Purpose. The purpose of this Ordina to provide for the protection, preservation, mainten of Mendota Heights wetlands and water resource rela maintain the natural drainage system, to minimize th ch may result from alteration by earthwork, loss of s of wildlife, and equatic organisms as�a result of ce of the natural environment, or from excessive sed pr����de for protection of probable fresY� water suppl ensure safety from floods. Section 2. District Boundaries. This Ordinance to wetlands and water resource related areas and to aaj wi hin one hundred (100) feet of normal high water mark an water resource related areas as delineated on the o "W tland Systems Map."' A copy of the above referenced "W tland Systems Map - Mendota Heights, dated in the office of the City Clerk. Said map and all of t re erences and other information shown thereon shall ha force and effect as if fully set forth herein and are h a art of this Ordinance by reference and incorporated fu ly as if set forth herein at length. Definitions. As used herein, the following words shal have the following meanings: A. Person: Any individual or firm, corporation, artnership, asso iation, or other private body or governmental entit . B. Wetlands Permit.� A. No person shall perform any action upon or oth rwise a Wetland or Water Related Resource Area without fi st obtain- written permit from the City. � B. The following activities in or upon a Wetlands irce Related Area shall require a permit: 1. The deposit or removal of any material; 2. Any excavation; 3. The construction, alteration', or removal of 4. The removal of vegetation; or Water structure; 5. The altering of any embankment or ponding area�or the changing of the flow of water or ponding capac ty. C. The applicant must submit, if determined neces ary, engi- neer'ng data that clearly indicates ine nagni�ude of i;r�pa � on th� wetl nd system or any component of the system, if any, th t will resu t from the proposed development. - D. All proposals to adjust a"W" District boundar line shal follow the same administrative p ocedures as outlin d in Sec- tion 5.7 of the City Zoning Ordinance� y E. Standards Pursuant to Issuance of Per�mit'. -A. No permits shall be issued unless it is deter ined that the proposed action within a"W" District complies with the following req irements: 1. Dredging and/or filling shall be Iocated in areas of minimal vegetation. 2. Dredging activities shall not significantly r duce the water flow characteristics or ponding capacit e 3. The size of the dredged material shall be lim'ted to the absolute minimum and said limits designat d on the dredging/graaing plan. 4. Disposal of the dredged material shal� not re uIt in a significant change in the current water flo s, ponding, or in destruction of vegetation, fish spawnin areas� or in pollution of water. 5. Earthwork will not be performed during the br�eding season of water fowl or the fish spawning season. 6. Only one boat channel or marina shall be allo ed per large scale development or PUD. In other res'dential developments, dredging shall be located so as to provide for the use of boat channels and marina by tw (2) or more adjacent property owners: The width of boat channel to be dredged shall be no more than the minim m required for the safe operation of boats at minimum op rating speeds. 7. No part of any septic tank system or any ot�he sewage disposal system requiring on-land.or in-the-g ound disposal of waste shall be located closer than fifty ( 0) feet - from the e�ge of a"W" District bour�dary unle s it can be shown that no effluent can reach the wetla d because of existing physical characteristics of the s teo On- -' site sewage disposal systems shall be permitt d only -� � if they meet state and city regulations. Existing wetlands shall not be used.as sedime�t traps. 21. Sediment yield from construction sites adjace t to streams and lakes shall not exceed two (2) tons per a re pe.r year. 22. The person seeking the development permit sha 1 be required to demonstrate that after the development is ompleted the conditions on the site will be stabilized such that the yearly solid loss from the site will not e greater than 0.5 tons per acre. ' 23. Development of woadlands shall not reduce the existing crown cover by more than fifty percent (50�). Scientific research and educational activities� that teach . principles of ecology and conservation. � 5. Leisure activities-such as hiking, nature stu ies, canoeing, boating, camping, water skiing, skin-diving, orseback riding, field trails, and general outdoor recreation including play and sporting areas that are no incon- sistent with the intent of this Ordinance. 6.
