certificates to the First Banks of St. Paul and
Minneapolis. '

Mayor Lockwood opened the meeting for the purpose o� e
public hearing on an application from St. Paul's
United,Methodist Church for conditional use permit
and variances to allow construction o£ e church on �he
esst side of Dodd Road, on�-half mile north of T.H.

Mr. Richard Haluptzok, from Buetow and Associates, was
present to represent the applicants. He stated that a
conditional use permit is required in order to
construct a church in an R-1 zoning district. Mr.
Haluptzok informed Council that the Church agrees to
dedicate a 60 £oot easement to the City f�r a new
street to be constructed on the north edge of the
property and has also agreed to grent a future
easement to Mn/DOT along the westerly property line,
ranging from 34 feet at the north edge to 17 £eet at
the south edge. He atated that it is planned that th�
westerly 2.9 acr�s o£ the site will be developed ae
church property and that the remainder o£ the property
will be platted into S single family lots at aome
future time. Mr. Haluptzok informed the Council thet
two variances are also requested: an 18 £o�t setback
varience on the north and south property lines and r
five £oot height variance to allow the church spire
height to be 42.5 feet.

decide to construct T.H. 149 on the al'gnment shown on
. the City maps, the easements which the church proposes
to dedicate to Mn/DOT might be inadequ te. Mr.
Danielson stated�that the right-o£-way which the
church has agre�d to dedicate would be edequste.

required. Mr. Danielson in£ormed Council that
the St. Thomas Academy and Touaignant properties and
two properties zoned B-1 and ad�acent to I-35E ere
af£ected by the proposed pro�ect. It,is proposed that
sewer•be assessed at 535.00 per £oot £or property
abutting the gravity sewer portion and that only the
Bisanz property be assessed for water. Of the
estimated 5133,000 pro�ect cost, it is proposed that
563,000 Ca portion of the lift station cost) be held
for £uture construction, and is estimated that the
Tousignant and St. Thomas properties be assessed
521,000 each for sanitary sewer and the other two
properties be assessed approximately �14,000 for
sewer:

Mr. Dave McCauley, the City's information management
MANAGEMENT system consultant, reviewed his report and .
recommendation on acquisition of so£tware and
hardware. Mr. McCauley informed the Council that, he
' and staf£ have met with representatives of CCSI,.Le^R,
Key Management and NCS and have been given .
demonstrations of the systems proposed by those�firms
in their bid proposals. He stated that after �
evaluations by staf£, additional consideration wss
given to the CCSI and NCS systems. He explained �he
differences in hardware con£igurations and price �or
the two systems. He explained that CCSI has�proposed
the use of s central proceasor CIBM,Systzm 36),�to
which the existing personal computers can be attached
, and that the bid £or so£tware, hardware and trairting
is 564,738. The NCS proposal uses networked micro-
computers: the bid price for the NCS software an�
training is 515,600. He pointed out that NCS�did nat
submit a bi.d £or hardware because the City can �
• purchase all of the necessary hardware through a Sta::•.e
purchasing contract at prices less than those which
NCS can offer. He estimated that hardware will cos�
approximately �40,000. '
Mr. McCauley stated that the software o£fered by t
two vendors appears to be o£ equal benefit and that
either system would satisfy the needs of the City.
He informed the Council that because of the differen-��
in cost and the lack of any ma�or advantege to the
CCSI system, he recommends that the�bid be awarded to
National Computer Systems CNCS) end that sta££ be
authorized to,solicit prices on hardware. -
Treasurer Shaughnessy recommended that Council
authorize an amendment to the 1986 capitol outlay
budget to re£lect a 550,000 increase for acquisition
o£ the system. He also recommended that if the
purchase is approved, the City should continue a levy
in 1987 and 1988 for computer service at the level
which the City would expect to pay LOGIS.

be awarded to National Computer Systems for their bid

Planner Phil Carlsan gave a brief backgraund resentation an the j
deve7.opment and history of Che south�ast area comprehensive plan ;
amendmen�. He indicated that the amendment i cludes severa]. i
guidelines for the southeast area: ;

2. Sensitivity to the natural terrain.
3. Encouragement of development on an appropriate scale for
the area, specifically limit of buildings to.24 units
except by conditional use permit.
4. Creation of opportunities for property ownership. With
regard to the latter, Planner Carlson indicated that wh ile,
. it was acceptable as a goal, it would not be legally enforce-
able as an absolute requirement.
Mr. Carlson then proceeded to discuss the proposed ordinances
wh ich he had prepared, which would implement the intents of the
southeast area plan amendment. � ..
He noted that the high density or R-3 district incorporated
language which had�the net effect of reducing the allowable
densities from 10 to 8 units per acre. He also said that the
ordinances incorporate a planned unit development process, which
allows the City additional flexibility and control in approving
rezoning and new development in the area. Included in the
ordinance amendments are four land use designations, low density
residential, medium density residential, high density residential,
and office. � '
The R-3 or multi-family district is an amendment of the existin�
R-3 district in the City. He pointed out language changes which
specify structures of two to 24 units, except by conditional use
permit, and a 150 unit limit on repetitive structures. He
added that such an amendment to the,R-3 district would apply to
any R-3 zoned property in the City, not just,in the southeast
area. '
Mr. Carlson noted that the amendment also adds a"conditional use"
of structures of 25 units or more. He said that the table of
lot area requirements per unit resulted in an average density of
8 units per acre. ' .
R-2,_or medium density residential,'is an amendment to the City's
existing duplex zone to accommodate the new MR designation for
the southeast area. The amendment changes this from a two unit'
district to uses of 2 to 24 units, and the table of unit to square
fo'ot area ratio results in a net density of approximately 4 units
per acre. R-1C, or low density residential, is a new zoning
district, somewhat similar to the large lot R-lA and R-1B
districts, but at a minimum density of 20,000 square feet per
lot. He said that.this zoning district had been created for
the Copperfield development in the southeast area of the City.
Next Planner Carlson described the ordinance amendments with
regard to the planned unit development district. He indicated
that it was similar to the existing PUD language in the zoning
code, except that it waives the minimum 10 acre requirement,

amendments proposed for the R-lA and R-1B distr ct. These
amendments merely correct some typographical er ors in exist-
ing language.
Commissioner Henning.questioned what the Commis ion was supposed
to accomplish this evening, and where all this anguage had come
from. He said�that he personally couldn't make any recommendation
on the ordinance, because the Council had inser ed a number of
amendments to the original southeast area conce't as approved
by the Planning Commission, and the Commission ad had nothing
to do with those changes.
Vice-Chairperson Morson responded that he though the purpose
was to consider ordinances which implement the i tent of the
southeast area plan amendment, and that language was before
the Commission this evening.
City Administrator Frazell also gave a presentat on on the
impacts and considerations of the Metropolitan C uncil's Guidelines
for Land Use Compatibility with Airport Noise. e reiterated
that•the Metropolitan Council had said they woul approve the
southeast area plan amendment when the City had rovided suff ic-
ient evidence to insure compliance with the Guid lines. He added
that City staff had had sev.eral discussions with the Metro-
politan Council staff, and had made significant rogress in
how this issue would be addressed, but still had not resolved
all of the issues. He said that while the Met C uncil would
like to enforce these Guidelines, it has never d ne all of the
background work�that it was supposed to do to ma e it, possible
for local governments to achieve such implementa ion. However,
he said that Met Council staff had indicated the would be
doing so in the next two to three months.
Vice-Chairperson Mor.son then asked for questionsland comments
from the audience.
Mr. Michael Thompson, representative of Condor C rporation,
2320 South Lexington Avenue, presented a letter ated March 20,
1986, which had been prepared by developer Jim R ley. Mr.
Thompson asked that the letter be entered into t e public hearing
record. That letter is attached and made a part of these
minutes as the public hearing record on this ite .
Commissioner Henning said that he felt the Plann ng Commission
was being used by the City Council, and that the really did
not have much say into the specifics of the ordi ance amendments.

Fal1. He said he felt like he was being asked to r.ubber
stamp Council preferences, and was not prepared to make the
changes at this time. He also questioned what had prompted
all of the specific numbers limiting things, such as the 24
unit buildings and the 150 unit repetitive structures.
Planner Carlson responded that the proposed zoning language

Commission could comment on whatever it felt would be

Planner Carlson reported that the 150 unit limit on repetitive
structures is probab.ly the least controversial. He said that
the 24 unit limit on buildings without a conditional use permit
was merely to create an opportunity for the City to review larger
structures. He said that the City of Burnsville has a similar
requirement, but on anything over 10 units. City Administrator
Frazell pointed out that the specific numbers referred to were
supposed to be "supporting guidelines" that.quantified how the
City intended to meet the goals and objectives of the south-
east area plan.
Mr. Thompson responded that he thought most of the restrictions
were put in in reaction to Condor Corporation's specific
proposal of 75 unit buildings.
City Administrator Frazell explained some wording changes which
City Atorney Tom Hart had proposed for the ordinances as
submitted by the City Planner's office.
Commissioner Krebsbach said that she would like to have more time
to study just what the changes in density would mean in terms
of quality for the development in the community. Vice-CYeairperson
Morson also noted that Commissioner Ultan Duggan had sent a
letter, requesting that action on the item be tabled until he
was present at the meeting. City Administrator Frazell respond-
ed that he saw no problem in delaying it for a month, since the
issue of the aircraft noise guidelines had yet to be worked out
with the Metropolitan Council. .
Commissioner Frank moved to continue the public hearing to the
April 22nd meeting.

Dr. Koepke said that during the day no one has to get in or out
of the building, and employees would be parkin in the rear. He
indicated that parking was not a problem at hi hospital, since

required parking spaces cited in the City staf report versus
the City Planner's report. Dr. Koepke noted t at not all of the

provision of the code similar to that for bank , which seemed
quite unreasonable, and suggested that the Cit Planner's use
of the standard office designation parking spa es was probably

takes her animals to Dr. Koepke`s office, and s never had a
parking problem,.since as he said it is only b appointment.

court in less than the 100 foot setback from Ro er's Lake shore-
line. ,
Mr. Johnson said that the sedimentation pond wo ld f ilter runoff
from the structure and parking lots before allo ing the overtlow
to go into Rogers Lake. He indicated that the ond and the
tennis court area would be heavily landscaped.
Commissioner Frank questioned why the proposed uilding was set
back so far from Mendota Heights Road. Mr. Joh son responded
that it was their intent to add an additional b ilding to the
front of the site at a later date:

Mr. Glowa said that United had done many other projects around
the metropolitan area with an 8�' parking stall width, and
indicated that it has worked quite well. He said that the
change goes with the changes in the size �of the average auto-
mobile. He also indicated that a ratio of 3.5 parking spaces
for each 1,000 square feet of office space was quite co�non
in,100� office developments.
Planner Carlson responded that the old standard of f ive
spaces per 1,000 square feet was coming down in most communities,
and that specif ic uses on a given property might justify further
reductions.

Commissioner Henning asked Mr. Erkilla if what they were trying

development in�the area. Mr. Thompson responded that while
this was not the kind of development Condor Corporation really
wanted to do, it�would be possible under the comprehensive plan
amendments. Mr. Erkilla added that it was not the best use of
the land because it does not preserve open space as well as
doing larger apartment buildings. .-
Planner Carlson responded that he did not see it as a really
serious proposal. Mr. Thompson said Mr. Riley would consider
it as a serious proposal if�he could not do anything.else with
the property. Planner Carlson said that the proposal perhaps
met two of the goals of the southeast area plan, waffled on a
third, but certainly did not meet the goal of sensitivity to
the natural terrain, since land usually had to be flattened
out to accommodate this kind of development.
Commissioner Henning asked if there would be any way the City
could prevent Condor Corporation from doing this kind of a
development if they submitted it. Planner Carlson responded
that while he was not an attorney, he feltthere probably would
be grounds to.deny the development on the basis that it lacked
any sensitivity to the natural terrain. Mr. Thompson responded
that Condor had been advised by legal counsel that they could
in fact, do such a development, and.that they thought the market
would accept these kind of units, even with the airport noise
and freeway impacts. .
Vice-Chairperson Morson responded that he did not see'it as a
serious offer either and asked the developer to present the
second plan.
The second plan as presented by Mr. Erkilla was for zoning at
the old R-3 density of approximately 10.5 units per acre. On
the entire parcel this would accommodate 1200 units. Mr.
Erkilla indicated that this proposal saves more green space and
existing vegetation. He also noted that they had not proposed
to use any building shape more than twice throughout the entire
development and that larger buildings would be placed on the
westerly part of the site, while the buildings got smaller to
th�e east. However, he said that the comprehensive plan amend-
ments as adopted by the Council would not allow this kind of
development, so an amendment would be necessary.
Mr. Thompson said that they would see this as a f ive to ten year
project, and while condominiums are not selling well right now,
if the market were ther.e for condominiums later, some of the
more easterly buildings might be owner-occupied, rather than
rental units.

This spring looks �o be busier than ever, with the Copperfi ld,
I orkton, United Me�.hodi�t Church, North End and LeMay projects a11 stacking
up. The field worlc generated by this canstruc�ion activity will be mpre
than enough to keep an intern busy.
The engineering department finished interviewing people for a summer
internship and has picked Greg Gund as the bes�. candida�e for th position.
Greg is a second year student of the St. Paui Technical Vocation 1 Instz-
tute. He has previous work experience working for Orr-Schelen-M yerson and
Associates on a survey crew and he is a resident af St. Paul. T e intern-
ship program will begin this Apri1 and carry through to the end i this
construction seasan. Greg's duties will include surveying, draf zng, pra-
ject inspection and miscellaneous engineering field work,

RESOLUTION APPROVING CONDITIONAL USE PERMIT
WHEREAS, on March 25, 1986, the Mendota Heights Planning Commission conducted
a public hearing relative to a conditional use permit application to allow con-
� struction of a garage addition to the Mendota Heights Animal Hospital, located
at 1938 Dodd Road; and • �
WHEREAS, said conditional use permit application was recommended for approval
• subject to Dr. Thomas Koepke locating the garage door so as to maximize the

Dr. Thomas Koepke, owner of the Mendota Heights,Animal Hospital 1938 Dodd
Road, has submitted plans for an expansion to his animal hospit 1 facility.
The proposed addition is to .be a 22'x34`:8" garage and storage s ace. The
hospital is allowed in a B-2 zone by a conditional use permit. Dr. Koepke's
original conditional use permit was granted and he added to the building in
1979 to allow construction of living quarters and garage on the site (see
attached resolution).
This type of facility is required by ordinance to have a inimum of
one parking space for each 200 square feet of floor area in the building.
With the proposed garage and present facility, the total buildi g contains
5,862 square feet. Therefore, a minimum of 30 parking spaces w'll be required.
The present conf iguration provides 14 or 15 parking spaces. With a garage
addition, the available parking spaces will be reduced to 10 sp ces.
Staff has observed Dr. Koepke's operation over the past fe years and has '
noticed that he has had ample parlcing for his operation. Howev r, we are j
concerned about further reducing the number of stalls. Because of the L-shaped �
building footprint, the two parking spaces adjacent to the gara e addition are �

of questionable use. Any one parking in the last space next to the garage add- ;
ition would have great difficulty in maneuvering out of his par ing space. �
Staff can see no encroachment of building setbacks on the

1. This property has 100.3 feet of frontage on the east side c
and is, as you � all know, accupied by the Mendota He
Hospital. The hospital was most recentiy added ta in the

clinic and haspital. Attached is a copy and a drawing il
site pian as it axisted and as it is proposed, along with
the floor plan of the proposed structure. Attached is a
resolution adopted by the City Counci! relating to the ap�

2. The current proposal is to construct a garage and storag facitity 22
feet by 34 feek 8 inches, equalling 762 square feet. Th s addition is
proposed to be added onto the south side af the structure, in iine with
the easterly end of the exisiing residence. The structure is added to
ihat partian af the residence accupied by an existing gara e. You will
note that the additian will be accessed by a garage and a pedestrian
doar. One of our concerns here is that Che garage door o ients directly
to a parking space so that if all the parking spaces are ccupied, it is
not possible to enter the garage doar. It would appear t at this could
be alteviated by simply moving the door further to the soca h end of the
structure, The propased addition meets aii requirements in terms af
setbacks, height, etc. The additiart will, however, reduce he amount of
parking thai was approved with the original addition. 7he parking
required for the structure is as listed in the following s ction of the
ordinance:

3. It appears from Dr. Koepke's site plan that the area af the rnedieal
facility is 3,210 square feet. Thus, in accordance with the required
parking space farmula, the medical facility would require 3 plus 6
spaces, ar about 9 spaces. It woutd appear that the site plan proposed
would provide for 9 spaces plus 1 in the garage. An additional space
would be possibie at the south end of the btrilding where there is IO
feet of space between the south end of the structure and the south end
of the existing parking area.
4. Observation an the part of the staff in the past few years has
indicated that, ta our knowledge, there seems to be no shortage of
parking at the site. Two parking spaces are required for the residence
so that the total required parking woutd be approximately 11 spaces.
5. Thus, it would appear that the propased addition meets the cade
requirements, unless portions af the garage and starage areas are
� � utilized in a manner more intensi�e than currently illustrated.

Because there were several outstanding questions about the con truction and

da e, they will have to reapply for a new wetlands permit.
The Commission voted unanimously to approve the wetlands permi as requested
by allas Development for construction of a sedimentation pond and s te grading as

2. The proposed structure conforms to zoning requirements, however, a
tennis court and an interim ponding area is located within t e 100 foot
setback required in the wetlands ordinance. The wetlands is of course,
the shore of Rogers Lake.
3. The tennis court is located at an angle, as you will

DIS�USSION
Members of Dallas Development Company have met with Planner Dahlgren
and staff over the past several months to develop a plan to cons ruct a
corporate headquarters for International Off ice Systems. The si e is located
on the north side of Mendota Heights Road, between I-35E and St. Thomas
Academy. The building has been located outside the required 100 foot wetlands
setback boundary, but there will need to be some cutting and fil ing within
the 100 foot wetlands boundary. The f illing is required to faci itate a
driveway to be constructed entirely around the building for emer ency vehicle
access. The cutting is to be done to construct a sedimentation ond for the
storm water drainage from the site. Staff requested that the de eloper pro-
vide the sedimentation pond to protect Rogers Lake from salt and sedimentation.
There is also a portion of a tennis court that is encroachi�g the 100 foot
tlands setback.
Staff feels that this is a minor wetlands permit and has no� ordered a
blic hearing.

Review the requested wetlands permit with the applicant, ta e action
waiving the public hearing requirement, and make a recommendatio to the
City Council.

1. The existing lot is question is 118 feet wide on Wentwort Avenue by
338 feet deep along Wachtler Avenue, comprising 0.91 acr . There is
an existing home on the north end of the lot, set back pproximately
35 feet from Wentworth, and 49 feet from Wachtler.
2. The property is zoned R-1, 15,000 square foot lot min mum. The
request is to split the lot in two, with the home remai ing on the
northerly lot, which will be 118' by 138', or 16,284 square feet. The
new southerly lot will be 118' by 200', or 23,600 square feet. Both
lots, clearly, will be larger than the minimum required.
3. The existing home will be set back approximately 75 fe t from the
proposed lot line to the south, which is more than adequ te for this
side yard condition. There is a 30' by 30' permanent util ty easement
along the Wachtler side of the existing lot. The proposed roperty line
between the two lots will roughly bisect this easemen , which is
desirable since it places the easement at the edge of each lot, not in
the middle.
5. We do not have detailed information on the topography f the erea,
particularly as it relates to the Wachtler frontage on the outhern lot,
but it is assumed that the grades are such that a driveway can be
constructed to serve this lot without great difficulty, if an when that
is proposed.

almo t entirely within a designated wetlands area. ;However, lots imm diately

allo ed construction of houses on the property. The land was platted prior to
adop ion of the City wetlands ordinance, and there does not appear to be any
reas n to preclude construction of homes on the platted lots.
The applicant intends to retain the natural slope to the back of the

The property has been assessed for the watermain which was
installed along V'andall many years ago. Aithough the property can be
served by .sanitary sewer lines along Third or Faurth Avenue�, there is
no sewer main in Vandall 5treet. Tt�is is an interior lot wa.th £rontag�
only an Vandall and there£ore ha� never been assessed for sanitary
sewer improvement�. I*fr. Wohi�outke has be?n in£armed tha� th� property
has nat been assessed for sewer end that it is City policy to require
connectian charge� at builciing permit issuance zn circumstancea such as
this. �
Tom Knutti•feels �hat th� property can best be serviced by
connecting into the Fourth Avenue sewer main which was installec3 in
19?O and assessect in 2�72 {Improvement No_ ?O, Pro�ect Nn. 3>. The
a�sessmen� rate for sanitary sewer under this p�o�ect wes S13.007 per
faat. The intere�t rate applied against the assessment xoi.l wa� 7i.
Based on these original rete� we have computed a connection charge of
52,357.55, which includes �1,187.55 in inter�st accummulated from the
da�e of asses�ment rall adoption through March 32st of this year.

SUBJECT: Case No. 86-07, United Properties, Request for Variance for Parking Stall Width
DISCUSSION
Mr. Dale Glowa, of United Properties, was in to see staff concerning the
construction of the final.two buildings in the Mendota Heights Business Center.
Cray Research will be the tenant for buildings 5 and 6, to be constructed this
year. Cray proposes to use these buildings entirely for off ice use. The original
plan was to have these buildings as off ice/service buildings. The parking at that
time was designed for a combination of'office and warehouse. With the proposal
of the buildings containing strictly�off ice use, the number of spaces falls short
of that which would be required�by ordinance.
The alternatives to providing the required parking are:
1. Filling in the pond feature and constructing a parking lot in that area.
2. Granting United's request and allowing 8� foot parking stall widths, rather
than the 9 foot width required by City Ordinance.
United has used 8z foot widths in a number of their other metro projects without
any problems.

You will recall that the City of Mendota Heights approve a planned
unit development for three structures at the northwest corner of
Northland Drive and Transport Drive, which is also direct y south of
Mendota Heights Road. The first structure (nearest the sout east corner
of the site) is a two-story structure to be occupied in to al by Crey
Research. They are now proposing to occupy the second s ructure and
possibly the third. Thus, these structures may be totally ffice space
rather than partially "office service". Accordingly, the Unit d Properties
people, represented by Dale J. Glowa, propose to stripe the parking lots
with an 8-1/2 foot width, rather than the required 9 feet n rmally used
in an office parking area. You will note from the attached letter from
United Properties dated March 12, � 1986, that they have tilized this
spacing in a number of other successful office areas in the win Cities.
We have no particular problem with the 8-1/2 foot parking idth for an
office park development; though, we would not recommend t for retail
parking purposes. -
2. In many communities today, allowances are made for up to 50 percent
of � the parking lot capacity to be in 8 foot stalls marked or compact
cars, with the remainder of the parking at 9 feet. Perhaps a
consistent 8-1/2 foot marking is simpler, achieving the sa e capacity
results.

congregated in large scale, requirements for parking have worked to as
(aw as 3.5 spaces per 1,OQ0. A recent survey that we conducted for
MEPC at the Gambte Center and Parkdale Office structures at the
squthwest carner of Highway 100 and Highway 12 produced a parking
need of 3.5 spaces per 1,000. This was a measurement of actual
parked cars serving completed and fuily occupied structures. You will
note that the locations mentioned in Mr. Giowa's Ietter af March 12 are
generally in areas where there is rnore mass transit available than in
the Mendata Heights Business Center. This may accaunt for some of
the reduction in parking need. Kevin Frazell, the City Manager,
infarms us that he has recently abtained a rerouting of the MTC bus
route �f19 ta now serve the Msndata Heights Business Center. 7hus,
there is at least a beginning af better transit service ta this part af
the City, effecting the parking needs for these and other structures in
the immediate area.

Late last year, United Properties had before Council consid ration to
change the name of Transport Drive to Enterprise Drive, and Carr'er Drive
to Executive Drive. Council•did not approve the changes at that time.
At the March 4 meeting, Council received a letter from Dale Glowa of
United Properties, requesting the opportunity to be placed on an upcoming
Council agenda for the purpose of discussing the requested stree name
changes. Council concurred in that request, and it is before yo for your
consideration this evening.
For your information, I am attaching an additional copy of nited's
letter of Februar.y 27, 1986. I understand that Mr. Dale Glowa o United
Properties will be present at the meeting.

o£ land w thin Mendota Heights have been for£eited. Two of the parcels
are locat.d within the Crown Point Addition and two in the Ivy ill Falls
Addition portions o£ the plat maps are attached).
The 'rimary City concern over sales of tax forfeited prope ty is the
collectio of assessments, both delinquent principal and_intere t and
outstandi•g assessment balances. The state atatute regulating sies o£
£or£eited.property, M.S. 282.01, stipulates that the minimum p rchase
price for a lot must be equel to or greater than 3ts sppra3sed elue.
Sale proc eds are diatributed to the community first if there a e
outstandi g assessments: proceeds remaining after payment to th City are
applied a ainst delinquent texzs. � .
The ounty has not yet performed appraisals on the £or:Eeit d Mendota
Heights p operties, but plans to do so in the near future. It eems
reasonabl to expect that the Crown Point lots will be appraise at a
value gre ter than the total assesaments Cplus delinquent asses ment
interest) which have been levied by the City. If the appraisal is less
than the ull amount of assessments and delinquent interest, th purchase
agreement provided by the County will stipulate that �the City w 11
reassess utstanding balances. There are no outstanding assesa ents
gainst t e Ivy Hill Falls lots.
Staf� can see no reason to recommend Council action to rec�.assify the

development. The Ivy Hill Falls lots are not developable and are totally
surrounded by Ramsey County Park property. It is not likely that they
will be purchesed under the forfeiture process. If thea� two lots are
not purchased, they will revert to State ownership and will continue to
remain as open space �ust as the lots which surround them.

to allow the sale of the properties under tax-forfeiture procedures.,
If Council concurs in the recommendation, it should pass a motion to

and authorize the Mayor to execute the Certificate of County Board of

he City has allowed this to happen•in•the past if.individual Hom owner's
greements were signed. I have modified one of those past Agreem nts.to apply I
to the Copperfield Subdivision.' That Agreement is attached for ur review and {
approval. ' �

Dick Putnam had not been made aware of the fact that the Ci would be �
�requiring the Agreements. He is particularly�concerned about the first clause �
which requires a$2000.00 escrow. The $2000.00 is an arbitrary a ount that was ;
established in the past. Staff would be comfortable with a lowe amount if
Council desires. We have never had to use any of these escrow funds in the past. i
The Homebuilder'�s Contractor is also required to supply.the City ith a$2000.00 i
bond. 1'his provides added protection to the City. ' �

At the March 24 meeting, Councilmember Cummins brought forth e request
h had had from a Mendota Heights citizen, concerning the potentia elimination
of MTC bus.route 4�29. Route ��29 provides Saturday, Sunday and;hol' ay service
fr m the Mendota Plaza with connections to Signal Hills and to down own St.
Pa 1. The matter had been brought to Councilmember Cummins attenti n by Mr.
Ha ry Fredkove, f rom Friendly Hills, who is one of the riders of th t service.
Attached is�the notice�from the MTC that they are considering li.mination
of this�route. As you can see in their analysis, ridership�on Rout ��29 is
ex remely:low, resulting in�an extremely high subsidy per passenger.
I have discussed this situation with route planners for the MT , and it
do s not appear that there are any readily available alternatives. I have also
sp ken with the coordinator for�the Minnesota Rideshare Program, St phanie
0' rien (349=7539), but Ms. 0'Brien informs me that she is not awar of any
po ential weekend carpools'from Mendota Heights to downtown St. Pau .
We can all sympathize with.Mr. Fredkove.'s dilemma. However, i does not
ap ear that it is�economically viable to provide any kind of public transit
se vice on weekends and holidays from Mendota Heights to downtown S..Paul.�
Th refore, those wishing.to,make such a trip will have to rely on p ivate
tr nsportation alternatives. ,

II. BACKGROUND ` ' '
The MTC is operating a number of weekend services with per pas en.ger
subsidies significantly higher than our guidelines allow (see able ��
in Section III). The average subsidy per passenger exceeds $5.00 {
for the five routes in question. With the exception of Rr�ute 7, �
all the services are new within the last year.�� They are showi g no �.
sign of ridership growth despite marketing efforts.: Rc�ute 27 S day -
service has been operated�for many years. It is a traditional poor�

Scheduling concludes`_that there are no viable rescheduling or r routing
alternatives.� Along with Rr�utes 37; 39, and 54, they make up t e
worst services in the MTC system and should be curtailed.
