There was a large attendance with predominant pport for the construction of the freeway evident at the hearin st of my statement was as follows: • We view the construction of 35E with mixed emotions. We say mixed emotions because the City has long been a supporter o the completion of the Metropolitan Freeway System as a whole with emphasis on completion of that portion in Dakota County in particular. In that sense we are pleased to see progress toward the completion of 35E in Dakota County and support that action. We are, however, very concerned about the potential impact on our community if 35E is completed in Dakota County but Interstate 494 is not. As you all know, the Metropolitan Circumferentia7 Freeway System is complete except for a missing link in Dakota Count, The detour for that missing link runs through the middle of our City. As a result, we are living with apalling traffic conditions on Highway 110 which was not designed to accomo- date freeway volumes. Now if 35E is completed from 35W in Burnsville to Highway 110 in Mendota Heights, the additional east bound traffic producted by this highway will be added to the substantial traffic from 494 already coming through ;ie middle of the City of Mendota Heights. This condition, of course, will be even worse if 35E is not completed throug the City of Saint Paul. rf 1 c: /` /:% rC. %7i r', t T E R R A C E iOTA 55403 612•377-3536 re- .ti ng 1 in The J •. Orville Johnson ily 23, 1976 Page The position of the City of Mendota Heights theref ore is as fo7lows: We endorse and approve the completion of 35E in Dakota County on the condition, however, that supreme efforts be made on the part of the Highway Department, the coun the corrrnunities, and the citizens of Dakota County to complete the missing link of 494 as recently approved by the Interstate Study Committe, the Transportation Advisory Board, and the Metropolitan Council. We further strongly endorse the completion of 35E through the City of Saint Paul to enhance the total integrity of the system and to fulfill the vital function of the freeway system as it af'ects all the communities and citizens of Dakota County. T is statement was made early in the hearing. Conversation with umerous p ople of various communities later in the hearing indicated thei general s pport and understanding for our position. Some members of the ighway d partment staff, including the district engineer, commented on t eir w llingness to exert every effor.t to expedite the completion of 4 4 and 3 E through Saint Paul. I feel the following points are worth noting: ITE';.;,, r1UL a 1a?a 27 at 75, tructed you wal. o the The only reason given for putting the road in was so the Curley addition ,Tould have a second means of ccess to Lexington Avenue. As we alYeady had a means o access to-Lexington we have seen no benefii for that pur ose. 2. Vdhy was the road not completed when the Curley pr ject taas beginning and the first entrance was installe ? The cost at that time would have been one-half th cost. The councils only excuse was that they were not i office then and i find that unacceptable. If it vasn't necessity then than why is it now? I asked the council if here was a law requiring a second exit and they sai.d no. 3. The total project was estimated at 75Q0.00 yet t e final price came in at $9781.00 because someone failed o include the right of way cost of $3500.00 in the figures. For the record no one currently owning property being ass ssed ever received any of the $3500.00. 4. The council seemed to justify the fact that the i addition isnt being taxed by saying only 30% is assessed to the property ajoining the road and t] is going on the general tax roes. There is lit tion in this as we are alsoon the general tax ro: in reality are paying twice. rley eing balance e consola- s and age Z At the hearing a specialpoint taas made again and of the fact that we are only eing assessed 30% an was very unusual. I got the impression we were be told how lucky we were that the.city Tas being so to us. As it turns out I find that the reason we only being assessed a total of 30o is that three o four being assessed are corner lots and only 25% o total amount can be assessed by law. Had we not h corner lots more than likely the entire amount wou have been assessed to the four of us. This point even brought up at the meeting as to why only 30%. don't like being mislead. Perhaps it was an overs that this was not pointed out, hotaever, the counci biggest defense as to why the Curley addition was being assessed was the fact that they would be inc: in the general tax roles and they made it seem li E was all planned out that way for our benefit. I don't buy the excuse that if the council was to sider assessing the Curley addition it would be t for ihe city to have another hearing and notify e Two wrongs don't malce a right. Had this been don very beginning the cost would'nt be an issue. Is council looking for the easy hTay out for themselv the right way? If safety was a factor in putting in the road it rather ironic that our home which was free from t and associated dangers is now directly in the mid them. The road has become an ideal spot for chil with bikes, slcateboards, roller skates etc, to tr on due to the slight incline at the Lexington end hope nothing fatal happens, however, it looks ver Automobiles also find it interesting,to travel ex fast by our home. At times it becomes dangerous in and out our own driveway. .gain l that :ind .re ' the ' the d d asn't I ght s ot uded it recon- costly eryone. at the the s or eems aff ic t of ren vel I do possible. remely ven pulling Now that the road has exposed Mr. Curley's vacant lot it has become a haven for children to play. It seem to me that with all the excess ec{uipment and other mate ial dumped there it is very likely someone will be hu t. -The road is in and that part can't be changed, al the proceedings leading us up to now are very unu Again, two wrongs don't make a right. 1e the adj pronert.y oi,*ners are seeing absolutely no benefits the road yet we are the only ones being assessed If the purpose t,ias to give another access to the addition, *hich is only to their benefit, then th also be assessed and help pay for it directly. hough ual . ining from 'or it . ;urley :v should I gss I've made as many points as are necessary. Not one of the nine tlia abut Marie Avenue has direct access to this road. !lt ome of the previous meetings that were held before constructic Ma ie Avenue, the councilmen and the city officials took the positic thi road was to benefit the entire western area of Mendota Heights it easier for Highland Heights residents to get to 5ibley School, Ro an all other places in the east side of Mendota Heights. For this we feel that a more general ass, essment would have been the prope to his problem. a direct buildings n of n that . Make ert 5treet, reason approach We are not voicing a complaint at being assessed, but rathex against the method of ssessment. The whole Eagle Ridge project is affected by this oad, not jus the abutting property. In other words, we feel the whole proj ct should ca ry their fair share of this assessment. Th apartment building will probably have the greatest benefit, an under the pr sent system they do not pay one cent for this service. Th re is also a large parcel of land in this complex that is owned y the Fi st I\Tational Bank, at this writing undeveloped, that should bear a fair sh re of ihis assessment as their tenants will benefit at a later da e. c onti , Mr. In y foll / Orvil Jahnson -z- July 29, i 976 ur notice of hearing on the proposed assessznent, your letter s ates as us: , "Ii is proposed Ea assess every Iot, piece ar parce7. af land ben fited by said improvements whether abutiiing thereon or not based up n benefits received without regard to cash valuati.an in accordanc wlth the propased assessment xoll thereof which is now on file 'th he Ciiy Clerk of the City of Mendota Heights ai ihe Gity HaII a saa.d City and which assessxnent roll is apen to public inspection. The parcel of land in question similar to those to the nortr the south, were origina7ly developed with frongtage on both and Delaware Avenues. The original lots are 235 feet deep ( from Delaware to Chippewa). , 2. The property to the north and the _property to the south hav been divided as shown on the attached sketch. You will not property to the north was divided in half with lot depths o each. To the south, the lot was divided with 105 feet on t and 130 feet of depth on the east side (fronting on Delawar 3. The applicant proposes to divide the land with 105 feet of Chippewa Avenue and 130 feet on Delaware Avenue. This prod areas of 12,090 square feet and 9,765 square feet. Unless some overriding reason for not doing so, it would appear re to consider dividing the property more nearly in half (as w the property to the north). We suggest that the applicant questioned as to the feasibility of such a division. You w that the proposed property line is 27 feet west of the exis frame garage on the property. Moving, the line to the cente lot would reduce this approximately by half. 4. In any case, it would appear reasonable on the part of the to divide the land as has been done to similar lots in the would appear only to be a question of whether or not the w should have a depth of more than 105 feet. and to ;hippewa ast-west previously that the 117.5 feet west side • I. pth on ;es 1 ot ere i s onable > done i n I1 note ing of the pl i cant ea. Heutmaker, 700 Se d Avenue Southeast-Corner of Clement $treet and Second Avenue South Variance to Side Yard Setbacl I visited Mr. Heutmaker's site on several occassions and o one occassion, with the Building Inspector. His problem is th t the contractor in constructing his home on his property, built the home twenty (20) feet from the east property line rather than t e ten foot minimum as established in the zoning ordinance. This of course, has reduced the amount of space he would have had availabl on the west side of his property next to Clement Street. 2. It would of course, appear feasible to build a separate ga age on the rear of his lot with access off of Clement Street. He e, however, he faces a severe hardship in as much as the southerly por ion of the lot has an extremely bad soil condition. This di.fficu t condition also occurs on portions of area on the north side of the 1 t but to a lesser degree. 3. You will notice from the sketch that the house to the nort of the property in question (across Second Avenue) is located app oximately twenty (20) feet from the right-of-way. In view of this f ct, and in the interesi of providing a better home and garage rela ionship on Mr. Heutmaker's land, we have suggested that he pply f r the variance to provide for the construction of a double gara contiguous to the west side of his house as shown in the sketch. Thi would require a variance to 21 feet (30 feet normally required) or the setback on Clement Street at the north end of the garage a d a 17 foot setback on the south end. 4. After reviewing this site and considering the various optic suggest that the proposed solution applied for by Mr. Heutr the most reasonable one, and will not adversely affect any properties in the neighborhood. ns , we aker i s of the a. isn . City Council ROM: Orvil J. Johnson City Administrator July 29, 1976 Increased Building Inspector Compensation The matter of building inspection has been a topic of conve sation r years. As you are aware, several attempts have been ma.de to employ replacement for Dick Bjorklund. Dick has asked on many occasi ns to relieved of such duties. Dick has aided me in recruiting rep acements, wever in one case the interested party failed to pass the stat rtification test and in another case the potential applicant f iled to spond to our offer.
