abandon,
the Riley site as an alternative far an athletic
complex, and 2) whether ta approve the requested
Comprehen�ive Plan amendment for Commercial designatian.
Cauncil wi11 then need to approve resubmittal of the
Sautheast Area Com�rehensive Plan Amendment to the
Metropolitan Couneil, either as previously adapted, ar
with appropriate changes to reflect Council preferences
on Park and Commercial designations.
6. Earlx October - It is anticipated that the City would
receive approval �ram the Metropolitan Council ta
im�lement the Plan Amendment. I believe that the is�ues
whsch previously precluded approval have been re�olved
by our adoptian o� the Aircraft Noise Ordinance, and
know of na reason why the Metropolitan Council would not
approve the Plan amendment expeditiously.
7. October 20th - With Metrapalitan Cfluncil approval
hapefully in hand, the City Council can adopt neoessary
� changes to the zoning ordinance, plus the rezoning, PUD,
and subdivision requasts of TandemjCentex. The zaning
ordinance amendments which are necessary to implement
the Sautheast Area P2an were the subject af public
h�aring in the Spring of 1986. All that remains is for
Cauncil ta pass a motion adopting the ordinance changes.
If the Council decide� to allaw the commercial
development it will be necessary to �ubsequently amend
our zoning ordinance to create a Commercial PUD
district, and that portion of the Tandem/Centex
application wauld have ta be processed at a later date.
8. If the Council has chosen to procead with the Riley
site, we will need to set a date for a referendum, and

resurr�ct our public infarmation program.
One step Council may wish ta consider this eveninq is to
authorize staff to retain Bartan-Aschman, aur parks planner,
to provide an evaluatian o� the Riley �ite alternative being
put forward by TandemjCentex. Their concept is different
from that presented by Barton-Aschman, in that it places more
of the com�lex alang the freewa� Dick Putnam was be�ore the
Parks Camm�ssion on July 14th with a very preliminary
concept. While all were agreed that the Bartori-A�chman
proposal is a better sports complex, the TandamjCentex
alternative is potentially more campatible wi�h surrounding
residential uses, and requires less pro�ertyj making the
Riley site more cost campe�itive with Sibley.
Barry Warner indicates that they could complete such an
evaluation for approximately $1,000, and it would be ready in
time far cansidera�ion by the Planning and Parks Commissions
on August 25th and Sep�ember 8th resp�ctively, As I am
authorized by resolutian ta execute purchases of u� to
$2,500, I would simply suggest that Council authoraze me to
administratively execute an agreement in an amount not to
exceed $2,500. ,
SUMMARY
It wau2d seem that the critical date for Council to make a
decisian is September 15th. By that time you will have both
the original Barton-Aschman concept far an athletic complex
on the Riley property, and as well as an alternative
presented by Tandem/Centex and evaluated by Barton-Aschman.
Yau will also have the recommendation of your Planning and
Parks Commissians.
Given what I perceive to be the rather narrawly defined
issues standing in the way of an agreement with the School
District I97 for joint development of the Sibley site, it
seems reasanable that we would also know by September 15th
whether it is going to be possible to resalve aur dif£erences
with the Baard on those issues. Once we have resolved the
policy issues, it �hould be a rather simple affair to draft
an agreement.
ACTION REQUTRED
If Council is satisfied with the pracess autlined above, the
following actions should be taken this evening:
1. Confirm whether the issues identified above under the
5ibl�y section are, in fact, thase that need ta be
discu�sed with the School Board.

2. Choose two or three potential dates for a meeting with
the School Board to discuss these issues.
3. Authorize the City Administrator to retain Barton-
Aschman to evaluate the Riley athletic site alternative
�resented by Tandem/Centex, in an amount not to exceed
1,500.

The District 197 School Board has directed that Superintendent Anderson and
undertake with the Council further discussions relating to the proposed
Sports Complex. A copy of the Board's resolution, adopted at its July 14
meeting, is attached.
We are cognizant of the Council's desire fully to consider the Riley site,
while giving further consideration to the Sibley site. The question of the
relative merits of the two sites from the city's perspective is appropriately
reserved to the Council's judgment, and we will not offer any opinions
respecting the Riley site.
Respecting the Sibley site, may we suggest the following procedures:
(1) It would be helpful if the Council would identify specific points
in the most recent proposal where alternative provisions might be desired.
Although we agree that our discussions are at "square one" in the sense that
no binding agreement has been reached, it would be difficult to justify
disregarding entirely the substantial efforts of the joint city-district
working group, which also underwent review b.y counsel for both entities.
(2) We also solicit the Council's suggestions respecting the format
of further discussions. We believe it would be prerrature at this point to
convene a joint meeting of the Council and the Board.• Our suggestion is
that a working group should be reconstituted. Since the group would not be
working against the deadline of a scheduled referendum vote, it would be
presumably possible for the group to maintain better communication with the
Council and Board, respectively, than was previously the case.
(3) Finally, we would welcome advice respecting the time frames for
further discussions. Our experience to this point suggests that consensus
building may r.ot be a quick process. A strong consensus shared by the
Council and the Board, however, seems indispensable for a referendum vote
involving the Sibley site to have any likelihood of approval.
The foregoing suggestions are only that, and we would welcome knowing of any
alternatives the Council might wish to propose. We will look forward to
hearing from you or your representative on this matter.

SUBJECT: Northland Drive Railroad Crossing
HISTORY:
Ever since the first layout of the City's Industrial Park, Northland
Drive has been planned to cross the railroad tracks and intersect with Trunk
Highway 55. During the time when Northland Drive was being constructed in
1982-83, plans were initiated to make that crossing, however the Milwaukee
Road Railroad rejected the City's plans and the we had to take legal action
to make them allow the crossing. The City prevailed in the legal action and
the Railroad was directed by the State of Minnesota to install the crossing.
To further complicate the issue, after we received permission to install the
crossing, Mn/DOT installed a temporary exit for I-494 at this same location
with signal lights. It would have been very costly to modify the signals to
provide for the Northland Drive access at that time so the City decided to
delay action. �
Several years have passed since the City has been authorized to con-
struct the Northland crossing and now Soo Line Railroad owns the track.
DISCUSSION:
United Properties is still very interested in having the railroad
crossing constructed and have sent the attached letter asking the City to
proceed. Since receiving the letter, I have been working with the Soo Line
Railroad to determine the requirements for having the crossing constructed.
They informed me that the City needs to pay the costs of the crossing up-
front and then the Railroad will do the actual construction (see the
attached letter).
FUNDING
As you can see the costs for the crossing are very high, but because
the entire Business Park area benefits from the crossing, the City has
budgeted for the project to be paid for out of Tax Increment Financing
Funds.

Camputer Purchase
In 198'7, we have budgeted for the purchase of a camputer
system �or data storage and retrieval at the fire department.
I have come to the paint of making a decision on the type of
computer that we should purchase far fire department use.
Since January, I have been evaluating computer systems that
are available that would fi�. our needs in the fire service.
DISCUSSION
In orcler to properly evaluate our needs I came up with a
].ist to help define our needs: .
1. A system that would pravide the neces�ary software
to do record keeping of fire runs and assorted information
such as when the fire was, where the fire was, what was the
fire, response time, number of �ersonnel respanding, number
of enc�ines respanding, officer �.n charge, was the cause o�
the fire determi.ned, was it an aetual fire in a commercial
building or in a residential buildinc�, car fire, false alarm
in a residential or commercial build�ng, was the respanse
an emergency response ar a non-emergency response. Al1 of
this�information must be easy to enter and retrievable for
reports and studies.
2. We need an eas�r way to record and retrieve�
infarmation on inventorxes for budget purposes and overall.
management ,
3. Maintenance records should be ke�t far al1
ec�uipmentj such as breathing apparatus, fire extinguishers,
fire apparatus 9.tself and station maintenance.
4. Fersonnel attendance records, training, al.ean-up,
meetings and fire aalls must be ea�y to enter by a11 �'ire
officers or assigned persons.
5. Software available to help us out with the new Super
Fund Title III Law requiring vast amounts of data storage
and availability to retrieve this material.
6. Easy to use system so that any line officer could
.••,get necessary information into and out of the system.
7. Have gra�hics capability'for inputing preplan
information on buildings within the City.
Probably the most important of all of the above points
is the fact that the system has to be usable by myself,
Assistant Chief Lerbs, Training Coordinator George Lowe, and
all of the Captains. I do not wish to purchase a s�stem that
only one or two �eo�le know how to operate because it defeats
the purpose of filling our fire and personnel reports out
after a fire call.
The system must be easily operable to make it
efficient. The primary users of the system are �oing to be
those listed above and the Fire Marshal, Paul Kaiser.
Occasional users may be the person in charge of radios
and pagers, the secretary of the fire department and persons
that may wish to become officers.
I have been to a number of computer seminars that have
dealt with computers in the fire service. Macintosh
equipment similar to the Police Department's and IBM
equipment have been discussed and used. One thing that I
have noticed is that until recently, most prepackaged
software adaptable for use in the fire service has been
written more towards the IBM compatible systems. This has
changed considerably, and i feel that the Macintosh software
can fulfill all of our basic needs.
I myself have been using a Macintosh Plus computer with
the City of St. Paul for over a year and one half. I am very
impressed with the capability of the Macintosh and how user
friendly it is. Within the last month, I have been
introduced to a program called CAMEO which was written for
the Macintosh. CAMEO stands for Computer Aided Management of
Emergency Operations. of all the pre-plan programs that I
have been exposed to, the CAMEO program is the best that I
have seen yet. The CAMEO program is very, very user friendly
and can be used by anyone. There are also several spread
sheet programs and file programs that are available. One of
the other advantages to the Macintosh is that the Police
Department also uses the Macintosh system. Police Chief,
Dennis Delmont, is very satisfied with his system and has
offered us clerical support if we need it.

RECOMMENDATION
After five months of evaluation, I would like to
recommend that the fire department purchase a Macintosh Plus
computer system with a 40 megabyte hard disk drive and an
-•�•��-�Image Writer II printer. I don't think that at this time we
need to purchase an expensive back-up system because we can
store back-ups on the floppy disks.
I am recommending the Macintosh because I feel that this
is the best system possible, I am very proficient with the
use of the Macintosh, and Dennis has offered clerical support
if we need it. Over the last year, I have created some files
on the Macintosh that I have been using for fire department
purposes. One example would be the monthly report and
another would be Sections 3-9 of the annual report. I also
have considerable access to software support personnel since
St. Paul uses a lot of Macintosh equipment.. This provides me
with easy access to help solve problems that we may have and
help determine what programs we may wish to use. If we are
going to make computers work in the fire department, we need
a system that is not too complicated to operate. I feel very
confident that we,will get much use out of the Macintosh. I
have reviewed thi5 recommendation with City Administrator
Kevin Frazell, and the City's computer consultant Doug
Banyon; they concur in my recommendation.
I would also like to recommend that we purchase this
ec�uipment from First Tech. This is the company that was low
bidder on the police department bid and for whom the police
department awarded the purchase of their system. I feel that
it would be advantageous for both the police and fire to
purchase their systems from the same people because we would
probably get better service and support when it is needed.
Cost for the equipment is:

The $4,187.00 that is required to purchase this
equipment is more than we had originally budgeted but capitol
items such as ceiling fans and hose came in at prices less
than anticipated and there are adequate monies available to
support the purchase.

SUBJECT: Fire Prevention Code
A Fire Prevention Code for the City of Mendota Heights
is being presented for your consideration. This code is
necessitated by a need to:
1. Centralize the existing ordinances into one
document.
2. Update the codes to meet the current needs of the
community.
3. Satisfy the requirements of the Insurance Service
Office (ISO) which establishes property insurance
rates for the area.
The language of the present ordinances is included in
this code. In addition, several new sections have been
introduced. These new sections are:
Section 4. - defines and rec�uires a permit for
recreational fires.
Section 5. -�rohibits fires or barbecues on balconies
in two or more vertically stacked
residen,�ia� units.
Section 6.

- defines the responsibility of cost when
fire lanes are mandated.

the July 21 Council meeting.
ACTION REQUIRED:
If Council desires to implement a fire prevention code,
thex should adopt the attached Ordinance No. , repealing
Ordinances No. 1006, 1007, and 220. Council s�iould also
adopt Ordinance No. adopting the Minnesota Uniform Fire
Code and the Nationa�ire Code by Reference.

SECTION 1. FIRE PREVENTION CODE
1.1 Uniform Fire Code Adopted
The Uniform Fi.re Code, 1982 Edit�an, published by the
Internatianal Con�'erenae of Building Officia].s, as amended by
Chapter 7510.4200 of the Minnesata Rules, its appendices and
Standards (hereinafter referred to as the MUFC) and the
National Fire Codes of the National Fire Protection
Associ.ation (hereinafter referred to as the NFC}, are hereby
adopted by reference and are, as authorized by Minnesota
Statutes Chapter 299F, the Fire Prevention Code of the City.
A copy of the MUFC sha11 be marked "official co�y"' and kept
available for public use in the office of the City Clerk. A
copX of the NFC shall be marked "official capy" and kept
available for pub],ic use in the office o�' the Fire Marshal.
Every provisian cantained in said MUFC and NFC, except as
deleted, modified or amended by this Ordinance, i.s hereby
adapted and made a part of this 4rdinance as if fully set
forth herein.
1.2 Definitions
1.2(1) Wherever the word "jurisdiction" is used in the MUFC, it
shall mean the City of Mendota Heights.
1.2(2} Wherever the term "Corparation Counsel" is used in the
MUFC, it shall mean the attorney for the City of Mendota
Heights. . •
1,2(3j Wherever the term "Chief" is used in the MUFC, it shall
mean the Ghief af the,Mendata Heiqhts Fire Department or

1.2(4) Wherever the term �'Enforcing O:fficer" is used in this

open atmosphere without passing through an adequate stack,
duct, ar chimney.

SECTION 2. �DMINI5TRATION AND ENF4RCEMENT

The Enforcing Officer{s) shall be respans3ble for the
administration and en�orcement of this code to ensure
campliance therewith.
SECTION 3. OPEN BURNING
3.1 o�en burning in the City af Mendata Heights is governed by
Minnesota Pollution Control Agency rules. -
3.2 No person, firm or carporation shall dispose of refuse by
open burning ar cause, suffer, allow, or permit o�en burning
of refuse upon or from any residential praperty situated
within the City or upon ar from any property in the City
situated in an area designated as residential district under
the C3.ty Zoning Ordinance.
3.3 Exceptions from this Sectian may be allowed far canse shown
upon application and approval. of the City Council provided
that such burning is not prohibited by or is canducted in
compliance with any ather applicable ordinances, laws or
regulations. Exemptian from the pravisions of this ordinance
shall not excuse a persont firm or corporation fram the
consequences, damages or injuries which may result �herefrom.
3.3(1) The fallowing are exceptions for which applicatian may be
made:
3.3(1)a. Fires purposely'�et'�for the instruction and training o£
� the City Flre Department.
3.3{i}b. Fire� set for the el.imination of a fire hazard which
cannot be abated by any other practical means.
SECTION 4.- RECREATIONAL FIRES
A recreational fire shall not exceed three foat by three foot
(3'by 3') in size. A permit, abtainable fram the Enforcing
Officer, shall be required for all recreatianal fires.
SECTION 5. FIRE5 OR BARBECUES ON BALCONIES OR PATIOS
5.1 Tn any s�ructure containing two or mare vertically stacked
residential unit� no person shall kindle, maintain, ar cause

any fire or open flame on any balcony above ground level, ar
on any ground floor patio immediately adjacent to or within
fifteen (15} �eet of any unit.
5.2 No �erson shall store anx fuel, barb�cue, torch, ar ather
similar heating or lighting chemicals or devices in either of
the places cited in Section 5.1. -
SECTION 6. ESTABLISHING FIRE LANES

SECTION 9. AMENDMENTS
General. The MUFC adopted by 5ection 1 is amended as set
forth in this sectian.
9.1 Section 2.3v3(b} is amended by addition of the following
language: "Whenever the MUFC, as amended by Chapter i510.4100
oE the Minnesota Rules, i�s silent on any sub�ect,
for any r�ason, in any situation, the provis�.ons of
protection sha11 be in acaordance with the National Fire Code
issued by the NFPA �Quincy, Mass. 1985j which are adopted by

9.2 Section 10.206 is amended by adding a new subsection (e)
which shall read as follaws: "Al1 snow shall be remaved from

valves within twenty-four (24) haurs of a snawfall."
9.3 Section 10.301 is amended by adding a new subsection (f)
which shall read as fallows: " All new and existi.ng gate
valves on automat3.c fa.re extinguishing systems sha21 have an
approved tamper switch installed.�� '
9.4 Section 10.301. is amended by addi.ng a new subsection (g)
which sha].1 read as follaws: "A11 sprinkler systems aver 100
heads must be monitored }�y an approved UL Central Station.

9.5 A new section, 10.316, is added as fallows: "SECTION 10.316
PORTABLE FIRE EXTINGLTISHERS, LOCATIONS, TYPES, TNSPECTIONS,
AND MAINTENANCE REQUZREMENTS.
(1) Multiple dwellinas. All areas throughout the building
shali be protected by ane (1) ABC multipurpose
extinguisher af a size not less than five (5) pounds to
be placed in each required standpipe cabinet. Addit�.onal
fire extinguishers shall be so located that no person
shall travel in exae�s of fi�ty (50) feet to reach a fire
extinguisher. one {3} ABC multipurpose dry chemical.

venting shall be provided to the outs3.de."
9.7 A new Sectian 11.30I{cy, Repartir�ct of Fires, is hereby added
as follows: "The soundinc� of any fire alarm, bel]., horn, or
audible device shall be a.mmediately reparted to the Fire
Department."
9.8 A new sentence is hereby added to Section 79.1207, Tank
Vehic].es for Flammable and Combustible Liguids, as follows:
"Fire extinguishers shall be kept in gaod operating condition
at all times and they shall be located in an accessible place
on each tank ar vehic].e and on the graund while unloading."

9.9 Article 82, Lic,�uified Petroleum Gase�, is included in its
entirety with the follawing changes:
9.9�(1) Section 82.102 is �ame�lded by adding a new sub-section (c)
' to read as follows: "Where a single contai.ner or the
aggregate of interconnected containers is 500 or more
gallons water capacity, the installer shall obtain a
permit and plan approval from the Chief or his authorized
representative."
9.9(2) Section 82.1o5(a) is amended by adding the fallowing

vehicle which is deemed to be an immediate''fire ar life
safety hazard without the 20 day natice, pzavided this natice
is in writing and hand delivered to the re�ponsible person.

Any person aggrieved by a notice pursuant to Sectian 9 af
this code may, within 15 days af�er serv3.ce of said notice,

SECTION 13. INTERPRETATION

DISCUSSION:
Several weeks ago staff was made aware by a phone call, that several '
� sidewaik hazards existed alang Delaware Avenue north of Dadd Raad. Staff
surveyed the problem and sent a memo to Council informing them in general
about th� problem. There was na specific recommendation and no action was
take'�at that time (see attached memo). The Delawaxe Avenue sidewalk is ald
and has many minor "trippers" but there are seven (7) l.ocations where the ,
tree roots have caused major upheavls (2"-4"}. City ordi�ance requires that
owners be required to repair their sidewalk wa.thin 90 days af ter notice from
the City {see attached ordinance}, '
RECQMMENDATION:
Staff recommends that �hese seven homeowners with the major hazards be
required to repair their sidewalk at their own expense within 90 days.
ACTION REQUIRED• �
If'Council desires ta implement the staff recommendation they should

INTRODUCTION
� At the north side of town on Delaware Avenue between Ellen and
Annapolis there is an existinc� sidewalk that is about 50 years old.
The sidewalk has slowly deteriorated over the years, and recently Mr.
Nei1 Cashman contacted the City because his wife tripped on a large
heave in the sidewalk and was hospitalized as a result. Mrs. Cashman
suffered no serious injuries, but the incident demonstrates that the
City should consider taking action to remedy the situation.

DISCUSSION
Staff inspected the sidewalk and determined that between 5 and 10�
of the sidewalk is in need of immediate repair, while another 20� of it
is marginal, and will need repairs in the next 3 to 8 years.
Accordinc� to Ordinance #701 (see attached) the Citx should
periodically inspect all sidewalks and direct the abutting property
owner to repair all damaged portions. However, as stated by Mr. Huber
of 969 Delaware, many of the residents in the area are elderly and on
fixed incomes. It appears that the City has several options- do
nothing, proceed as per the ordinance, fix the sidewalk at city
expense, reconstruct the entire sidewalk, or remove the sidewalk.
Staff estimates the cost of these options to range from 0 to $20,000.
RECOMMENDATION
At present Staff has no recommendation.
ACTION REQUIRED
Council should consider the options and direct Staf� to take a
course of action.

the Fall of 2983. My recent observation is that we are
operating somewhat differently than was envisioned in the
original concept, and I am plaaing this on tonight's agenda
for a clarification.
DISCUSSTON
The purpase af '"Pubic Comments" is to allow citizens to bring
issues to the attention af their elected aificials in person
at a regular Council meeting. Because there is always a
danger is bringi.ng up topics nat anticzpated, it is important
to establish some ground rul.es. My concept is as Eollaws:
1. The citizen is allawed a fixed amount of time
(perhaps five minutes maximum) to present his/her
issue. . �
2. The is�ue raised is not answered at the meeting
where raised, but rather referred to staff for
background research.
3. Staff prepares a report for the subsequent Counca,l
meeting, sending a copy to the requesting aitizen.
The item i� scheduled for discussion under "Respanse
to Public Comments."
4. Cauncil considers the sta£f report and
recommendation, taking whatever action is deemed
apprapriate. �

SUBJECT: ICMA/NLC Seminar on Council/Manager Relations
Attached, is a seminar announcement I received regarding
an upcoming seminar on Council/Manager relations. The
seminar is being co-sponsored by the International City
Management Association and the National League of Cities. As
you can see, one of the sessions will be held on Monday,
September 28th, in Minneapolis at the Hyatt Regency.
The program looks excellent, and I would like to attend.
They are suggesting that participants attend in at least
pairs of the manager and one council member, and ideally in
teams of the manager plus several council members.
I would suggest that as many of you as possible attend
the session, and would specifically request that Council
desi�nate at least one of its own members to serve as part of
a pair.

Subject: Use of R-1 praperty across from Fishers Gas And Tawing, gas
station on podd Road for selling used cars
Discussion: I received complaints from Council and Staff af Harry Kirchner
parking cars acrass fram his statio� with for sale signs �n them. A ietter
was written and sent to him July 9, 1987 explaining that �his was in via-
]atian af City �rdinances. A copy was also sent to Peregwin Investment Co,,
owner of the property. The vehicles were moved fram the property within the
two days as requested and have not been parked there again, as of July 14.
I wi11 cantinue to watch for a repeated violatian.

Last Council meeting Courtciltnember Blesener nated that the City's
bike trail along Lexingtan Avenue where it crosses Trunk Eiightaay 110
was a probl.em. Staff passed the coneern along ta the Iiighway Department
for suggestions. They said they wauld probably get a chance ta Iook
aC it sometime during the weak af July 19th. Staff will pass along
their response when it arrives.
