Sectian 1. Recitals.
1.01. It has been proposed that the Ci�y modify
Increment Redevelopment llistrict c7a. 1(the "vistrict

"Plan"}, all pursuant to and in accardance with Minnes
S%atu%es, Sections 273.71 ta 273.78, both inclusive, a

1.02. The Council has investigated tlie facts and desires
to amend the Plan and modify the District by deletiny tiiree
parcels from the District and adding tnree parcels to the
District.
1.03. The City has taken all action required by law to ue
taken prior to the modification of the District and the
amendment of the Plan including, but not limited to,
notification of Dakota County and Independent Scnool Uistrict
No. 197 which have taxing jurisdiction over the llistrict, and
the holding of a public hearing, following published notice as
required by law. .
Section 2. Modification of Tax Increment Redevelopment ,
District No. 1 and Amendment of Tax Increment Financing Plan.
2.01 Appendix A to the Plan for the District, adopted
April 1, 1981, revised April "ll, 1981 and May 5, 1981, is
hereby amended as follows:
(a) Parcels numbered 45 and 46 on page A-3 (PIN:
27-48300-030-03 and 27-48300-040-03, res�ectively) (the
"Deleted Parcels") are hereby deleted from the District. The
Deleted Parcels total 4.2 acres in size (2.10 acres each), are
listed under property category A, and have a taxable value of
$9,456 each and have no structures located thereon.
(b) The following three parcels are hereby added to the
District and Appendix A: a). PIN 27-1910U-1y2-05, b) YIV
'`�"� 27-19100-194-05 and c) PIN 27-19100-195-US (hereinafter "Parcel
192-05", "Parcel 194-05", and "Parcel 195-05", respectively)
(collectively, the "New Parcels"). The i�ew Parcels have
current taxable values as follows: . Parcel 192-U5 -$2Ei, �£3U. ,
Parcel 194-05 -$37,410 and Parcel 195-OS -$38,988. The New
- Parcels total approxi.mately 3.8 acres in size: Parcel 192-U5 is
2.89 acres, Parcel 194-05 is .385 acres, and Parcel 195-05 is
.525 acres. The New Parcels shall be listed under YroNerty
• category A and have the following structures: Parcel 192-U5,
old barn used for furniture storage (Comcn.), Parcel 194-05, old
basement furniture showroom (Comm.) and Parcel 195-05, old
filling station and convenience store (Conun.)

Section 3. Findings for the Modification of Uis�rict and
Amendment of Plan. � .
3.01. The Council hereby finds that the modific tion of
the District and the amendment of the Plan is intende and, in
the judgment of this Council, its effect will be, to rovicie an
impetus for commercial development in the City, to in rease
employment and otherwise promote certain public purpo es and
accomplish certain objectives as specified in the Tax Increment
Financing Plan.
3.02. The Council hereby finds that after the a clitiori of '
the New Parcels to the District, the District qualifi s as d
redevelopment district as defined in Minnesota Statut s,
Section 273.73, Subd. 10 in that the followin� condit'ons
exist:
"70 percent of the parcels in tlze district
are occupied �by buildings, streets, utiliti
or other improvements and 20 percent ot ttie
buildings are structurally substandard and
additional 30 percent of the buildinys are
found to require substantial renovatioci or
clearance in order to remove such existing
conditions as: inadequate street layout,

overcrowding of buildings on the land,
exeessive dwelling unit density, obsolete
buildings not suitable for improvement or
conversion, or other identified hazards to '
the health, safety and general well being o
the community. "

Mr. C3ernard Biessen�r, one of th� Furldng petitioners,

asked that the Furlong utilities be installed at the
same time as the Lemay Lake improvements are
constructed. He stated that he does not want to be �
assessed for the drainage improvements and then be
told later that sewer end water pro�ect is too costly
and will not be installed. He asked that Council
conduct e feesibility hearing soon so that the
residents can be informed of potential assessments for
sewer and water.
Mr. Robert Tousignant felt that the increesed level of
Lemay Lake was caused by Mn/DOT improvements along
Highway 55 and.�suggest�d that when new T.H. 55 is .
built it will possibly increase the lake level as much�
as three to four times - which will necessitate
putting an outlet in Lake Augusta. He felt that
Mn/DOT is responsible £or the problem and should be
responsible £or the cost o£ drainsge improvements.
Members of the audience suggested that since the
increased lake level is adversely a£fecting only two
residential properties, the City should acquire those
properties rather than installing the storm sewer
system.

costs. In respon's� to a question from Mayor Lockwood,
he stated that a storm sewer system for the area is
ultimately essential.
Mayor Lockwood stated that several questions should be
considered: is there any technical reason why the
pro�ect must be completed this year, and if not, can
it wait until the Furlong area feasibility study and
hearing are completed; is diking feasible; is it
possible to buy the two homes which are immedietely
af€ected by the lake level. Councilmember Eilessener
esked what other long-range impact there would be i£
the two homes were acquired and the pro�ect was not
constructed at this time.
Councilmember Cummins asked what obligation the City
has to construct the drainage improvements: up to
what amount of money must the City spend to salvag�
two properties. He stated that hz has a problem with
spending 5187,000 for a storm sewer pro�ect if in fact
only•two residential prop�rties are benefitted.
Administretor Frazell stated that he believes
no reason why the City could not acquire the
properties as a public improvement pro�ect and
the costs but that at this time it is unknown

SYNOPSIS OF MONTHLY FIRE RUNS
The department responded to 22 calls during the month. The total property
damage dollar loss for Che month was $25,600. The first property damage
occurred on March 9, at 3:20 P.M. The department was called to a possible
structure fire at 724 Roundhill Road.� Upon arrival at the scene the department
found a compost pile on fire next to the residence. The fire did an estimated
$S00 damage and the cause was determined to be owner neglect. Apparently, the
owner had cleaned out hot ashes from the fireplace and dumped them on the compost
pile, thus causing combustion. The second major fire loss was to a semi-tractor
that was fully �involved upon arrival. This occurred on March 19th, in the
Sperry parking lot. As mentioned when the first pumper arrived, the tractor
portion of the semi was fully involved and the fire damage estimate was set at
$25,000.
' The fire department also responded to a hazardous chemical spill on March
13th at 12:50 P.M. This occurred at'Minnesota Knitting Mills. When the first
• engine arrived, the officer. in charge found that the police department had already
� started evacuation of the building. It was later determined by fir2figYi��rs ''�`"
=•=5 wearing self-contained breathing apparatus, that a fill spigot had broken off�
•_ of a 55 gallon drum of glacial acetic acid. A female employee had received acid
burns and was transported to the hospital. The fire department was on the scene
for approximately l� hours. Calls were made to Metro Waste, Chemtrek, and the
manufacturer of the chemical. West St. Paul Fire Chief and Assistant Chief also
responded for assistance. The situation was handled very well and without further
incident.
The fire department was dispatched to a smell of smoke in a building at
Lexington Heights apartments, 2330 South Lexington. When the department arrived
at midnight, the first men in discovered a concentration of smoke in the area of
:-r>::.� apartment 204. Upon further investigation and knocking at apartment 204, a tenant
was aroused. When entry was made into the apartment, it was discovered that food
had been left cooking on the stove while the tenant fell asleep. The department
. stayed on the scene for about an hour doing smoke extraction on the apartment.
SYNOPSIS OF MONTHLY TRAINING
The department had Mr. David Hawkins, a senior account representative with 3M,
come in and give a one hour presentation on the use of the Opticom System. The
training was very informative and some things that the men never knew were pointed
out to them in the proper use of Opticom. The second half of the training was
used in going over sprinklered buildings thar are in the City - how to use them
and how to cap sprinkler heads after the fire is out to prevent further water
damage. The monthly rescue drill was spent going over equipment on 2290 and the
cleaning of the equipment.

The bids for the Copperfield Phase I public improvement proj ct were
pened on April 8, 1986 at 10:00 A.M.. The Engineer's Estimate w s$418,000
nd there were 12 bidders on the project (see attached resolution .
As you can see, the bids came in approximately 13 percent un er esti-
ate. Orfei and Sons, Inc., the low bidder is a contractor that he City,
as worked with many times in the past. They have been an excell nt con-
ractor to work with.
ECOMI�ND ATION :
Staff recommends that the Council award the bid to Orfei and Sons, Inc.
or their low bid of $362,066.15.

� At this time, two of the�original parcels have been affected by the replatinc�
done by United Properties in tf�e industrill park. l�e would propose to formally
remove these two parcels totaling 4.2 acres.
There has been consideration of adding to the District the parcels in the
� northeast corner of TH 110 and Lexington. The objective of such addition of nrope
would be to facilitate development of the area N�hich is now occupied by substandar
, non-conforming use structures. They include the gas station, convenience store,
-=�. furniture building arid storage barn. The total area of the three parcels would be

3.8 acres. _ .
There has been discussions of redevelopment of the area, which would include
' renoval of the existing buildings and relocation of streets to uQgrade the area and
`:�::r: improve the Lexington/110 intersection. Some P1SA funds might be available to aid
;.�::�: in the Lexington improvements and if�added to the TID, the balance could come from
' Increment. .

Mr. Houchens and�his wife were out of town during the time th condi—

d rk about what was being planned. Staff has therefore met with t e
, H uchens on several occasions to explain the proposal. The Houche s are not
o posed to the church, however they are opposed to running the pub ic street
� a ong their property line and they are opposed to being assessed f r those
c sts. They have expressed their concern and comments to me as fo lows:
. l. The.Houchens feel that,the new City street should be cons ructed
a ong the Church's south property line. They have always planned o serve
t eir property by a'road constructed between them and the property to the
rth.
Staff proposed that the road be on the north side of the chur h because
w felt that the property along the south lot line would not benef t from a
n w road. The lots along the south line are large and could have new lot
d vided off in the back along a new road but those lots would be w de,
s allow lots only about 100 feet deep (see the attached map). Als the
M nnesota Department of Transportation was consulted because an ac ess
p rmit will be needed to connect the new City street with Dodd Roa . They
i dicated to us that they pref erred to have this new street access point at
t e north property line. The Houchens, however, pointed out that ight
d stances on Dodd Road would be greater if the south alignment wer used.
2. If the road does go on the_north lot line the Houchens be
t ey will not benefit and ask that the church pay for all the asse
T ey feel that the church property will not be on the tax rolls so

` 3. At the very least the Houchens feel that the church is forcing this
development and should dedicate all the right-of-way at no expense to them.

'. feel it would be a disaster to have to remove them for a ne�a street.

4. The Houchens feel as if they are being victimized by this new
development and ask thaC the minimum construction possible be done. They
feel that the church could°and should,be constructed with only a driveway _
access, no new City street. �- -
RECOI�II�IENDATION:
Staff is sympathetic with the Houchen's problem however we still feel
the best location for the street is along the north property line. '_
ACTION REQUIRED:'' � ' �
Conduct a public hearing.to consider the feasibility of�the proposed
project. Staff will be prepared to give an oral presentation the evening of
the hearing. Based on the outcome of this hearing if Council wishes to
proceed with the project they�should pass a motion adopting Resolution 86-

The Evergreen Knolls preliminary plat was given approval on N
82. Mr. Gryc, the major landowner then decided not to complete
tire plat all at once, so he applied for and was granted final a�
r Evergreen Knolls lst Addition in November 1984. This first a
cluded 24 of the originally approved 43 lots. The second addit'
cludes thirteen more lots with the remaining plat to be done at
te. Mr. Gryc desires to get this plat approved now so that sta

3. Redesign the curves to be closer �o the 30 m.p.h. minimu and resubmit
a new variance request.
Staff has redesigned the curves to be 26.83 m.p.h. curves. This is a
ixirnum sge�d that can b� accommadat�d requiring a minimum af ne��r right-of-
�y acquisition still allowing the homes to remain and a minimum 'mpact on
the surrounding driveways and yard drainage. Staff has discussed this new
design with MSA officials and they feel that the City would stand a very
good chance of having a variance granted with this new design. They have
found some examples of past cases where similar siL-uations occurred and �the
variances were granted. '
Staff has contacted Pine Bend Paving, the low bidder on the project and
they are willing to cooperate with the City and still honor their contract
with an award later this summer.
RECOMMENDATION:
Staff recommends that alternate number three be selected.
ACTION REQUIRED:
If Council concurs with the staff recommendation they should pass a

. Council•determined that a project was needed and ordered City staff ta prepare
. the plans and specifications to complete the work. There was some indecision on
whether.to install curb and gutiter throughout Che who7.e area, �.hat was caused
.�`:�: because of the uncertainty o,E how cos�Iy a ful� project would be. Staff was
� therefore ordered to prepare p7.ans tl�at included curb and gutter throughout and
retain Che option far deleeing curb and gutter from Hiawatha, Fremant, Garden and
EllEn.
� Bids were apened Pfarcl� ].l, 19$6, and ttte low bid was 15 percent bel.ow our
estimate. We feel tha.s low bid was due in par� to lower ail prices thus affect-
ing the bituminous cost, how�ver curU and gutter costs and storm sewer costs are
also lower than expected. The price per foor. for stree� that was esta.mated Co '
� $14.OQ in the feasibility report is now a� �1.0.40 per faoC, The price per squa.
foot of storm sewer that was estimated at �0.13 per square fooC is now �0.09 per
"�' - square foat. Staff feels thst these prices are very reasonable, and are recom-
. mending to the City Cauncil that they take advantage af the low prices an�i
praceed with the entire project. The Gouncil has r�viewed these costs and has

ISSUE I- Attached is a map showing the location of the contour lines as originally
developed. These are computer-generated and based on a model of geometric
diminishment of noise from the source. In other words, the mid-point of Zone 1
has the greatest noise, the mid-point�of Zone 2 half the noise, the mid-point
of Zone 3 one-quarter, and the mid-point of Zone 4 one-eighth.
The City has argued that the contour lines are not "fast and hard" but
should be used as guidelines, with discretion left to the local units to define
some more meaningful line. In this case, we have argued for Mendota Heights Road.
The Metropolitan Council staff has agreed that some amendment to the line might
be reasonable, but feels Mendota Heights Road to be too drastic. They have
pointed out that if the areas shown for School and Park actually end up single-
fam�ily, there is the potential for 200+ residences north of Mendota Heights Road,
but in Noise Zone 4. "
�::';'� This is a particularly important concern to the City, since staff feels that
implementing the noise attenuation and notification requiremerits would be difficule
in a single-family development. ' . ,
. ISSUE 2- It is presumed that interior noise reduction would be achieved through
special building standards (i.e., triple-glazed windows, baffled air ducts, etc.).
The City has previously raised several philosophical concerns, but I won't
reiterate those here. Our more immediate concern is how to enforce this provisio•
absent any existing technical standards.
As stated above, the Metropolitan Council has committed itself to development

ISSUE 3- Perhaps the most difficult:issue is whether and how new residents are
notified of the fact that they are moving into an aircraft noise zone. While the

they frankly have not been very helpful in suggesting a realistic program to
accomplish this goa1. They have committed themselves to designing a notification
and public relations program simultaneous to development of the model noise
ordinance.
Again, in the interim, we could r.equire the developer to present evidence of <;
notification program prior to approval of the'development.
ALTERNATIVES AND RECONM�NDATIONS
The last tirne this issue was before Council, you endorsed the staff suggestion
that we offer to revise our Plan amendment so as to r.equire developer certif-
ication of ineeting noise attenuation and notification requirements for multi-
family and office develo�ments south oF hfendota Heights Road. We would then not
concern ourselves with implementation of Che Guidelines in the single-family area;,
to Che north. 'Lt does not appear that Che Metr.opolitan Council will agree to that
appr.oach.

City staff continues to be very concerned about the practicality of
implementing the Guidelines north of Mendota Heights Road. As the Metro-
politan Council has committed itself to taking some leadership on this problem
by developing the model ordinance and notification program, City staff recommends
that we simply withdraw this portion of our Plan amendment at this time, taking
a"wait and see" attitude. At present, we have no development proposals for this
land anyway.
If Council concurs with that recommendation, we are left with the decision
of what to do about the lands south of Mendota Heights Road. Attached is
proposed Plan amendmenC language that has been developed by Planner John Shardlow,
City Attorney Hart, and me. Based on our extensive discussions with the Metro-
politan Council staff, it appears likely that the Council would approve this
language and allow us to proceed with implementation of developments in this area.
The other alternative would be to simply withdraw the unapproved

indicateci that they could deliver the equipment within two weeks from

We are planning on manually converting all o£ our accounting an�
utility in£ormation from LOGIS to our system -- a very lzngthy process
which we hope to complete before begin election planning in July. W�
are so concerned about early delivery o£ the equipment that I have
decided to write and place this memo be£ore you on Tuesday evening,
with only limited information Cwe have only to £irm propossls at this
time and two additional are anticipated by the middle of next week�, so
that the equipment'order does not need to be delayed until a£ter the
next meeting CMay 6th). '
Bob Rodin from NCS has given us a quotation of 5400 to completei;-
�.;.y.; install the system, including installing 'upgrades in the three exist3rT�::
`'.=' comput�rs. This i.s a considerably less expensive set-up charge than

The total cost of the computer system, NCS software, dBase and
Topview software, installation, treining and one year o£ maintenance r�:;
the hardware is estimated to be a maximum.of 552;000. We will make a
recommendation on network training and system maintenance at a later
date, but have included a very basic estimate. in the �52,U00 so that
Council might have a better idea of the total potentisl outlay.

I recommend that Council suthorize staff to order the necessary
computer equipment, networ1c components, peripherals and softwar� at e
price not to exceed the State contract cost of 533,700, from one or

system installation by Bob Rodin.

approves our recommendation and the date for computer delivery is no

week%of-the regular session. The bill, H.F. 418, had laid on the
table since �he adjournment..,of the Legislature the first-year of the

up the bill on the floor without notifying the affected public
employers or their associations. Within six days, the Le�islature
had p,assed the bill. Because �he Legislature didn't provide public

th Business Park. After some discussion, you unanimously approved the
re uested"street name changes, changing Transport Drive to Enterpri e Drive

Attached is an Ordinance providing for the name changes. Staff will post

on or near Transport Drive of the intended name change, and have al o notified

At the meeting of March 18, Councilme��er Cummins raised a ques ion about any
1 cal traffic�impacts from construction of the automobile distribu ion center
t be located in the City of Rosemount. As you may recall, this r ther large
f cility will receive shipments of new cars by rail, then distribu e them through-
o t'the upper midwest on the higfiway system. Councilmember Cummin questioned
w ether a significant amount of the truck traff ic from this develo ment would
f nd its way through Mendota Heights.
Planning Consultant to the developer is John Shardlow, of Dahl ren, Shardlow,
a d Uban, our City Planner. I have discussed Council's concerns w th Mr. Shardlow,
a d he assures me that there would be little to no traff ic impact n'Mendota
H ights. It is anticipated that there will be approximately 256 t uck trips per
d y in and out.of the center, and the primary routes would be alon County Road
4, TH 52�, and Cedar Avenue'. John feels that the only possible re son for any
o this traffic to find its way through Mendota Heights would be f r delivery
t car dealers located along Highway 110, and even that would be u likely or.
