age da, and one for deletion. There is new information
pro ided for two items, 5.e. List of Claims, and 9.c. Dobie
sub ivision. .

It 's recommended that Council adopt the agenda with the
add'tion of Item 7.a. Presentation by Fire Chief regarding
Cou try Club warehouse fire, deletion of Item 9.j. Discussion
wit District 197 School Board, and replacement with 9.j.

7.a. Presentation � Fire Chief regarding Country Club fire
Fir Chief John Maczko has requested about five minutes of
you time under the Introductions section, to offer a few
co ents about the fire and subsequent firefighting effort at
the Country Club warehouse on November 20/21.
9.c. Reconsideration of Dobie subdivision
Ple se see attached memos from the City Administrator
con erning procedural issues, and from City Planner Howard
Dah gren offering reaction to the proposal prepared by
Pla ner John Voss on behalf of the Stratford Rd. residents.
9•j.� _ deletion = Joint Meeting with School Board
Sch ol District staff indicate the consultant/staff draft of
a d velopment plan and joint development agreement should be
rev'ewed by the School Board's Sites and Facilities
Committee, before proceeding to the full Board at the joint
session. Therefore, it is premature to set a date for that
joint meeting. The meeting will likely not take place until
after the first of the year.
9.j. = replacement - Approval of revised Divine Redeemer
ambulance contract.
At the meeting of November 10, Council approved the concept
of revising the Divine Redeemer ambulance contract to delete
the requirement for an annual subsidy from the nine member
cities. The revised contract is attached for your approval.
The contract is identical to the contract entered two years
ago, except for removal of sections relating to the subsidy.
The new contract will expire at the same time as the existing
contract, December 31, 1988.
Action Required
Council should pass a motion approving the revised contract
as submitted.

At he meeting of November 18, Council voted to reconsider
its previous action at the meeting of November 10th approving
the Stratford Woods subdivision. That reconsideration was
pos poned to this evening's meeting.
Acc rding to City Attorney Hart, the first formal action
Cou cil must take on a reconsideration is to vote once again
on xactl the same motion it previously acted on. The
min es o the November 10 meeting reflect "Mayor Lockwood
mov d that the subdivision proposal be accepted as
ori inally requested." If the motion fails on tonight's
vot , Council would then be free to offer alternative
mot ons, or following discussion, could choose to adopt the
ide tical motion once again.

AMBULANCE SERVICE AGREEMENT
This AGREEMENT made and entered into effective the first day of January, 1987,
by and between the cities of Eagan, Inver Grove Heights, West St. Paul, South
St. Paul, 1Aendota Heights, Rosemount, Sunfish Lake, Mendota, and Lilydale,
thereinafter referred to as "Cities", and D. R. M. H., Inc ., d/b/a Divine Redeemer
Memorial Hospital, hereinafter referred to as "Hospital".
WHEREAS, the Hospital, a Minnesota corporation, desires to provide paramedic
ambulance service to the Cities, and
WHEREAS, the Cities, desire to jointly assure that adequate ambulance service
is available .
NOW, THEREFORE, in consideration of mutual covenants, agreements and matters
set forth herein, the parties hereto agree as follows:
1. Nature of Ambulance Service to be Provided.
The Hospital agrees to provide paramedic ambulance service to the Cities.
2. Duties and Responsibilities of the Hospital. �
As a part of its duty and responsibility to furnish ambulance service to
the Cities, the Hospital agrees that it will:
a. Either own or lease and operate two fully equipped paramedic ambu-
lances meeting state license requirements .
b. Maintain and staff each ambulance on a 24-hour basis, seven (7) days
per week.
c. Staff each ambulance with two (2) paramedics with National
Certification.
d. Be self-sustaining without reducing the level of service to which it
has agreed.
3. Fee to be paid by the Cities
There will be no fee paid by the Cities for the contract period.
4. Miscellaneous Terms
a. There shall be no employment relationship established by this �
Agreement. The Hospital, in the performance of this Agreement, shall at all
times, be an independent contractor. Ambulance drivers, attendants and parame-
dics performing duties for the hospital are employees of the Hospital and the
Cities shall have no right to direct, control or influence their actions, nor
shall the Cities in any way, be responsible for their acts, their salary or any
employment benefits. Likewise, police officers, firefighters or other employees
or agents of the Cities are under the sole direction of the Cities and Hospital
shall have no right to direct, control or influence their actions, nor shall the
Hospital in any way, be responsible for their acts, their salaries or any �.

b. The Hospital is required to maintain full and complete administra-

In this regard, the Hospital shall be responsible to the patient

c. Except as indicated above, this AGREEMENT be amended only upon

d» Any disputes between the Cities and Hospital arising under this
Agre ment shail be settleci by arbitration in accardance with the provisions of
the niform Arbitration Act of the State of Minnesota, by a Board of Arbitrators
comp sed o# three members. The Hospital shall appoint ane arbitrator, the
Citie shall appaint one arbitrator and the two so appointed shall select the
third acbitrator. Within 45 days of the occurrence' giving rise ta arbitration,
fihe p rty demanding arbitratian shall notify the other party in writing of such
dema d specifying the matter to be submitted to arbitration and the name of the
arbit ator selected by the party making such demand. Upart receipt af such wri.t-
ten tice, the other party shall have ten (10 ) days in which to select an
arbit ator, and to specify any matters which such garty desires to have sub-
mitte to arbitration and to notify the other party in writing of such selec-

Minutes of the Special Council Meeting
Held Wednesday, November 12, 1986
Acti g Mayor Witt called the meeting to order at 7:12 P.M. for the purpose
of a Joint Land Use Workshop with the Planning Commission. The following
memb rs were present: Mayor Lockwood, Councilmembers Blesener, Cummins,
Hart ann and Witt, Mayor-elect Mertensotto and the following Planning Com-
miss on members were present: Morson, McMonigal, Henning, Duggan and
Kreb bach.
City Administrator Frazell gave a brief introduc-
tion to the workshop.
IMPLICATIONS City Attorney Hart was present to discuss the legal
standards in making land use regulation decisions.
First he described legislative vs. quasi judicial
decisions. He specifically made a point that a
conditional use permit for a planned unit develop-
ment is a right not a privilege. He also stressed
that when ever possible the Council should make
findings on decisions for land use matters.
He went on to review the Local authority to enact
Comprehensive Plan and Zoning Ordinances. He
stated that Zoning Ordinances do control over the
Comprehensive Plan however that a City is�required
to rezone to bring the Zoning Ordinance in line
with the Comprehensive Plan unless there is a ra-
tional basis not to do so.
He stated that it was unreasonable to deny a re-
quest on the basis of maintaining the "character"
of a neighborhood. Council should do regulation at
zoning ordinance level.
Tom stated that Council can not deny a subdivision
if it meets the standards of the Zoning Ordinance.
Landowners have the fundamental right to develop `
their land.
Tom went on to talk about the concept of "taking"
in land use. He stated that it was difficult for
landowners to prove taking, because if there is any
reasonable use of the land remaining it is not a
taking. It is easier to prove damages if the City
spot zones.

Finally Tom spoke about acceptable basis for
denying variances. He said that after a variance
has been granted, following similar variances will then need
to have compelling reasons for denial.
PLANNING IMPLICATIONS City Planner Dahlgren was present to discuss
Comprehensive Planning in the City. He gave a
brief history of planning within the City, speaking
on the original Comprehensive Plan as it was first
prepared in 1959 and then modified twenty years
later in 1979.
Mr. Dahlgren spoke of preparing check lists for
planning applicants. This was well received and
should be implemented.
PROGRAM CHANGES Following the presentations by the City Attorney
and Planner, workshop participants developed the
follow:i.ng list of areas of interest for the staff
and Council to address during the zoning and
amendment process:
VARIANCES
Routine variances will be primarily dealt with by
the Planning Commission, then placed on the Council
consent calendar.
Written consent from all property owners within 100
feet will be required, or else a formal public
hearing will be held with mailed notice.
ZONING CODE
Lot area requirements (particularly side yard)
should be related to house size. Floor-area ratio
might be one approach.
Review appropriateness for lot size requirements in
all Business districts.
Consider requirement for attached garage, except by
specific variance.
Look at non-conforming use language in Section
4.3(7).
Look at standards for commercial/industrial
building permit review in Section 4.17.
Consider need for elevation requirements for
garage/floor grades.
Consider regulation of alignment of homes on cul-
de-sacs.
SUBDIVISION ORDINANCE
Review appropriateness for required submission
materials now in ordinance.
Reduce cul-de-sac size requirement.
Consider expression of policy preference for -
residential street design that discourages thru
traffic.
Delete code requirement that final plats go back to
the Planning Commission.
Improve or bolster review of parks/green space.
PLANNED UNIT DEVELOPMENT
Revise definition of net buildable area to exclude
open water, and perhaps other area that would be
otherwise unbuildable. ' '
Require 4/5's vote of the Council where the PUD
will change the type of land use from that
stipulated i.n the underlying zoning.
Consider an option for the developer to have a pre-
application conference with the Council, as well as
the Planning Commission.
Hold public hearing earlier in the process (perhaps
sketch plan stage), and consider earlier Council
input.
Amend language, as necessary, to insure PUDs remain
a privilege, not a legal right.
Clarify .the process for amendments to Conditional
Use Permits, which includes PUDs.
CRITICAL AREA REVIEW
Waive fee and allow staff approval for minor
variances (i.e. previously constructed single-
' family home totally inconformance to CAO ordinance
standards).
ADDITIONAL PUBLIC HEARING ISSUES
Require published notice of public hearing for
Conditional Use Permits, as stipulated by State
statute. This includes PUDs.

Clarify that staff is responsible for setting the
date and time of public hearing, and sending out
proper notice as required.
Hold required public hearings at the Planning
Commission only, and do not duplicate at the
Council. This refers to formal public hearings.
- Citizens would still have the opportunity to speak
at the Council meeting as recognized by the Mayor.
FENCE REQUIREMENTS
Adopt 3'- 4' as allowed fence height in the front yard,
which should reduce the number of variance applications.
Review line of site requirements in Section 4.7.
MISCELLANEOUS
Staff to develop checklist of required submission
materials to be given applicants. Also "toughen
uPr► .
Develop public information brochure that updates
where the City is in accomplishment of its long-
range plan.
Clarify and toughen penalties and other remedies
for non-compliance with land use regulations.
ADJOURN There being no further discussion at the workshop,
Councilmember Hartmann moved, seconded by Witt to ad-
journ the meeting. The meeting was adjourned at 10:44

Councilmember Blesener agreed, stating that had

matter was discussed on November 10th, she would
have suggested that the Council was acting aut
of order in looking at a through s�reet
praposal. She stated that the matter was tabled
on October 22st to a3.low the developer to came
back in with a better cul-de-sac praposal. She
stated that even if legally and technically that
cannot be supported, she doesn't think the
Council acted in goad faith rejecting something
one meeting and then approving it the next
meeting.
Councilmember Witt agreed that there was really
no discu�sian on cuZ-de-sacs on the Tenth.
Mayar Lackwaod stated that at the October 7th
meeting, the developer was directed to meet with
the City Plannar and Councilmembers Witt,
Hartmann and Blesener to came u.p with a
salutian: there was no directian to come back
with a cul-de-sac propo�al or nothing at a11.
Councilmember B1.esener �tated that the meeting
was to provide the develo�er with some input
inta his desi.gn and for him to come up with a
cul-de-sac solution. She stated that the plat
was deni�d and the only reason it was
recansidered as so that Mr. Dabie cauld come
back to the Council rather than starting aver
again at the Planning Commi.ssian. She stated
that she could never have supported
reconsideration if

Councilmember Hartmann stated that the matter
was not tabled for the purpose of only to come
up with a cul-de-sac solution; Council tabled
the matter to c�ive the developer an opportunity

He pointed out that Planner Dahlgren has stated
that the best way to develop the plat is with
through streets.
Councilmember Witt felt that Council did not
hold enough discussion on cul-de-sacs, and that
it didn't seem that the residents had enough
opportunity to discuss cul-de-sacs.
Mr. Eide stated that the residents had no idea
that the matter was going to appear on
November 11th and therefore they should have an
opportunity to be heard.
Mayor Lockwood responded that he believes people
were given ample opportunity to discuss the
issue, and stated that he felt that they were
well prepared for the discussion. Councilmember
Blesener stated that people had no knowledge
that the Council was going to look at the
original proposal again on November 10th and
they had no time to react.
Mayor Lockwood stated that he would not move to
reconsider, that his position is clear and that
he believes that cul-de-sacs when not necessary
are �oor planning. He felt the matter should be
considered at the next meeting since Council-
member Cummins is not present this evening.
Attorney Hart stated that the only time a motion
to reconsider is proper is at the meeting
following that on which the action was taken.
He pointed out that the motion to reconsider
must occur at this meeting or not at all.
Mr. Eide stated that the residents are not
asking to be heard on the matter tonight, but
are only asking that the reconsideration action
be made so that they can be given an opportunity
to speak on the issue at another meeting.
Councilmember Hartmann stated that he is
inclined to bring the issue up for
reconsideration. He stated that Council
look at what the Planning Commission has

what the City Planner has said. He pointed out
that Council has looked at a variety of cul-de-
sac options including two suggested by the City
Planner, and in his opinion after all
consideration, the through street is the proper
decision. He stated that his understanding of
tabling the issue at the earlier meeting was so
that Council could look at possible additional
cul-de-sac options, but that did not rule out
the original plat. He felt that there was ample
information in the minutes of past meetings to
support the decision on the through street.
Councilmember Blesener stated that thinks that
the Council is being unfair --the plat was
denied and then reconsidered so that the
developer could come back to the Council rather
than the Planning Commission and so that the
Council could give input on design.
Mayor Lockwood suggested that Robert's Rules of
Order be suspended until Councilmember Cummins
is present so that he or Councilmember Hartmann
could make a reconsideration motion if they so
desire. Attorney Hart advised that in
accordance with the City Ordinance which
incorporates Roberts Rules the issue is finished
tonight unless there is a motion to reconsider
tonight.
Administrator Frazell stated that he feels it is
wrong to get so caught up in procedure and miss
the point of what is the best solution. He
pointed out that there was a legal hearing on
the issue in October. The issue of through
street versus cul-de-sac was thoroughly
discussed then and the residents were given
ample opportunity to debate the issue at that
hearing which was closed after discussion.
Councilmember Blesener again stated that she
believes it would be unfair not to reconsider
the issue.
Mayor Lockwood stated that he has not changed
his mind on the issue but since Councilmember
Blesener feels so strongly that Council is being
unfair and since Councilmember Cummins is not
present to make input, he would make a
reconsideration motion.

HALL The Council discussed a memo from the City
Administrator regarding architectural services
for Phase II of the City Hall project. Council-
member Blesener stated Council knows the style
of building that it wants and that she wants
Lindberg-Pierce Architects to know that the
design must conform to Council's desires and not
that of the architects. She suggested that a
pre-contract conference be conducted to discuss
concerns with the firm's representatives.
It was Council consensus that a conference with
the architects be conducted immediately
preceding the December 2nd meeting. Council
also concurred in the City Administrator's
recommendation that a closed session for labor
negotiations and salary issues be conducted at
the end of the meeting or at a pre-Council

opening of Mendota School (item 9g). It was the
concensus that the Council should not take a
position on the issue and that while members of
the Council might wish to make comments on their
own behalf at the November 25th Board hearing,
none should be made on behalf of the Council.
OUS The Council acknowledged a memo from the Police
Chief regarding accidents at the intersection of
Highway 13 and Downing.
CHIPPEWA The Council acknowledged and discussed a report
from the Code Enforcement Officer relative to
the state of completion of a house which was
moved to 929 Ch�.ppewa. It was the.concensus of
Council tha� the owner, Mike Clasen, should be
requested to attend the December 2nd meeting to
discuss the completion schedule.

the Council, Councilmember Hartmann moved that
the meeting be adjourned.

The department responded to 15 calls this month. The only fire loss was a
zar fire, damage of $6,500.
No other damage �occurred in the City during this month.

The regular meeting of the Mendota Heights Planning
ssion was called to order by Chairman Morson at 7:31 o'clock
The following members were present: Morson, Burke, Frank,

NO. 86-31, Chairman Morson called the meeting to order
, SUBDIVISION for the purpose of a continued public hearing
on an application by Donald Mager for the
subdivision of the Houchen and Anderson
properties located at 1860 and 1870 Dodd Road.
Mr. Floyd Unruh and Mr. David Doyle from Tri-
Land Engineering were present to explain the
plan revisions and to answer any questions.
Mr. Doyle noted the differences between the
revised plan and the previous drawing, adding
that there are now three lots along Mager
Lane, as opposed to the previous four lots.
He also noted the lesser gradient on Westlie
Court.
Chairman Morson noted the spelling of Westlie
Court and asked if it should be spelled Wesley
Court, as in Wesley Lane that St. Paul's
United Methodist Church fronts on. Mr. Unruh
noted that Westlie is Mr. Mager's wife's
maiden name and it was spelled to reflect that
name, not to correspond with Wesley Lane.
Commissioner McMonigal suggested eliminating
the access on Lot 16 to Westlie Court on the
final plat. The Commission also noted the
existing nine inch clay pipe on Lot 10, which
will drain to Lot 6, and asked if that was a
good idea. Public Works Director Danielson
noted that this would not be a significant
drainage problem.

Mrs. Jean Ratchye, 1844 Dodd Road, wanted to
clarify the potential access to her residence.
Planner Dahlgren suggested the line should go
to a 45 degree angle northeasterly to the
Ratchye residence (off of Lot 6).
There being no further questions or comments
from the audience, Commissioner Frank moved to
close the public hearing at 7:46 P.M.
Commissioner Duggan seconded the motion.
Commissioner Frank moved to recommend approval
of the preliminary plat for Rolling Woods
Addition, with the change of the�Mager Lane
cul-de-sac extension being set off at a 45
degree angle to allow better access to the
Ratchye residence. •
Commissioner Duggan seconded the motion.
The Commission noted that a park contribution
of $600 per the 16 new lots created would be
required.
CASE NO. 86-38, Chairman Morson called the meeting to order
GEORGE, LOT SPLIT for the purpose of a public hearing on an
application from John and Cathleen George,
1834 Dodd Road, to split Lot 25, Willow
� ' Springs Addition. Mr. George was present,
• noting that this lot contains 1 1/2 acres, and
he and his wife desire to construct a new home
for themselves on the rear portion of the lot,
with access to the home off of Dodd Road. He
stated that the sewer utilities end at the
� northwest corner of the existing driveway, and
� he proposed to move the south lot line north
2.3 feet.
The Commission noted that the north/south
boundary lines seem to be the only matter
unresolved.
Chairman Morson asked for questions or
comments from the audience.
Mr. Boyd Ratchye, 1844 Dodd Road, felt that
the George's were encroaching six feet along
the Ratchye/George boundary, which is the
George's south boundary line. He stated that
he had contacted Paul McGinley to survey the
lot and the survey should be ready by December
10 or 15. He and Jean Ratchye objected to the

proposal until a new survey is completed.
Jean Ratchye stated she would have no
objections if the survey resolves the problem
of the lot lines.
Chairman Morson asked Mr. George to provide
Mr. Ratchye's surveyor with copies of his
surveys.

from the audience, Commissioner Frank moved to
continue the public hearing to the December 15
Planning Commission meeting.
Commissioner Duggan seconded the motion.

NO. 86-39, Chairman Morson called the meeting to order
ON, SUB- for the purpose of a public hearing on an
ION application from Ms. Carmen Swenson for the
subdivision of property on the southwest
corner of Marie and Dodd.
Mr. David Swenson noted that there were five
parcels of property involved in their
proposal, two that Carmen owned, one owned by
John Bessley, one owned by Pat Moran, and the
City-owned tax forfeit property. He went on
to explain the complications involved
regarding the tax forfeit parcel and stated
that slight modifications have been made to
the� plan, with three lots containing 330 feet
of frontage on Ma�rie, and eliminating the tax
forfeit piece. The westerly lot would contain
115 feet of frontage, the center lot 115 feet
and the easterly lot would have 100 feet of
frontage, and would contain 15,000 square feet
of land without the tax forfeit lot. He
stated that lot one would be 22,200 square
feet, lot 2 would be 23,300 square feet and
lot 3 would be 15,000 square feet, with all
lots meeting the minimum 100 foot of frontage.
Commissioner Krebsbach expressed her feeling
of keeping that particular corner (Dodd/Marie)
green by keeping the tax forfeit parcel.
Chairman Morson asked for questions or
comments from the audience.
Mr. Brian Birch, 755 Willow Lane, felt that
this proposal dealt injustice to the area with

the smaller lot sizes. He felt the lots in
the area were intended to be larger. He also
pointed out the drastic elevation drop on Lot
3.
Ms. Swenson noted that the three lots fronting
on Marie are across the street from 100 foot
front lots, so they are in keeping with the
adjacent lot sizes.
Mr. Birch suggested looking at the deed for
Somerset Hills for restrictions. Ms. Swenson
noted that the deed has long expired. She
also noted that the larger lots will be
located in back, with the smaller lots along
Dodd Road.
Mr. Birch expressed concern with a decrease in
property valuations due to the proposed
subdivision.
Chairman Morson pointed out that this proposal
meets the City's ordinance requirements and
they can't deny a property owner the right to
subdivide their property.
There were no further questions or comments
from the audience.
Planner Dahlgren noted that the revision
" regarding the lot lines of lot 3 were very
� minor and that the Commission could act on the
' proposal at this meeting.
The members noted the 8% grade on the cul-de-
sac off Dodd Road and Mr. Swenson noted there
will be 100 feet of landing at a 1% grade at
the top of the area.
Commissioner Krebsbach asked for consideration
in requiring turn-around driveways for the
lots fronting on Marie. Mr. Swenson felt this
would be no problem, but noted that Marie
Avenue is quite wide, and he didn't really
feel this would be a problem. ,
Commissioner Krebsbach felt every effort
should be made to keep the vegetation/trees
along Marie and asked that there be no
unnecessary removal of trees from the site.
Ms. Swenson said the only grading to be done
will be for the cul-de-sac.

Commissioner Krebsbach felt that the members,
as a Commission, have the opportunity to hang
onto the beautiful green and wooded area, and
that the� should take advantage of that
opportunity.
Mr. Swenson noted that protective covenants
will be required.
Planner Dahlgren noted that the Commission
could ask the developer to require the green
space preservation in the covenants.

comments, Commissioner Duggan moved to close
the public hearing at 9:06 P.M.

revised preliminary plat of Spring Creek Acres
and to recommend that the applicant develop
covenants to maintain the integrity of the
property to retain as many trees as possible
on the property and to recommend exempting the
applicant from submitting the required soil

REVIEW Public Works Director Danielson advised the
Commission of the opening of I-494 at noon

Tandem Corporation, would like to meet with
the Commission at their December 15 meeting to
discuss his proposal for the southeast area of
the City. Mr. Danielson also gave a report of
cases that had been before the City Council.

The City was prevented from installing the sidewalk in Copperfield
Phas I this year because Northern States Power and Northwestern Bell Tele—
phon did not get their trenches repaired in time. Next spring the City's
cont actor will have to reprepare the subgrade for the sidewalk, and he will
also have to cut through some driveways that have now been installed in the
side alk area. The attached Change Order covers the added work involved for
inst lling the sidewalk next spring.

Staff recommends that Change Order No. 3 be approved.
REQUIRED•
If Council desires to implement the staff recommendation they should

Mr. Floyd Unruh, realtor, has been at the last three Planning Commis-
sion meetings presenting a proposed subdivision for the Houchens and
Ande son properties (see attached staff reports). These properties are two
larg lots located immediately north of the United Methodist Church site.
Appr val at the Planning Commission was delayed three months to allow Mr.�
Unr to complete his plan and to work but an acceptable street design that
woul accommodate the Ratchye property located immediately north of the
subd vision.
During the time of the subdivision approval, Mr. Houchens discovered
that he had $4800 in deferred assessments that were due and payable at the
time of his land sale. Adding interest to the assessment the amount in-
crea es to $10,176. Mr. Houchens is distressed by this assessment, because
it w s his understanding that at the time the assessment was levied back in
1970 the assessments were going to be abated (see attached letters). He
said he never received word that�they were deferred, not abated. He has now
aske that some consideration be given to reducing the assessment. I told
him hat staff could not do anything to change the assessment. If the
asse sment is to be changed, it needs to be done at the City Council level.
Some factors that figure on any decision are:
1. Mr. Siebell who sold the. property south of Mr. Houchens to the
Unit d Methodist Church also had deferred assessments from the same project
and as paid them in full.
2. Mr. Houchens was assessed for his full 200 feet of frontage along
Dodd Road for both sewer and watermains. The sewer only runs 75 feet in
fron of his property, also it is located on the opposite side of the road.
The ity Council could consider reducing the sewer assessment to be for only
the 5 feet constructed. His new assessment cost would then be:
Sewer $13.00 X 75 feet = $ 975.00
Water 11.00 X 200 feet = 2,200.00

month ago.
We then met with Mr. Ratchye who indicated his general concurrence
with the proposal which would allow for the development of two
additional lots on his property as previously discussed with the Planning
Commission. Mr. Ratchye indicated that he was going to review this
with his ex-wife who is a co-owner of the property. Hopefully, Mr.
Ratchye and his ex-wife will be at the Planning Commission hearing so
as to verify their attitude towards the revised plat.
We do not have in our hands, at this writing, a copy of the proposed
plat, but we have just received word by telephone from Mr. Jim
Danielson, Director of Public Works, that a revised plat has just been
submitted to his office. He indicates that the proposal that is now
drawn meets with his approval and that it is similar to that which we
had reviewed at the staff ineeting last week. Thus, it would appear
that with the revisions as now accomplished and the additional
engineering work as having been submitted to City Hall, that the
preliminary plat is now in a condition so as to merit positive
consideration by the Planning Commission and Council.
This has been a long arguous application process due principally to the
lack of sufficient engineering data and graphics having been prepared by
. the applicant. It is hoped that the process has now achieved a
workable solution that will produce good building lots for future citizens
of Mendota Heights under terrain and existing development conditions
which are some what unique.

Approval of Preliminary Plat
As you wili note fram aur sketch map attached, this property co�sists
af two tracts of 4.33 acres and 5.21 acres, totalling 9.54 acres.
Contiguaus to the southerly tract is ths new right-of-way for Wesley
Street, which will project from Dodd r'Zoad easierly to and Chrough the
Warrior Pond property, easterly of the property in question.
The two tracts were surveyed by John E. Swenson, a registered land
surveyar empioyed by MnDOT. ivir. Swenson surveyed the two tracts.
The layout of the praposed p1aC was done by Mr. Floyd Unruh. Mr.
Swenson prepared a center line gradient sheet for each of the two
cul-de-sacs, but was not requested ta da additional engineering ar a
grading plan as required by the subdivision regulatians. .
We are concerned about the grading of the cul-de-sac off Dodd Raad
because Che owner to the narth has zrtdicated his unwiliingttess to plai
additional lots on the north side of the 'proposed cul-de-sac. It wouid
appear that at least tw�.. additionai lats c4uld be so platied. Thus,
without cooperatian from the neighbor to the north, the grading of Chis
cul-de-sac will be crucial. The contours blown up � from the contour
map systern o€ fihe City indicate a ciifferenee �af . 14 feet from the
northeast side of the cul-de-sac to the southwest. If these contours are
correci, it wouid appear thai sorr�e reiaining walls will be required to
construct the cul-de-sac as indicated. In conversations with Mr.
Swensan, he suggests that on-site grades be obtained and that the
preliminary grade engineering be done as required by the ordinance.
The basic lot pattern proposed appears to wark. However, the lot line
dividing the lats occupied by the two existing houses would appear to
be considerably irnpraved if angled from the southwest to northeast,
rather than straight east and west as it now exists.
Mr, Danielsan, Public Works Director, is checking with the State of
Minnesata regarding the amount right-of-way that will be required for
additional dedicatian contiguous ta Trunk Highway 149 on the west side

of Che plat. The additional right-of-way was provided on the plat to
the south on the lot contiguous to Trunk Highway 149 (occupied by the
church). This shauld not be a significani problem.

appear that the basic platting praposal is workable.
7. An alternative to the cul-de-sac extending easterly from Dodd Raad is a
cul-de-sac extending northerly from Wesley to serve the westerly third
of the properties proposeci to be platted. Such a cul-de-sac, however,
would result in lots fronting on Dodd Road or lots with double frantage,
each of whieh is less desirabie than the two corner lots praposed in
this proposal. Though the neighbor to the north may object to the
eonstruction of a cui-de-sac, Mr. Danielsan infarms us that the City
could canstruct the cul-de-sac and defer the assessments affecting the
property to the narih until such time as the lats may be plattsd. We
understand also thai the house on the property to the north is not
currently served with public wa�er and sewer. Obviously, the
construction of the cul-de-sac as proposed in this plat would provide for
the availability of such utilities (for the existing house and two
potsntiai lois to the west�.

Mr. Floyd Unruh is working with Donald Mager, who is
pu chasing the Houchens and Anderson properties at 1870 and 1860
Do Road, for the purpose of subdividing and developing them.
Mr. Unruh has been in to see staff on many occasions in developing
the attached proposed subdivision. Staff has advised Mr. Unruh
eac time he has been in to retain a competent planner or surveyor
to ssist him in preparing the preliminary plat. Mr. Unruh has
bee reluctant to take staff's advice, and has prepared the
att ched drawings himself.
The lots all exceed the minimum size required by the zoning
ord'nance for the R-1 district. It appears as if Lots 10, 11, 13
and 14 do not meet the required 100 feet of frontage at the
bui ding setback line. They are, however, extremely large lots
and probably will not be a problem with future variances, except
the home on Lot 14 which will have to be set back substantially
fur her than normal to make setbacks.
PUB IC IMPROVEMENTS = STREETS:
Mager Lane is shown connecting to Dodd Road and a Mn/DOT
acc ss permit will need to be obtained. Wesley Court is shown to
con ect to Wesley Lane, east of where it is presently constructed,
how ver, the church has indicated to staff that they are in favor
of he Unruh proposal and would be willing to cooperate with the
ext nsion of Wesley Lane. The grades shown for both of the
pro osed streets do not have an adequate landing area where they
con ect to existing streets.
Staff is unsure of what future Highway Department right-of-
way requirements may be needed along Dodd Road. We have contacted
Mau een Jensen at Mn/DOT and she reports that the maximum needed
wou d be 33 feet, probably a much narrower amount will be required
and she is studying the needs further.

Utilities can be made available to all the lots with normal
con truction, however, sanitary sewer to serve Mager Lane will
nee to be run + or - 300 feet either north of the property or
sou h back to Wesley Lane.
ASS$SSMENTS:
There are deferred assessments against both the Houchen's and
And rson property. A method of payment will need to be arrived at
for bringing these assessments current.
The developer has not prepared a grading plan for the
sub ivision and although one is not specifically required by
Ord'nance, staff feels that it would be prudent to require the
dev loper to prepare one for this proposal. Mager Lane abuts some
und veloped property to the north and the grading of the area
cou d be a problem.
DEDICATION:
There are 16 new lots being proposed, therefore, according to
Cit Resolution, a$9,600 park contribution is required prior to
fin 1 plat approval.
REQUIRED:
Conduct a public hearing to consider this subdivision request
and based on input from the public and Commission, make a
rec mmendation to the City Council. .

The Planning Corcunission conducted a public hearing at their November
mee ing to consider a subdivision proposal from Ms. Carmen Swenson and two
of er neighbors (see attached sta£f inemos). �Brian Birch was the only
res dent at the meeting to speak against the proposal. He felt the lots
wer too small for the neighborhood.
Because of some problems with the City owned tax forfeit land along
Mar e Avenue, there were some options to consider (see staff inemo). Ms.

Carmen Swenson owns a large piece of property fronting an
Dod Road and Marie Avenue and has prepared the attached
sub ivisian proposal. The plan alsa includes two o� her
nei hbors who awn property on Willaw Lane.
Th� proposed subdivision has a creek running through the
mid le of it so many o� the newly created lots will need wetlands
pa its when they are developed. The plat cantains eight new lats
and three lots with existing structures. Al1 of the lots meet
min mum area and frontage requirements. .
The City acquired a small piece o� tax forfeit land that is

rol s and told tha applicant that it should be included as part of
the proposed plat.

We have since done further research an the steps needed to be

easy - the City can not sell or g�ve the property directly to
ne. If we want to release it, it will have ta be given back
he State and then the State will put it up for auctian, at

There are �everal options:
1. Readju�t the lot lines oE the three lots franting on
Marie so that they have the minimum requzred frontage and
can be developed without the City property included.
2. Keep the lot lines as they are. The City wotzlc3 turn back
the tax exempt praperty to the State for sale. Lot 3
would now be platted substandard with ultimate
develo�ment being made contir�gent upon succassful
acquis�.tian o�' the City's tax exempt property and adding
that praperty to lot 3.
3. City retain ownerShip of the tax forfeit property. The
lot 3 lat lines would be adjusted so that a home could be

canstructed totally an Iat 3. An agreement would be
arrived at stipulating that the Gity's tax forfeit land
would be maintained by the lat 3 owner and used as yard
area by them. Variances could then be granted �or lot

avaiZability of the tax farfeit land that is to be used
by the owner of lot 3. •
The attached materials camply with all the City's subdivision
ordinance requirem�nts with the exception of a tree survey and
soi3 survey. The Commission may wish ta consider exempting the
applicant from those two requirements because there will only be a
minimum of site grading accomplished to prepare this site for
develapment.

Approval of a Preliminary
Plat
The property in question consists of 5 existing parcels plus a 30 foot
street right-of-way originally dedicated for Spring Creek Road. We have
copied a portion of the section map on a scale of 1" = 200' to indicate
these original parcels. One of these parcels, north of the creek and
south of Marie Avenue at the immediate southeast intersection of Marie
Avenue and Dodd Road, is owned by the City having been acquired as a
tax forfeit parcel, we are so informed.
The proposal is to combine these 5 parcels and the existing right-of-way
into a preliminary plat which would produce a total of 11 lots, 3 of
which would be occupied by existing houses. The land is zoned R-1 for
which the minimum lot frontage is 100 feet and the minimum lots are
is 15,000 square feet.
The staff has met with the applicants and their engineering consultants,
Suburban Engineering Incorporated, a number of times reviewing possible
alternative methods of platting the property in question. Conferences
with the engineering staff and ourselves conclude that the development
as proposed represents the most logical method for dividing the land
efficiently, providing good housing sites for the 8 vacant lots and
accommodating the existing homes on good lots meeting the ordinance
requirements. The 11 lot sizes proposed are as follows:

4. There is some question as to how the City may handle the proposal to
plat Lot 3, a portion of which is owned by the City. Consultation with
the City Attorney may devise an appropriate method for putting this
land back on the tax rolls, if the plat is approved. The significant
change to the City owned property is the fact that a substantial portion
of the land is added to the existing parcel to the west with this plat,
thus, producing a lot area of 26,100 square feet.
S. The development of portions of the lois will require a modification
(variance) to the Wetlands Ordinance which establishes a standard of 100
feet of distance from a creek line to the nearest residential
development. The Public Works Director informs us, however, that in
this case the existing creek is confined to a fairly steep bank and that
the 30 foot easement proposed in the. plat would be adequate for
drainage purposes. �ualifications of the 100 foot standard should be
considered at this time as individual lots are proposed for development
and should not wait for the time of the preliminary plat reveiw.
6. The Public Works Director informs us that the method for supplying
sewer and water to the site is the most appropriate method under the
circumstances, as indicated on the second sheet of . the proposed
preliminary plat drawings. You will note that there is relatively little
grading required in the development of this parcel, the cul-de-sac having
been placed and proposed to be graded to minimize the impact on
existing grades. While the cul-de-sac will have an 8 percent grade, Mr.
Danielson informs us that the plan for grading is workable as presented.
7. The important achievement of the plat �is that 5 large and somewhat
difficult lots are combined so as to efficiently produce 11 housing sites
conforming to m nimum lot size and frontage requirements. As land
values become greater in the City and demand for buildable
single-family lots increases, we can anticipate more combinations of lots
proposed for division, as is the case in this proposal. In some cases,
some of the lots will be unusual, but highly developable with skilled site
planning of the type we often see in the City of Mendota Heights. It
would appear that the preliminary plat, as proposed, merits positive
consideration by the Planning Commission and Council, subject to any
concerns of which we are not aware at this time.

M. Frazell has requested that we briefly comment on the various plans
a sembled by Mr. Dobie that have been prepared and reviewed for the
p operties southeasterly of "Stratford Wood" existing subdivision. Our remarks
w re made to current considerations rather than to repeat our previous
r commendations on the initial submission and its numerous alternatives.
W received a courtesy call from John Voss yesterday prior to our receiving a
c py of his sketch plan. We agree that the basic problem is that "everybody
w nts to live on a cul-de-sac" and sometimes that results in forcing cul-de-sac
si uations where they do not necessarily provide the best solution. Whenever
a cul-de-sac solution results in a. double frontage lot, it is suggested that
ru ning the street through may be a better solution. One would not do that
if there is extreme terrain conditions that are solved by the cul-de-sac
so ution or if the- resultant traffic would be undesirable.

e tension of the street through Victoria to Walsh Avenue does not constitute a
a traffic problem. Obviously, the street goes nowhere--either to the west or
to �the east -- therefore, "through" traffic is not a factor. In this case,
h wever, it will be convenient for pedestrians particularly to travel east-west
th ough this part of the neighborhood. It is this internal circulation that is
at issue here. Without it, children and adults wishing to visit a neighbor
fr m each of the two subdivisions would have to walk around on Victoria,
so th to Kay Avenue or proceed northerly all the way to Marie Avenue. Why
w uld one propose this inefficiency on purpose?

is possible in any of the cul-de-sacs schemes to provide for a pedestrian
lkway from one cul-de-sac to the other. These, however, are abhorred by
ist homeowners as much as or more than those delighting in their residence
a cul-de-sac. Maintenance of such walkways are difficult and the public

t aveling along the contiguous side lot lines of the affected residences can be
a problem. In good planning, we attempt to achieve this internal neighborhood
c rculation without the use of such walkways where possible.
J hn Voss' cul-de-sac proposal will• work (as= do all the others) though it has
t e problem of the double frontage lots. The cul-de-sac exceeds the
aximum City standard accepted by all communities in this part of the
c untry (the same as our scheme ��2). From a design standpoint, the
d velopment of either scheme with a straight east-west cul-de-sac is less
d sirable than a curvilinear solution.
Nir. Voss summarizes on the second page of his letter that "the dual
c�l-de-sac olan, as � attacl�ed, would h�ve the advar�tage� of:
Higher value homes and lots created by the mor� private environment
and correspondingly higher taxes paid the to the City.
Greater security is created by a closed-end street system rather than a
through street.
There would be reduced traffic, slower traffic, and a safer environment
would be created for children living in the area:'

�bstantial homes that are not on cul-de-sacs, but still provide high quality
evelopment and living conditions.

hemselves to traffic on Walsh Avenue, Marie Avenue, Victoria, or Kay
�venue. It is that walk along some of these major thoroughfares which may,
i fact, be the most dangerous for children and adults. You will find that
edestrian traffic deaths in suburban areas relate principally to persons walking
long thoroughfares without sidewalks.
1r. Voss summarizes the City's interest in the next to the last paragraph in
is letter without commenting on these concerns. He correctly lists the
�gredients without comment on their impact. The fact is, those very
oncerns listed are the reasons for continuing the street through as was
riginally planned. The record will show that the plat was approved on the
ondition that the cul-de-sac be "temporary".

T e City and the developer have the right and the obligation to extend a
ri ht-of-way approved as a"stub street" which, in this case, provides the best
so ution. Even though that solution may cost slightly more, that should not
be the City's concern. The developer is willing to expend those funds.
T e bottom line is that there is a series of cul-de-sac solutions which can be
built. In this case, however, the best solution is to extend the roadway
th ough as was originally proposed. When completed, the neighbors will not
fi d it to be a traffic problem and the convenience of joining these two
po tions of the neighborhood will be readily accepted and understood by the
pr sent and future occupants of the lots on the roadway system in question.

SUB ECT: Sign Permit for IOS Office Building, 1031 Mendota
Heights Road
DIS USSION:
Council considered and approved a conditional use permit for
a p anned unit development on November 10, 1986 for the IOS site.
Par of this consideration and approval included a ground sign to
be ocated at their site entrance.
The sign is proposed to be located 43 feet from the east
pro erty line, 20 feet from the south property line, and 5 feet
fro the west edge of the access road to the site. (See attached
sit plan). The sign itself is proposed to be 9'8" high, 9'9"
wid , and 16" in depth (see attached drawing).
The sign base is 24" x 9'9", IOS part of the sign will be
3'9' x 9'9". The top part of the sign which is 3'9" x 9'9" will
be or identification of the occupants of a building to be
con tructed on the south portion of the recently divided property.
The concept of one sign for two tenants was discussed with staff
and Planner Dahlgren to eliminate two signs at the entrance to the
pro erty.
RECQMMENDATION:
� Staff recommends approval of the proposed sign and proposed
loc tion.

Staff has received an application, drawings, letter of
re est, and site plan from Midway Sign Company, Inc., on behalf
of Cherry Richline, to allow replacement of the existing sign on
th ir property.
The applicant was in to see staff and Planner Dahlgren and we
ag eed that we could see no problem with what was being proposed.
Th new sign will be placed in the same location on the existing
si n base which has been in place for quite some time. Council
ha approved the low profile type sign in the Industrial Park at a
re uced setback and staff sees no reason why this sign couldn't be
co sidered in the same light.
The applicant has explained all aspects of the sign in his
le ter of request (see attached).

We re submitting a sign permit for our customer, Cherry Richline, 2515
Pil t Knob Road.
The work we propose will make the new sign smaller, lower, and certainly more
att active than the existing sign. The existing sign has a deteriorating
, . dec rative wood facia, broken corrugated plastic faces and missing letters.
As ou can see by the copy of the photograph on the enclosed sheet, their
exi ting sign is located within a�rick planter that matches the building.
The sign's dimensions are 5'h' x 9' and is 3'6" above the planter.
The proposed sign is only 3' x 9', and would be only 24" above the planter.
The 9' dimension was retained to fit the existing supports. The material
wou d be baked enamel aluminum with molded plastic letters for "CHERRY-�
RIC LINE", and the rest of the copy would be painted directly onto the
sur ace. This change in copy and layout was requested by our customer's
cor orate headquarters.
As t now stands, the sign is a"nonconforming use", as it is too close to
the property line by today's regulations. At what point the sign was
ori inally installed, and under what conditions, I do not know. But in the
lat 70's/early 80's, the County took a large portion of front footage from
the property to improve and modify Pilot Knob Road (see Drawing #2). This,
in ffect, moved the property line toward the sign at least 22 feet. By the
Cou ty's drawings (see #1), theyindicated the sign structure was approximately
38' from the property line. As the sign now exists, the planter is only
18'/Z' from the curb. We respectfully ask the City to consider our request to
imp ove this existing sign as proposed.

DIS�USSION:
Council may recall that Lloyd's Food Products, Inc. was in
for Council building permit approval on August 5, 1986, subject to
sta f review af complete documents to expand the newly purchased
Pab t Meats building at 1455 Mendota Heights Road. Council
app oval was granted.
Since that time, a decision was made to reduce the size of
the expansion and to move the position of the a�ddition. • to the
nor h and east of the existing building, instead of to the west.
Bec use of the changes, staff felt it would be appropriate to have
Cou cil again review the proposed expansion.
The new drawings submitted are attached along with a letter
of equest for Council approval. Staff has reviewed the
pre iminary plans and they appear to be in compliance with code
and ordinance requirements.
REC MMENDATION:
Staff recommends Council approval of the building permit
sub ect to staff review of full plans and specs.
ON REQUIRED:
If Council wishes to implement the staff recommendation to
app ove the permit as requested, it should pass a motion approving
the requested building permit subject to staff final review.

Although Mendota Heights has always thought of itself as a

owners in Mendota Heights and Eagan are promoting this area as

Council is likely aware of recent discussion at School
District 197 regarding the possibility of reopening Mendota

� Banyon, a computer consultant recommended by Mr. Rodin, was
in late July to install the network software and assist us in
ip the total network system. Early in the process of setting
�twork, it was determined that the most efficient and effective
to fully implementing a networked system is to implement it in
.y small pieces over a period of time. For this reason Doug,

., expanding the network capabilities one or two computers at a

System Overview
There are eight personal computers connected through the
network: two in Engineering, one in Po1ic�, one in K�vin�s o�fice,
three in the general office and one in the Cierk'� office. The
City also awns two non-IBM computers, a MacIntosh used by Chief
Delmont and a Leading Edge, which are not cannected to the
network. Two af the computers, Shirley's and Kim's, are servers
far the system. A number of applicati.on pragrams have been
installed on Shirley's camputer for use at all of the computer
stations. Doug ha� prepared menu-driven network disks for each
camputer user so that each user can simply laad the disk and
easily access word processing and �preadsheet applications,
operating system utilities and a desktop organizer, and can �elect
the desired printer. A message baard is also now availab3.e, and
each user can communicate electronically with the other �tations
an the system. There are two word processing pragrams available
on the system, PFS Write and the network versa.on of Microsoft
Word. Everyone on the system is using PFS and the system
utilities very proficientiy, and as time allows we will train
sta�f in using Word and Lotus ].-2-3 and shared databases.
Financial and Utility Systems
Shirley has been spending as much time as possible entering
financial information into the NCS system. She has entered the
chart af accounts, vendor list, 1986 and 1987 budget figures and
1986 year-to-date accaunt and fund balances as af Se�atember 30th.
Once the trial balance has been run and verified against LOGIS
infarmation, she will enter October transactions and run parallel
with LOGIS through the end of the �ear. Kevin has natified LOGIS
of our intent to withdraw from their system. Al1 1987
transactions will be done thraugh the NCS system, and we will us�
LOGTS in 1987 only through completion of the thirteenth month
�accrtza3 and year-end adjustment} of the 1986 accounting cycle.
Progre�s an the utility system has been slower than
originally anticipated. The street index and acaaunt codes have
been entered into the system, billing entry and information
retrieval screens have been developed, and all af the residential
accounts have been entered into the system. What remain� to be
done is the most time-consuminr� activity - entering account
histories and billing infarmat�.on for all residential customers.
Our original estimate i.ndicated'that a minimum of 200 hours would
be needed to complete the tran�ition to the NCS system, but �---_
if entry of the re�idential account cades and property owners wa�
done externally, we would be able to begin to run �arallel with
LaGSS by September 1st. This has been an extraord�narily busy
year and Kim has nat had sufficient uninterrupted blacks of time
to dedicate to entering more than a small percentac�e of the
accaunt history in�ormation. Tt appears at this time that it will
be necessary to hire sameone for two to three weeks to relieve Kim
r�
fro her telephane, counter and permit responszbilities so that
she can work full-time on data entry.
The relationship of the NCS system to the netwark is anly
sli ht at this time. The utility system resides only on Kim'�
cam uter and the fund accountin�jpayroll elements reside only on
Shi ley's camputer. At thi� pa�nt neither Kim nor Shirley can
acc �s information in the elements not residing on their own
com uter. The network on my camputer hard-drive is set up so that
I h ve access by password to the complete NCS system. Within the
nex two weeks, we will define a structure to �rovide read-only
acc ss to information in the accounting and utility systems to
oth r sy�tem users.

DISQUSSION:
Comments have been made at City Council meetings about the
slo process of completing a moved-in house at 929 Chippewa.
Sta f would like to schedule Mike Clasen to attend a City
Cou cil meeting so Mr. Clasen can have a discussion with Council
on he progress or lack of progress on the moved-in house
reh bilitation.
The last complaints centered around openings in the
fou dation walls where the house moving beams were and the lack of
win ows in the basement walls. The fear is that children may
cra 1 into these openings and fall into the basement.
Perhaps a completion schedule could beAgreed upon and the
tim ng of this schedule of completion can be monitored by staff.
Staff has made numerous site visits and finds the following

such building, house or structure shall be removed to a depth
of 18 inches below the finished grade of the lot. The

days after such building, house or str.ucture is moved but in
al1 cases, until such wor.k has been completed, an appropriate
barricade shall be placed around all excavation and the area
must otherwise he maintained in a safe condition.
'ION 5. PERFORMANCE BOND

roof gutters and downspouts upon such building, house or

Grading and Sodding: Install or causP to be installed a finish
grade on al1 parts of the premises onto which such building,
house or structure is moved including the planting, or
installation of live sodd.ing on all pa�ts of the plot or parcel
involved.
Landsc:aping: Install or cause to be installed proper landscaping
upon the premises onto which such building, house or structure
is moved of a type and nature comparable to the landscaping in
the immediate neighborhood of the lot or property to which
such building, house or structure is moved.

5.6 Drainage: Construct and provide all necessary and pr_op�r
drainage upon the property upon which such builcling, hause
ar structure is to be si�uated in accardance wi�.h a plan
submitted by the applicant and appraved by �he City Code
Enforcement Officer.
5.7 General Construction: Update and imp.rove all plumbing, hea�.ing
and electrical PquipmPnt to meet then current speci.fica�ions
as set forth in �Ghe City Bui].ding Code as well as other
applicable ordinances..
SECTION 6. I55UANCE OF PERMIT
6.1 No building moving permi� shall be issued under the prava.sions
of this ordinance providing for the moving of a bui7.ding, house,
or s�ructu.re to a location within the carporate limits af �he
City of Mendata Heights unless and until the Code Enforcement

be declared by court to be invalid, the same shall not affect the
