GREENHOUSE Mr. Robert Larson was present to request app oval of a building
permit to allow construction of new greenhou e facilities at the
present greenhouse location. The Council ac nowledged receipt
of a memo from the City Planner recommending approval of the
permit conditioned upon conformance with all of the appropriate
setbacks.

on the west side of the present structure to house a compressor

At the September 21 Budget hearing discussion, a considerabl amount of
t'me was spent discussing the need and conditions relating to sha e tree
d'sease control. The resolution was to direct staff to prepare a program for
f ther consideratior_. This memo then shall constitute a respons to the
p evious request. It is based on a considerable amount of input rom
J hn Neska and Harvey Franzmeier, our certified tree inspectors, rom
L rry Shaughnessy as an interested citizen and finance expert, an further
d'scussions with the State Departr.tent of Agriculture. Attached a e three
s parate memos from John Neska addressing to the following topics
A. Future outlook on Lhe Dutch Elm Disease epidemic in
Mendota Heights;
B. Projections on cost of Lignason injections in City
park areas;
C. Reforestation program in biendota Heights.

Reference is made to the planning report prepared for the Aug�
mee.ting of the Planning Commission, which report outlines man�
the basic elements of the proposal. At that meeting of the Py
Commission, the applicant appeared informally (it was not an
advertised public hearing) and generally explained their propc
Some residents of the neighborhood were present.
Some suggestions and expressions of concern on the part of thE
neighbors and the members of the Planning Commision v�ere brouc
out at�that meeting. The applicants agreed to consider these
ideas in the preparation of a revised site plan to be presentE
at the nublic hearing scheduled for this meeting of the Plann-
Commission. (This meeting of the Planning Commission will be
September 28th.) Items suggested for review were:
a. Acquisition of residence - As noted in our earlier report
we feel that the potential isolation of the lJilliam and
Catherine Mo7vihi1l property at the immediate corner of
Hunter Lane and Highway 110, is a matter of considerable
concern. L�le suggest that the acquisition of this home
on some kind of contract basis would be highly desirable
from the siandpoint of both parties. We are concerned
. about the permanent isolation of ihe home at ihe
immediate intersection of Highway 110 service road and
•'>• Hunter Lane.
-''�t�.-� Access via 110 Service Road - The residential property
r�;�:t:;s�:�x owners immediately west of Hunter Lane (across the street
;, from the proposed parking lot) expressed concern about
� traffic coming into Hunter Lane and proceeding north and
-..south from the parking area. It was-suggested at the mee�
that permanent access to the parking area should be
constructed via a drivetNay directly to the existing 110
service road. This eliminates access directly off of
Hunter Lane, thereby improving the conditions for single
family residential development in this area of Hunter Lan
The applicant agreed to consider this as part of their
revised plan.

3 We have not heard from members of the congregation regardinq
status of any revised plan to be presented before the Plannin
Commission hearing. We suggest that development of the proqe
in question, as a religious center, is an appropriate use und
the right conditions. General.conditions should be that it d
not have a permanent deleterious affect upon existing single
development in the area, and that the traffic to and from the
parking area be accommodated in a manner so as to minimize th
of traffic in and around the residential district of which th
proposed center is a oart.
4 Houses of worship are traditionally listed as permitted or coi
uses in single family residential zones in this country. The
have consistently ruled in favor of such religious institutioi
7ocate in residential areas. The courts do recognize, howeve�
City's right to review the conditions under which such structi
are approved for development within their communities. In th�
case, we suggest that the conditions should be carefully revi�
and that the applicant be encouraged to consider the suggesti�
offered at the last Planning Commission meeting. In �he even�
attempt is made to consider revisions to satisfy the conditioi
out7ined, the Planning Commission would have the option of
recommending denial of the Conditional Use Permit•or the acce�
of the permit with appropriate conditions recommended by the
Planning Commission.

The applicant is a Jewish congregation (Sons of Jacob) who prop se to
move their synagogue from St. Paul to Mendota Heights. They a
accordingly seeking approval of a conditiona7 use permit for th
construction of the synaaogue on the property in question.
The h1endota Heights Ordinance lists churches (presumed to inclu
synagogues) as a conditional use in R-1 Zones. Most communitie
the country include churches and synagogues as permitted or con
uses. The courts in the country have consistently ruled that s
structures must be allowed in single family area, but may be su
reasonable conditions imposed by the City.
We have met on numerous occassions during the �ast six months w
representatives of the applicant to discussing site conditions,
and other code requirements, and site planning requirements.

One of the requirements to the Ordinance is that all structures
located more than 50 fieet from contiguous single family areas.
The applicants in this case propose to locate the structure 70
east of the existing house owned by William and Catherine Molvi
at the immediate corner of Hunter Lane and Highway 110. The st
will be located 103 feet north of the existing right-of-way for
Highway 110 which would be at least 55 feet away from the proje
expanded right-of-t�vay north of 110 as will show on the proposed
plan and drawings.

near the road is an office and maintenance building.

We have met with Mr. Sweeney and other representatives of the d ocese
and representatives of the Acme M�rble and Granite Company to r view
the proposed development which consists of the construction of
mausoleum on the westerly side of the property fronting on Lexi gton
Avenue. The mausoleum will be a marble, concrete and steel str cture
consisting of 13,164 square feet to be built on the site approx mately
1,200 feet west of Lexington Avenue. Reduczd copies of the sit
plan accompany this report indicating the proposed location wit in
the recently graded cemetery site. Large scale plans of the pr posed
structure will be available at the public hearing for more deta�led
examination.
-The mauso7eum consists of a memorial chapel, and space designed
accommodate approximately 3,500 caskets in above ground vaults.
These vaults are inside the structure to be built in seven high
tiers within an 18 foot ceiling height. All facilities are, of
course, sold much like a cemetery lot but has the feature of prc
a great deal more burial accommodation within a limited space.

Approval of Variance to Sign Re�ulation
Attached is a copy of a letter from the PJorthland Land Company
developers of the Mendota Heights Industrial Park, outlining t eir
proposal to construct two signs on their properties for the pu pose
of initiating a marketing program for the ultimate sale and
development of their property. -
The Sign Ordinance allows for a sign 100 square feet in area f r the
purpose of promoting the sale of land in such a development ar a.
This particular project,is, of course, of an unusual size and t is
not well served by a single sign. The applicant is therefore eeking
permission to construct a second sign at the intersection of M ndota
Heights Road and Trunk Highway 55 for the purpose of informing the
public of the location and availability of land within the ind strial
park.
In the middle '60's after the planning and zoning of the land n
question, the City encouraged the acquisition and ultimate nla ning
and platting of the industrial park, of what was then the Unit d
Properties Company (forerunner of Northland Land Company). Th
company has since expended considerable funds in the construct on
of roads, utilities, and extensive grading for preparation of he
sites for industrial purposes. Though a few structure have be n
placed on the property, the Company has basically held the pro erty
in anticipatio'n of the ultimate construction of 494 across the
Minnesota River into east Bloomington. Obviously, the ultimat
development potential for the land and its higher values depen upon
the development of this freeway system and its access to the a ea
via Pilot Knob Road.
�We have discussed this proposal with representatives of the No thland
Land Company and have advised them concerning appropriate sign
��1ocations and sizes. It is noteworthy that the signs will be laced
in accordance with the ordinance requirements. The variance s ught is
simply one to allow the construction of a second sign and that it •
�e allowed to be up to 200 square feet in area. The company h s

be placed on the signs. We suggest that this request be given
serious consideration for approval. It would appear to consti ute
a reasonable signage program for, the purpose of the ultimate "
development of the land, attracting good industrial users bene icial
to the City and the landowners, as well.
