th y planned to use as their afficial new�papers for 1987. The
ci ies of South St, Paul, West St. Paul, and Inver Grove Heights
wi 1 be continuing to tzse the SunJCurrent. Schaol District No.
19 use� the Sun/Current for noti�ication of bids and publication
of minutes, while they use the South-West Review for publication
of agendas, meeting notice�, and hearing notices.

Mayar Mertensotto has expressed a preference far writing the

Midway Sign Company, Inc., has submitted to staff forr
re iew and approval of a sign �ermit application and sign �
dr wings. The proposed sign will be done with individual �
le ters. The sign will cover a 9' x 3' area and contain 27
sq ft. The proposed location will be in the same location
of the existing Pabst Meat Supply sign attached to the south
si e of the building. See attached drawings. �
RE�OMMENDATION
Since the proposed sign complies with all zoning
or inance requirements, staff�recommends that Council approve
th sign permit as requested subject to licensing of Midway
Si n Company, Inc. . w

PERSONNEL Police Chief Delmont was present to recommend
the appointment of Rebecca Birch as Police
Clerk/Receptionist. He introduced Miss Birch to
the Council.
Councilmember Witt moved to appoint Rebecca
Birch to the full-time position of
Clerk/Receptionist in the Police Department
effective January 1, 1987 at Grade I, Level A of

DRIVE The Council acknowledged and discu�sed a memo
from Public Works Director Danielson regarding
the curve an Lake Drive by Ragers Lake.
It was the cansensus of Council that staf� be
directed to install curve and speed signs and
centerline stripes as recommended by staff.
NG - THE Mayar Lockwood opened the m�eting for the
�urpose oi a feasibility hearing on propas�d
�.mproveinents to serve The Ponds of Mendota �
Heights. The Council acknawledged a
- feasibility st�zdy addendum far the Rolling Woods
Subdivision.
Public Works Director Danielson recommended that
the hearing be delayed and that the project be �
combined with the adjacent Rall.ing Waods
Subda.vision a.mprovement� in order to reduce
project costs.
Mayor Lackwaod asked for questions and comments

HUNT Administrator Frazell informed the Cauncil that
the DNR has withdrawn its request £or permissian
to conduct a deer hunt. ,
WOODS Mr. Terry Dobie was present to request Council
consideratian ai' an amended application far the '
Stra�ford Woods subdivision. Mr. Dobie stated '
that he is disappointed with Cauncil's denial of
the thraugh street proposal for the subdivi.sion

which had been supported b� the City staff and
Planner, and which he considered to be the best
proposal for all parties including the residents
on Stratford Lane. Mr. Dobie presented and read
a written statement which he had prepared. Mr.
Dobie stated that tonight he is requesting
Council consideration of an amended application
for proposed a cul-de-sac plan which was the
preferred alternative of the City Planner. He
stated that if the Council would agree to
consider all alternatives, he would agree to
extend the 120 day review period.
The Council acknowledged Mr. Dobie's letter of
December 11th and a report from the City
Administrator recommending that a public hearing
be conducted on the matter.
Responding to a question from Councilmember
Blesener, Mr. Dobie stated that his engineer did
a lengthy review of the Voss proposal.
Councilmember Cummins noted that in Mr. Dobie's
letter he seemed to be saying that he would like
the discussion opened up to all considerations,
yet he is now saying that he proposes Planner
Dahlgren's alternative. Mr. Dobie responded
that he believes all the options should be
discussed, includinc� the Voss plan, and that he
thinks it would be in the City's best interest
to open up the through street proposal, but that
he could live with the Dahlgren alternative.
Mayor Lockwood stated that he would encourage
the Council to hear all the alternatives, and
pointed out that all of the cul-de-sac proposals
end up with a 30 to 50 foot easement between
lots because of the sewer.
Mayor-elect Mertensotto stated that he has no
problem with the amended application or
considering all alternatives, but asked that
Council refer the matter to the Planning
Commission for hearing at their next meeting.
Councilmember Cummins disagreed, stating that
there have already been seven hearings on the
issue between the Council and Planning
Commission and that he thinks that delayinc� a
decision would be a dis-service to Mr. Dobie.

Mr. Dobie stated that he would agree to the 120
day extension but wants ta avoid the possibility
that the 120 days will be another deiay only ta

hearing for the January 20th Council meeting for
consideration of a11 alterr�atives which may be
brought up at that time.
Mayar Lockwood seconded the mation.

Councilmember Cummin� requested that City
Planner Dahlgren be present for the discussion
at the February 3rd Council meeting.

Mr. Mxke Clasen was present ���_.<:_. _�_�.: to cliscuss
his plans for completion of wark on 929 Chippewa
Avenue. Mr. Clasen in�ormed Council that the
schedule for completion contained in the add-on
agenda will be met and that he can complete all
but three items within the next twa manths. The
three items, garage construction, exterior
painting and final grading and sodding cannot be
completed until spring.
Administratar Frazell a.nformed the Council that
Mr. Cla�en has submitted a$37,5Q0 k�ond and that
if the schedule is nat met the Gity can file a
Ietter with the bond campany, calling on the
bond.
Cauncilmember Blesener suggested that City
ordinances should be amended to establi�h
completion deadlines far alI structures, new and
maved-in. Counci2member Fiartmann felt that
there should be a requirement for a house-movers

agreements which woul.d state deadlines and
conditions.
Gouncilmember Cummins moved to direct staf� to
formally nota.fy Mr. Clasen to com�lete all but
the last three items of schedule in twa months,
�he remaining three items to be completed within
five manths, and to further nati�y Mr. Clasen
that a claim will be filed against the
perfarmance bond if at the end of the two and
five months he has not campleted the wcsrk
required.

BLOCK GRANTS Mr. Mark Ulfers, fram the Dakota Caunty HRA, was
- present ta discuss the 1987 CDBG grant
appiication. Mr. Ul.fers also informed Cauncil
that block grant monies for the North End Street
project will take the farm of grants rather than
loan� because oP law changes.
In response to a statement by Mr. Ulfers
relative to the possibility that Congr�ss may
make some Iaw changes this spring, Mayor
Lockwood suggested that the City send a letter
to HUD and the City's legis].atars pointing out
that the residents of the north end prefer the
loan appxoach. Staff was directed to send
2etters.ta the �3[RA and Conqressman Venta.
After di�cus�ion on the 1987 program, Mayor
Lockwood moved adoption af Resoiution No. 86-

a permit had been approved by Cauncil in

NO. 86-40, Mr. Dale Glowa, from United Properties, was
ED PROPERTIES, present to explain the requested vari.ances for
ANCE a�roposed Northland Snsurance Campany
buxlding to be constructed at the northeast
corner of Northland Drive and Enterprise
Drive. He noted that the request is the same
as that which was rec�ntly granted for the
Cray Research project. Mr. Glowa noted that

the structure is proposed to be three stories
of dark brick with dark reflective glass and
would have underground parking for 30 cars.
There are 170 employees currently with -
projections for 230 employees over the next
ten years.
The variance requests are for a six inch
parking stall width, allowing 8'6" parking
stalls widths, as opposed to the nine foot
width required by Ordinance, and a parking
stall ratio variance of one space per 1000
square feet of useable building area, allowing
4 spaces per 1000 square feet, rather than the
required 5 spaces per 1000 square feet.
There being no further Commission questions or
discussion, Commissioner Duggan moved to
recommend.approval Qf a six inch variance to
the parking stal•1 width, and a one space per
1000 parking stall ratio�variance, allowing
four spaces per 1000 square feet.
Commissioner Frank seconded the motion.

MISCELLANEOUS While waiting for representatives for the next
item to arrive, Chairman Morson asked City
Administrator Frazell to update the Commission
and audience on the status of the Model
Aircraft Noise Ordinance for the Southeast
Area of the City.
TANDEM PROPOSAL Mr. Richard Putnam, from Tandem Corporation,
and Mr. Thomas Boyce, President of the
� Minnesota division of Centex Homes, were
present to give an informal verbal and slide
presentation of their proposed development
plans for the southeast area of the City.
They noted they were present to answer
questions and get feedback from the Commission
and audience.
After the slide presentation, Chairman Morson
noted that there are several different plans
for the several different areas of the site.
Mr. Tandem noted that this is primarily a
for-sale housing site, and added that Centex
has not built any rental propert� in the Twin
Cities area since they started nine years ago.
Dr. Frederick Owens, 2455 Delaware Avenue, and
owner of part of the site, noted an
improvement in the air traffic noise, but said

I-494 traffic is noticeably noisy.
Planner Dahlgren stated that the basic
approach of this project is a sound plan and
is within the density requirements of the
City. He also noted that he likes the public
park approach, and felt it was better for
everyone. Mr. Dahlgren also noted that Mr.
Putnam had been the Planning Director in Eden
Prairie for a number of years, and he is a
very competent planner.
Mr. James Losleben, 815 Hazel Court,
complimented Mr. Putnam on his plan of home
ownership, versus rental, but wished to note
that the Comprehensive Plan amendments are not
adopted at this time, as they had been
withdrawn from the Metropolitan Council in
April of 1986. He also felt that if this plan
is such a good idea, why not spread the
development throughout the community, instead
of concentrating it in just the southeast area
`of the City.
Chairman Morson noted that this was a
preliminary presentation and that nothing was
to be resolved at this meeting. He then
thanked Mr. Putnam and Mr. Boyce for their
presentation. ,
REVIEW Public Works Director Danielson gave a verbal
review of cases that had been before the City
Council.
There being no further business to come before

the meeting be adjourned.

As described in the attached letter, the Kaufman family, 995
Ca en Caurt, experienced a sanitary sewer backup in their basement
on Thursday, November 13. Mr. Stuart Kauiman ha� submitted a
cl im far reimbursement in the amaunt of $225, to compensate him

Natwitlzstanding the insurance company's decision, Mr. Kaufman

re'mbursemeilt. In reviewing the histary of sewer backups in this
ar a aver tYie past two or three years, it does seem that there has
be n an unu:aual problem, althaugh we have never been able to
s stantiate, that there is any de:�ect in the City � s system. t�Te

Dear Mr. Daniel'son:
On Thursday, November 13, a plugged Mendota Heights sewer located
on Caren Rd. caused extensive water damage to our residence at
995 Caren Ct. Four inches of sewer water covered our carpeted
floor, and a strong odor permeated throughout our-home.
After the sewer was opened by the Mendota Heights Public Works
Dept., we took immediate action to extract the water and are
attempting to clean and deodorize the carpet. When the carpet
dries we will assess the damage and notify you accordingly. We
expect to be re-imbursed for the damages suffered.
In addition, our neighborhood is very concerned about this
continuing problem. This is the third time in the past couplew
years that this sewer has become blocked. The most extensive �
damage did occur in this instance. ,�What procedures can you talce
to prevent this situation from re-curring?

This offic�e has been handling the sewer back-up claim
you submitted to the city of Mendota Heights. After
a careful •consideration of your claim, we must deny
any Liability on the part of our insured.
A summary of existing Minnesota case law indicates that
a claimant must prove four things in order to prevail.
(1) Claimant must have suffered damages due to a sewer
back-up.
(2) The sewer back-up was caused by a defect in the
municipal line.
(3) The city had notice of this defect and

(4) the city had failed to exercise ordinary and reasonable
ca�e in resolving the said defect.
The investigation has revealed that the city took prompt
and reasonable action in responding to your sewer back-up.
For the reasons cited above, I cannot recommend any payment
for this claim.
The city Public Utilities Department also informed me that
the lines uere cleaned this past summer and no defects
Were found at that time. As for the two previous back-ups
over the past three years, the city informed me they responded
to your call and no problems uere found at that time.

We have received letters of request from both the Minnesota
Sub rban Newspapers, Inc. (Sun/Current), and Lillie Suburban
New papers (South-West Review), to be designated as the official
Cit newspaper for 1987. Minnesota Statutes require that an
off cial paper have offices of publication either in the same
cou ty as the municipal government, or in an adjoining county.
Min esota Suburban Newspapers is located in Hennepin County, and
Lil ie Suburban Newspapers in Ramsey County, so either meet the
sta utory test.
In the past, the Sun-Current has served as our official
new paper. Although the two papers quote their rates in different
way , City Clerk Kathy Swanson indicates that both are at the
sta utorially set allowable rate, and are essentially the same.

Appointment of Volunteer Firefighters
The fire department has been at an authorized strength of 34
;itions, plus Fire Chief and Assistant Chief. However, for some
ie they have been operating with only 30 firefighters. The
'icers, members of the department, and I, recently considered
l interviewed candidates, and recommend the following three to
i for appointment.
James Perron, 676 Callahan Place - Mr. Perron is a Mendota
Heig�its na�ve, having graduated from Henry Sibley High
School in 1980. He currently resides with his parents on
Callahan Place, and plans to remain in the immediate area.
Jim is employed as a driver and helper with Berquist Disposal
in St. Paul.
Kevin Perron, 676 Callahan Place - Kevin Perron, Jim's
rother; is of course, also a Mendota Heights resident and a
1981 graduate of Henry Sibley High School. He is also a
graduate of the Dakota County AVTI in Rosemount. Kevin is
employed by Minnesota Fence and Iron in Eagan. He lives with
his parents on Callahan Place, and anticipates staying in the
Mendota Heights area.
Aaron Coates, 2361 Dodd Road - Aaron is a Mendota Heights
resi�ent, and recent (1986) graduate of Henry Sibley High
School. He is attending Inver Hills Community College where
he is studying law enforcement, �.-: works part-time as a
cashier/stock person at the Tom Thumb Store on Dodd Road, and
is a member of the West St. Paul Police Department Explorer
Post.
The three candidates will be present at the Council meeting
:sday evening to be introduced to Council.

Mn/dot wants a very expensive storm sewer system in place of ditch
reconstruction. However, Staff has examined the situation and
feels that the ditch reconstruction isn't necessary; the current
ditch drainac�e along T.H. 149 appears to be adequate. The City has
already received a permit from Mn/dot to drain water into the T.H.
149 ditch, so this option has previous approval from Mn/dot and it
reduces the cost of the project to the City.
TOPIC III DISCUSSION: Affected Home-Owners
The final topic of this memo concerns the sanitary sewer line
that the City proposes to extend from Callahan Place to serve six
lots in the Ponds subdivision. Staff recently contacted the owners
of the two properties on Callahan that will have the sanitary sewer
installed along their common lot line. Mr. LaPean of 620 Callahan
Place, in particular, expressed opposition to the project. There
is no feasible way to serve the six lots other than along LaPean's
lot line without changing the development. Staff did anticipate
potential problems in regard to installing�the proposed sanitary
line and budgeted accordingly.
RECOMMENDATION
When the deferred assessments are included �he total per lot
assessment for the Rolling Woods/Ponds project is roughly $13,800.
Staff feels this figure is acceptable and, as discussed in the
original feasibility report, recommends approval of the project.
Staff recommends that the existing storm sewer plan for draining
the Rolling Woods/Ponds subdivision be implemented, but the
proposed ditch reconstruction be deleted. Staff recommends that
the present sanitary sewer plan remain unchanged, although there is
some home-owner opposition.
ACTION REQUIRED
If Council concurs with Staff's recommendation to construct
city utilities to serve the two Subdivisions using the plan
proposed in the feasibility report then Council should pass

It has been my past impression that Mendota Heights and Eagan
are fundamentally in agreement about the corridor, as
evidenced by last summer's joint resolution. Therefore, I
think it is important that we meet with Eagan officials prior
to January 27th, to see whether we can still present a united
front. I agree with the Mr. Hohenstein that having the two
communities taking differing positions would only add
ammunition to other metropolitan area interests that would
like to see the whole idea of a restricted corridor in Dakota
County abandoned, so that more air traffic could be sent this
way.
As to City representation, I suggest that we involve John
Shardlow. John was been our representative on the MC/MAC
Committee that devised the whole corridor concept in 1981,
and is currently representing us on the FAA Part 150 study
process. I think it would also be good to have a
Councilmember involved in the meetin� with Eagan, and at the
MASAC meeting. I understand Eagan will be represented by
Planner John Voss and Councilmember Tom Egan, as well as City
staff. -
ACTION REQUIRED
To discuss the issues with MASAC representative_Friel and
City staff, then decide on a course of action to prepare for
the January 27th MASAC meeting.

on he basis of the noise zones developed in 1981 and contairied within the
Avi tion Chapter of the Metropolitan Development Guide (see Attachment I),
said zones having been prepared by the Minnesota Department of Transportation

If you or your staff has any difficulty in compiling this
information, please contact me at your earliest opportunity. As
I am sure you are aware, the City is attempting to approach this
situation in a constructive rather than confrontive manner. We
believe that if the airport reviews what its own consultants are
saying about the worst impacts of noise in the Eagan-Mendota
Heights area, that some means can be found to place the worst of
that impact at the corridor's center. This community recognizes
that both sides of the corridor will always get some noise, but
we insist that the corridor be used in the way in which it was
designed to spr�ad noise equitably and place the worst of it
where compatible land uses can absorb it.
As you are aware, the City of Eagan is acutely aware of its role
in noise abatement for the metropolitan area. Neither our
responsibility to meet this need nor �your responsibility to
promote policies which most equitably treat those exposed to
noise in Dakota County are temporary. We have a long term
responsiblity to our citizens and to the region and so do you.
The City looks forward to continuing to work with the airport to
resolve these issues. The airport is important to our economy
just as it is to that of the entire regiont but polluting
industries have an obligation to mitigate negative impacts on all
of their neighbors, they do not absolve themsel ves by simply
maximizing their adverse impacts on the smallest constituency.

dep rtures are undertaken between five and ten degrees north of
run ay center line. However, we cannot suppor�G or modify that
ass rtion withaut an opportunity �o review the contour analysis.
All we can prove is that the current situation unnecessarily
con entrates the worst impacts of al.i nai.se at the southern edge
o� he carr��or a��d recognize only the relationship of aperat��ns
to ompatible land use and not their noise impacts to the same
la d use. As you are well aware, the naise envelope of
departures extends far to each side of the critical track on
dep rture ana an optimum departure track mix must take that into

leg'slation of this kind is introduced, please be aware that the
Cit of Eagan and, I am sure, other cities in the area would be
mos interested in providing input to you in its regard.
Alt ough not specifically mentioned here, the City is aware that
cer ain legislative interests in the city of Minneapolis are
int rested in attempting to legislate an end to any recognition
of he Eagan - Mendota Heights corridor. The language likely to
be sed would be a prohibition of any limitations to departure
tra k selection criteria. If passed and enforced, this would
hav the effect of removing any restriction from the flight paths
flo n southeast of the airport. Because this .area already
rec ives more than half of all operations at.the airport, such a
mov would serve to inundate the Eagan and Mendota Heights areas
wit noise while providing little, if any, noise abatement gain
for South Minneapolis and a margina� operational gain for the
air ort. If the noise envir.'onment for these two communities is
to e even remotely tolerable, it is essential that the large
amo nt of traffic concentrated in the area be focused as much as
pos ible toward the middle of the Eagan - Mendota Heights
cor idor.

RESOLUTION REG�RDIVG AIR TRAFFIC PATTERNS
:REAS, the City of Mendota Heights, through Land Use planning, has provided
ior through the southern area of the City for the safe and unobtrusive
�n of aircraft arriving and departing from the Twin Cities International

TdH REdS, during the past three years there has been a continuing and increasing
movenent of the departing tracks of aircraft over well established residential
neighbo hoods, located to the north of the compatibly zoned land; and
L REAS, the operations of departing aircraft on runways 11L, due to heading
turns o t of the provided corridor, have resulted in an intolerable situation
for the residents of the City; and
WH REAS, it has come to the attention of the City that at least a part
of the ondition is a result of the designation of a small residential area
(specif'cally the Timberline Addition in the City of Eagan) south of the flight
path by the FAA as a no overflight area; and
REAS, the City of Mendota Heights has been provided with noise contour
maps fr m the MAC and Metropolitan Council which indicate f ield operations should
be cond cted in a manner that restrict the excessive noise to the non-residential
corrido provided; •
N0+1 THEREFORE BE IT RESOLVED by the City Council of the City of Mendota
Heights that the MAC and the FAA Air Traffic Control be required to maintain
all dep rting aircraft on Runway 11L to a compass heading of no less than
105 deg ees or such heading as is necessary to maintain all traffic in the corridor
provide and shown in exhibit A attached hereto.
BE IT FURTHER RESOLVED, that in the event that such operations cannot be
accommo ated and effective on or before July I0, 1984, that the MAC close F.unway
11L to 11 departing turbo jet traff ic on a 24-hour a day basis until such time
as oper tions can be maintained in such a compatible manner.

DIS�USSION:
Jahn and Cathleen George reside at 1834 Dodd Road, which is
Lot 25, Willow Spring Addition.
Their lot is very large (1.5+ acres) and they would like to
sub ivide it into two lots and construct a new home for themselves
on he newly created lot in the rear.
City sewer and water are available an Dodd Road ta serve the
pro osed new house and the Georges' are dedicating a 20 �oot
uti ity easement alang their north baundary in order ta be able ta
ext nd services to these City main�. There is ample area to
cre te an additional buildable lot. However, there is not enough
fro tage far each lot to have 100 feet af frontage alang a public
str et, therefare a flag lot i� being proposed. Flag lots have
bee approved in the past where it is ine�ficient to canstruct a
Cit street to serve difficult pieces of property.
This subdivision was submitted before staff had time to
pr are the checklist �or subdivision request�, consequently
se eral of �he requirements in the subdivisian ordinance are
la ing; the existing and proposed contours, location of
co tiguous homes, approximate area of the exi�ting and propo�ed
lo , tree coverage and sail survey have not been submitted.
Mr. Boyd Ratchye, the propert� owner immediately south of the
Ge rges' property, has contacted CZty sta�f and stated that he
fe 1s the south property line as staked i� incorrect.- He
re ests the City not approve the propased subdivisian until the
Io ation of the south line has be�n verified. Mr. Ratchye has
hi ed his own surveyor and may be ready to comment about the
lo ation of the south property line at the public hearing.
ION REQUIRED:
Conduct a public hearing. The Commission should th�n d�cide
wh ther they want to exempt the applicant from the several omitted
or inance requirements because of the simplicit� of the request,
ar continue the matter to the next meeting and in�truct the
ap licant to canfoa:m ta all of the ordinance requirement�.

WHE EAS, the City Engineer reported �hat the proposed zmprovements and
con truction �hereof were feasible and desirable and further reported on the
pro ased costs af said improvements and canstruction thereof; and
EAS, the City Council has heretofare directed that the City Engineer
eed with �he preparation of plans and specifications thereof; and
EAS, the City Engineer has prepared plans and specifications for said
avements and has presen�ed such plans and specifications to the City
cil for approval.
THEREFORE, IT IS HEREBY RES4LVED by the Gity Gounci2 of the City of

1. That the plans and specifications for said improvements be and

DISqUSSION:
The State of Minnesota Highway Department keeps on file agreements with
the local County and City municipalities designating the State to act as
the'r agent to apply for Federal grants for road projects. They do this so
tha in the event Federal funding should become available the State can act
rap'dly to make applications._ =If they.did not do this, they would have �o
exe ute agreements with each municipality for every opportunity and it would
gre tly slow th�eir reaction time. They had existing agreements but have
mod"fied them to include a single audit requirement as mandated by the
Fed ral government. They request that these new agreements be executed
(at ched).
Examples of where this agreement has come into play in the past are:
Gre t River Road Signing Project, Safety Projects, Billboard Cleanup, Dis-
ast r funds, Emergency Aid. �
ATION:
Staff recommends that the City enter into the attached agreement
aut orizing the State to act as its agent in accepting Federal Aid on behalf
of he City for road and bridge construction.

AGENCY AGREEMENT
This Agreement made and entered into by and between the
Ci y of herein after referred to as
th "City" and the Commissioner of Transportation of the State of
Mi�nesota hereinafter referred to as the "Commissioner", �
WI'�NESSETH:
WHEREAS, �ursuant to M.S. 161.36 the City of
desires the Commissioner to act as its agent
in accepting federal aid on the City's behalf, for road and bridge
i
co struction and in contracting for the construction, improvement �
�
i
or maintenance of roads or bridges financed either in whole or
oa�t with federal moneys: and _
WHEREAS, M.S. 161.36, Subdivision 2, requires that the
te�ms and condition of the agency be set forth in an agreement:
NOW, THEN, IT IS AGREED:

That pursuant to. M.S. 151.36, the City does hereby
ap�oint the Commissioner its agent with respect to all federally
fu�ded projects, to acceQt and receive all federal funds made
av ilable for said projects and to let contracts pursuant to law
fo the construction and improvement of local roads and bridges.
Each contract will be in accordance with plans and
sp�cial provisions for said projects on file in the Department of
Tr�ansportation, State Transportation Building, St. Paul, Minnesota

55155, and the latest edition of "Standard Specificatians for
Higriway Canstruction" and all amendments thereo�, which said
plans, special provisions and specifications are made a part o�
this agreement by reference as though fully set forth hezein.
In the letting o� said contract, it is hereby agreed
that the �ollawing procedures shall be follawed, to-wit:
(a} The Commissioner shall cause the advertisements
ca2ling for bids on saia work �o he published in �he Constructzon
Bulletin. He sha11 also cause a�vertisements for bids to be
published in the officia•lly designated newspap�r of the City.
Said advertisement or cali for bids shall specify that sealed
proposals or�bids wzll be recezved by the City Furchasing Agent on
behalf af the Cammissioner as agent of said City. Proposals,
plans and specifica�ions shall be available for the inspection oE
praspective bidders at the Depar�ment of Transportatian, St. Paul,
Minnesota 55155, and at the affice of said City Purchasing Agent
and the adver�isement shall so sta�e. The bids received in
response to said advertisements Eor bids shall be opened for and
on behalf af the Cammzssianer by a District Director af the
Department af Transportation ar such other engineer of �he
Department af Transportatian as may be from time to time selected
by the Commissianer. After said bids shall have been opened, the
City Council shall �irst consider the same and thereupon transmit '
to the Commissioner all bids receive3 together with i�s
recommendation that the lowest bid submitted by a responsible
bidder be accepted ar that all bids be rejected. Upon receipt af

t be tabulated and shall thereupon determine who is the lowest

r sponsible bidder and shall awar3 the contract to the lowest

t e construction of said projects after the same has been let.
T e City agrees to furnish its City Engineer or other registered
e gineer and assign him to the active supervision and direction of
t e work to be performed under any contract let for the aforesaid

p ojects. Said engineer so assigned shall act under the ,
s pervision and direction of the Commissioner. The City further

a�rees to furnish such other personnel, services, supplies�and �
e uipment as shall be necessary in order to properly supervise and ;

(c) The Commissioner may make changes in the pl�ns or
t e character of the work as shall be recommended-by the engineer

i charge of the work. If he concurs in such recommendations, the

C mmissioner may enter into, for and on behalf of the City, '

s pplemental agreements with the contractor for the performance of

a y extra work or work occasioned by any necessary, advant�ageous,
�
o desirable change in plans or construction. ; �
It is underst�od by the City that the Commissioner
c�annot personally investigate and pass judgment on the various
items of extra work and plan changes necessary and desirable
d ring the construction of the projects but that he must d!elegate

are employed by the Minnesota Department of Transportation. The
City does hereby autharize these engineers, so delegated by the
Commissioner, to enter into, far and on behalf of the City, the
supplemental agreements specified in the preceding paragraph
hereof.
(d) The City hereby authorizes its City Engineer, for
and on behalf oE �he City, from time to �ime, during the progress
of the work on said projects, to request the Commissianer to
furnish for use on said projects speci�ic engineering services to
be performed by skilled employees of the �innesota Department af
Transportation. The Commissioner may but is'nat obligated to
furnish the services so request�d. If the Cammissioner in
comp2iance with such request shall furnish for the use of the Czty
an said praject the services of any Minnesota Departmen� of
Transporta�ion em�Iayee, then and in that event, the City agrees
ta reimburse the Trunk Highway Fund for the full cost and expense
of the furnishing of such services including all casts and
ex�enses of any kind or nature whatsoever arising aut af,
connected with, or incidental ta the furnishing of such services.
(e} The Commissioner sha21 receive the funds to be paid
by the City and the funds to be pai@ by the United States as
federal aid funds, for said projects and ta pay therefrom when due

any and aIl sums that may become due the contractor to whom the
contract is awarded, and upan fina2 comp3e�ion and acceptance o�
the wark, to oay from said funds the�finaZ estimate to said
contractar for said work.

accordance with Minnesota Rules Chapter 8820.1500 Subp. 3. i
At regular monthly intervals after contractors shall

ha e started work under contracts let by the Commissioner as agent
for the City for the construction of said projects, the engineer
assigned to and in charge of said work shall pr�pare partial
estimates in accordance with the terms of said contracts lelt for�
sa�id projects and the procedures established by'the Office of
Co�ntract Administration and Maintenance, Minnesota Department of
Transportation. The�`said.engineer in charge of said work shall

i ediately after preparing each partial estimate, transmit the -

same to the Commissioner in duplicate. Each such partial � �

estimate, shall be certified by the engineer in charge and by the

contractor performing such work. The said engineer assigned to

a d in charge of said work shall also prepare and submit to the

C missioner the final estimate data, together with the required
pr�oject records in accordance with the terms of said contracts let

set forth in the applicable documentation manual. After the
approved final estimate has been submit�ed �o the Gommissioner,
the City will pay to the Commissioner any additional amount which

When the contractor shall have completed the work an
said projects, the City agrees ta inspect the same and forthwi�h
upon �he completion of said inspection advise the Cammissioner
whether or not the wark performed should be, by the Commissioner
as its agent, accepted as being performed in a satisfactory
manner. In the event the Ci�y should, aPter said inspectian,
recamnnend to the Cammissioner that he shauld not accept said work,
then �he City shall at the time �uch recom�enda�ion is made
specify in particularity the def ects in saia work and the reasons
why the work should nat be accep�ed. It is fur�her agreed that

any recommendations made by the City are no� binding on the
Commissioner but �hat he shall have the right to de�ermine whether
or not the work has been acceptably perfarmed and ta accept or
reject the work performea under any said contract.

United Praperties has submitted a request to the City asking
th t street lights be installed in the business park area (see
at ached le�ter). Larry Lee has also requested that ].ights be
in talled in his area. As you can s�e by the date on Dale Glowa's
le ter, United Properties`has been pressing staff for street
li hts for so�tte time. However, because af the heavy wark Ioad in
19 6, staff has not had the time ta pursue the rec�zest unti2. now.

United Properties is anxious to have the light� installed in
so staff has pramised to make an effort to fit the work into
�ear's schedule. We feel that a 2isting a£ the �teps that
to be followed in getting the lights installed is as follaws:
1. Council Approval of the Concept ;
The concept:af lighting the business park has been�
presented to Council bei'ore, and at that time staff felt
that there seemed to be an acceptance af the proposal.
However, we would like to have formal appraval of the
cancept befare proceeding with �urther studies. We would
plan to pay for the installation of the 3ights through a
429 Assessment Procedure and set up a special taxing
district, as approved by the��tate legislature in 1986,
ta pay far the operation and maintenance o�'•the lighting
systent. There would also be available the aption to do
the installation of the s�reet lights uszng a special
taxing district. �
Unitad Properta.es has also rec�uested a specific 2ight
fi.xture design {see attached sllustratian). This fixture
is identical to what is bei.ng used in a number of their
parking lots throughout the park. I
2. Landowners Notificatian �

Once Cauncil has autharized sta�f to praceed, we feel
that an in£ormal meeting between staff and the other
Iandowners in the area shauld be conducted to advise
them o� the proposal and get their input. This meeting
would be done during the day with staff inembers
conducting the meeting. �

3. Order Feasibility Study/Hearing
After the landowners have been informally advised of the
project and their input received, staff should prepare a
feasibility study. This is the first step in the 429
assessment process. This study will further develop the
lighting scheme, more accurately predict the costs, and
develop a method for payment. •
4. Order Plans and Specifications and Install the Lights
Should all the above steps go smoothly, a contract could
be let this summer and lights could be installed starting
later this summer.
RECOMMENDATION
Staff feels that lighting the business park will be�n ,
attractive addition to the area, with all costs for installation,
ongoing power, maintenance and re�air being borne by the area
landowners. -We recommend proceeding with the project using�the
lighting standard requested by United Properties. �
ACTION REQUIRED
If Council desires to implement the staff recommendation,
they should pass a motion approving Resolution No. 87- ,
RESOLUTION ACCEPTING PETITION AND ORDERING PREPARATION OF
FEASIBILITY REPORT FOR STREET LIGHTING OF BUSINESS PARK. This
would allow staff to proceed with Steps 1 through 3 above.

ently adopted City Vision Statement, and invited citizens to

tement. Deadline for submitting ideas was December 15.
Three citizen responses were sent in, one person provided
ee suggestions. They are reprinted below:

As Council has previously been notifzeclj there are faur terms
of office ending on the Parks and Planning Commission at the end
of January. Parks commissioners whose terms expire include'Jim
St in and Mary Jeanne Schneeman; Planning cammissioners arelBill
Fr nk and Stuart Henning. ;
Parks Chair Jim Stein has indicated his desire and �
wi lingness to remain an the Parks Commission until we have,aur
pa ks bond referendum later this Spring. At that time, it wauld
be his intentian ta resign and provide Council with the �
op artunity to appoint a new me�ber. Mary Jeanne Schneeman'has
co tacted City staff to indicate that she does not wish to be
re ppointed, because o�' personal conf],icts with meeting times.
We have not been advi�ed by either o�' the incumbent Planning
Co issioners whether thay wish ta be reappointed. :

way 110. At the meeting he described some of the problems he �
untered getting a Corps of Engineers Permit to do wark on his site.
