Council Statement of Su�port for the Parks Bond Referendum The promotianal brachure for the 1972 par�s bond referendum (see attached) included a statement of support signed by each of the Councilmembers. I am suggesting that perhaps we include a similar statement in the April issue o� the Heights Heighlites, which will be a special issue for the referendum. Danielson Public Works Director SUBJECT: Temporary Full-time help for Engineering DISCUSSION: Mr. Gregg Gund is an Engineering Technician student at St. Paul TVI and worked for the City last year as a summer intern. Gregg will be graduating from TVI this spring and needs a job. Gregg did excellent work for us last summer and we would very muck like to have him back. We also feel that the City's summer work load will be high for the next two summers. We could therefore continue to use Gregg for the summer of 1988 too. Gregg does not mind working as a temporary employee with the idea he would work 8-9 months a year for two years. Because Gregg would be something more than just a part-time summer intern we have agreed to request that Council authorize giving him some of the full-time benefits: � 1. Paid Holidays. 2. Paid Health Insurance. (single plan) 3. PERA (this is required). Because of the mild winter contractors are already beginning to work and Tom Knuth needs help staking, Gregg could begin to work part-time immediately. RECOMMENDATION: Staff recommends that Council authorize the hiring of Gregg Gund for $8.50 per hour and the above stated benefits. Gregg would start immediately working part-time (approximately 20 hours per week) until he graduates in May. ACTION REQUIRED: If Council desires to implement the staff recommendation they should pass a motion approving the hiring of Gregg Gund. CITY OF MENDOTA HEIGHTS MEMO � _.... Danielson Public Works Director SUBJECT: Sewers, Water, Streets Mendakota Estates Eide Easement Condemnation Job No. 8621 Improvement No. 86, Project No. 8 DISCUSSION: March 17, 1987 a The Mendakota Estates project requires that utility connection be made to Swan Court in the Eide subdivision. Also, when plans and specifications were approved by the Council, they indicated that a trail should be installed connecting the two subdivisions. In order to do this easements need to be acquired from Northern States Power and from two lots in the Eide Subdivision. Northern States Power has signed their easement, the Eides have not. Staff, with the help of an appraiser, ha5 established a value for the required easement s at $5,510. The Eides maintained they would accept no less ' than $10,000. Staff has therefore initiated condemnation proceedings. A court hearing date has been set for Wednesday, March 18, 1987, to appoint three commissioners who will set the valuation and establish a date by which the City can enter the property. Staff needs the City Council to pass a motion directing the City Attorney to acquire the needed easements through their power of eminent domain. RECOMNNIENDAT ION : Vernon Eide, the landowner of two lots in the Eide Subdivision refuses to sell utility and trail easements to the City for their appr aisal value�theref ore� staff recommends that the City Council direct the City Attorney to acquire the land by their power of eminent domain. ti ACTION REQUIRED: If Council desires to implement the staff recommendation they should pass a motion directing the City Attorney to acquire utility and trail easements from Vernon Eide over Lots 8 and 9, Eide Estates (see attached drawing). �� ✓ CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, March 3, 1987 Page No. 2399 March 3, 1987 � Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, was held at 7:30 o'clock P.M. at City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Ayes: 4 Nays: 0 PRESENTATION OF APPRECIATION ABATEMENT Ayes: 4 Nays: 0 Mayor Mertensotto awarded a Certificate of Appreciation to Mary Jeanne Schneeman for her service on the Park and Recreation Commission. Assistant County Assessor Bill Peterson was present to request approval of a tax abatement. Councilmember Cummins moved to grant an abatement to Daniel and Mary Caruso for Parcel NO. 27-30700- 090-00, reducing the assessed value from 5236 to 3500 for taxes payable in 1987. Councilmember Hartmann seconded the motion. FEASIBILITY Mayor Mertensotto opened the meeting for the HEARING -- �urpose of a public hearing on proposed PARK PLACE improvements to serve the Park Place Addition and adjacent areas. Public Works Director Danielson reviewed the feasibility stud� and stated that the project was initiated by petition from the developers. He pointed out that there are two parcels of land at the south end of the �lat which are not owned by the developers and which would be affected by the project. Mr. Danielson stated that the lots-within Page No. 2401 March 3, 1987 the plat would be assessed approximately $12,000 to $13,000 each, the cost to the Zwach property would be approximately $14,000 and the Nelson property "-- .. could be assessed approximately $28,000. Mrs. Grace Zwach, 1575 Wachtler Avenue, stated tha�t she does not know why her property should be assessed for sewer and water because she has already paid for those improvements years ago. She also expressed concern that the street will be very close to her home. Public Works Director Danielson responded that the City will need to acquire seven feet of right-of- way from Mrs. Zwach and that the edge of the right- of-way would be about 23 feet from her home. Mayor Mertensotto directed that the Public Works Director make an appointment with Mrs. Zwach to discuss her concerns. Mr. Philip Nelson, 1573 Wachtler Avenue, stated that their property is served by City water now and expressed concern over the cost for the proposed improvements. Councilmember Cummins seconded the motion. COUNTRY CLUB Mr. Ronald Lagerquist was present on behalf of MARKETS Country Club Markets to request approval of a building permit for construction of a warehouse at _ _ 1460 Sibley Memorial Highway. Mr. Lagerquist stated that Country Club representatives have met with Councilmember Blesener and City staff since the last Council discussion on the matter. He reviewed a proposed plan, developed as the result of the discussion, which increases the landscaping and screening proposed in prior plans. CABLE COMMISSION The Council acknowledged receipt of letters from three individuals interested in appointment to the NDC-4, Judy Skoglund, Mike Sokol, and Ron Rogoscheske. Mr. Sokol and Mr. Rogoscheske were present for the discussion and reviewed their qualifications and interest for the Council. The Council thanked Mr. Rogoscheske and informed him that his resume will be kept on file and he would be informed in the event of a vacancy on the Board or other Cable agencies. ;� Staff was directed to research whether terms on the Commission are to be indefinite.� The Council acknowledged and briefly discussed the feasibility report for proposed improvements to serve the Stratford Woods plat and adjacent areas. After discussion and public comments, Councilmember Witt moved adoption of Resolution No. 87-24, "RESOLUTION EXPRESSING INTENT TO CONSIDER AMENDMENT OF THE COMPREHENSIVE LAND USE PLAN." Councilmember Hartmann seconded the motion. The following members were present: Stein, Damberg, Doffing, new member Vicki Katz, Knittig, Leffert. Absent: Lachenmayer. Also present: City Administrator Frazell, Dick Putnam of Tandem Corporation, Barry Warner and Margaret Kearney of Barton-Ashman Associates. APPROVAL OF A motion was made, seconded and carried to MINUTES approve, without chanc�e, the minutes of the January 13, 1987 meeting as previously submitted. ELECTION OF Leffert moved, seconded by Knittig, that the OFFICERS following Commissioners be elected to fill the respective Commission offices for the following year: Chairman: Jim Stein - 1st Vice Chairman: Robert Doffing 2nd Vice Chairman: Marsha Knittig Secretary: Vicki Katz Also, if for any reason the office of chairman becomes vacant during the year, the two vice- chairmen will move up one office respectively to fill the remainder of the term of the vacant office. Commissioners offered names of residents who would be candidates for the marketing committee. The Commissioners would then contact each of the proposed persons after they receive a letter from Jim Stein and Bob Lockwood. The first meeting of the Marketing Committ•ee is scheduled for Thursday, February 26, 1987, at 7:30 P.M. in the Council Chambers. The Commission then considered a resolution (copy attached) requesting the City Council to call for a parks bond referendum. Vicki Katz moved, seconded by Marsha Knittig, to approve the resolution. The Commission offered suggestions and were invited to attend another meeting�on Friday, February 20, at noon, to review the progress being made by the consulting firm. TANDEM/CENTEX PROJECT NEXT MEETING ADJOURN Dick Putnam of Tandem Corporation presented a review of the Tandem/Centex project and offered suggestions on park dedication layouts. DISCUSSION The purpose of this memo is to recommend that the frequency of the Engineer's Report be reduced. Currently the report is presented to Council once every month. But during the winter months when there is very little construction taking place, there are so few changes in the status of projects that only one or two lines of the report need to be changed to update the previo.us month's report.. During the summer months, there are"many ch'anges in project status, so a monthly report is probably necessary. � RECOMMENDATION Due to the lack of activity during the off season, Staff recommends that the Engineer's report be presented to Council on a quarterly or special case basis during the winter months. Once construction begins in the summer, the report would be presented to Council every month. Danielson Public Works Director MEMO March 10, 1987 Ad in�t�tor � SUBJECT: IOS Sanitary Sewer Project - Assessment Roll Job No. 8233 Improvement No. 82, Project No. 7 DISCUSSION: The project to construct sanitary sewer mains to serve the IOS building was completed late in 1986, not soon enough to conduct the assessment hearing and certify the roll to the County in October. The project is now completed and staff has prepared the attached roll for Council review. There are five parcels that abut the project (see attached map). The IOS building site is to be assessed f or its full width, the newly created IOS lot south of their building site is to be assessed for the minimum B-lA frontage, and the Bisanz site south of Mendota Heights Road will be assessed for its full frontage along Mendota Heights Road. The Tousignant property is to be assessed for its full frontage. (Note: The Tousignant property is in green acres and the City will receive no income from the site until such time as that category is changed) The St. Thomas property abutting the project is their athletic field area. All of St. Thomas' existing buildings are already served by sewer from Lake Drive, therefore staff proposes not to assess the St.�Thomas site for this project. We propose to spread their share of assessments among the other sites. If St. Thomas should ever need service from Mendota Heights Road a connection charge would be collected at that time. The other properties served are all commercially zoned properties and we feel that they are benefited enough to pick up St. Thomas' share of the costs. See the attached assessment table that shows the impact that not assessing St. Thomas has on the other parcels. There was no watermain construction with this project, however watermain was made available to the I05 sites from an earlier project and they were not assessed for it. This earlier construction was a 16" tr-�uck line under I-35E that was constructed as a system improvement. They hooked into that line and need to be assessed for that privilege. Because the costs for the 16" line are considerably higher than normal, an assessment rate was determined that wo uld represent an 8" water line improvement for the two I05 sites. In addition, a minimum af 25% of Kim's (the Clerk/Receptionist) time is spent on utility billing activities. The pasition descrzption also requires that Kim serve as secretarial suppart� person for the City Clerk, Code Enforcement Officer, Public Works Superintendent, and others as delegated. By necessity, Kim is also the back-up accaunting clerk and is pressed into service as Mary Ann's s�ubs�itute during vacation and miscellaneous absences. During normal activity levels, the tasks required of Kim and the demands on her �ime warrant creation o�' a new fuil-time position, thus the budget recommendation. Because of the extremely heavy building activity (unanticipated for this time af year), th� praposed hiring af a summer Gode Enforcement Intern in March rather than June, the anticipated response to the se�er rate increase, and an April 21st Park Bond Referendum, we believe that a new position shou3.d be created as eariy as possible, The budc�et request farm erroneously Iabeled the propased pasi.tion as Receptionz.st/Clerk Typist. It was, and is, intended that the recammended position be that of secretary, and that Kim Blaeser be pramoted into the position. The sal.aries for the two positions in the Administration Department's 198'7 budget totals $17,334. If the new position is created on April 15th, the annual salary cost to the Administration budget will be $18,066.69. (This does not recognize any adjustments which may need to be implemented under Comparable Worth.) A job description has been developed for. the receptionist position which reflects tasks more commonly associated with a typical municipal rece�tionist position, including issuance of permits and licenses and providing clerical support for Code Enforcement. There is more than sufficient workload to support a full-time person in this `position. This is envisioned to be an entry-level position, Step A of Grade I in the pay matrix. The 1987 annual salary for this, the first level of the pay matrix, is $12,136, the proposed starting salary. The higher level tasks currently being performed by the receptionist have been removed from the receptionist job description and incor�orated into that of the secretarial position. Responsibilities include serving as secretary for the City Clerk, Treasurer, Fire Chief and Fire Marshal, and others as delegated. Twenty-five �ercent of the position is dedicated to utility billing. Other tasks include serving as back-up accounting clerk, processing assessment certifications and splits, maintaining fixed assets, records retention schedules, and voter registration files and assisting with elections. Again, there is more than sufficient,workload to support the position. The level of responsibility of the proposed secretarial �osition is equivalent to that of the secretarial positions in the Engineering and Police Departments. It is therefore proposed that the position be placed at the same grade, Grade V, in the salary matrix. Because Kim has actually-been performing many of the tasks for some time, and in fact has earned an Associate in Applied Science Degree (executive secretarial training) during her tenure with the City, it is proposed that she be placed in Step D of Grade V. The proposed probationary salary for the position is $17,076. After satisfaction of the probationary period, she would advance to Step E of the matrix, which is the target step for tenured employees. The position is proposed to be funded by both Administration (75%) and the Utility Fund (25%). RECOMMENDATIONIACTION REQUIRED It is recommended that Council move to authorize creation of an Administrative Secretary position, effective April 15th, to be placed at Step D of Grade V of the pay matrix,_and that Kimberlee Blaeser be promoted to the position. Phase I will be completed within ninety �(90) days, Phase II within an additional sixty (60) days. All work will be completed as expeditiously as possible unless delayed for reasons of unexpected emergencies, forces beyond the control of the parties, or by request of a party acquiesced in writing by the other party. If so delayed for more than ninety (90) days at the request of the CLIENT, the CONSULTANT reserves the right to renegotiate the contract to account for rising costs before resuming work. The contract shall terminate after six (6) months unless extended by mutual agreement. The change�provisions of the contract are described below, and are before Council for its consideratian and approval. DISCUSSIQN: As I have previously indicated to Council, suburban city labor contracts in general, and police contracts even mare in particular, tend to follow trends that are set by early s.ettlements. There were a number af two-ysar contracts signed i.n ; 1986, which provided a 4% increase and $10 on insurance far 198'T. All contracts of which I am aware that have been settled specifical.ly for 2987 have followed this saate trend. Since pol.ice officers have recourse to binding arbitration, i� seems highly unlikely that we wauld reach any other settZement. Accordingly, the provisions af the new contract are as follows: 1. A one-year contract from January 1, 1987 through December 31, I987. 2. A 4% increase in all wage classifications, making them respectively: Start {lst six manths} $2,035 (2nd six manths) 2,154 ., 2nd year 3rd year 2,328 2,497 After 36 months af continuous emp3.oyment 2,667 3. A$20.00 per month increase (ta $275.04} in the City's maximum monthly contribution toward health, life, long- term disability, and dental insurance. The previous contract limited dental insurance to no more than $10 of the employer's maximum contribution. However, we agreed to take this out of the contract, since it makes no sense to specifically limit the contribution to dental - insurance. All nine of our bargaining unit members are fully utilizing their em�loyer contribution, so to allow them to apply more �f this towards dental insurance merely increases their options, at no additional expense to the City. All other provisions of the contract remain as currently written. For the sake of saving on copying and size of Council packets, we have not reproduced the contract for your review. However, I will have a copy at the meeting on Tuesday night, should Council have any specific questions about other provisions. RECOMMENDATION• It is my recommendation that Council approve a 1987 contract between the City and Law Enforcement Labor Services, Inc. for a contract per the changes as outlined by the City Administrator. Danielson� Publ-ic Works Director fu��u(�] City ini��"�or SUBJECT: Victoria/Trunk Highway 13 Improvements DISCUSSION: March 13, 1987 L At their last meeting,Council was made aware of the fact that Mn/DOT and Dakota County had come to an agreement whereby County Road 45, Victoria Road,would be relocated west of the Standard Station at its intersection with Trunk Highway 13. Council asked staff to invite a Mn/DOT representative to attend their next meeting to provide a status report on the project. - On March llth I attended a joint meeting between Dakota County and Mn/DOT staff inembers to discuss the cooperative agreement. The biggest topic of discussion was the curve that would be created and how sharp it could be. Ultimately County staff inembers decided that, because of the steep downgrade to Trun�c Highway"13, they wanted a much gentler curve than what Mn/DOT was proposing. This means that the County will have to acquire much more property from the Victoria Road Town House project but the County staff was willing to bite the bullet and pay the price. Mn/DOT now needs to change their plans to reflect this new alignment. This design change will take a few weeks. They asked that a presentation to the City Council be delayed a few months until they are more certain of their final design.
