THE WETLAND SYSTEMS ORDINANCE
The City Council of the City of Mendota Heights
follows:
Section l. Purpose. The purpose of this Ordina
to provide for the protection, preservation, mainten

Section 2. District Boundaries. This Ordinance

Section 4. Definitions. As used herein, the following words
shal have the following meanings:
A. Person: Any individual or firm, corporation, artnership,
asso iation, or other private body or governmental entit .
B. Wetlands: Low areas which are permanently or eriodically

wet eadows, sloughs, or intermittant lakes, or ponds.
C. Water Resource Related Areas: A water course, natural
drai ageway, water body, areas of hig permament or seaso al water
tabl , recharge zones, and generally those areas where water is
stor d, flows, or is recharged to the ground water table. This

Section 5. Wetlands Permit.�
A. No person shall perform any action upon or oth rwise
a Wetland or Water Related Resource Area without fi st obtain-
written permit from the City. �
B. The following activities in or upon a Wetlands

1. The deposit or removal of any material;
2. Any excavation;
3. The construction, alteration', or removal of

changing of the flow of water or ponding capac ty.
C. The applicant must submit, if determined neces ary, engi-
neer'ng data that clearly indicates ine nagni�ude of i;r�pa � on th�
wetl nd system or any component of the system, if any, th t will
resu t from the proposed development.
- D. All proposals to adjust a"W" District boundar line
shal follow the same administrative p ocedures as outlin d in Sec-
tion 5.7 of the City Zoning Ordinance�

the rocedures specified for the processing of a conditio al use
perm't under the City Zoning Ordinance.

� Section 6.
Standards Pursuant to Issuance of Per�mit'.
-A. No permits shall be issued unless it is deter ined that
the proposed action within a"W" District complies with the following
req irements:
1. Dredging and/or filling shall be Iocated in areas of
minimal vegetation.
2. Dredging activities shall not significantly r duce the
water flow characteristics or ponding capacit e
3. The size of the dredged material shall be lim'ted to
the absolute minimum and said limits designat d on the
dredging/graaing plan.
4. Disposal of the dredged material shal� not re uIt in
a significant change in the current water flo s, ponding,
or in destruction of vegetation, fish spawnin areas�
or in pollution of water.
5. Earthwork will not be performed during the br�eding season
of water fowl or the fish spawning season.
6. Only one boat channel or marina shall be allo ed per
large scale development or PUD. In other res'dential
developments, dredging shall be located so as to provide
for the use of boat channels and marina by tw (2) or
more adjacent property owners: The width of boat channel
to be dredged shall be no more than the minim m required
for the safe operation of boats at minimum op rating
speeds.
7. No part of any septic tank system or any ot�he sewage
disposal system requiring on-land.or in-the-g ound disposal
of waste shall be located closer than fifty ( 0) feet
- from the e�ge of a"W" District bour�dary unle s it can
be shown that no effluent can reach the wetla d because
of existing physical characteristics of the s teo On-
-' site sewage disposal systems shall be permitt d only

Run-off from developed property and construct on projects
may be directed to the wetland only�when reas nably free
of silt and debris and chemical pollutants, a d at such

to enter the wetland or other water resource area.

shall be put in place prior to commencement o each develop-
ment increment to limit gross soil loss from he development
site to not more than five (5) tons per acre er year.
20. Existing wetlands shall not be used.as sedime�t traps.
21. Sediment yield from construction sites adjace t to streams
and lakes shall not exceed two (2) tons per a re pe.r
year.
22. The person seeking the development permit sha 1 be required
to demonstrate that after the development is ompleted
the conditions on the site will be stabilized such that
the yearly solid loss from the site will not e greater
than 0.5 tons per acre. '
23. Development of woadlands shall not reduce the existing
crown cover by more than fifty percent (50�). The removal.
of trees seriously damaged by storms or other acts of
God, or diseased trees shall not be prohibite . �

3. Conservation of soil, vegetation, water, fish
life.

5. Leisure activities-such as hiking, nature stu ies, canoeing,
boating, camping, water skiing, skin-diving, orseback
riding, field trails, and general outdoor recreation
including play and sporting areas that are no incon-
sistent with the intent of this Ordinance.

Section 8. Conditional Use Permit.
A. A conditional use permit may be approved subj ct to com-
pli nce with such conditions as are reasonable ancl neces ary to

cha acter of the proposed work, require the construction of other
str ctures, require replacement of vegetation, establish required
mon tering procedures, stage the work over time, require the alteration
of he site design to ensure buffering` or require publi dedication
or onveyance to the City or another public entry of suc lands
or .;�terest therein as deemed reasonable and necessary b the �ity

Paul D eelan is 35 years old, is a carpenter and has lived at the abov address
for ab ut three years. His medical exam appears in order, his doctor inding
him qu lified to fill the position of volunteer fireman. Chief Siebel sub-
mitted this application to me, asking for favorable consideration.
The pr sent volunteer complement is down to 26 due to several recent r tirements.
Severa more retirements are eminent, hence it is desireable to appoin new
volunt ers to be trained and experienced before the "old timers" leave

I woul like to request that the-City Council make a change in the tit e of
Deputy Clerk-Treasurer's position. At the present time Joanne Cobian 's the
Deputy Clerk-Treasurer. My request would be that Joanne Cobian be nam d the
Deputy Treasurer-Finance Officer and Kathy Swanson be named Deputy Cle k. Due
to var ous developments in the work load in the Clerk-Treasurer Office these
past t o years and the thinking for future years to come, when I will t be
here. I recommend this change to be effective as of this date.
Both o my girls are highly efficient, very satisfactory in their knowledge
of the various jobs to be accompl$�hed. Kathy Swanson takes the minut s of
the Co cil Meeting and etc., along with all the election process unde the
new sy tem of voting.
Joanne Cobian has performed her duties as bookkeeper in a most satisf
manner, but I would like to have her get more into the field of finan
specia assessments, etc, a3� with her other duties.'

The enclment does not change any of the wording of the present ordin nce, however,
it a pts the prohibitions against stopping and parking contained in SS 169.34,
