Mr. Lee was amenable to any suggestions that
were offered, and noted that the proposed
building is not for the ConferencelCenter,
which will be constructed behind tie

Planner Dahlgren noted that the Inclustrial
zone has no limitation on occupancy and
suggested that this requirement beldeleted
from City ordinances.

approval of amending Ordinance No. 401,
Section 11.1(4), by deleting the phrase "the

exceed fifty (50) persons and".

approval of a six foot height variance to
allow construction of a three story building
for Yorkton, Ltd.

CASE NO. 86-25, DOBIE,Chairman Morson called the meeting to order
SUBDIVISION & for the purpose of a public hearing to
WETLANDS PERMIT consider a- request from Mr. Terrence Dobie
for the subdivision of property in the
Rolling Green area, to be� known as Stratford
Woods.
Mr. Dobie was present to explain his
proposal to build 13 homes on approximately
8 acres. He noted that Stratford Road is
now a 600 foot dead-end and that his
proposal envisions it to be a 1350 foot long
through street. He explained that much of
his property is heavily wooded and rolling
terrain and is difficult to develop. He
sent out 52 letters to the surrounding
property owners explaining his proposal, and
received 3 written favorable responses and 2
phone messages preferring the cul-de-sac
proposal, which was his original intent. He
noted that after talking with staff and

Stratford Road as a through street.

can only be 500 feet long by Ordina�nce, and

over 1000 feet long and a variance would be
needed to allow the extra length. �

Commissioner Henning asked why a cul-de-sac
is only 500 feet long. Planner Dahlgren
explained the various reasons. Planner
Dahlgren also explained that Rolling Green
was platted with Stratford Road as a through
street and it was never intended to be a
cul-de-sac. He felt that the traffic impact
would be very small in either case.
Mr. Lee Houske, 975 Kay, asked for a
resolution of Outlot A also.
There being no further discussion,
Commissioner Frank moved to continue the
public hearing to the September 23 meeting.
Commissioner Krebsbach seconded the motion.

CASE NO. 86-16, Chairman Morson called the meeting to order
HALLEY, SUBDIVISION for the purpose of a continued public
hearing on the application from Mr. Michael
Halley for the subdivision of land known as
the Wachtler property. Mr. Halley noted
that the hearing had been continued from the
June 24 meeting when he was referred to the
Park and Recreation Commission to see what
their desire was as far as the property is
concerned. He stated that the Park
Commission decided that they were not
interested in the property as an active park
and that all of his lots meet the R-1
requirements. He also added that the five
northerly lots are 110 feet wide, as
requested by the abutting Cherry Hill
residents.
His first drawing contained 48 lots and the
revised drawing contains 49 lots, one of
which would be a double frontage lot. He
added that the northern cul-de-sac is 650
feet long.
Planner Dahlgren felt that the northern cul-
de-sac would be a mistake, and also noted
that there is no access to Valley Park to
the west.

of Farmdale and Wachtler, asked why a paved
walkway would not work, in lieu of�a "T"
intersection.
Mr. Halley stated he would agree to an
emergency vehicle access and paved�walking
area through a northerly lot and that the
lot would be developed as a tot lot. He
also stated that he would accommodate the
Commission's request for access somewhere to
Valley Park, but that he doesn't kriow
exactly where yet. �
Planner Dahlgren felt that a tot lot is not
clearly a need here, and he felt that a
person could use their back yard as a tot
lot. �

addressed.
Mr. Halley said the "T" intersection is fine
with him, but he is not interested in
discussing any park dedication. He will
work on the street issue and access to
Valley Park, but will not consider further
park dedication.
After further discussions, Commissioner
Henning withdrew his motion.
There being no further discussion,
Commissioner Frank moved to close the public
hearing at 10:00 P.M.

SYNOPSIS OF MONTHLY CALLS
�
The fire department responded to 28 calls during the month. There were 3
vehicle fires that results in an estimated $12,250 damage. On ;7uly 18, the
department was requested to standby while personnel from NSP tightened a valve on
a 150,000 gallon tank of liquid propane that was on the railroad tracks near
the Pool and Yacht Club. There were no problems with the procedure and the
department was congratulated on their professional response. On July 23, at
00:55, the department was dispatched to a report of a basement f ire. Upon
arrival, dense smoke was found pouring out of the garage. The fire was knocked
down and extinguished with minimal damage, estimated at $500 structure and $200
contents. Cause was determined to be a small ceramic kiln. �
SYNOPSIS OF MONTHLY TRAINING
Fire personnel were trained in the proper use of self contained breathing
apparatus with an actual hands on drill in a smoke�"iTTed house. Ths house
is currently bei.ng used as a drill house and we anticipate burning it down
some time in October.

Below is a list of all major equipment that is ope

1. 1946 GMC Jimmy pumper with a 500 gpm hale pump
foot extension ladder.

The 1960 C800 pumper with a 750 gpm waterous pum
foot extension ladder, and 4000 watt generator.
1970 Ford F900 pumper with 55 foot articulating
Squrt master stream device. This also has a 100
waterous pump, 3800 watt generator, and 30 foot
ladder.
4. A 1978 Ford L9000 pumper with a 1250 gpm water
a 5000 watt generator, and 30 foot extension 1
5. 1981 Ford L8000 tanker with a 1982 - 2000 gall
and a 1000 gallon drop tank.

Upo staff review, it was nated that there isn't any port�on of

TO THE PROJECT PURSUANT TO THE MINNESOTA
MUNICIPAL INDUSTRIAL DEVELOPMENT ACT AUTHORIZING
THE SUBMISSION OF AN APPLICATIO� FOR APPROVAL OF
THE PROJECT TO THE DEPARTMENT OF ENERGY AND ECONOMIC
DEVELOPMENT OF THE STATE OF MINNESOTA
AND AUTHORIZING THE PREPARATION OF
NECESSARY DOCUMENTS AND MATERIALS
IN CONNECTION WITH THE PROJECT
WHEREAS,
(a) The purpose of Chapter 474, Minnesota
St tutes, known as the Minnesota Municipal Industrial
De elopment Act (the "Act") as found and determined by th�
le islature is to promote the welfare of the state by the
active attraction and encouragement and development of ec�
ca ly sound industry and commerce to prevent so far as po
th emergence of blighted and marginal lands and areas of
chronic unemployment;
(b) Factors necessitating the active prom
a development of economically sound industry and commer
t e increasing concentration of population in the metropo
areas and the rapidly rising increase in the amount and c
g vernmental services required to meet the needs of the
i creased population and the need for development of land
w ich will provide an adequate tax base to finance these
i creased costs and access to employment opportunities fo

(c) The City Council of the City of Mend
H ights (the "City") has received from Stuart Lloyd
P rtnership, a Minnesota partnership (the "Company") a p
t at the City assist in financing a Project hereinafter
d scribed, through the issuance of a Revenue Bond or Bon
R venue 1Vote or Notes hereinafter referred to in this
r solution as "Revenue Bonds" pursuant to the Act;
(d) The City desires to facilitate the s

ta be located at 1455 Mendota Heights Road, at the intersection
o� Mendota Heights Road and Highway 13, in Mendota Heights anfl
cansists of the acquisition af land and an exa.sting building
and renovation and expansion thereof and installation of
equipment therein to be initially owned and operated by �he
Company, and will result a.n the emplayment of additianal
persons to work within the new facility;
{�) The City has been advised by representa-
tives of Company that conventional, commercial financing to pay
the capital cost af the Project is available,only on a limited
basis and at such high costs of borrowing that the ecanomic
feasibility o£ operating the Project would be significantly
reduced, but Company has also advised this Cauncil that �he
P�oject would not be undertaken but for �he availability of
indus�.rial band financing;
(g) Pursuant to a resolu�ion of �he City
Counczl adopted an August 5, 1986, a public hearing on the
Proj�ct was held an September 2, 1986, a£ter notice was
published, and ma�erials made avai.lable �ar public inspectian
a� the City Hall, all as required by Minnesota S�atu�es,
Section 474,Q1, Subdivisian 7b at which public hearing al1
those appearing who sa de�ired to speak were heard;
(h) Na public of£icial of the City has either a
direct or indirect financial interes� in the Project nor wil.l
any public af�ici.al either directly ar indirectly benefit
�9.nancially �rom the Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Mendata Heights, Minnesota, as follows:
1. The Council hereby gives preliminary approval to the
propasal of Company that the City undertake the Praject
pursuant to the Minnesota Municipal Industrial. Development Act
{C apter 474r Minnesata Statutes}, consis�ing af the acgu
si ion, renovation, construction and equipping of facilit
wi hin the City pursuant to Campany's specifications �uit
fo the operations described above to be initially owned
op rated by the Company and pursuant to a revenue agreeme
be ween the City and Company upon such terms and conditio
wi h provisions for revision �rom time to time as necessa
as ta praduce incame and revenues suf�icient �o payr when
th principal of and interest on the Revenue 8onds in the
ma imum aggreqate principal amount of $3,540,OQ4 �a be is
pursuant to the Act to finance the acquisition, construct
an equipping �f the Project; and said agreement rnay also
pravide for the entire interest o� Company therein to be
mortgaged to the purchaser of the Revenue Bonds; and the
hereby undertakes preliminarily to issue its Revenue Bond
accordance with such �erms and conditions;
2. On the basis of information available to this Co
i appears, and the Council hereby finds, that the Projec

c nnection with one or more revenue producing enterprises
e gaged in any business withiri the meaning of Subdivision

4. In accordance with Subdivision 7a of Section 474.01
Minnesota Statutes, the Mayor of the City a.s hereby authorized
and directed to submit the proposal for the Project to the
Authority requesting its approval., and o�her officers,
employees and agents of the City are hereby authorized to
pravide the Authority with such prelimi.nary in�ormatian as it
may require;
5. Company has agreed and it is hereby determined that
any and all costs incurred by �.he City in connection with the
financing of the Project whether or not �he Praject is carried
to completion and whether ar nat approved by the Authority will
be paid by Company;
6. Briggs and Morgan, Professional Associatian, actiny as
bond counsel, is authorized �o assist in the preparation and
review of necessary documents relating to the Project, to
consult with the City At�orney, Company and the purchaser of
the Revenue Bonds as to the ma�urities, interest rates and
other terms and provisions o� �.he Revenue Bonds and as ta the
covenants and ather pravisa.ons o� �he necessary documents and
ta submit such documan�.s'ta the Council for final approval;
7. Nothing in this resolution or in the documents pre-
pared pursuant hereto shall au�harize the expenditure of any
municipal funds on the Project other than the revenues derived
from the Project or atherwise gran�ed to the City for this
purpose. The Revenue Bond� �hall no� constitute a charge, lien
or encumbrance, legal ar equitable, upon any property or funds
of the City except the revenue and proceeds pledged to the
payment thereof, nor shall the City be subject to any liability
thereon. The ho].der o� �he Revenue Bonds shall never have the
right �o compel any exercise of the taxing power of the City to
pay the au�.stattding principal on the Revenue Bands or the
interest therean, ar to enforce payment thereof against any
praperty o� the City. The Revenue Bonds sha31 recite in
substance that the Revenue Bonds, including interest thereon,
is payable salely �ro:n the revenue and proceeds pledged ta the
payment thereof. The Revenue Bonds shall not constitute a debt
of the City within the meaning of any constitutional or
statutory limitation;
8. In an�icipation o£ the approval by the Authority the
issuance of the Revenue Bonds to finance all or a por�ian at
the Prajec�, and in order �hat completzon of the Project will
not be unduly delayed when approved, Company is hereby

At their August meeting, the Planning Commission conducted a
pub ic hearing to consider amending the City's Zoning Ordinance to
rem ve the 50 person maximum occupancy requirement from the B-1
zon (see attached memos). They also considered a six foot
bui ding height variance to Larry Lee's first building, which is
sch duled for construction this Fall. �
RECCIMMENDATION :
The Commission voted 5-1 to recommend amending the Zoning
Ord'nance and 6-0 to recommend granting the six foot building
hei ht variance. �

its entirety so that as amended said Section shall read

DIS�USSION:
Yorkton Ltd. has submitted drawings and has made application
in reparation for construction of a three story office building.
The present zoning of the site is B-1, which has a minimum lot
siz of 15,000 square feet. Yorkton's subdivision has lot sizes
wel in excess of the minimum size required. The occupant load
for an office building in a B-1 zone is limited to 50 persons.
Thi seems to be much too restrictive. Potentially, ever,y
bui ding within Larry Lee's subdivision will need a variance to
tha requirement. Staff suggests that the Commission and�Council
con ider changing that requirement by deleting the refereice to a

INT�RODUCTION :
Staff has been working with Ken Kerns, et al,of Yorkton Ltd.
on he development of a 48,000 square foot, three story office
bui ding with a full basement. This building is proposedlto be
bui t on Lot 6, Block 2, in the Centre Pointe South subdivision.
The lot is a corner lot bounded by Centre Pointe Boulevard on the
eas and STH No. 110 Frontage Road to the north (see site�plan).
DISCCUSSION:
� Staff has reviewed the plans and makes the following
co ents:
1.
The proposed driveway located near the NE cornerlof the
property is too close to the intersection of Centre
Pointe Blvd. and the TH110 Frontage Road. The developer
should work with engineering staff for an appropriate
access point. �
2. Additional storm water inlets should be added to
parking lot area.
3. The City does not have sewer and water available
site, but is going to recommend awarding a utili
contract for sewer and water at this meeting.

staff that a Corps Wetland Permit is needed. Mr� Lee has
applied for, but has not yet received that permi�.
5. The Planning Commission recommended approval of a six
foot variance to the height of the building and approval

DISICUSSION :
The City Council, at their last meeting, closed thewpublic
hea ing on this proposal and directed staff to prepare a�
res rictive covenant agreement with the Developer and the Golf
Cou se that would approve..the rezoning with certain contr,ols. The
Cit Attorney has prepared a draft of that agreenient and�it is
att ched.
Councilmember Blesener also stated that she had some separate
con erns. It was agreed that she and any other Councilmembers who
als had separate concerns would convey them to City staf�f before
the following Friday, so that the Developer could have th�em in
tim to prepare responses for this meeting. �
The concerns were received as follows:

Conditioned upon reasonable solution of perceived
lems:
1. Coordination with Mn/DOT as far as traffic, roadldesign,
driveway locations, right-of-way dedication.
2. Satisfactory PUD plan approved, including information on
financing, market feasibility, tenant commitments,

3. Commitment, other than just verbal, from Mendakota that
the new clubhouse will be built. �
4. Covenant reversing zoning to R-1 if Hayber doesn't build.

The City Council of the City of Mendota Heights, Minnesota,
ordains as follows:
Section 1. Ordinance No. 402 known and referred to as the
"Mendota Heights Zoning Ordinance" is hereby amended in the
follawing respects:
A. The fallowing described property situat�d in the City a�
Mendota Heights in Dakota County, Minnesata, is hereby
re�oned from R-1, One Family Residential District, as the
case may be to a B-�, Shopping Center, ta wit: (see
attached).
Sectian 2. The Zoning map o�' the City of Mendota Heights
referred to and de�cribed a.n said Ordinance Na. 401 as that
certain map entitled "Zoning Map of Mendota Heights" shall not be
published to shaw the aforesaid rezoning, but the City Clerk shall

In 1983, the Sons of Jacob Congregation were granted a
itional use permit to construct a synagogue at TH 110 Frontage
and Hunter Lane.' Their plans to build fell through and this
gogue was never constructed. Now that same congregation has
ed with another and is aga�in making plans to build. They are
known as the Beth Jacob Congregation. They held a land
cation ceremony several weeks ago and requested that the City
w them to erect a sign in conjunction with that event� This
was to be placed at approximately the same location as the
r sign that has been there for many years. Their signs do not
the City's minimum setback requirement and are 20 square feet
er than allowed in a residential area. �

Staff gave the synagogue permission to install the sign for
ceremony, but instructed them to apply for a variance to be�
ewed at the next Planning Commission meeting.
In their discussions with staff, the synagogue
�esentatives mentioned that they were intending to begin
truction of a new facility shortly and that they felttthat the
�iously granted CUP would cover this new facility construction.
'f reviewed the old permit (Resolution attached) and it does
appear as if the old permit will cover this new facil�ty. A
conditional use permit will need to be applied for.
ON REQUIRED:
Review the requested two variances with the applicant and
a recommendation to the City Council. The variances; are for

Earlier this year the City was denied payment by MSA�because
the final approval of the project plans were never processed. We
wer instructed that;the payment could not be made unless a
var ance was granted�from the rules.
A variance was applied for and I appeared before the Variance
Co ittee earlier this month�to make a presentation. The�attached
let er was just received, notifying us that we were successful and
a v riance has now been granted. �
REC MMENDATION:
In granting variances, it is standard procedure for the State
to equire that the City adopt a resolution holding the State
ha less. Staff has prepared that resolution and recommends that
the Council adopt it so that MSA can process the City's flnal
pa ent claim for $53,008.

would be added costs with a creek crossing. The total cost of
con�tructian, engineering, overhead, �'eas and contingencies, wauld
amount to $9345, or abaut $3115 per lot.
Option 3 for sana.tary sewer construction invalves hoaking up to
the existing line at Wachtler Avenue, and extending the lateral up
the Marie Avenue right of way, along the back af curb. Lat 4
would be served with a service sttxb from the existing line to the
east, This option would allow ail three houses to be full base-
ments, but it is considerably more expensive; the total cost
amounts to $13260, or about $4420 per lot.
The water utilities can be brought in from either Valley Curve
or Wachler, but the Va1.Iey Curve option is much cheaperr so it is
the only option proposed in this �easiblity report. The utilities
will consist of 3�xtra lang service lines, one for each 1ot that
needs service. A total. of 600' o�' 1-1/2" copper service line will
ba required, in additian to the private lines fram the houses.
The total estimated ca�t for construction, engineering, overhead
fees and contingencies for the water u.tilities is $10300, or
abaut $3433 per iot,

Staff has made a field inspection of the moved in house at
929 Chippewa and reports that the following items have been
com leted as of August 27, 1986: �
1. House has been wired and inspected by the electr`ical
inspector. �
2. Plumbing rough-ins, except for basement, have been
installed.
3. House moving beams have been removed.
4. House has been reroofed.
5. House foundation has been inspected and approved�.
6. Weeds on lot have been cut.
I believe that the only item which has been a topic of
dis ussion about this project is the fact that the foundation has
not been backfilled. Staff is aware that two or three sewer and
wat r contractors have been in to get information as to locations
for the sewer and water services. If the foundation were�
bac filled, it would be necessary to re-excavate for the �
ins allation of sewer and water. The contractor has now made
arr ngements with the City to have the utilities stubbed to his
pro erty in conjunction with the north end project and as' soon as
the utilities are stubbed in, the sewer and water lines w�ill be
bac filled, along with the house foundation. I
I have talked to Mike Clasen and he said that he wou�ld be
hap y to attend a future Council meeting and explain, in his own
wor s, the progress or to answer any questions that Counc�il may

After checking with our auditors, it was determined��that this

OF MENDOTA HEIGHTS AND DAKOTA COUNTY JOINT CABLE COMMISSION
The following agreement between the City of Mendota�Heights
an the Dakota County Joint Cable Commission (DCJCC) is for the
sole purpose of enabling the employee of the DCJCC to receive
pa roll disbursements through the City of Mendota Heights payroll
sys em. The agreement shall not be interpreted in any way as
re erence to the employees as an employee of the City of(Mendota
Hei hts. I

The City will perform the following functions:
1. Establish a separate and distinct Trust Fund on�the City
books through which all funds for disbursement are
accounted. I
2. Issue payroll checks through such fund on a biweekly
basis (or any other method consistent with all City
employees). �
3. Withhold and disburse all Federal, State and FICA taxes
payable through the special trust fund, and report sucli
earnings as required by State and Federal law. �
4. Issue to the Cable Commission and the employee the
necessary reporting forms for state and federalltaxes.
5. Record to the employees record such vacation and sick
leave time as stated in the employment agreement between
the Cable Commission<and the employees.
The Cable Commission agrees with the City as follows:;
1. Prior to the first Friday of each month to deliver to the
City funds representing the total salary to be disbursed
plus amounts equal to FICA taxes due during thelcalendar
month.
2. The Commission agrees to assume all payments due for
� health and disability insurance, workmen's compensation
insurance and unemployment insurance as well as�any
additional benefits accruing under its employment
• contract. The City of Mendota Heights understarids that
the Cable Commission will be responsible for direct
payments of disability and health insurance, unemployment
�
insurance and any other direct benefits. The City
further understands that as a result of being on the City
payroll, that workman's compensation insurance will be
covered through the City insurance and that the amount of
insurance shall be billed by the City to the Commission
annually.
3. Will hold the City harmless from all liability and claims
due its employees and the City agrees to act only as the
agent of the Commission in the disbursement of salaries
to the employees of the Commission.
4. As compensation to the City, the Commission agrees to pay
the City an annual fee of $25.00 representing the
approximate annual cost.to the..City to process payroll

RECOMMENDATION
Staff does not have a recommendation at this time. This
memo is an attempt to provide City Council with some options
regarding fences and fence permits. �

Study Alternatives and provide staff with direction as to
how City Council would like to handle the fence problem.
