requested by you and the City Council, I made a statement in re
ntation of the City of Mendota Heights at the public hearing rel
the construction of Interstate 35E at Metcalfe Junior High Scho
e City of Eagan. The�re was a large attendance with predominant
pport for the construction of the freeway evident at the hearin
st of my statement was as follows: •
We view the construction of 35E with mixed emotions. We say
mixed emotions because the City has long been a supporter o
the completion of the Metropolitan Freeway System as a whole
with emphasis on completion of that portion in Dakota County
in particular. In that sense we are pleased to see progress
toward the completion of 35E in Dakota County and support
that action. We are, however, very concerned about the
potential impact on our community if 35E is completed in
Dakota County but Interstate 494 is not.
As you all know, the Metropolitan Circumferentia7 Freeway
System is complete except for a missing link in Dakota Count,
The detour for that missing link runs through the middle of
our City. As a result, we are living with apalling traffic
conditions on Highway 110 which was not designed to accomo-
date freeway volumes. Now if 35E is completed from 35W in
Burnsville to Highway 110 in Mendota Heights, the additional
east bound traffic producted by this highway will be added
to the substantial traffic from 494 already coming through
;i�e middle of the City of Mendota Heights. This condition,
of course, will be even worse if 35E is not completed throug
the City of Saint Paul.

The position of the City of Mendota Heights theref ore is
as fo7lows:
We endorse and approve the completion of 35E in Dakota
County on the condition, however, that supreme efforts
be made on the part of the Highway Department, the coun
the corrrnunities, and the citizens of Dakota County to
complete the missing link of 494 as recently approved
by the Interstate Study Committe, the Transportation
Advisory Board, and the Metropolitan Council. We
further strongly endorse the completion of 35E through
the City of Saint Paul to enhance the total integrity
of the system and to fulfill the vital function of the
freeway system as it af�'ects all the communities and
citizens of Dakota County.

p ople of various communities later in the hearing indicated thei general
s pport and understanding for our position. Some members of the ighway
d partment staff, including the district engineer, commented on t eir
w llingness to exert every effor.t to expedite the completion of 4 4 and

Mayor Huber moved that an ahatement be grant d to
Ray R. and Marilyn V. Klassen for Parcel No. 27-28400-080-01,
reducing the assessed value from 47644 to 78 0 Residential and
37238 Commercial for taxes payable in 1976.
Councilman Losleben seconded the motion.
Councilman Lockwood moved that an abat�ment e granted to
Darrel J. Gubrud for Parcel No. 27-37600-110 06, reducing the
assessed value from 32560 in 1974 to 29729 f r taxes payable
in 1975 and reducing the assessed valuation rom 35996 to
32872 for taxes payable in 1976.

COMMISSION Mayor Huber acknowledged receipt of written ecommendations

After a lengthy discussion, Councilman Merte sotto moved that
the matter be referred to the City Planner f r study and
response and that the Clerk advise Mr. Cummi s of the Council

Council that Mendota Heights has been awarde a pedestrian
safety citation for 1975.
The Council acknowledged receipt of the Poli�e and Fire
Department monthly reports for June, 1976.

T. PAUL WATER Admi.nistrator Johnson outlined a proposed am ndment to the

would allow the Water Department to increase water rates for

recommended that the Covncil authorize a chan e order to the
Clement/Vandall improvement project to includ the removal
of diseased trees on public right-of-way. Th trees could
then be removed as part of the project and th cost could be
paid by general obligation taxes. Public Wor s Supervisor
Harvey Franzme�er explained how the disease i transmitted
from one tree to another and that the most ef ective method
of control is proper sanitation. The Council discussed the
matter at length, including the current budge limitations and
a number of possible methods of financing tre removal.

C WORKS The Covncil acknowledgeci receipt of a memo fr m the City Planner
ITY regarding the requirements that a public work garage site
should meet and suggesting the acquisition of a parcel which
meets the requirements. The recommended site consists of 5
acres and is located on Lexington Avenue near the future
intersection of Mendota Heights Road. The Co cil discussed
the memo and the desireability of additional esearch on the
site as well as a possible referendum in Nove er. After
considerable discussion, the Council directed the Administrator
to commence negotiations and prepare a prelim nary appraisal -
on the site. Additional discussion was table to August 3.
�CELLANEOUS Councilman Wahl advised the Council of a Poli e Department
summary indicating that 9 accidents had occur ed at the
intersection of Marie Avenue and Delawaxe Ave ue in 1975. He
_ urged the CounciZ to initiate a reques-t for 4 way stop signs
at the intersection.

The only reason given for putting the road in was so
the Curley addition �,Tould have a second means of ccess
to Lexington Avenue. As we alYeady had a means o access
to-Lexington we have seen no benefii for that pur ose.
2. Vdhy was the road not completed when the Curley pr ject
taas beginning and the first entrance was installe ?
The cost at that time would have been one-half th cost.
The councils only excuse was that they were not i office
then and i find that unacceptable. If it �vasn't necessity
then than why is it now? I asked the council if here was
a law requiring a second exit and they sai.d no.
3. The total project was estimated at �75Q0.00 yet t e final
price came in at $9781.00 because someone failed o include
the right of way cost of $3500.00 in the figures. For the
record no one currently owning property being ass ssed ever
received any of the $3500.00. �
4. The council seemed to justify the fact that the i
addition isn�t being taxed by saying only 30% is
assessed to the property ajoining the road and t]
is going on the general tax ro�es. There is lit�
tion in this as we are alsoon the general tax ro:

1. The parcel of land in question similar to those to the nortr

Variance to Side Yard Setbacl
I visited Mr. Heutmaker's site on several occassions and o one
occassion, with the Building Inspector. His problem is th t the
contractor in constructing his home on his property, built the home
twenty (20) feet from the east property line rather than t e ten
foot minimum as established in the zoning ordinance. This of course,
has reduced the amount of space he would have had availabl on the
west side of his property next to Clement Street.
2. It would of course, appear feasible to build a separate ga age on
the rear of his lot with access off of Clement Street. He e, however,
he faces a severe hardship in as much as the southerly por ion of
the lot has an extremely bad soil condition. This di.fficu t condition
also occurs on portions of area on the north side of the 1 t but
to a lesser degree.
3. You will notice from the sketch that the house to the nort of the
property in question (across Second Avenue) is located app oximately
twenty (20) feet from the right-of-way. In view of this f ct, and
in the interesi of providing a better home and garage rela ionship
on Mr. Heutmaker's land, we have suggested that he �pply f r the
variance to provide for the construction of a double gara� contiguous
to the west side of his house as shown in the sketch. Thi would
require a variance to 21 feet (30 feet normally required) or the
setback on Clement Street at the north end of the garage a d a 17 foot
setback on the south end.
4. After reviewing this site and considering the various optic
suggest that the proposed solution applied for by Mr. Heutr
the most reasonable one, and will not adversely affect any
properties in the neighborhood.

Increased Building Inspector Compensation
The matter of building inspection has been a topic of conve sation
r years. As you are aware, several attempts have been ma.de to employ
replacement for Dick Bjorklund. Dick has asked on many occasi ns to
relieved of such duties. Dick has aided me in recruiting rep acements,
wever in one case the interested party failed to pass the stat
rtification test and in another case the potential applicant f iled to
spond to our offer.
Recently Dick has approached me concerning an increase in
ensation. As you are aware, he has received compensation in

a. $150 per month retainer;
b. Inspections at $5.00 per inspection.
, quick search indicates that the retainer fee has remained at
�onth since 1971 and of course the inspection fees have varied
