KEARING -- CASE Mayar Lockwoad opened the meeting far the

Mr. Michael Kurtz, representing The Preserve,
stated that the August 5th hearing had been
cc�n�inued for resolution a�' the followi.ng
items: removal of one af the seven lots on the
east side a� the plat to create six 110 faot
wide lots; consideration af running the storm
sewer to We�ley Lane and installing a control
device an the pand; preparation of sail samples
to determine buildability of the site;
determination aver whether Warrior Drive shauld
be extended; and, preparation of nature
easemen�s around the pand. He stated that he
has not yet been able to prepare the nature
easements but will do so, and that the soil
testing has been completed.
In response to Cauncil questiansr Public Works
Director Danielson stated that whil.e he had
jus� received the soil report this evening, the
report appears to be favorable. He alsa
responded that the Wesley Lane storm �ewer
connection wiil work because oi the prapased
controlled out].et an the pond, and there should
be no basement flooding problems.
Respanding ta a question From Mayar Lockwaod,
Mr. Kurtz stated that he believes the
designation of a�scenic ea�ement will enhance
the praperty and has no objection to providing

the requested easement.
Councilmember Blesener noted that the staff
memo indicated that there might be reservations
over development of the six easterly lots. Mr.
Kurtz stated that he will have to deal with the
issue after the feasibility study is completed,
and commented that the terrain of the property
may not allow development.
With respect to Warrior Drive, Councilmember
Witt stated that she is wholly opposed to its
extension because she believes it would be a
real safety hazard. Councilmember Blesener
concurred and stated an extension would serve
little purpose other than to provide the six
lots with an outlet to Marie Avenue.
Mayor Lockwood asked for questions and comments
from the audience.
Mr. Larry Burtz, 1912 South Lane, stated that
he just purchased his home and had no
knowledge of the potential extension of South
Lane. He felt that if the road is constructed
as proposed he will have no front yard and
stated that if the street is constructed, it
will cut off his existing driveway. He felt
that the value of his home will be destroyed.
Mr. Burtz stated that while the development
site is beautiful and should provide nice
homesites, accomplishing the development will
destroy his property and that of the Petersons
west of him. He stated that the developer
should be able to come up with some other
alternative to avoid extending South Lane.
Ms. Marlys Zinnel, 1926 South Lane, stated that
she has heard the developer's comments about
the beautiful land and the beautiful homes
which will be built on a quiet cul-de-sac. She
further stated that in order to develop the
land Mr. Kurtz is proposing to take away a nice
quiet dead-end street to the detriment of
property owners in the neighborhood. She
pointed out that the three homes on South Lane
which will be affected by the proposal have
been in existence for 26 years and should be
given some special consideration -- some other

access should be developed.
There being no further questions or comments,
Councilmember Blesener moved that the hearing
be closed at 8:20 P.M.
Councilmember Cummins seconded the motion.
Councilmember Witt stated that she would like
to see if roads which will be constructed to
serve potential development of the Houchens and
Anderson property on Dodd Road could also serve
The Ponds rather than constructing South Lane.
Councilmember Blesener stated that she feels
the requested Comprehensive Plan amendment
would be appropriate because the type of use
of the property does not differ from
surrounding uses, but that Lots 3 and 4 are
inappropriately small and should be made
larger. She suggested Wesley Lane could be
shifted and 20 feet could be added to Lots 3
and 4 by reducing the sizes of Lots 14 through
18.
Mr. Kenneth Peterson, 645 North Freeway Road,
stated that he believes the South Lane
extension would destroy his property because it
would become a corner lot and informed Council
that he would go through adverse possession
over the proposed street area if the plat is
approved.
After discussion, Councilmember Cummins moved
approval of the preliminary plat subject
to incorporation of changes proposed for the
alignment of Wesley Lane and the shifting of
South Lane as much as possible to the west.
Councilmember Blesener seconded the motion.
Councilmember Cummins suggested that the
developer be asked to cooperate with Mr.
Peterson and Mr. Burtz to see if there are any
other alternatives available, and that if there
is no other viable alternative the developer
should work with those residents to provide
trees and screening to minimize the impact of
the street construction.

Councilmember Blesener moved adoption of
Resolution No. 86-77, "RESOLUTION AMENDING
CITY'S COMPREHENSIVE PLAN," to change the
designation of the property from RR to LR.
Mayor Lockwood seconded the motion.

rezoning should be made after the Metropolitan
Council's response to the plan amendment is
received.
CAS NO. 86-16, Mayor Lockwood opened the meeting for the
HAL EY purpose of a public hearing on an application
from Michael Halley for Comprehensive Plan
Amendment and subdivision.
Mr. Halley reviewed his proposal for the
development of the Wachtler property into 50
single family lots. He informed Council on
discussions held at Park and Planning
Commission meetings relating to the proposed
development and stated that the recommendations
of both Commissions have been incorporated into
the preliminary plat. Responding to a question
over Outlot B, Mr. Halley stated that his firm
hopes that the buyer of the adjoining lot will
also purchase the outlot.
Councilmember Witt asked whether there will be
a homeowners' association and who will maintain
the tot lot, and stated that the City has no
desire to create additional tot lots. She
felt that the street names might create
confusion because there are already streets
named Ivy Falls Avenue and Drive, and suggested
that the names within the plat be changed.
Mr. Halley stated that there will be an
association which will own and maintain the
lots on which a proposed play area is to be
located.
Councilmember Blesener stated that she believes
there is a need for play areas in the community
and that she disagrees with the Park
Commission's attitude on tot lots. She felt
that someone who lives perhaps two blocks from
the play area might wish to use it and would be
restricted if the area were privately owned.

Mayor Lackwaod asked for questions and comments
from the audience,
Mrs. Vicki Katz, 1855 Hunter Lane, asked
whether the iat sizes warrant the sale price
anticipated by the developer. Mr. Paul Katz
asked whether there is any guarantee on
the price o� the houses which will be
cgnstructed and whether there could be such a
stipulation.
Cauncilmember Cummins askedt�Mr. Halley had
prepared protective covenants �'or the plat and
requested a capy at such time as they are
prepared.
Councilmember Cummins stated that Council has
had a continuing concern in other neigY�.borhoods
where peopla are building very large hames on
�mall lots. He pointed out that in other
recent develapments, CounciS has reguested that
developers reduce the number o� lots and
increase iot sizes to eliminate variance
requests� for very large homes on lots on which
they do not fit. He stated that given the
price range af hom�s cantemplated by Mr. Halley
people will tencl to want ta build into the
setbacks and the beauty of the neighborhoad
will be reduced. He suggested that if four
lats were eliminated Mr. Iialley cauld create
19,pq0 �quare foot lots where there are now
15,000 square foot lots proposed and the
potential variance requests would be
eliminated.
Councilmember Blesener suggested that rather
than reconfiguring lot lines Council could
request a restrictive covenant requiring
greater sidelot setbacks.

Mr. Halley �tated that it has been his
experience that peaple are spending more money
per square �oot of structure but don't
necessarily build largc�r hames. He indicated
that if a client were to want to build a very
large home he could combine two lats and that
if a trend �or larger homes were to materialize
he would come back to Council with a request to
replat larger lots. xe stated that he

understands the concerns and would have no
problem with restrictive covenants as
suggested. He stated that while he wants to
cooperate with the City he has spent months
working with the City Commission and he
feels confident with the plat as proposed.
Council discussed the proposed access to Valley
Park and the play area.
Councilmember Cummins stated that while he does
not wish to discourage Mr. Halley, he has a
concern over lot sizes and the need to maintain
open space in developments. He asked that Mr.
Halley take those concerns into consideration
prior to consideration of the final plat.
There being no further questions or comments,
Councilmember Witt moved that the hearing be
closed at 10:06 P.M.
Mayor Lockwood seconded the motion.
Councilmember Witt moved approval of the
preliminary plat for Ivy Park subject to
changes suggested in the Public Works
Director's report dated September 9th and
consideration of the reconfiguration of lot
lines.
Councilmember Blesener seconded the motion.
Mayor Lockwood moved adoption of a Resolution
amending the City's Comprehensive Plan to
change the designation of the land from Park to
L-R.
Councilmember Blesener seconded the motion.
The motion failed for lack of 4/5ths vote.

Councilmember Cummins moved to reconsider the
prior motion.
Mayor Lockwood seconded the motion.
Councilmember Cummins moved to table action on
the proposed Comprehensive Plan amendment to

RECESS Mayor Lockwood called a recess at 10:15 P.M.
The meeting was reconvened at 10:25 P.M.
I.R. BONDS, Council acknowledged a memo from Treasurer
BAPTIST HOSPITAL Shaughnessy stating that bond counsel
FUND representing the Baptist Hospital Fund has not
completed the necessary final documents related
to the Funds request for Industrial Revenue
Financing. Discussion on the matter was tabled
to October 7th.
MENDAKOTA MALL The Council acknowledged a report from the City
Administrator informing Council that staff has
not received any further information from the
Hayber Group on the Mendakota Mall proposal and
recommending that discussion be tabled.
Council also received and discussed the options
contained in a legal opinion on the issue
prepared by Attorney Timothy Kuntz of the
LeVander Law Firm.
Mr. Lou Brenner, representing the Mendakota
Country Club, stated that neither comprehensive
plan amendment or rezoning is needed at this
time. He stated that what is necessary is some
type of indication by the Council that it likes
the Hayber proposal. He stated that Hayber
Group has no control over when it will receive
control of the property: if Council takes some
positive action Hayber will give Mendakota a
substantial letter of credit but only if
Mendakota goes forward with its clubhouse
development plans will the firm get the
property. He stated that the Club does not
want the rezoning unless the Hayber plan goes
through as it is proposed and that all that is
asked of the Council is a conditional approval
of the preliminary plan subject to all of
Council's concerns being resolved before
anything goes forward.
Councilmembers Blesener and Cummins pointed out
that there is an application for rezoning
pending and that Mr. Wenker indicated that a
commitment on rezoning was necessary. While
both indicated that they would not vote to
rezone, they indicated that they would be in
favor of preliminary plan approval if that is
all that is necessary to keep the project alive

Councilmember Blesener referenced a statement
in the Metropolitan Council Chair's transmittal
letter regarding retention of a recognized
acoustical specialist to certify building
plans. She expressed concern over how it can
be determined who is a recognized acoustical
expert and pointed out that there are very few
acoustical experts around.
After discussion, staff was directed to draft a
letter to the Metropolitan Council conveying
the concerns expressed in th� Administrator's
report and that�expressed by Councilmember
Blesener.
MEETING DATE Council acknowledged a memo from the City
CHANGE Administrator recommending the rescheduling of
the November 4th regular meeting because it
falls on Election Day.
NDC-4
It was the consensus of Council that the
regular meeting be rescheduled to Monday,
November lOth and that the Council convene as
Election Canvassing Board at 5:00 P.M. on
Thursday, November.6th.
Councilmember Cummins moved approval of the
NDC-4 budget for 1987.
CITY HALL Council 'acknowledged a memo from the City
ARCHITECT Administrator along with materials provided by
Lindberg Pierce, Inc. informing Council on the
firm's design experience.
Councilmember Blesener suggested that Council
should not be talking about selection of an
architect before it definitely makes a decision
on whether to build a City Hall and where to
build it.
It was Council consensus that articles
informing the community on the City Hall
construction issue be placed in the City's
newsletter and local papers.

Minutes of the Pre-Council Meeting
Held Tuesday, October 21, 1986
r Lockwood called the meeting to order at 7:00 P.M. for the
ose of a workshop on the Airport 150 planning effort. The
owing members were present: Mayor Lockwood, Councilmembers
ener, Cummins, Hartmann and Witt.
RT 150 Planner John Shardlow, present for the
HOP discussion, shared with the Council a memo
prepared by the Part 150 consultant to the
Metropolitan Airports Commission, concerning
land use management strategies. The memo
outlined possible mechanisms for resolving .
land use/aircraft noise incompatibilities.
Planner Shardlow then went over the memo
response that he had prepared for Planner Mark
Ryan of the Metropolitan Airports Commission.
Planner Shardlow indicated that the airport
will soon have a Part 150 plan approved by the
Federal Aviation Administration, which means
that it will be possible for the Commission and
surrounding communities to apply for federal
grants to assist in achieving aircraft/land use
compatibility. Potential grant applications
include house purchases, insulation programs,
etc. He said that the Airports Commission will
need a resolution of local support for the Part
150 program once it is adopted.
Planner Shardlow said that City staff had
suggested potential relocation areas to include
Rogers Road and the Furlong neighborhood.
After some discussion, there was a consensus of
the Council in favor of pursuing the
possibilities of federal funding for relocation
assistance. It was also suggested that at the
time of considering the resolution of support
for the Part 150 program, the City should hold

a public information meeting for the
potentially affected neighbors.
ADJOURN There being no further discussion at the
workshop, the meeting was adjourned to the
regular Council meeting at 7:35 P.M.

AUDIT Mr. Steve Laible, from Peat, Marwick, Mitchell,
was present to discuss the 1985 Audit Report.
Mr. Laible highlighted a number of items in the
� financial statement, legal compliance opinion,
and Federal Revenue Sharing compliance report.
As part of the discussion, Mr. Laible stated
that both the Engineering and Utility Enterprise
Funds had negative cash balances at year's end.
He suggested that Council consider making an
advance from the General Fund to the Utility
Fund to eliminate that fund's deficit. Mr.
Laible also responded to Council questions.
HUMANE SOCIETY Mr. Mike Shannon, of the Minnesota Valley Humane
Society, was present to request City financial
participation in the establishment of an animal
shelter in Dakota County. Mr. Shannon gave the

MINUTES, OCTOBER 14, 1986
The regular meeting of the Mendota Heights Park and
Rec eation Commission was held on Tuesday, October 14, 1986, in
the City Hall Council Chambers.
Members present: Chairman Stein, Doffing, Knittig, and
Lef ert. Absent and excused: Schneeman and Damberg. Resigned:
Sin er. Also present: Recreation Director Selander, Maintenance
Sup rvisor Blum, City Administrator Frazell, and Dick Putnam from
Tan em Corporation.
�/COPPERFIELD Mr. Dick Putnam of the Tandem Corporation, made
>ERTY a presentation concerning Phase II of the
Copperfield/King property and the park
dedication recommendation for this property.
After viewing the slide presentation and much
discussion, it was decided to refer this matter
to staff and our consultant, Barton-Aschman for
their consideration. It was suggested that this
item be included in our agenda for next month.

ON Recreation Director Selander gave the members an
update on the recreation program. Hiring of ice
rink attendants and scheduling of ice time were
discussed. It was suggested that an ad be
placed in the City's newsletter to secure
applicants for ice rink attendants.
Administrator Frazell is to see that this ad is
placed in the newsletter.
REPORT Terry Blum, park maintenance supervisor, gave a
report on the condition of City parks and
ball fields. He reported on the fertilization
of the ball fields and painting of the hockey
rink fences.

RES�GNATION
Chairman Stein gave the commission an update and
review of the Henry Sibley Park Study.
Chairman Stein announced that Commissioner Al
Singer had resigned, creating a vacancy on the
Park and Recreation Commission. Chairman Stein
asked that any recommendations for filling the
vacancy be mentioned to him and he would forward
the recommendation to the City Council.

HALLEY LAND Chairman Stein led a discussion and update of the
CORP. Halley Land Corporation proposal for park
dedication for their recent plat of Park Place on
the Wachtler property. -

ission was called to order by Chairman Morson at 7:31 o'clock

NO. 86-31, Chairman Morson called the meeting to order
., SUBDIVISION for the purpose of a continued public
hearing on an application from Mr. Donald
Mager, who proposes to subdivide the Houchen
and Anderson properties located at 1860 and
1870 Dodd Road. Mr. Floyd Unruh and Mr.
Brad Swenson, Engineer, were present for the
discussion and presented the Commission and
staff with revised drawings, noting that-the
plan was principally the same as last month,
except the northern cul-de-sac is shorter
and pulled back, with only a 3% grade. Mr.
Unruh noted that the eastern portion of the
site is the same as was presented in
September.
Chairman Morson expressed concern with the
6% grade and the sharp turn on the Wesley
Court cul=de-sac. Mr. Unruh responded that
grading is very possible on the cul-de-sac.
The Commission also discussed the grade on
the northern cul-de-sac. Mr. Unruh noted
that 17 feet is allowed for the possible
future widening of Dodd Road right-of-way.
The Commission noted that four lots on
Wesley Lane only have 95 feet of frontage,
,rather than the 100 feet required.
Commissioner Henning noted that preservation
of any trees is lacking and that should be
considered. He felt it was unfair to the
Commission to be asked for action at this
meeting, when the members had just received
the revised drawing at the meeting, and
there was no time to review it.

Mr. Unruh stated that four trees on the
upper and four trees on the lower cul-de-sac
will need removal.
Commissioner Henning expressed concern over
the lot widths. Chairman Morson stated that
he would like to see a grading plan for the
entire site.
Planner Dahlgren expressed concerns over
Lots 2, 3, 5, and 6, Block 2, that they were
well under the 100 foot of frontage at the
building line, and also that the northern
cul-de-sac only shows a 90 foot diameter
instead of 120 feet. He also felt that the
neighbors to the north, the Ratch�e's,
should have their concerns taken into
consideration. Planner Dahlgren felt it was
impossible to review this matter at the
meeting.
Chairman Morson asked for questions and
comments from the audience.
Mrs. Ratchye, 1844 Dodd Road, agreed with
Planner Dahlgren's comments as well as �
Commissioner Henning's comments. She felt
this matter was too rushed and asked for
more time for consideration.
There were no further comments from the
audience.
Chairman Morson felt there were too many
if's with the proposal, and Mr. Swenson, the
engineer, noted that he ran out of time in
preparin� for the meeting, even though staff
had provided him with a guideline to follow.
Commissioner Henning expressed concern with
the 20 foot width of the driveway and the
frontages of Lots 6, 7, 8, and 9, Block 1,
and the lack of a meeting with the
Ratchye's.
Mr. Unruh and Mr. Swenson were directed to
have their revised drawings in to staff and
the Commission at least a week ahead of the
meeting to allow time for review and also to
meet with the Ratchye's �rior to the next
Planning Commission meeting to hear their
concerns and possibly work with them.
There being no further discussion,

CAS NO. 86-36, PUMP Chairman Morson called the meeting to order
& M TER SERVICE, for the purpose of a public hearing on an
CUP - HEARING application from Pump & Meter Service for a
conditional use permit to install gasoline
pumps to the Tom Thumb Superette Store at
1944 Dodd Road.
Mr. Michael Eicker from Pump & Meter Service
and Mr. George Maye, representing Tom Thumb,
were present for the hearing. Mr. Eicker
noted that their proposal is to install a
retail, self-service facility at Tom Thumb,
with three underground storage tanks and two
fre�-standing pumps, with no attendant
required. Mr. Eicker asked several
questions regarding the staff report on
parking stalls and noted that the owner
would have no problem adding curbing to the
site, as required. He noted that the
produc�. price sign would be on the canopy
and the owner has no problem filling in the
ditchline referred to in the staff report.
It was noted that rezoning from B-2, which
is the current zoning of the property, to B-
4 would be required to allow for a motor
fuel station. The Commission members
expressed concern with the additional 17
feet of right-of-wa� that may be needed for
widening Dodd Road in the future. They also
noted that several major variances would
still be required even if the property were
rezoned to B-4.
Commissioner Henning asked the applicant to
submit a rezoninc� application, rather than
have the Commission ask the Council to
consider amending the B-2 zoning, or rezone
the property to B-4. That should be the
applicant's responsibility, not the
Commission;s responsibility.
Chairman Morson felt that this is not an
adequate site for their proposal.
Mr. Maye noted that he felt the existing B-2
district could be amended to allow the gas
station.
Commissioner McMonigal felt it would be

setting a precedent, and that bothered her.
Chairman Morson felt that the Commission
should reject the conditional use permit and
ask the Council to modify the B-2 zoning,
because the B-4 zoning district has too many
variances.
Planner Dahlgren noted that when the
applicants met with staff, they were advised
that the site is too small and that they
should drop the whole idea. He felt their
proposal would have a deleterious impact on
the residential neighborhood to the west.
Chairman Morson asked for questions and
comments from the audience.
Dr. Thomas Koepke, from the Mendota Heights
Animal Hospital, next door to Tom Thumb,
spoke noting that he felt it was a stupid
proposal and asking the Commission to walk
around behind Tom Thumb, noting the lack of
landscaping behind them, as compared to his
hospital and the Texaco Station. He noted
the weeds and garbage, and said they only do
minimal landscaping and lawn care, and he
felt they were not an asset to the
community. He also felt there was no sense
in having gas at Tom Thumb, which is right
next door to the Texaco Station. He asked
the Commission to vote no on their request.
Mr. Jerry Kafka, 1941 Dodd Road, spoke
noting that he appreciated Dr. Koepke's
comments, and added that he continually
cleans his yard from the Tom Thumb trash.
He felt they definitely were not good
neighbors and noted that his front yard is
lit up until 11:00 P.M. from lights at the
store. He questioned whether the pumps were
really necessary.
Mrs. Joan Kauf stated that she is annoyed
with the trash from Tom Thumb and she
doesn't need more trash or more pumps. She
felt it was stupid to put gas pumps there.
Mr. Richard Mullins, 781 Ridge Place agreed
with the other comments, and felt that more
parking spaces would be lost if pumps are
put in. He asked if the applicants had
talked to the Drycleaners or Video King
about their proposal. The applicants stated

Mr. Brian Birch, 755 Willow Lane, and the
landowner adjacent on the east side of the
subject property, gave a handout on the
City's ordinance requirements and pointed
out many violations of said ordinance if the
pumps were allowed.
Commissioner Burke noted that he had
received two phone calls in opposition to
the proposal. One was from Mr. Lloyd
Troeltzsch, 825 Hilltop, and the other was
from Mr. Tom Norman, 674 South Freeway Road.
There being no further c�{uestions or comments
from the audience, Commissioner Frank moved
to•close the public hearing at.8:53 o'clock
P.M.
Commissioner Henning seconded the motion.
Commissioner Henning moved to deny approval
of the conditional use permit.
Commissioner Frank seconded the motion.
Mr. Dale Glowa, United Properties, was
present to explain his variance request. He
apologized to the Commission for the lack of
a representative for this case at the
September meeting. He noted that the
proposed sign will be a temporary sales sign
to be located along the edge of I-494, and
asked for a 40 foot setb�ck variance and a
28 square foot sign area variance to allow
the sign to be 128 square feet in size. He
stated that the sign will be V-shaped, and
easily visible to traffic in both
directions. United Properties will be
responsible for maintenance of the sign, as
it will be in place for several years. The
sign will be non-illuminated, blue
background with whiLe/black lettering. Each
side of the sign will be 128 square feet.
Planner Dahlgren noted that the variance
would go with the site, and the sign is
proposed to be moved along the freeway. He
said if it is moved, it should be noted in
the variance that it should cover the entire
piece of land.
Planner Dahlgren suggested a more attractive

sign should be designed, although he had no
problem with the sign, he just felt it could
be more attractive, since it will be in
place a long time. It will be the most
prominent sign in the City and should be
better than two or three sheets of plywood.
Mr. Glowa stated that a more attractive sign
won't sell more land or attract better
tenants, and the cost of the proposed sign
is $1,500.
After further discussion, Commissioner Frank
moved approval of a 40 foot setback variance
and a 28 square foot sign area variance.
Commissioner McMonigal seconded the motion.
Commissioner Frank felt that United
Properties could do a better job with the
sign.
Planner Dahlgren suggested doing a take-off
on the permanent signs United has in place,
since they are a better quality.

CASE NO. 86-37, VAN, Mrs. Dorothy Van, 966 Smith Avenue, was
LOT SPLIT present to request approval of the division
of five lots into two lots. The property is
Lots 29 and 30, Posavad's Addition and the
West 1/2 of Lot 12, Springers Subdivision, on
Chippewa Avenue, behind 941 Delaware. The
proposed division would result in the
easterly lot containing 20,845 square feet
and the westerly lot having 15,108 square
feet. Thus both lots would meet the minimum
City requirements.
There being no questions or problems,
Commissioner McMonigal moved to waive the
public hearing requirement and to recommend
approval of the lot division as requested.

The asso iation uses City athleCic facilities at FrzendZy Hilis, Wentwarth
Paric and Ivy Fa11s Park. The gaal posts were installed an time, the fields
were mar ed as soon as it was physically gossible and were mawed and
re-marke at mid season. When one of the goal posts at Wentworth was
damaged 't was repaired immediately. If Che weather had been perfecC from
mid Sept. to mid Oct. I couldn't have asked for better service.
Cansider'ng the excessive rainfall in that CimE span, the service would
have to e considered superb. �
Terry B um and his cxew are to be commended. A21 of the work to put the
fields 'n �shape and keep them in shape was doae on time wi�hout the need
for any ne �o remind them of what needed to be done. If they handle the
remaind r of their work as well Chey are certainly an asset to our
communi y.

The specificat�ons for this truck were written around a 198b demo truck
MacQueen Equipment had on their lo�.. This was done for three reasons,
t we wanted to get a replacement truck in time far this winter's glawing
on. Second we had been informed that Ford was go3.ng �.o change engines
heir 1987 models and we did not want to the be guinea pigs for a new
ne if Fard was low bid. Finally we were led to believe we would be
n a very good price f or this demonstrator model. .
You wi11 notice that Bill Boyer Ford is the low bidder and their bid is
a new I9$7 Ford. He informs us tha� I9$7 Ford trucks are still being
manufactured with the caterpiller engines. Upon reviewing his �id we notice
that it did nat meet �he specificatians campletely, he omitted two options.
Also he wauld be unable to meet our delivery date. Boyer has since given us
prices for the options he omitted and still is the low bidder. .
Upon review of the situation s�aff now feels that we would prefer a new
19$7 model instead af the 1986 demo f or the fallowing reasons:
1. The demo has a twa way dump box. We have done further -research
on the two way dump bax and have found tha� some current awners
are not very pleased with them. One of the reasons is that there
are mare mechanical parts with the two way dump box causing the
possibility af mare mechanical failures. There are other rea�ans
therefore we now pref er ta have the ane way dump box.
2. We ques�ion buying a used vehicle (the demo we wrate specifica-
tions around) if we can get a brand new 29$7 model cheaper. We
thpught by buying a demo madel we could get a be�ter deal.
RECOMMENAATIQN:
Staff would prefer to reject all the bids and rebid the truck speci-
fying a 1987 madel. with a ane-way dump box. Staff will make the old In�Cer-
nati.onal go one more winter.

As�directed by Council, staff has scheduled a public
dis ussion and comment regarding the proposal for construction of
a C ty Hall as a part of this evening's agenda. Notice of this
opp rtunity has been included in the recently released issue of
the City Newsletter, Heights Highlites, as well as local general
cir ulation newspapers.
City Hall Committee Chair Stan Gustafson will begin the
dis ussion by giving a brief presentation of the City Hall
Co ittee, its findings and recommendation. Site plan and
bui ding schematics, as prepared by architects Lindberg Pierce,
wil be available for the presentation.
As the completion of Stan's remarks, Council will want to
ope the floor for a public discussion and comment on the
bro osal.

WHEREAS, Dorothy J. Van, owner of Lots 29 and 30, Posavad's
Addition and the West 1/2 of Lot 12, Springer's Subdivision,
Dakota County, Minnesota, has requested from the City to divide
off the East 19 feet of those lots and add it to P.I.N. 27-58500-
020-00; and
WHEREAS, the City Council has reviewed said lot division and
finds the same to be in order.

Approval of Lot Division
Attached is a copy of a survey indicating the proposed division of five
lots owned by Ms. Van. A home accupies the approximate easterly half
of these lots fronting on Delaware and located at 941 Delaware Avenue.
This home is occupied by Ms. Van's son.
She proposes to divide the five lots into two lots, moving the
north-south line dividing the two lots a distance of 19 feet to the west
from the center. This division would appear to result in a lot on the
easterly side (fronting on Delaware Avenue) with 130 feet of width and
a depth of 139 feet equalling 20,845 square feet. The minimum lot
size is 100 feet of frontage and a lot area of 15,000 square feet.
The westerly most lot would have a frontage of 15U feet and a depth
of approximately 101 feet, producing a lot area of 15,108 square feet.
Thus, the minimum lot width and lot area are maintained for both of
the proposed lots. - •
Mr. Danielson informs us that the recent improvements on Chippewa
Avenue included the construction of a service stub to the lot proposed
and that adequate municipal utilities are available for both lots. It
would appear than that there is no particular technical problem with
respect to the proposed lot division. •

Mr. Mike Cornick, 1176 Sibley Memorial Highway, lives along
TH 3 directly below the Lilydale Lexington Court Townhomes.
Sto water from the townhomes runs down the bluff and into his
bac yard and basement. He has been trying to get someone to take
som action to correct the problem all summer, but because there

I recently arranged a meeting between him, Bernie Weitzman,
Lil dale's Mississippi River WMO member, Kevin Frazell, and myself
on he site to survey the situation and discuss solutions. We
fou d that it is impossible to determine what the solution
alt rnatives are unless a study is done. Kevin and I promised to
do he study and Mr. Weitzman promised to get Lilydale to
coo erate in a solution.
The first step in studying runoff is to prepare a topo map.
The aerial photos the City has were all taken before the townhomes
wer constructed, so they are out of date. The two alternatives
to etting them updated are: ,.
1. To field survey them
2. Buy some aerial topos. (Martinez flew the site in 1985).
Mar inez could prepare topos from the 1985 aerial photos for $950.
For staff to field survey, the information would cost almost as
muc and we do not have the time available.
REC�MMENDATION:
Staff recommends that the City help Mr. Cornick find a
sol tion to his storm water problem. That study will cost about
$2, 00, $950 for aerial topography from Martinez and $1,000 for
sta f study.
REQUIRED:
If Council desires to implement the staff recommendation,
should pass a motion authorizing the study.

Fire Marshal, Paul Kaiser has determined that the Lexington Heights
tments need to have three more fire hydrants installed. One by each
ding (see map). According to St. Paul Water Utility there are three
ons to getting these hydrants installed:
1. Private Hydrants - In this case an extension of the fire line
from the building (metered water) would be run out of the building
to the new hydrant locations. These hydrants would be constructed
by and paid for totally by Mr. Riley the apartment owner.
2.� Private Watermain - In this case a private utility easement would
be created around the existing+fire line from where it connects to
the public main in Lexington Avenue up to where a new hydrant
would be installed. Then a private main agreement between Mr.
Riley and St. Paul Water Utility would be developed. Similar
arrangements to this are already in existence for Mendakota Golf
Course and Cray Research. All the costs for this construction
would be borne by the apartment owner, Mr. Riley.
3. Public Watermain - A public utility easement could be granted
' around the private fire line from Lexington Avenue up to where the
hydrants are to be installed. The City would then install the
hydrants and assess all costs back to the apartments over a period
of time.
Paul Kaiser-has been working with Mr. Riley over a long period of time,
�mpting to get him to install the required hydrants using either Alter-
�s 1 or 2 above. Mr. Riley now states that he would prefer to have the
� install the hydrants and have the costs assessed back to him. He has
�efore signed the attached petition for utilities and waiver of hearing.

Staff recommends that Council authorize the preparation of a feasi-
bi ity study, the first step in a public improvement project.

When Mn/DOT upgraded TH 149 in conjunction with I-494
con truction, they eliminated the Visitation Convent's driveway
acc ss on Dodd Road and provided them with a new access by means
of public street off Mendota Heights Road (Visitation Drive).
Tha street was later dedicated by Mn/DOT to the City.
Visitation feels the street intersection is too dark and has
hir d Hoffman Electric to install a street light. (See attached
dra ing). The light is proposed to be installed on public right-
of-�ay, so Council needs to grant permission to allow�it to be
the e.
REC�MMENDATION:
The entire costs for installation, maintenance, and monthly
ele tricity will be paid for by Visitation. Staff recommends that
Cou cil allow the light to be installed.

As outlined in the attached letter, representatives of Divine
Red emer have met with the mayors and managers of the nine cities
in heir service area to discuss alte�native pricing schedules.
At ur last meeting on Septemb�erl9, they indicated they would be
tak ng a look at eliminating the city-paid subsidy.
Apparently, they have now decided that they will eliminate
the subsidy�effective the first of 1987. Attached is a chart
sho ing the cost of their services, compared to those of other
Twi Cities area ambulance service providers. The first two lines
on he chart also compare their present charges (with city
sub idy) to the new charges without the subsidy.
In 1986, our subsidy payment to Divine Redeemer was $10,116.
For 1987, we have budgeted for up to $11,000.
REQUIRED:
If Council concurs with this proposal, I will so notify
Div ne Redeemer by letter, so that necessary amendments can be
mad in the service contract. If Council desires further
inf rmation, I could also invite representatives to a future
Cou cil meeting.

Divine Redeemer Memorial Hospital are planning to change our pricing schedule
for ambulance service to a tier level pricing system. Under this system, we
would charge a fixed fee for a given level of service . This would make pricing
easier for us and eliminate many lost charges that we have been experiencing.
Examples of this system are enclosed for your review. Also, please note that
our prices will be competitive with other ambulance services in the Metropolitan
area.
We will call you sometime during the week of October 27 to answer any questions
or discuss concerns you might have regarding this matter . If all works out as
anticipated, we will implement the new price system and eliminate the subsidies
for 1987.

Traffic Study
We have completed our review of the above referenced area of T.H. 13.
Our review centered on the capacity versus present volume at the following
three intersections:
1. T.H. 13 at Lexington Avenue.
2. T.H. 13 at I-35E West Ramps, including Victoria Road.
3. T.H. 13 at I-35E East Ramps.
The following is a summary of our findings at each of the,locations:
1. T.H. 13/Legington Avenue ,
The City has expressed an interest in developing an all-way stop at
this intersection.
We have reviewed the accident history at this intersection and it
does not indicate the need for an all-way stop. We also collected new
traffic counts for this intersection in May of this year. Our latest
counts show that there has been very little change in the traffic volumes
here since our last counts were taken in August of 1984. The counts
also verify that T.H. 13 has a much higher volume than Lexington Avenue.
The installation of stop signs for north and southbound T.H. 13 traffic
would greatly increase the total delay at this intersection.
I would like to emphasize that stop signs are used as a means to control
traffic, they are not necessarily a safety device. In fact, we would
actually expect to see an increase in total accidents at this intersection
if we installed stop signs for T.H. 13.
Given the above, we consider the present traffic control to be proper
at this intersection. �

T ere may be a ques�ion as to why the al2-way stop works at the west ramp
t rminal yet it wi11 not work here. The reason is simply because during
t e peak hours, the valumes appraaching the east ramp terminal from the
n rtheast is nearly double the volumes tha� approach the west ramp terminal
f om the southwest.

The ideal solution here would be to construct a southwest-bound left turn
lane and a northeast-bound right turn lane on T.H. 13 and signalize the
intersection. This work will be constructed under the project mentioned
earlier and presently scheduled for 1988. However, this work cannot
be done now due to inplace constraints which prevent widening T.H. 13
through this area. A signal at this location without the addition of the
left turn lane for southwest-bound traffic is not a viable option. One
left turning vehicle waiting for a gap in opposing traffic would completely
block the heavy southwest-bound traffic.
Therefore, we have determined that in order to provide the best overall
condition here, there should be no change in the present traffic control.

working with you on the resolution of these problems.

tha the surface of Wagon Wheel Trail was in an extremely bad
con ition and asked what the County planned to do about it. I
cal ed Larry Figgins, the Assistant Dakota County Engineer, and he
inf rmed me that Wagon Wheel Trail has been budgeted to receive an
ove lay in 1987. He also reminded me that it was scheduled to be
tur ed back to the City as soon as they could get the turnback
pol cy established.
