Mayor Huber acknowledged receipt of a letter from
Mr. Ronald Smith requesting a thirty-day con inuation of
discussion on his application for street vac tion and
subdivision of property. Discussion then fo lowed with respect
to the Ronald Smith application for street v cation and
subdivision of property. Councilman Mertens tto reported that
numerous area residents have indicated their desire that the
City retain the 30 foot street dedication fo Cheri Lane. The
Council also acknowledged receipt of a petit on, signed by 43
property owners, in opposition to the propos d subdivision and
street vacation. Councilman Mertensotto poi ted out that the
street right-of-way is necessary for utility maintenance purpose
as well as for pedestrian access to Rogers e. It was noted
that if the street were vacated as requested one of the
proposed lots would not be on �a public stree and accordingly
would not meet the applicable City ordinance requirements.
The Council further noted that if the vacati n were not
approved, the lots as proposed waiild not mee the Zoning-
Ordinance requirement for frontage or setbac s, and the
Department of Natural Resources requirements that homes be
built a minimum of 75 feet from the lake wou d not be met.

Several members of the Council noted that t e subdivision
application has been under consideration at several Council
meetings and that a considerable amount of nformation has
been prepared, studied and discussed. It w s their desire that
a final determination on the matter should ot be delayed.
After considerable discussion, Councilman M rtensotto moved
the application for subdivision of Lot 18, inden Addition
and the vacation of a portio n of Cheri Lane be denied.

Councilman Losleben moved that the Mayor and Clerk-Treasurer
be authorized to execute the 1976/77 labor c ntract with the
Police Department and Local 320.
Councilman Lockwood seconded the motion.
Councilman Wahl moved the approval of Change Order No. 2 for
the Lexington Highlands Additions improvemen s(Improvement
No. 74, Project No. 2) to include the constr ction of Lilac
Lane in the improvement contract.

Mayor Huber moved the adoption of Resolutio No. 76-52,
"RESOLUTION AUTHORIZING ACQUISITION OF EASE NTS, " and
directed the City Attorney to commence imme iate condemnation
proceedings for the Kassan easement.
Councilman Losleben seconded the motion.
SERVICES Public Works Inspector Pearson advised the ouncil that the
E.T. Adkins property at 554 Junction Lane c nsists of two
buildable lots, the home on one lot and the driveway on the
second. He requested Council authorization for installation
of sewer and water services to serve the va ant lot (in
conjunction with the northeast area improve ent projec).
Mayor Huber moved that the City Engineer be directed to order
a sewer and water service to be installed i the vacant lot,
adjacent to 554 Junction Lane.
Councilman Lockwood seconded the motion.

There wa a total of 16 man-hours devoted to police training d ring June,
1976. D ve Olmstead attended a Basic Crime Scene Processing c urse of-
fered by the Bureau of Criminal Apprehension.
On June 6 a written test was taken by 20 applicants for a pol'ce
patrolma 's position. We should have the new patrolman on the job with-
in 4 to weeks. A promotional examination will then be given for the
Sergeant s position which is presently open, and that position should be
filled h September 1.

. Amendment to St. Paul Water Contract
An attached letter from Elmer Huset, General Manager of the t. Paul Water
artment, explains their desire for an amendment to the water s rvice contract.
original water service contract was executed in 1962. Since at time a
�ber of rate changes have been made, however, there have been n substantive
nges to the contract language. A careful reading of Mr. Huset's letter will
eal that the present contract does not allow for increasing ra es charged
large water users. This is due to the very constrictive perce tage spelled
in the original contract for large water users. -
I have analyzed their proposal and have the following statemc�nts to make:
1. Mr. Huset's letter is factual, however, he fails to note
that the demand or fixed charges for meters larger han
one-inch is being increased from 10� in the old con ract
to 20� in the new amendment. This is applicable to all
customers with meters of 1� inches or larger. This means
a potential increase for the limited number of inete s for
most non-residential users. Other than this, the 1 tter
is quite factual and straight-forward.
2. The amendment will allow St. Paul to charge large w ter
users within St. Paul and outside of St. Paul a mor
appropriate water service charge. In the past it h s been
common knowledge that the wet industries and large ater
users were given preferential treatment inherent wi hin
the rate structure.
3. As is noted in Mr. Huset's letter, there are severa

L'gnason HLP is a systemic fungacide which is made to be injected i.nto, or
s rayed onto the foliage of a"Elm tree. It is manufactured by th Dupont Co.
w ich has pioneered in Dutch Elm research. Dupont has previously manufactured
B nomyl iBenolate) which is the forefather�of Lignason� Benomyl roved to
b effective only in a few cases, and thus uJas abandoned. Zignas n BLP is
a new taater soluable formulation of Benomyl VJhich has been on the market
s'nce the middle of I�lay,1976.

In reference to.professional nurserymen, I have contacted a few ve not-�ble
nu serymen of the Twin Cities. ROSL HILI, nurseries of St. Paul is a very
��e 1 established firm which has been working with trees for years. They do not
do Lignason Injections. They are working �uith Dr. French in doing some experiments,
bu� agree that the fungacide is still to experimental. Once they ind that
th ir success ratio is very favorable, they will then start offeri g the
in'ection service. PARK NURSERIES of St. Paul is also a very rel able firm.

co tacting them I found that they do not do any Lignason injection . They
fe 1 trat it is no miracle cure, and that it would be less costly o replant
th se areas affected by Dutch Elm Disease.
Co tinuing our efforts, we wondered if any other municipalities we
wi h Lignason injections. After contacting South St. Paul, Bloomi
we found that they were not doing anything with this type of chemo
